[Enacted by the Uttaranchal Legislative Assembly in the Fifty-fifth year of the Republic of India]

Further to amend the Uttaranchal (the Uttar Pradesh Municipalities Act, 1916) Adaptation and Modification Order, 2002

An Act

1. The act may be called the Uttaranchal (The Uttar Pradesh Municipalities Act, 1916) (third Amendment)

Act, 2005

Short Title

2. in Section 54 of the Uttaranchal (the Uttar Pradesh Municipalities Act, 1916) Adaptation and Modification Order, 2002 hereinafter referred to as the Principal act, in sub-section (2) the following sub-section shall

be substituted, namely:-

Amendment of Section 54 of the Principal Act

(2) the term of office of a Vice- Chairman shall be two years and six months from the date of his election or the residue of

his term as a member, whichever is less.

(3) the provision of aforesaid sub- section (2) shall also apply to the Vice- chairman, who is declared elected in the last election.
3. Section 47-A of the Principal Act shall be omitted		Omission of Section 47- A of the Principal Act, (Act No. 2 of 1916)
4. In Section 48 of the Principal Act-		Amendment of Section 48
(a) in sub-section (2), in clause (b) after sub-section (viii), the following sub-clauses shall be inserted, namely:-
(ix) causes loss or damage to any property of the Municipality; or
(x) misappropriated or misused the Municipal fund; or
(xi) acted against the interest of the Municipalities; or
(xii) created an obstacle in a meeting of the Municipality in such manner that if becomes impossible for the Municipality to conduct its business in the meeting or instigated some one to do so; or
(xiv) willfully contravened any order or direction of the State Government given under this Act; or
(xv) misbehaved without any lawful justification with the officers or employees of the Municipality; or
(xvi) disposed off any property belonging to the Municipality for a price less than its market value; or
(xvii) encroached, or assisted or instigated any other person to amoroso upon the land, building or any other immovable property of the Municipality,
(b) In sub-section (2-A) the proviso shall be omitted

5. Section 87-A of the principal Act shall be omitted.		Omission of Section 87- A
6. In section 96 of the Principal Act, in sub-section (1) in clause (b)		Amendment of Section 96 of the Principal Act
(a) for the words “ten thousand rupees” the words “fifty thousand rupees” shall be substituted
(b) for the words “three thousand rupees” the words “fifteen thousand rupees” shall be substituted
(c) in the proviso for the words “twenty thousand rupees” the word “one lakh rupees” shall be substituted

Further to amend the Uttaranchal (the Uttar Pradesh Nagar Nigam Act, 1959) Adaptation and Modification Order, 2002

An Act

Short Title

1. The act may be called the the Uttaranchal (the Uttar Pradesh Nagar Nigam Act, 1959) Adaptation and

Modification Order, 2002 (third Amendment) Act, 2005

Amendment of Section 15 of the Uttaranchal (the Uttar Pradesh Nagar Nigam Act,

1959)

2. In clause (b) of Sub-section (1) of sectin 15 of the Uttaranchal (the Uttar Pradesh Nagar Nigam Act, 1959) Adaptation and Modification Order, 2002 (hereinafter referred to as the Principal act) following clauses shall be substituted, namely-

“(b) the term of office of Deputy Mayor shall be for period of two years and six months from the date of his

		election or the residue of his term as a Corportor, whichever is less.
		(c) the provisions of clause (b) shall also apply to a Deputy Mayor, who is declared elected in his last election.
Amendment of Section 16 of the Principal Act		3. In Section 16 of the Principal Act the following shall be substituted namely-
		(1) Where the State Government has reason to believe that -
		(a) There has been any default on the part of the Mayor or Deputy Mayor in the discharge of his duties;
		(b) The Mayor or Deputy Mayor has-
		(i) Acquired any disqualification mentioned in section 11 and 25; or
		(ii)Intentionally earned any share or interest, whether financial or otherwise, directly or indirectly by him or on his behalf or by any partner in any contract with the Nagar Nigam or any employment in the Nagar Nigam under section 463; or
		(iii) As a Mayor or Deputy Mayor or Corporator intentionally worked in any such matter in which he or his partner has directly or indirectly has any share or interest, whether financial or otherwise or had professional interest on behalf of any client, owner or any other person; or
		(iv)Against the Nagar Nigam or the State Government attended as a lawyer and worked on behalf of any individual in any suit or other legar proceedings in connection with any nazul land under the management of the Xxxxx Xxxxx, worked or attended ay criminal proceeding on behalf of any such person against whom any criminal proceeding has been instituted by him or the Nagar Nigam; or
		(v) Has vacated his usual place of residence under municipal area of the Nagar Nigam, or
		(vi) Has been quilty of misconduct in discharge or his duties; or
		(vii) Has grossly misused his office as Mayor or Deputy Mayor during the current or earlier term of the Xxxxx Xxxxx acting as Chairman or Corporator or in any other capacity whatsoever, during any period or intentionally acted in contravention or any provision of this Act, or any rule,

		regulation or bylaw or caused such damage or loss to the fund or the property of the Nagar Nigam which disqualifies him to continue as Mayor or Deputy Mayor, or
		(viii) He is quilty of any other misconduct whether such act has been done as a Mayor or Deputy Mayor or Corporator; or
		(ix) Has acted against the interest of the Nagar Nigam; or
		(x) Has obstructed any meeting of the Nagar Nigam in such manner that the conduct of the meeting becomes impossible or abetted any one to do so; or
		(xi) Has intentionally acted in contravention of any order or direction of the State Government issued under Act; or
		(xii) Misbehaved with the officers or employees of the Nagar Nigam without any valid reason; or
		(xiii) Disposed or any property of the Xxxx Xxxxx for a price less than its market value; or
		(xiv) Encroached upon any land, building or any other immovable property of the Nagar Nigam or assisted or abetted any other person for such an enecoachment.
		The State Government any require him to show cause within the period specified in the notice that why he should not be removed from his post.
		(2) The State Government after considering the explanation submitted by the Mayor or Deputy Mayor or after such inquiry as may be deemed necessary recording the reasons may remove the Mayor or Deputy Mayor from such post.
		(3) any order issued by the State Government under sub-section (2) shall be final and no objection shall be raised against it in any court of law.
		(4) The Mayor or Deputy mayor removed under sub- section (2) not remain even as Corporator and shall not be eligible for re-elction a Mayor or Deputy Mayor for a period of 5 years, from the date of his removal on any ground under clause (a) and (b) of sub-section (1).

Amendment of Section 51 of the Principal Act		4. In section 51 of the Principal Act :-
		(a) The following sub-section shall be substituted for sub-section (2), namely-
		“(2) The Deputy Mayor shall be ex-officio Chairman of the Executive Committee.”

To further to amend the Uttar Pradesh Nagar Palika Adhiniyam, 1916 for its application in Uttaracnhal regarding provisions for the election of the Nagarpalika Parishads and Nagar Panchayats:

AN ORDINANCE

Promulgated by the Governor in the Fifty-Third of the Republic of India:-

Whereas, the State Legislature is not in session and the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action; Now, therefore, in exercise of the power conferred by clause (1) of Article

213 of the Constitution, the Governor is pleased to promulgate the following Ordinance:-

(1) This Ordinance may be called the Uttaranchal (the Uttar Pradesh Nagar Palika Adhiniyam, 1916) (Amendment) Ordinance, 2002.

(2) It shall come into force at once.

1. Short title & commencement

Section 9-(1)(A) of the Uttar Pradesh Nagar Palika Adhiniyam, 1916 (hereinafter referred to

2- Amendment of Section 9-(1)9A) of the Uttar Pradesh

as the ‘Principal Act”) the following section shall be substituted, namely:- The elected members, whose number shall be not less than 4 and not more than 45, as may be prescribed by the State Government and notified in the official Gazette:			Xxxxx Xxxxxx Xxxxxxxxx, 1916
	(e)	He has more than two living children of whom one is born, after expiry of 300 days from the date of notification of this part; or,
	(h)	has been convicted of any offence against a women; or,
	(j)	has an interest or share, in a publication wherein advertisement regarding activities of the municipalities can be published; or,
	(m)	is a paid employee of any institution, receiving financial aid from the municipalities; or,
	(n)	The person or any member of his/her family or his/her legal is in unauthorized occupation of any land or building owned or managed by the municipality/Government or a public road or pavement, canal, drain, or is a beneficiary of such unauthorized occupation; or,
	(o)	is a representative or a office bearer of any federation or union of any cadre or class of employees of the municipality; or
	(p)	has been convicted of any offence involving violation of any Act, Rules, Sub-rules, regulations and Govt. orders relating to Municipality and has been found guilty of working against the interest of the municipality;

After section-13-E of the Principal Act a new section 13-F shall be inserted:-

Procedure of voting:- Wherever an election takes place in any ward, voting shall be either

through secret ballot or voting machine and there shall be no proxy voting.

7. Insertion of Section-13-F

In sub-section (2) (a) of section-43-A-A of the Principal Act after sub-section (p) of section 13-D, sub-section (i), (m), (n), (o), (p) shall be

added.
