Tenant Losses definition

Tenant Losses shall have the meaning set forth in Section 8.2.
Tenant Losses means all claims, demands, expenses, actions, judgments, damages (whether consequential, direct or indirect, known or unknown, foreseen or unforeseen), penalties, fines, liabilities, losses of every kind and nature (including, without limitation, property damage, sums paid in settlement of claims and any costs and expenses associated with injury, illness or death to or of any person), suits, administrative proceedings, costs and fees, including, but not limited to, reasonable attorneys’ and consultants’ fees and expenses, and the costs of cleanup, remediation, removal and restoration, that are in any way related to any matter covered by the foregoing indemnity.
Tenant Losses means all claims, demands, expenses, actions, judgments, damages (actual, but not consequential), penalties, fines, liabilities, losses of every kind and nature (including, without limitation, property damage, diminution in value of Tenant interest in the Premises, damages for the loss or restriction on use of any space or amenity within the Premises or the Property, sums paid in settlement of claims and any costs and expenses associated with injury, illness or death to or of any person), suits, administrative proceedings, costs and fees, including, without limitation, attorneys’ and consultants’ reasonable fees and expenses, and the costs of cleanup, remediation, removal and restoration, that are in any way related to any matter covered by the foregoing indemnity or Landlord’s indemnity as outlined in Section 9.1 and 9.2, Notwithstanding anything to the contrary set forth in this Lease, however, in all events and under all circumstances, the liability of Landlord to Tenant shall be limited to the interest of Landlord in the Property, and Tenant agrees to look solely to Landlord’s interest in the Property for the recovery of any judgment or award against Landlord, it being intended that Landlord shall not be personally liable for any judgment or deficiency. The provisions of this Section 17.2.2 shall survive the expiration or termination of this Lease.

Examples of Tenant Losses in a sentence

  • Landlord shall indemnify Tenant against all Tenant Losses (as defined in Section 17.2.2 hereof) actually suffered by Tenant as the direct result of the applicable portion of the Premises not being in material compliance with Laws on the applicable Commencement Date.

  • In the event of a Tenant Loss or multiple Tenant Losses, Landlord may, at its sole option, select another Tenant to fill any of the open Tenant contract slots in this Lease Agreement, and such new Tenant will hereinafter be referred to as a “Replacement Tenant”.

  • In the event of a Tenant Loss or Tenant Losses, the remaining Tenants or Tenant will hereinafter be referred to as the “Remaining Tenants”.


More Definitions of Tenant Losses

Tenant Losses means all claims, demands, expenses, actions, judgments, damages, penalties, fines, liabilities, losses of every kind and nature (including, without limitation, sums paid in settlement of claims and any costs and expenses associated with injury, illness or death to or of any person), suits, administrative proceedings, costs and fees, including, without limitation, reasonable attorneys' fees and expenses actually incurred without regard to statutory interpretation and consultants' fees and expenses, and the costs that are in any way related to any matter covered by the foregoing indemnity. Notwithstanding the foregoing, nothing contained in this SECTION 16.2(B) shall override (or be deemed to override) the waivers contained in SECTION 9.2 above. The provisions of this SECTION 16.2(B) shall survive the expiration or termination of this Lease.
