Unanticipated Adverse Effects definition
Unanticipated Adverse Effects means those direct and indirect adverse effects on the Collective Rights and Interests of the Community, which are attributable in whole or in part to the Project and are caused by the change from the Pre-Project Water Regime to the Recurring Water Regime, but are unknown and/or unanticipated and are not discernible with the ordinary exercise of due diligence by the Community at the Effective Date. Unanticipated Adverse Effects shall not include any Adverse Effects or Incremental Adverse Effects, as defined herein.
Unanticipated Adverse Effects means those Adverse Effects which as of the Date of this Agreement were not foreseen, nor with the exercise of due diligence and concern, reasonably foreseeable.
