Vessel Tender Date definition
Vessel Tender Date as defined in Section 5.9(b).
Vessel Tender Date has the meaning provided in Section 9.08. "Voting Stock" means, with respect to any Person, Capital Stock of any class or kind ordinarily having the power to vote for the election of directors, managers or other members of the governing body of such Person. "Wholly Owned" means, with respect to any Subsidiary of any Person, such Subsidiary of such Person if all of the outstanding Common Stock or other similar equity ownership interests (but not including Preferred Stock) in such Subsidiary (other than any director's qualifying shares or Investments by foreign nationals mandated by applicable law) is owned directly or indirectly by such Person.
Vessel Tender Date has the meaning set forth in Section 4.25.

The Company and each Guarantor do hereby declare that the right, title and interest of the Company and each Guarantor in and to the Trust Estate, whether now or hereafter acquired, is subject, to the extent provided in this Indenture, to the rights, mortgage and security interests created by this Indenture and, when entered into on the Closing Date or a Vessel Tender Date, as the case may be, the First Preferred Ship Mortgages and the other Security Documents, in favor of the Trustee and the Holders.
