Usury Not Intended. Notwithstanding any provision to the contrary contained in this Agreement, the Bond Resolution, the Indenture or the Bonds or any other instrument executed in connection with this Agreement, the amount of interest payable or paid on any Bond, and the amount of any Installment Payment under this Agreement that may be deemed interest, shall be limited to an amount which shall not exceed the maximum nonusurious rate of interest allowed by the applicable laws of the State of Texas, including with respect to the Authority, Chapter 1204, Texas Government Code, or any applicable law of the United States permitting a higher maximum nonusurious rate that preempts such applicable Texas laws, which could lawfully be contracted for, charged or received (the "Highest Lawful Rate"). In the event Bank ever receives, collects, or applies as interest any such sum, such amount which would be in excess of the maximum amount permitted by applicable law shall be applied as a payment and reduction of the principal of the indebtedness evidenced by the Note; and, if the principal of the Note has been paid in full, any remaining excess shall forthwith be paid to the Borrower.
