Unauthorized Work definition

Unauthorized Work. Any Work or portion thereof performed by or on behalf of the Subcontractor that constitutes a Change without a Change Directive authorizing such Change, or if a Change Order has been issued, without such Change Order having been accepted by the Subcontractor. Warranty Period: Has the meaning ascribed to it in Section 13. Work Schedule: A schedule prepared by the Subcontractor and, if applicable, outlined in Appendix J - Work Schedule & Schedule of Values, containing a detailed breakdown of the sequence and duration of all activities to be completed by the Subcontractor necessary for the execution Work.
Unauthorized Work has the meaning given to it in Section 3.4(14) of this Schedule.

Examples of Unauthorized Work in a sentence

  • Any Work including any materials, goods, equipment, labor, services or combination thereof which in the judgment of the County is not authorized or required by the Contract Documents shall be classified as Unauthorized Work.

  • The Contract Administrator has authority to curtail services if necessary to ensure proper execution of the Contract, to take actions needed to assure that the Contractor’s Work conforms with the Contract, to decide questions regarding quality and acceptability of Work, to suspend Work, to reject Unacceptable or Unauthorized Work and to refuse to approve Progress and Final Payments until Unacceptable or Unauthorized Work is corrected.

  • Work done contrary to instructions of the Project Supervisor and any work done beyond that which is specified or ordered, will be considered as Unauthorized Work and will not be paid for under the provisions of the Contract.

  • The Work is fully completed, operational and ready for use by the County in all respects in accordance with the Contract Documents, including correction of all punch list items and any other Defective or Unauthorized Work.

  • The County reserves the right, should Defective or Unauthorized Work or materials used by or on the part of the Contractor be discovered, either before or after the Project has been accepted, or even after Final Payment has been made, to claim and recover by process of law such sums as may be sufficient to correct, remove or replace the Defective or Unauthorized Work or materials.

  • Any Defective or Unauthorized Work performed by the Contractor, regardless of whether observed before or after completion of the Work and whether or not fabricated, installed or completed, shall be removed immediately and replaced by the Contractor with Work and materials which shall conform to the specifications, or shall be otherwise corrected and remedied in an acceptable manner authorized by the County or its designee.

  • Unauthorized Work is Work done contrary to the instructions of the Engineer, beyond the plan lines, or any extra work done without the LPA’s permission.

  • The Resident has the authority to reject Unacceptable or Unauthorized Work and refuse to approve Progress and Final Payments until the Unacceptable or Unauthorized Work is corrected.

  • This clause shall have full effect regardless of the fact that the Defective or Unauthorized Work may have been performed, or the defective materials used, with the actual or implied knowledge of the County.

  • Unauthorized Use means either of the following:

  • Unauthorized Access means the entrance of a person into a restricted area without permission of the operator or the operator’s designated representative.

  • Unauthorized signature means one made without actual, implied, or apparent authority and includes a forgery.

  • Unauthorized alien means an alien as defined in Section 1324a(h)(3) of Title 8 of the United States Code.

  • Unauthorized Code means any virus, Trojan horse, worm, or other software routines or hardware components designed to permit unauthorized access, to disable, erase, or otherwise harm Software, hardware or data.

  • Unauthorized Gas means (a) the quantity of gas taken by Customer exceeding the amount which is permitted during a Period of Interruption or (b) the difference (whether positive or negative) between the quantity of gas taken by Customer and the volumes provided for under an Operational Flow Order.

  • Unauthorized disclosure or "unauthorized release" means any disclosure or release not permitted by federal or state statute or regulation, any lawful contract or written agreement, or that does not respond to a lawful order of a court or tribunal or other lawful order.

  • Unauthorized Third Party means any person or entity that, at the time of the Computer Fraud, is not an Authorized User.

  • Unauthorized person means any person who accesses government data without a work assignment that reasonably requires access, or regardless of the person's work assignment, for a purpose not described in the procedures required by section 13.05, subdivision 5.

  • Unauthorized insurer means an insurance institution that has not been granted a certificate of authority by the commissioner to transact the business of insurance in this state."

  • Unauthorized Removal means the Contractor’s removal of Key Personnel without the prior written consent of the State.

  • Company Proprietary Software means all Software owned by the Company.

  • Authorized Users(s) means an individual or individuals with a business need to access DSHS Confidential Information, and who has or have been authorized to do so.

  • Authorized Use The Student Data shared pursuant to the Service Agreement, including persistent unique identifiers, shall be used for no purpose other than the Services outlined in Exhibit "A" or stated in the Service Agreement, or authorized under the statutes referred to herein by this DPA.   • Contractor attributional/proprietary information means information that identifies the contractor(s), whether directly or indirectly, by the grouping of information that can be traced back to the contractor(s) (e.g., program description, facility locations), personally identifiable information, as well as trade secrets, commercial or financial information, or other commercially sensitive information that is not customarily shared outside of the company.

  • Custom Materials means Materials developed by the Supplier at the Procuring Entity's expense under the Contract and identified as such in Appendix 5 of the Contract Agreement and such other Materials as the parties may agree in writing to be Custom Materials. Custom Materials includes Materials created from Standard Materials.

  • Authorized Users means Customer’s employees or Authorized Agents.

  • Contractor Software means software which is proprietary to the Contractor, including software which is or will be used by the Contractor for the purposes of providing the Services.

  • Contractor Materials means Materials owned or developed prior to the provision of the Work, or developed by Contractor independently from the provision of the Work and without use of the JBE Materials or Confidential Information.

  • Malicious Software means any software program or code intended to destroy, interfere with, corrupt, or cause undesired effects on program files, data or other information, executable code or application software macros, whether or not its operation is immediate or delayed, and whether the malicious software is introduced wilfully, negligently or without knowledge of its existence.

  • Customer Materials any materials, data, information, software, equipment or other resources owned by or licensed to You and made available to Us pursuant to facilitating Your use of the Services, including Customer Data.

  • Supplier Materials has the meaning given in clause 8.1(h).

  • Proprietary Materials means any tangible chemical, biological or physical research materials that are furnished by or on behalf of one Party to the other Party in connection with this Agreement, regardless of whether such materials are specifically designated as proprietary by the transferring Party.

  • Program Materials means the documents and information provided by the Program Administrator specifying the qualifying EEMs, technology requirements, costs and other Program requirements, which include, without limitation, program guidelines and requirements, application forms and approval letters.

  • Derivative Work means a work that is based on one or more preexisting works (such as a revision, translation, dramatization, motion picture version, abridgment, condensation, enhancement, modification, or any other form in which preexisting work may be recast, transformed, or adapted) which, if created without the authorization of the copyright owner of the preexisting work, would constitute copyright infringement.
