Prior to lease end (typically in late April) CBS Rentals will issue a Move-Out Letter to Residents, which will include instructions for moving out and cleaning requirements that are Resident responsibility (please refer to page 6 of the Lease Agreement.) The cost of any excessive cleaning and/or damage will be the responsibility of Resident and billed to the Resident, in addition to the Restoration Fee and any other charges and may be deducted from the Damage Deposit.
In exchange for the Restoration Fee, Landlord agrees that Landlord will be responsible for certain cleaning and restoration, for which Resident would otherwise be responsible under this lease, to restore the premises to its move-in condition, normal wear and tear excepted, as more particularly set forth below.
Resident agrees to pay Landlord a Restoration Fee of $ U.S. Dollars upon the termination of this lease and Landlord is authorized to deduct the Restoration Fee from the Damage Deposit.
This remedy may be exercised within the sole discretion of MAC, and in the event it is so exercised, Tenant shall not have any obligation to pay the Restoration Fee, but Tenant shall pay for the Restoration Work as described in Section 3.B. Tenant authorizes the Restoration Fee to be deducted from the Deposit if not otherwise paid by the end of the Term, and agrees to immediately pay such Fee to Landlord, should the Deposit be insufficient to cover all sums owed to Landlord.
Tenant may request, with at least five days written notice, to be present during the move-out inspection.* If the amount is not otherwise noted in Section 1, above, the Restoration Fee will be charged as follows: $250.00 per bedroom.
If repairs, replacements, extra painting or additional cleaning beyond that covered by the Restoration Fee is needed, in Landlord’s sole discretion, and employees of Landlord perform such work, charges therefore shall be $75 per hour for labor, plus the cost of materials, and overhead of 20% of labor and materials.
However, if Customer desires re-connected, and LymeFiber agrees to do so, Customer agrees to pay the Restoration Fee.
In such event, the Manager shall include the Restoration Fee requirement in all Use Agreements and ticket sale agreements for the Cinema and shall remit the net Restoration Fee proceeds to the Owner.
