The purpose of this Gas Transportation Agreement is to establish the respective rights and obligations of the Parties concerning the provision by the Transporter to the Shipper of Transportation Services during the Transportation Period.
This Agreement shall enter into force upon signature of this Agreement by both Parties and shall expire on the last day of the Transportation Period as set forth in Article 6 (Term) of Appendix 1 (Commercial Terms).
During the Transportation Period, INGL shall, at its own expense, maintain, repair, renew and operate the Transmission System (or procure its maintenance, repair, renewal and operation) in accordance with the standards of a Reasonable and Prudent Operator and in compliance with all applicable laws and regulations.
The Shipper shall be entitled to extend the Transportation Period by the period of the existence of Force Majeure (subject to payment of the Transportation Fee).
The Shipper shall promptly notify INGL of any changes to the arrangements described in this statement at any time during the Transportation Period.
Notwithstanding the above, any Capacity Overrun Charge applied with respect to any of the first 12 (twelve) Months of the Transportation Period for each Designated Redelivery Point shall not deem to cause a compulsory increase pursuant to this Section 15.3.
The imbalance correction will be invoiced once with the invoice for the Transportation Charge for the last month of the Transportation Period.
SWISSGAS confirms its availability to perform the transportation service for the Shipper during the Transportation Period (Article 5) from the Delivery Point to the Re-Delivery Point, subject to the provisions set out here below.
Type of Service: Firm Transportation Period: January 1, 2002 through March 31, 2005, and year to year thereafter until terminated by either party with sixty (60) days advance written notice prior to March, 2005 or any anniversary thereof.
