Tariff Agreement has the meaning set out in Recital D;

• The Operator has accepted the appointment and has issued that certain Berth Services Tariff Agreement for Annacis Island Fraser River Berth currently dated effective January 1, 2023, but as may be amended, revoked, replaced or otherwise altered by the Operator at any time without notice (the “Tariff”).

• BC Hydro shall not unreasonably withhold consent for the assignment of this Tariff Agreement by the Customer.
