Termination by Company for Cause shall be effective as of the date noticed by the Company.
If the Agreement is terminated by Company pursuant to this Section 13.4 (Damages and Termination), Company shall have the right to collect Termination Damages, which shall be calculated in accordance with Article 16 (Damages in the Event of Termination by Company) of this Agreement.
If the Agreement is terminated by Company because of one or more of the Events of Default by Seller, Company shall have the right, in addition to the rights set forth above in this Section 15.4 (Rights of the Non-defaulting Party; Forward Contract), to collect Termination Damages, in accordance with Article 16 (Damages in the Event of Termination by Company).

In such event, the Executive shall be entitled to the payments and benefits provided to the Executive as if such termination of his employment were pursuant to Section 5(c) (Termination by Company without Cause).
In the event that the Company terminates your employment in the manner described in Section 8(d), Termination by Company Without Cause, at any time during the Noncompetition Period you may make a written request to the Company’s Chief Executive Officer for a waiver of the Noncompetition Period and the covenants contained in Section 7(b)(iv).
