In the event of such a lease of Unleased Property, any use must be compatible to Tenant’s operation of a charter school.
Notwithstanding anything in this Lease to the contrary, this Lease shall be deemed ineffective with respect to any property interests described in Exhibit A hereto burdened by such a restriction if such restriction is unsatisfied (such property being hereafter referred to as the "Unleased Property").
Such waiver shall not affect Landlord’s future attempts to lease the Unleased Property.
Lessor shall exercise reasonable efforts to cure any prior consent requirements with respect to such Unleased Property and, effective upon the satisfaction of such requirements, such Unleased Property shall be deemed a part of the Leased Property without any further action on the part of Lessor.

If, as of the applicable Property Cut-Off Date, such Property is an Unleased Property, such Property was previously leased by an Affiliate of Borrower to an Eligible Tenant pursuant to an Eligible Lease.
If the Property is subject to a Lease or is an Unleased Property previously subject to a Lease, at the commencement of the related Lease, such Property was (and to Borrower’s knowledge continues to be) in a good, safe and habitable condition and repair, and free of and clear of any damage or waste that has an Individual Material Adverse Effect on such Property.
As of the applicable Property Cut-Off Date, unless such Property is an Unleased Property, or, in case of any Substitute Property, as of the date such Property becomes a Substitute Property, the Property was leased by Borrower (or, in each case, an Affiliate thereof) to an Eligible Tenant pursuant to an Eligible Lease and such Lease was in full force and effect and was not in default in any material respect.
Separate Meters: Landlord may, if it so elects, separately meter the Leased Premises, the Joint-Use Premises and the Unleased Property and in such event, shall assess Tenant the actual costs of its utility usage insofar as that can be determined.
If Tenant fails to deliver written notice within the Notice Period, Tenant waives its right to lease the Unleased Property.
