ADHESIÓN DE UCRANIA AL ACUERDO SOBRE CONTRATACIÓN PÚBLICA

El Comité de Contratación Pública,
Teniendo en cuenta el párrafo 2 del artículo XXIV del Acuerdo sobre Contratación Pública hecho en Marrakech el 15 xx xxxxx de 1994 (el "Acuerdo de 1994"), y el párrafo 2 del artículo XXII del Acuerdo sobre Contratación Pública de 1994 modificado por el Protocolo por el que se modifica el Acuerdo sobre Contratación Pública, hecho en Ginebra el 00 xx xxxxx xx 0000 (xx "Xxxxxxx modificado")1;
Teniendo en cuenta la Decisión del Comité de Contratación Pública sobre la adopción del texto del Protocolo por el que se modifica el Acuerdo sobre Contratación Pública, adoptada el 00 xx xxxxx xx 0000 (Xxxxxxxx 1 del documento GPA/113, de 2 xx xxxxx de 2012), y en particular sus párrafos 3 y 4;
Teniendo en cuenta la entrada en vigor del Protocolo por el que se modifica el Acuerdo sobre Contratación Pública el 6 xx xxxxx de 2014 de conformidad con el párrafo 3 de dicho Protocolo, y la ulterior aceptación del Protocolo por el que se modifica el Acuerdo sobre Contratación Pública por otras tres Partes;
Tomando nota asimismo de que hay aún otras dos Partes en el Acuerdo sobre Contratación Pública que deben aceptar el Protocolo por el que se modifica el Acuerdo sobre Contratación Pública; y
Considerando la solicitud de adhesión al Acuerdo sobre Contratación Pública presentada por Ucrania, que figura en el documento GPA/107 de 9 de febrero de 2011, y las consultas celebradas con las Partes en el Acuerdo sobre Contratación Pública, así como la documentación adicional presentada a tal efecto;
Decide lo siguiente:
1. De conformidad con las disposiciones del párrafo 2 del artículo XXIV del Acuerdo de 1994 y del párrafo 2 del artículo XXII del Acuerdo modificado, Ucrania podrá adherirse al Acuerdo sobre Contratación Pública en las condiciones establecidas en la presente Decisión, incluidos sus anexos.
2. El Acuerdo sobre Contratación Pública entrará en vigor para Ucrania el trigésimo día siguiente a la fecha de su adhesión, es decir, la fecha en que el Director General reciba el instrumento de adhesión, en el que se reproducirán las condiciones establecidas en la presente Decisión, incluido su anexo A.

3. De conformidad con el párrafo 4 de la Decisión del Comité de Contratación Pública sobre la adopción del texto del Protocolo por el que se modifica el Acuerdo sobre Contratación Pública, adoptada el 00 xx xxxxx xx 0000 (Xxxxxxxx 1 del documento XXX/000, xx 0 xx xxxxx xx 0000), Xxxxxxx estará obligada por dicho Protocolo a partir de la fecha de entrada en vigor del Acuerdo sobre Contratación Pública para ella.
4. A partir de la fecha de entrada en vigor del Acuerdo sobre Contratación Pública para ella, Ucrania proporcionará acceso a la contratación que incluya en el marco del Apéndice I, según se establece en el anexo A de la presente Decisión, a todas las Partes en el Acuerdo sobre Contratación Pública.
5. A partir de la fecha de entrada en vigor del Acuerdo sobre Contratación Pública para Ucrania, los Anexos del Apéndice I de la Unión Europea serán aplicables con sujeción a las disposiciones que figuran en el anexo B de la presente Decisión.
6. Hasta que el Protocolo por el que se modifica el Acuerdo sobre Contratación Pública haya entrado en vigor para todas las Partes en el Acuerdo de 1994, entre Ucrania y una Parte que sea Parte solamente en el Acuerdo de 1994 será aplicable el Apéndice I del Acuerdo de 1994 de dicha Parte.
7. Ucrania presentará su instrumento de adhesión en el plazo de seis meses desde la fecha de la presente Decisión, a menos que el Comité prorrogue el plazo para la presentación del instrumento.
8. A partir de la fecha de entrada en vigor del Acuerdo sobre Contratación Pública para Ucrania, las condiciones adjuntas a su instrumento de adhesión pasarán a ser parte integrante del Acuerdo sobre Contratación Pública como Apéndices correspondientes a Ucrania.

Note to Annex 3
I. Provided that the conditions in paragraph II are met, this Agreement does not cover procurement:
a. by a procuring entity from an affiliated undertaking3, or
b. by a joint venture, formed exclusively by a number of procuring entities for the purpose of carrying out activities within the meaning of paragraphs a. to f. of this Annex, from an undertaking which is affiliated with one of these procuring entities.
II. Paragraph I shall apply to services or supplies contracts provided that at least 80% of the average turnover of the affiliated undertaking with respect to services or supplies for the preceding three years derives from the provision of such services or supplies to undertakings with which it is affiliated.4
3 "Affiliated undertaking" means any undertaking over which the procuring entity may exercise, directly or indirectly, a dominant influence, or which may exercise a dominant influence over the procuring entity, or which, in common with the procuring entity, is subject to the dominant influence of another undertaking by virtue of ownership, financial participation, or the rules which govern it.
4 When, because of the date on which an affiliated undertaking was created or commenced activities, the turnover is not available for the preceding three years, it will be sufficient for that undertaking to show that the turnover referred to in this paragraph is credible, in particular by means of business projections.

The Agreement covers all services procured by the entities included in Annexes 1 to 3 except for:
a. services of international mediation courts, international commercial arbitrages provided for consideration and resolution of disputes involving the procuring entity;
b. services of financial institutions, including international financial institutions, related to the raising of credit resources and funds for the chartered capital by a procuring entity;
c. research and development services identified in Division 85 of the United Nations Provisional Central Product Classification (CPC Prov.);
d. financial and related services identified in Division 81 of the United Nations Provisional Central Product Classification (CPC Prov.) procured or provided by the National Bank of Ukraine.

GENERAL NOTES
1. The General Notes apply to all Annexes.
2. The offer regarding services and constructions services is subject to the limitations and conditions specified in Ukraine's offer under the GATS negotiations.
3. This Agreement shall not apply to the following procurement:
a. construction services procured by diplomatic representations abroad;
b. goods and services for the design, development and production of protected paper, banknotes, coins of Ukraine, their storage and the record-keeping thereof as well as personal identification documents, documents regarding special legal status, citizenship documents, including passports, and other documents requiring special security features or brands of paid excise tax pursuant to the laws of Ukraine and goods or services required for their manufacture.
