DILIGENCE OF THE BENEFICIARIES AND GUARANTORS. For the purposes here set out in Clause 14, the Parties explicitly place on record that the occurrence of any of the circumstances set out above shall constitute an Accelerated Maturity Circumstance, irrespective of the degree of responsibility or diligence shown by the Beneficiaries and Guarantors in order to prevent it. Without prejudice to the above, if an Accelerated Maturity Circumstance occurs, in the opinion of the Fund, the Administrative Board may (but will not be obliged to) issue a resolution ordering the immediate repayment of the amount of the Finance, having first conducted the relevant procedure pursuant to Act 39/2015. In addition, and in any event, the Fund shall be entitled to indemnification for any damages that might have been occasioned to it. All the foregoing applies without prejudice to the liabilities and effects set forth in Article 69.4 of Act 39/2015.
