Wrongful Use definition

Wrongful Use means Manufacturer has knowingly or with gross negligence embedded a Digital Certificate in any other product or application that is not Compliant.
Wrongful Use means Subscriber has knowingly or with gross negligence embedded a Digital Certificate in a VEN implementation or any other product or application that is not Compliant.
Wrongful Use means they knew or should have known the conduct would be harmful to the elder/dependent adult.

Examples of Wrongful Use in a sentence

  • CableLabs’ receipt of revenue from Wrongful Use is in addition to any damages CableLabs is entitled to receive by law.

  • If this Agreement is terminated due to Wrongful Use, in addition to revoking CableLabs’ authorization for Manufacturer to receive Digital Certificates, CableLabs shall receive all revenue Manufacturer receives from Wrongful Use.

  • Manufacturer shall indemnify and hold harmless CableLabs, its members, directors, employees, and agents (including the entity that holds the Root Certificates and the CA Certificates that issue the CVCs and Device Certificates), for any claim arising from or related to Manufacturer’s use and implementation of the Digital Certificates, including, without limitation, Wrongful Use.

  • Notwithstanding Clause 15 (Wrongful Use of Account), the Company (and/or the Cardholder, as the case may be) shall in all circumstances be liable for any and all cash advance transactions by any person whomsoever, whether or not authorized by, or made with the knowledge of, the Company and/or Cardholder, plus all applicable charges and fees, except in the case of gross negligence or wilful default on the part of the Bank.

  • If this Agreement is terminated due to Wrongful Use, in addition to revoking Kyrio’ authorization for Subscriber to receive Digital Certificates, Kyrio shall receive all revenue Subscriber receives from Wrongful Use.

  • Subscriber shall indemnify and hold harmless Kyrio, OpenADR Alliance, the Certificate Manager and their respective, directors, employees, and agents, for any claim arising from or related to Subscriber’s use and implementation of the Digital Certificates, including, without limitation, Wrongful Use.

  • Kyrio’s receipt of revenue from Wrongful Use is in addition to any damages Kyrio is entitled to receive in law or equity.

  • In addition to the requirement set for in the OpenADR Alliance Certificate Policy, Subscriber shall indemnify and hold harmless Kyrio, OpenADR Alliance, the Certificate Manager and their respective, directors, employees, and agents, for any claim arising from or related to Subscriber’s use and implementation of the Digital Certificates, including, without limitation, Wrongful Use.

  • In addition to revoking Excentis’ authorisation for Vendor to receive a Digital Certificate, Excentis shall receive all net revenue Vendor receives from Wrongful Use.

  • Manufacturer shall indemnify and hold harmless CableLabs, its members, directors, employees, and agents (including the entity that holds the CableLabs’ Root CAs and the entity(ies) that holds the CAs that issued DPoE CVCs or Digital Certificates), for any claim arising from or related to Manufacturer’s use and implementation of the CVC or Digital Certificates, including, without limitation, Wrongful Use.

Related to Wrongful Use

  • Alleged wrongful conduct means violation of law, Infringement of Company’s rules, misappropriation of monies, actual or suspected fraud, substantial and specific danger to public health and safety or abuse of authority”.

  • Wrongful Act means:

  • harmful interference means interference which endangers the functioning of a radio navigation service or of other safety services or which otherwise seriously degrades, obstructs or repeatedly interrupts a radio communications service operating in accordance with the applicable international, Union or national regulations;

  • Public Domain means readily accessible to the public in a written publication, and does not include information that is only available by substantial searching of the published literature, and information the substance of which must be pieced together from a number of different publications and/or sources;

  • Intentional for purposes of this Agreement, no act or failure to act on the part of the Executive shall be deemed to have been intentional if it was due primarily to an error in judgment or negligence. An act or failure to act on the Executive’s part shall be considered intentional if it is not in good faith and if it is without a reasonable belief that the action or failure to act is in the best interests of the Bank.
