Unreasonable Conditions definition

Unreasonable Conditions means any condition, requirement or obligation whether in or proposed to be in a Planning Permission, a Planning Agreement or an Infrastructure Agreement as set out in Schedule 13 (Unreasonable Conditions) PROVIDED ALWAYS that for the purposes of this Agreement, none of the following constitute an Unreasonable Condition: 9 Relevant KPIs and calibrations to be agreed with Bidders during dialogue – Section 3 of Part 3 of the Schedule 3 must be self-contained and capable of clearly identifying what constitutes a pass or failure on the Track Record Test (see Table 5 in this regard).

In the event that the employer is not a party to the Strategic Partnering Agreement, then any employees who are to transfer will be considered to be Transferring Non-Participant Employees for the purposes of these provisions. This will need to be considered further on a case-by-case basis.
