TMI Product definition
TMI Product means any product or service of TMI or of an affiliate or subsidiary of TMI. Notwithstanding the foregoing, in the event XGIC or an affiliate, subsidiary or customer of XGIC (collectively and individually, an "XGIC Party") asserts a patent against TMI or against any affiliate, subsidiary or customer of TMI (collectively and individually, a "TMI Party"), the foregoing covenant shall not apply as between such XGIC Party and such TMI Party.
