Subsidy Period means the period during which a Project is subject to the requirements of any federal, state, or local affordable housing program as a result of receiving operating or capital subsidies, including but not limited LIHTC, tax-exempt private activity bonds, project-based rental assistance (such as a Housing Assistance Payments [HAP] contract), or other public funding sources. For purposes of this definition, the Subsidy Period includes the full term of any such assistance, including the initial LIHTC Compliance Period if applicable and the base term of any project-based HAP contract (e.g., 20 years), but does not include any portion of the Extended Use Period (if any) or affordability restrictions that continue solely due to recorded agreements or regulatory requirements beyond the expiration of the original subsidy term, such as the period following the end of a 20-year HAP contract base term unless renewed or extended with continued subsidy.

Subsidy Period is defined in Section 4.1(c).
