Lessor has made no representations to Lessee concerning the presence of Toxic or Hazardous Substances within the definition of the Montana Comprehensive Environmental Cleanup and Responsibility Act (CECRA) on the Land.
The indemnification provided by this subsection shall also specifically cover, without limitation, costs incurred in connection with any investigation of site conditions or any cleanup, remedial, removal or restoration work required by any federal, state or local governmental agency or political subdivision or other third party because of the presence or suspected presence of Toxic or Hazardous Substances in the soil, groundwater, or soil vapor on or under the Property.
The Local Agency shall not cause or permit the release or disposal of any Toxic or Hazardous Substances on or from the Property.
However, Lessee does not indemnify the Government for liability for environmental impacts and damage arising out of the existence or release of toxic or Hazardous Substances on the Leased Premises or other property caused by the use or release of Toxic or Hazardous Substances by the Government or its employees or contractors on any portion of the Installation, including the Leased Premises, provided such impacts or damage are not exacerbated or contributed to by Lessee.
Lessee Hazardous Substances includes Toxic or Hazardous Substances that are or were attributable to the activities of Lessee, its agents or contractors during the term, whether or not Lessee had knowledge of such Toxic or Hazardous Substance.
Tenant is not in violation of, or subject to, any existing, pending or threatened investigation by any governmental authority under any applicable federal state or local law, regulation or ordinance pertaining to air and water quality, the handling, transportation, storage, treatment, usage or disposal of Toxic or Hazardous Substances, air emissions, other environmental matters, or any zoning or other land use matter.
From the Effective Date through the Closing Date, Seller shall not cause or permit any Toxic or Hazardous Substances to be brought upon, kept or used in or about the Property by Seller, its agents, employees, contractors or invitees except in the ordinary course of managing, maintaining and operating the Property and in accordance with all applicable laws, rules and regulations regulating any such Toxic or Hazardous Substance.
Lessee's indemnification of County shall include costs and expenses incurred in connection with Toxic or Hazardous Substances present on, under, above or appurtenant to the Leased Premises as a result and to the extent of any Release caused by Lessee, its officers, employees, contractors, invitees or agents onto or adjacent to the Leased Premises during the occupancy of the Leased Premises by Lessee.
Toxic or Hazardous Substances: Buyer assumes all risk of loss, damage or injury which may arise as a result of, or may be in any way connected with, the presence of radon gas, asbestos mold, synthetic stucco or any other toxic or hazardous substance in or about the Property.
Without limiting the generality of the foregoing, Lessee, at its sole cost, shall comply with all Environmental Laws relating to Toxic or Hazardous Substances brought onto the Leased Premises by ▇▇▇▇▇▇.
