Written Objections. The Settlement Notice shall provide that any Class Member who has not submitted a Request for Exclusion may object to the Settlement by filing and mailing a Written Objection. Any Written Objections must be made in accordance with the terms set forth in the Settlement Notice and will be deemed timely only if postmarked on or before the Written Objection Deadline. Any Written Objection along with supporting papers, if any, must be (1) filed with the Court, (2) mailed to the Claims Administrator at the address that is set forth in the Settlement Notice, (3) mailed to Defendants’ Counsel at the address set forth in the Settlement Notice, and (4) mailed to Class Counsel at the address set forth in the Settlement Notice. A Written Objection must be signed by the objecting Class Member and contain the Class Member’s full name, current address, and include all objections and the reasons therefore, and include any and all supporting papers (including, without limitation, all briefs, written evidence, and declarations). No Class Member shall be entitled to be heard at the Final Approval Hearing (whether individually or through counsel), unless written notice of the Class Member’s intention to appear at the Final Approval Hearing has been filed with the Court and served upon Class Counsel and Defendants’ Counsel on or before the Notice Deadline and the Class Member has not opted out of the Settlement. A Class Member who desires to object but who fails to comply with the Written Objection procedure set forth herein shall be deemed not to have objected. The Claims Administrator shall send all Written Objections it receives to Counsel for Defendants and Named Plaintiff by .PDF file within 24 hours of receipt. Any Class Member who files a Written Objection remains eligible to receive monetary compensation from the Settlement. The Parties shall not be responsible for any fees, costs, or expenses incurred by any Class Member and/or his or her counsel related to any objections to the Settlement and/or appeals arising therefrom.
