The Design/Builder, as part of its agreements with any Team Subcontractor, Subcontractor or consultant, will secure such license and use rights from each such entity, and shall defend, indemnify and hold the Owner and any successors or assigns harmless from any claims from such for claims by such entities for copyright or patent infringement.
If a Team Subcontractor or Subcontractor refuses to furnish a release or waiver required by the Owner, the Design/Builder may furnish a bond satisfactory to the Owner to indemnify the Owner against such lien.

If a part of the Agreement is to be sublet, the Design/Builder shall either: Cover all Team Subcontractors and Subcontractors in its insurance policies, or Require each Team Subcontractor and Subcontractor not so covered to secure insurance which will protect subcontractor against all applicable hazards or risks of loss as and in the minimum amounts designated.
The Team Subcontracts shall require each Team Subcontractor, to the extent of the Work to be performed by such Team Subcontractor, to assume towards the Design/Builder all the obligations and responsibilities which the Design/Builder by the Contract Documents assumes towards the Owner.
All Team Subcontracts shall incorporate the terms of this Agreement and the Contract Documents to the extent applicable to the Work to be performed by the Team Subcontractor.
