ALTERNATIVE CONSEQUENCES TO ACCELERATED MATURITY. In the event of any of the circumstances constituting an Accelerated Maturity Circumstance, irrespective of the possibility that accelerated maturity may directly or subsequently be declared, the Fund may also raise the threshold from 75% up to 100% of the limitations set forth in Clause 13.8 on Conditions of Governance. This consequence shall not apply in the event that the Fund explicitly waived this entitlement prior to the Accelerated Maturity Circumstance. A failure to fulfil this demand shall in itself constitute an Accelerated Maturity Circumstance. Fulfilment of this penalty does not release the Beneficiaries and Guarantors from fulfilment of the obligations imposed (which shall remain enforceable), nor does it preclude the right of the Fund to be compensated for any damages that such breaches might have occasioned.
