MODIFICACIONES DEL APÉNDICE I PROPUESTAS POR EL JAPÓN EN EL MARCO DEL ACUERDO SOBRE CONTRATACIÓN
PÚBLICA REVISADO
COMUNICACIÓN DEL JAPÓN DE CONFORMIDAD CON EL PÁRRAFO 1 DEL ARTÍCULO XIX1 DEL ACP REVISADO
La siguiente comunicación, de fecha 7 de diciembre de 2015, se distribuye a petición de la delegación del Japón.
La presente notificación reemplaza la notificación del Japón GPA/MOD/JPN/76 presentada el 27 xx xxxx de 2015, que queda sin efecto. Los cambios introducidos en la notificación inicial son el resultado de las consultas mantenidas con los Estados Unidos, que notificaron objeciones (GPA/MOD/JPN/77 y GPA/MOD/JPN/77/Rev.1) a la notificación inicial los días 16 y 19 xx xxxxx de 2015.
1. De conformidad con el párrafo 1 del artículo XIX del Acuerdo sobre Contratación Pública modificado por el Protocolo por el que se modifica el Acuerdo sobre Contratación Pública (denominado en adelante el "Acuerdo revisado"), el Gobierno del Japón notifica por la presente al Comité de Contratación Pública las siguientes modificaciones de carácter puramente formal en relación con su Anexo 3 del Apéndice I del Acuerdo revisado:
1. Sustitúyase "1.17. Japan Environmental Safety Corporation" por "1.17. Japan Environmental Storage & Safety Corporation" en el apartado "1 GROUP A" de la lista de entidades;
2. Sustitúyase "1.22. Japan Foundation" por "1.22. Japan Foundation, The" en el apartado "1 GROUP A" de la lista de entidades;
3. Sustitúyase "1.44. Mutual Aid Association of Agriculture, Forestry and Fishery Corporation Personnel" por "1.44. Mutual Aid Association for Agricultural, Forestry and Fishery Organization Personnel" en el apartado "1 GROUP A" de la lista de entidades;
4. Sustitúyase "2.8. Institute of National College of Technology, Japan" y añádase "2.40. National Institute of Technology" en el apartado "2 GROUP B" de la lista de entidades;
1 El texto del párrafo 1 del artículo XIX (Notificación de propuestas de modificación) es el siguiente: Toda Parte notificará al Comité las rectificaciones propuestas, las transferencias de una entidad de un anexo a otro, el retiro de una entidad, u otras modificaciones de sus Anexos del Apéndice I (las que se denominan en adelante "modificación"). La Parte que proponga la modificación (denominada en adelante "Parte modificante") incluirá en la notificación: a) en caso de que proponga el retiro de una entidad de sus Anexos del Apéndice I, en ejercicio de sus derechos, por haberse eliminado efectivamente el control o la influencia del gobierno sobre las contrataciones abarcadas que realice esa entidad, las pruebas de esa eliminación; o b) en caso de que proponga cualquier otra modificación, información sobre las probables consecuencias del cambio en la cobertura mutuamente convenida prevista en el presente Acuerdo.
5. Sustitúyase "2.37. National Institute of Health and Nutrition" por "2.43. National Institutes of Biomedical Innovation, Health and Nutrition (Note 3.h.)" en el apartado "2 GROUP B" de la lista de entidades, y añádase "h. Procurement other than that conducted for the National Institute of Health and Nutrition is not covered." al párrafo 3 de las "Notas al Anexo 3", como se muestra en los suplementos;
6. Vuélvanse a numerar las demás entidades en consecuencia.
2. Estas modificaciones obedecen a lo siguiente:
1. El 24 de diciembre de 2014, la Corporación Japonesa de Seguridad Ambiental (Japan Environmental Safety Corporation), que figura en la lista del Anexo 3, asumió la responsabilidad del almacenamiento provisional y se reorganizó con el nombre de "Japan Environmental Storage & Safety Corporation".
2. Con las modificaciones relativas a las entidades mencionadas en los apartados 2, 3 y 4 se quiere reflejar los nombres de esas entidades que se utilizan más habitualmente en inglés.
3. El 1º xx xxxxx de 2015, el Instituto Nacional de Salud y Nutrición (National Institute of Health and Nutrition), que se incluye en la lista del Anexo 3, se fusionó con el Instituto Nacional de Innovación Biomédica (National Institute of Biomedical Innovation), que NO está abarcado por el Acuerdo revisado. Esta entidad reorganizada se denominó "National Institutes of Biomedical Innovation, Health and Nutrition".
3. Para mayor información de las Partes en el Acuerdo, los cambios introducidos en la notificación inicial (GPA/MOD/JPN/76) son los siguientes:
1. No se introduce ninguna nota en relación con "1.17. Japan Environmental Storage & Safety Corporation" en el apartado "1 GROUP A" de la lista de entidades. Se elimina la nota propuesta anteriormente: "h. Procurement related to interim storage is not covered.".
2. El texto de la nota introducida en relación con "2.43. National Institutes of Biomedical Innovation, Health and Nutrition (Note 3.h.)" en el apartado "2 GROUP B" de la lista de entidades se modifica como sigue: "i.h. Procurement related to the functions that have been transferred from the former National Institute of Biomedical Innovation other than that conducted for the National Institute of Health and Nutrition is not covered.".
4. Las modificaciones que propone el Japón no alteran la cobertura mutuamente convenida prevista en el Acuerdo revisado.
5. El suplemento A muestra (tachadas y subrayadas) las modificaciones propuestas de las páginas correspondientes del Anexo 3 del Apéndice I. En el suplemento B se indica cómo quedarían esas páginas del Anexo 3 del Apéndice I tras la introducción de las modificaciones propuestas.2

Notes to Annex 3
1. This Agreement does not cover contracts to be awarded to co-operatives or associations in accordance with laws and regulations existing at the time of the entry into force of this Agreement for Japan.
2. This Agreement does not cover contracts which the entities in Group A award for purposes of their daily profit-making activities which are exposed to competitive forces in markets. This note shall not be used in a manner which circumvents the provisions of this Agreement.
3. Notes to specific entities:
a. Procurement related to operational safety of transportation is not covered.
b. Procurement which could lead to the disclosure of information incompatible with the purpose of the Treaty on the Non-Proliferation of Nuclear Weapons or with international agreements on intellectual property rights is not covered. Procurement for safety-related activities aiming at utilization and management of radioactive materials and responding to emergencies of nuclear installation is not covered.
c. Procurement related to geological and geophysical survey is not covered.
d. Procurement of advertising services, construction services and real estate services is not covered.
e. Procurement of ships to be jointly owned with private companies is not covered.
f. Procurement of public electrical telecommunications equipment and of services related to operational safety of telecommunications is not covered.
g. Procurement of the services specified in Annex 5, other than construction services, is not covered.
h. Procurement other than that conducted for the National Institute of Health and Nutrition is not covered.
4. With regard to procurement by Japan Railway Construction, Transport and Technology Agency:
a. Note 3.a. applies only to the railway construction-related activities;
b. Note 3.d. applies only to the activities relating to the settlement of the former Japan National Railways;
c. Note 3.e. applies only to the shipbuilding activities.
5. East Japan Railway Company (Note 3.a.) (Note 3.g.), Central Japan Railway Company (Note 3.a.) (Note 3.g.) and Xxxx Japan Railway Company (Note 3.a.) (Note 3.g.) shall be deemed to be included in Group A with respect to Goods and Services of this Annex until such time as the European Union withdraws its objection against the delisting of these companies.
As soon as the European Union's notification of the withdrawal of its objection has been notified to the Committee on Government Procurement, this note shall cease to have effect.
6. National Aerospace Laboratory of Japan shall be deemed to be included in Group B with respect to Goods and Services of this Annex until such time as the European Union and the United States withdraw their objections against the delisting of this abolished entity.
As soon as the United States' and the European Union's notifications of the withdrawals of their objections have been notified to the Committee on Government Procurement, this note shall cease to have effect.

As soon as the United States' and the European Union's notifications of the withdrawals of their objections have been notified to the Committee on Government Procurement, this note shall cease to have effect.
