Tract 7. All of that certain tract of land out of the ▇. ▇▇▇▇ Survey, ▇▇▇▇▇▇▇▇▇▇ County, Texas, being approximately 350’ from the current right-of-way line of SH 29 abutting the property described in the ▇▇▇▇▇▇▇▇▇▇ County Appraisal District as R484926 and being generally depicted on Exhibit “A”, attached hereto and incorporated herein; and Prior to the execution of a Special Warranty Deed document by Seller, Purchaser shall create a metes and bounds survey of the exact area to be conveyed and which shall be attached to the executed deed document for recording in the real property records of ▇▇▇▇▇▇▇▇▇▇ County, Texas. Tract 8: Previously, ▇▇▇▇▇▇▇▇▇▇ County acquired two separate tracts of land from Seller for water detention purposes for the expansion of ▇▇▇▇▇▇ ▇▇▇▇▇▇ Blvd., being a 1.98 acre tract (WCAD R# ) and a 2.74 acre tract (WCAD R# ), totaling 4.72 acres, as shown on Exhibit “B”. As part of this transaction, and as previously agreed upon by the parties, Seller agrees to convey to Purchaser in fee simple Tract 8, which is the approximate 2.93 acre tract shown on Exhibit “B” attached hereto, Together with all and singular the rights and appurtenances pertaining to the property, including any right, title and interest of Seller in and to adjacent small strips of property abutting Tracts 1-7, above, and as shown on Exhibit “A” and streets, alleys or rights-of-way (all of such real property tracts, rights, and appurtenances being referred to in this Contract as the “Property”), and any improvements situated on and attached to the Property described in Exhibit A” not otherwise agreed herein to be retained by Seller, for the consideration and upon and subject to the terms, provisions, and conditions set forth below. Tract 7. Seller has entered into a written agreement with the adjoining landowner pursuant to which a new ingress-egress easement will be recorded prior to the Tract 7 closing. The easement area will consist of a 40-foot wide corridor between the northeast part of Tract 7 and C.R. 500 North. A survey of the easement area is posted. A copy of the signed agreement with the adjoining landowner is available to review upon request.
Tract 7. A parcel containing a home and approximately 5(±) acres between Tracts 5 and 7 is excluded from the auction, as approximately depicted in Exhibit A. The existing driveway and road entrance on CR 1400 N is part of the excluded parcel. The electric power serving Tract 7 is currently supplied by an electric service panel located on the excluded parcel. The water well serving Tract 7 is located on Tract 7, but the waterline from the well runs through a pressure tank located on the excluded parcel. The Buyer of Tract 7 will be responsible for all activities, permits and/or costs related to: (a) the installation of a new driveway and road entrance on CR 1400 N.; (b) obtaining separate electric service for Tract 7; and (c) installing a new water pressure tank on Tract 7 and disconnecting the water line going to the excluded parcel.
Tract 7. The barn and grain bins on Tract 7 are currently served by an electric supply line crossing the Seller’s adjoining parcel to the south. Tract 7 will have the benefit of a new easement, to be recorded concurrently with the closing, for the continued use of said electric line for power to the existing barn and grain bins (the “Utility Easement”). The form and content of the Utility Easement shall be as determined by Seller in Seller’s sole discretion. Buyer expressly acknowledges and agrees that the Utility Easement shall constitute a Permitted Exception and Seller’s delivery of such instrument at Closing shall not be a violation of any Conveyance Requirements. Seller makes no representation or warranty as to the adequacy, availability or metering of any electric or other public utilities serving Tract 7. Buyer shall be responsible for undertaking all actions necessary to cause such utilities to be delivered to Tract 7 in compliance with applicable laws and service provider requirements.
Tract 7. Notwithstanding anything set forth in the Preliminary Title Evidence, the barn and grain bins on Tract 7 do not enjoy vehicular access to the nearest right-of-way, Highway 185. The barn and grain bins on Tract 7 shall benefit from a new easement for agriculture purposes over the existing driveway on the abutting parcel to the south of Tract 7 to Highway 185 to be recorded concurrent with closing (the “Access Easement”). The form and content of the Access Easement shall be as determined by Seller in Seller’s sole discretion Buyer expressly acknowledges and agrees that the Access Easement shall constitute a Permitted Exception and Seller’s delivery of such instrument at Closing shall not be a violation of any Conveyance Requirements.
Tract 7. The Seller’s Disclosure Statement form and the lead-based paint disclosure form for the home on Tract 7 are posted and shall be signed by the Buyer of Tract 7 at the end of the auction. Advertised building dimensions are approximate. No warranty or authoritative representation is made as to the size or dimensions of any building or fixture. The sale of Tract 7 includes the fridge, stove, washer and dryer in the home and three underground fuel tanks. The airplane is specifically excluded.
