Transferred Access Rights definition
Transferred Access Rights has the meaning given in clause 13.114.1(c)(i)(D). Transport Infrastructure Act means the Transport Infrastructure ▇▇▇ ▇▇▇▇ (Qld). Underutilisation Event for a Train Service Type means any cause, event or circumstance, or combination of causes, events or circumstances, other than the failure by Aurizon Network to make the Access Rights for the Train Service Type available, which will, or will likely, have a sustained or permanent and material adverse impact on the End User’s or the Operator’s ability to utilise, or need to utilise, the Access Rights for that Train Service Type (including, the End User or the Operator (as applicable) ceasing to hold, or have the benefit of, any Supply Chain Rights).
Transferred Access Rights has the meaning given in clause 11.112.1(c)(i)(DE).
Transferred Access Rights means such Access Rights (and applications therefor) of the Seller Group that relate exclusively to the Business (other than any Communication Permits).
