Condiciones Generales de Prestación de Servicios de Hosting y Dominios
Las presentes Condiciones de Contratación regulan la relación entre France Telecom España S.A. con sede social en Parque Empresarial La Finca, Paseo del Club Deportivo 1, Xxxxxxxx 0 - 00000 Xxxxxxx xx Xxxxxxx- Xxxxxx.
Inscrita en el Registro Mercantil de Madrid, tomo 13.183, Folio 129, hoja M 213468 CIF X-00000000 (denominada en adelante por su marca “Orange' y el titular del Servicio, es decir las personas físicas o jurídicas receptoras del mismo (en adelante el 'Cliente') que contraten cualquiera de los productos y servicios de Wanadoo Pro. No obstante lo anterior, alguno de los productos y/o servicios puede prestarse, adicionalmente, bajo unas Condiciones Particulares, las cuales resultarán igualmente de aplicación. En caso de existir contradicciones entre las presentes Condiciones Generales y las Condiciones Particulares primarán estas últimas.
France Telecom España S.A. presta los servicios "Hosting y Dominios" únicamente en territorio español.
(I) Condiciones de Prestación de los Servicios Hosting y Dominios
1.- Objeto. La suscripción a los Servicios de Internet de Hosting y Dominios supone la prestación por parte de Orange y/o a través de terceros, de alguno o varios de los siguientes productos y/o servicios (en adelante los Servicios) (con independencia del nombre comercial que puedan tener cada uno de ellos):
i. Xxxxxxx Xxxxxx
ii. Cuenta de Correo
iii. Alta en buscadores
iv. Planes de alojamiento.
u otros servicios que Orange preste en la actualidad o en el futuro. Todo ello de conformidad con los términos y condiciones descritos en la oferta concreta, en la modalidad del Servicio o en las Condiciones Particulares del mismo si estas existieran, así como con lo previsto en las presentes Condiciones Generales.
Los Servicios "Hosting y Dominios" están dirigidos mayoritariamente a Profesionales y Empresas, aunque también podrán ser contratados por particulares.
Condiciones legales de aplicación. La relación entre Orange y el Cliente, para cada uno de Servicios "Hosting y Dominios" de que se trate, se regirá:
a. Por las presentes Condiciones de Prestación de los Servicios Hosting y Dominios, en lo que a cada uno de los Servicios Hosting y Dominios" se refiera específicamente.
b. Por las Condiciones Generales de Contratación de Servicios de Internet de ORANGE que serán de aplicación a la parte de Internet de el servicio contratada, y que se encuentran disponibles en: xxxx://xxxxxxxx.xxxxxx.xx/xxxxxxxxxxx/xxxxxxxxx_xxxxxxxx.xxxx
Lo establecido en las Condiciones Generales de Contratación de Servicios de Internet resulta de plena aplicación a los Servicios "Hosting y Dominios", con la única excepción de aquellos aspectos que se regulan en las presentes Condiciones Particulares de manera contraria o incompatible, caso en el que se entenderá que prevalece lo previsto en las presentes Condiciones de Prestación de los Servicios Hosting y Dominios y las particularidades de cada uno de los servicios contratados.
Las presentes Condiciones de Prestación de los Servicios Hosting y Dominios, sustituyen a cualesquiera otras anteriores a la fecha que se indica al final de las mismas.
2.- Duración del Contrato. El presente contrato entrará en vigor desde que la solicitud realizada por el Cliente se considera válida. La solicitud realizada por el Cliente se hará a través de la aceptación expresa y sin reservas de las presentes Condiciones Generales, aceptación que es considerada condición esencial para la prestación de los Servicios por parte de ORANGE y que ocurrirá si se produce cualquiera de los siguientes eventos:
(i) la activación del botón quiero darme de alta o aceptar o continuar o similar en la solicitud de alta en el Servicio
(ii) la firma y/o envío de la solicitud de alta en el Servicio
(iii) la solicitud de alta en el Servicio realizada por vía telefónica
(iv) el pago de la correspondiente factura o cargo en caso de servicios facturables o no gratuitos así como cualquier otra acción que implique por parte del Cliente el uso del Servicio.
La solicitud debe ser considerada válida (se han completado correctamente todos los datos de la solicitud de contratación, está correctamente firmada y el Cliente ha aceptado las presentes Condiciones Generales y/o las particulares asociadas), además queda sujeta y condicionada a la facultad de previa verificación por Orange de los datos, informaciones y documentos aportados por el Cliente en la contratación del mismo. Una vez la solicitud se considera válida se iniciará el contrato, con la duración estipulada para cada tipo de servicio en sus propias Condiciones Particulares, y siempre existiendo una comunicación al Cliente en tal sentido.
3.- Precio del Servicio. En caso de Servicios facturables o no gratuitos, como contraprestación a la prestación del Servicio, el Cliente deberá pagar y ORANGE tendrá derecho a cobrar el precio correspondiente al Servicio y concreta modalidad contratada, de conformidad con las tarifas de ORANGE vigentes en cada momento, disponibles en xxxx://xxxxxxxxxxxxxxxx.xxxxxx.xx/xxxxxxxxx/xxxx/xxxxxxxxxxxxxxx/
El Cliente ha sido informado, conoce y acepta las tarifas vigentes en el momento de suscripción del Servicio. Las tarifas se incrementarán con los impuestos indirectos que resulten legalmente aplicables en cada momento. No obstante lo anterior, en los casos en los que Wanadoo lance promociones temporales para estos Servicios, los precios aplicables serán los que se establezcan en la oferta correspondiente.
4.- Facturación y forma de pago. Orange facturará, de acuerdo con la modalidad elegida por el Cliente, las cantidades a abonar por el uso del servicio. En las facturas aparecerán desglosadas las cantidades a pagar por cada uno de los Servicios contratados. Además, se desglosarán los descuentos y promociones ofertados y aplicados por Orange.
El pago se realizará mediante domiciliación de las facturas en la cuenta bancaria o cuenta de ahorro que el Cliente haya designado, o en su defecto, por transferencia bancaria a la cuenta habilitada a tal efecto, salvo que el cliente hubiera elegido otro medio de pago. La fecha en la que se debe realizar el pago no podrá exceder los 30 días a contar desde el final del período de facturación. En caso de domiciliación bancaria el cliente recibirá de la entidad bancaria o de ahorro en la que se ha realizado la domiciliación la notificación con el importe a abonar por el Cliente.
Las facturas no abonadas en la fecha prevista por causas no imputables a Orange, tendrán la consideración de deuda vencida y estarán sujetas a ejecución inmediata. En caso de ejecución judicial, Orange se reserva la posibilidad de aplicar, desde la fecha en que el pago debió realizarse, un interés de demora igual al interés legal del dinero más dos puntos porcentuales. Igual interés se devengará en el caso de que, como consecuencia de una reclamación judicial, el Cliente tenga derecho a alguna devolución.
En el caso de que el Cliente abone a ORANGE un importe sin identificar específicamente el Servicio determinado por el que se realice el pago, el Cliente autoriza a ORANGE para aplicar los importes abonados por el mismo a ORANGE al pago de cualquiera de los Servicios que haya contratado el Cliente, en la medida en que ello sea necesario para la extinción, total o parcial, de cualquier deuda contraída con ORANGE por la prestación de otros Servicios. Si el pago de la totalidad de las cantidades debidas (incluyendo los intereses moratorios) por el Cliente a ORANGE se realizara con posterioridad a la suspensión del servicio, ORANGE se reserva el derecho de dar de nuevo de alta al Cliente que así lo solicitara. Asimismo, el impago por el Cliente, facultará a ORANGE, previo el requerimiento, a comunicar este extremo a los servicios de información sobre solvencia patrimonial y de crédito, de acuerdo con lo previsto en la Ley 15/1999 de Protección de Datos Personales y demás normativa aplicable al efecto.
5.- Reclamaciones. Las quejas, reclamaciones y cualquier incidencia contractual deberán ser dirigidas a Orange en el plazo de un mes desde el momento en que se tenga conocimiento del hecho que las motive, bien telefónicamente al número 902 014 002, o bien por escrito por fax al número 000 000 000 o bien al Xxxx. xx Xxxxxxx 00000, 00000 Xxxxxx, indicando Ref: RECLAMACIONES.
Cuando un Cliente se dirija al Servicio de Atención al Cliente (S.A.C.) deberá tener constancia de la reclamación, queja o petición efectuada, debiendo el SAC de Wanadoo comunicarle el número de referencia dado a la misma. Si el Cliente quisiera tener constancia escrita de la reclamación efectuada, tiene derecho a solicitarla.
Formulada la reclamación, el Cliente podrá dirigirse a la Secretaría de Estado de Telecomunicaciones y para la Sociedad de la Información en un plazo máximo de 3 meses tanto sino hubiera obtenido respuesta satisfactoria de Orange como si a la finalización del plazo del que Orange dispone para contestar, no lo hubiera hecho. Para supuestos de contratación o comunicaciones comerciales electrónicas y protección de datos personales, si no hubiera obtenido respuesta de Orange en el plazo de un mes, o ésta no fuera satisfactoria. El Cliente podrá dirigirse al procedimiento de mediación y subsiguiente arbitraje ante la Secretaria de “Confianza on-line”, (xxx.xxxxxxxxxxxxxxx.xxx) sita en la X/ Xxxxx xx Xxxxxxxx xx 00, 0xX, 00000 Xxxxxx.
6.- Protección de los datos personales. A los efectos de lo dispuesto en la normativa vigente relativa a la protección de datos de carácter personal, Wanadoo informa al Cliente de la existencia de un fichero automatizado de datos de carácter personal creado y bajo la responsabilidad de Orange, con la finalidad de realizar el mantenimiento y la gestión de la relación contractual con los Clientes.
Asimismo le informa del carácter facultativo de contestar a los datos personales solicitados en el anverso del presente contrato y en caso de cumplimentarlos, sobre la posibilidad de ejercitar en cualquier momento los derechos de acceso, rectificación, cancelación y oposición al tratamiento de los datos personales, telefónicamente llamando al número de Atención al Cliente de Wanadoo 000 000 000 o mediante comunicación escrita acompañada de su D.N.I. a la siguiente dirección: Xxxx xx Xxxxxxx 00000, Xxxxxx 00000; Ref: Protección de Datos.
El cliente, mediante la firma del presente contrato, presta su consentimiento expreso para:
1) Que los datos personales facilitados formen parte del mencionado fichero.
2) La cesión a las empresas del grupo France Telecom y al canal de distribuidores y agentes que, en su caso colaboren con Orange en la contratación de los diferentes productos y/o servicios, de los datos de carácter personal contenidos en el mencionado fichero.
3) Utilizar sus datos de tráfico con fines de promoción comercial o prestación de servicios con valor añadido. No obstante el cliente podrá retirar en cualquier momento su consentimiento para el tratamiento de sus datos de tráfico dirigiéndose al SAC de Orange.
4) Remitirle Comunicaciones Comerciales a través del correo electrónico que en su caso facilite, de conformidad con lo establecido en la Ley de Servicios de la Sociedad de la Información y Comercio electrónico (LSSICE), sin perjuicio del derecho del Cliente a poder revocar su consentimiento en cualquier momento posterior enviando un documento por escrito al Xxxx xx Xxxxxxx 00000, Xxxxxx 28080.
5) Recibir llamadas con fines de venta directa realizadas mediante sistemas de llamada automática. En cualquier caso el cliente podrá retirar su consentimiento al respecto dirigiéndose al SAC de Orange.
Orange se compromete al cumplimiento de su obligación xx xxxxxxx de los datos de carácter personal y de su deber de guardarlos y adoptará las medidas necesarias para evitar su alteración, pérdida, tratamiento o acceso no autorizado, habida cuenta en todo momento del estado de la tecnología.
7. Obligaciones de las Partes
Además de la obligaciones asumidas por Orange frente al Cliente en las Condiciones Generales de Prestación de los Servicios de Internet, ORANGE responderá única y exclusivamente del servicio que preste por sí misma y de los contenidos directamente originados por ORANGE e identificados con su copyright.
Dicha responsabilidad quedará excluida en los casos en que concurran causas de fuerza mayor, falta de adecuación de la configuración de los equipos del Cliente para permitir el correcto funcionamiento y/o uso del servicio, así como cualesquiera otras causas que escapen al control de ORANGE.
En cualquier caso, la posible responsabilidad de ORANGE vendrá limitada a la cantidad abonada por el Cliente como contraprestación a la prestación de estos Servicios, excluyéndose expresamente cualquier otro tipo de responsabilidad, ya sea por daños directos o indirectos, daño emergente y/o por lucro cesante.
En ningún caso ORANGE vendrá obligada a la reparación de terminales, aparatos telefónicos o de otro tipo o cualesquiera equipos informáticos, que en todo caso deberán contar con sus correspondientes certificados de homologación y cumplir cuantas obligaciones y especificaciones técnicas legales requeridas.
En cualquier caso la configuración y capacidad de los equipos del Cliente deberá ser suficiente para permitir el correcto uso de los Servicios que contrata, responsabilizándose el Cliente de su correcta instalación.
8.- Resolución del contrato.
El presente contrato se extinguirá por las causas generales de extinción de los contratos. Por otra parte el cliente tendrá derecho a resolver este contrato en cualquier momento, telefónicamente llamando al número de Atención al Cliente de Orange 902 014 002 o mediante solicitud escrita bien por fax al número 000 000 000 o bien al Apdo. de Correos 62064, 28080 Ref: BAJAS (Madrid), con una antelación mínima de quince días al momento en que ha de surtir efectos.
9.- Legislación aplicable.
El presente contrato se regirá por la legislación española aplicable para la prestación de los servicios de comunicaciones electrónicas contratado.
10.- Remisión a Condiciones Generales.
Las disposiciones detalladas a continuación se podrán consultar en las Condiciones Generales de Prestación de Servicios de Internet:
Depósito de garantía.
Suspensión por impago; suspensión temporal, desconexión e interrupción definitiva del Servicio. Secreto de las comunicaciones.

11.- Varios
En el caso de que cualquier disposición de este documento fuera considerada nula, el resto del mismo se mantendrá plenamente en vigor las demás disposiciones.
La falta de ejercicio por parte de ORANGE de cualquier derecho o disposición contenidos en este documento no constituirá una renuncia al mismo, salvo reconocimiento escrito y expreso por su parte.
Todas las comunicaciones o notificaciones que hayan de efectuarse por parte de ORANGE podrán ser enviadas a través del correo electrónico al buzón del que sea titular el Cliente.

- Condiciones Particulares de Prestación de los Servicios de Wanadoo Pro vigente para contrataciones realizadas con anterioridad al 08/08/2002 y aplicables hasta el 28/08/2002
- Condiciones Particulares de prestación de los Servicios de Wanadoo Pro vigente para contrataciones realizadas a partir del 08/08/2002 hasta el 21/09/2003
- Nuevas Condiciones Particulares de prestación de los Servicios de Wanadoo Pro vigente para contrataciones realizadas a partir del 22/09/2003 hasta el 14/09/2004.
- Nuevas Condiciones Particulares de prestación de los Servicios de Wanadoo Pro vigente para contrataciones realizadas a partir del 15/09/2004. hasta el 21/12/2005
- Nuevas Condiciones Particulares de prestación de los Servicios de Wanadoo Pro vigente para contrataciones realizadas a partir del 22/12/2005 hasta el 23/07/2006.
Condiciones Particulares de Prestación de los diferentes Servicios de Hosting y Dominios comercializados actualmente
1. DOMINIO PROPIO Registro de dominio.
Servicio de adquisición, gestión y traslado de un nombre de dominio de segundo nivel, bajo los dominios ".com", ".net", ".org", ".biz", ".info", “.eu” (nivel genérico) y ".es" (nivel territorial).
El cliente tendrá la posibilidad de redirigir el dominio a una página web concreta alojada en los servidores de ORANGE.
La contratación del Servicio se realizará por un periodo de un año, renovándose de forma automática por el mismo periodo de tiempo. Si el Cliente desea no renovar el contrato deberá comunicárselo a ORANGE por escrito, ya sea vía fax o correo certificado, con una antelación mínima de quince (15) días a la fecha de renovación del contrato.
La fecha de entrada en vigor será la fecha de alta en el Servicio. Una vez WANADOO ORANGE reciba la solicitud del Cliente, se tramitará el alta en el Servicio. PLAZO DE ACTIVACIÓN DEL SERVICIO DOMINIO PROPIO: Un plazo máximo de 48 horas En el caso de traslados de dominios, el cliente debe autorizar la petición de traslado por lo cual en este caso el plazo de activación dependerá de este hito y se calcula que será un plazo de una semana.
A. Registro de nombres de dominio bajo ".es".
La prestación de este servicio está condicionada a la aceptación y cumplimiento por parte del Cliente de la normativa en vigor sobre la materia, especialmente las que se refieren a las normas de asignación de nombres de dominio de segundo nivel bajo ".es" establecidas por el ES-NIC, entidad que realiza las funciones de Registro Delegado de Internet en España (o el organismo que las pudiera sustituir en el futuro). A título meramente enunciativo, dichas normas se encuentran en la dirección de Internet xxxx://xxx.xxx.xx/xxxxxx/xxxxx.xxxx . Asimismo, el ES-NIC establece qué requisitos debe cumplir un nombre de dominio para ser otorgado y mantenido, además de las causas de anulación o baja del registro de un nombre de dominio.
ORANGE no garantiza que el nombre de dominio solicitado por el Cliente sea efectivamente asignado al mismo por el ES- NIC, limitándose el Servicio a la tramitación de la solicitud de registro, de acuerdo con la información proporcionada por el Cliente.
La titularidad, autoridad y responsabilidad última del uso del nombre de dominio recae sobre el Cliente. ORANGE no es responsable administrativo del dominio asignado al Cliente, independientemente de que haya hecho de intermediario para la asignación de dicho dominio.
El formulario de solicitud de alta debe ser debidamente cumplimentado y firmado por persona con poder bastante, quien declara:
- Aceptar en su totalidad las normas establecidas para el registro de nombres de dominio bajo "es" en el DNS de Internet, en concreto la ORDEN de 21 xx xxxxx de 2000 por la que se regula el sistema de asignación de nombres de dominio de Internet bajo el código de país correspondiente a España (.es). y la ORDEN de 00 xx xxxxx 0000 por la que se modifica la Orden de 21 xx xxxxx de 2000 por la que se regula el sistema de asignación de nombres de dominio de Internet bajo el código de país correspondiente a España (.es). (la información es pública y puede obtenerse en xxxx://xxx.xxx.xx).
- Conocer y aceptar que las normas y procedimientos vigentes en la actualidad pueden sufrir en el futuro las modificaciones que el ES-NIC, la IANA (Internet Assigned Number Authority) o la ICANN (Internet Corporation for Assigned Names and Numbers), así como la propia ORANGE, estimen oportunas.
- Que los datos facilitados en la solicitud de alta en el servicio son ciertos.
- Aceptar que cualquier falsedad en los datos consignados en la solicitud podrá ser causa de rechazo de la misma o de baja del nombre de dominio en cualquier momento si el registro ya se hubiera producido y que, en este caso, el nombre de dominio es reutilizable para su posterior registro por otro solicitante de acuerdo con las normas y procedimientos establecidos.
- Comprometerse, una vez le sea comunicado el resultado favorable del procesamiento de su solicitud, al pago de las cuotas de alta y mantenimiento presentes y futuras que le correspondan.
- Aceptar que, en caso de impago o pago insuficiente tras los plazos y prorrogas establecidos, el nombre de dominio registrado será dado de baja, pasando a ser reutilizable desde ese mismo momento para su registro por otro solicitante de acuerdo con las normas y procedimientos establecidos.
- De acuerdo con su conocimiento, el uso del dominio propuesto no viola los derechos de ninguna tercera parte.
- Ser consciente de que el registro por parte del ES-NIC del nombre de dominio propuesto no le confiere ningún derecho legal sobre el mismo y de que cualquier disputa sobre los derechos de uso de un determinado nombre de dominio habrá de ser resuelta entre las partes contendientes utilizando los cauces legales normales. Asimismo acepta que, en caso de disputa, el ES-NIC no tendrá otro papel ni responsabilidad que el de facilitar a las partes en conflicto la información de contacto necesaria para que puedan resolver sus diferencias de la forma que crean oportuna (acuerdo bilateral, Juzgados y Tribunales competentes, etc.).
- Conocer y aceptar que el firmante de la solicitud de alta en el servicio es el responsable a todos los efectos de cualquier problema relacionado con los derechos de uso del nombre de dominio. - Las personas cuyos datos personales han sido proporcionados en el formulario de solicitud de alta, dan su consentimiento para que sus datos personales sean tratados de acuerdo con lo establecido por la Ley Organica 15/1999 de 13 de diciembre de Proteccion de Datos de Caracter Personal, siendo incorporados a las bases de datos internas y publicas mantenidas por el ES-NIC.
- Comprometerse a mantener siempre actualizada la información facilitada en la solicitud, mediante el envío a ORANGE de una solicitud de cambio de los datos de un registro previo siempre que haya modificaciones en cualquiera de los datos consignados. El no hacerlo así puede dar lugar a que el dominio sea dado de baja (por ejemplo, por imposibilidad de comunicar con las personas que figuran como responsables de facturación, administrativo o técnico del dominio al no haber notificado cambios de sus datos de contacto o cambios de responsables).
B. Registro de dominios bajo ".com", ".net", ".org", ".info", ".biz", “.eu”.
El servicio de adquisición y licencia de un nombre de dominio bajo ".com", ".net", ".org", ".info", ".biz", “.eu”, se presta al Cliente a través de NordNet, entidad de registro de nombres de dominio reconocida y acreditada por el ICANN (Internet Corporation for Assigned Names and Numbers). La prestación de este servicio se regirá:
Por las Condiciones Particulares de Contratación de NordNet, como entidad encargada de la tramitación ante el ICANN del registro del nombre de dominio solicitado. GENERAL TERMS OF REGISTRATION AND MAINTENANCE OF NORDNET REGISTRAR DOMAIN NAMES version 1.2 (11 may 2006) NordNet is a company duly organised under the laws of France, specialised in Internet services (access to the Internet, computer safety, registration and maintenance of Domain Names, referencing, hosting of Websites and hardware).
Concerning Domain Names, NordNet is a registration centre(«Registrar»), certified by ICANN (Internet Corporation for Assigned Names and Numbers), and various national or supranational regulatory authorities, including EURid and AFNIC.
In this capacity, NordNet (« NordNet Registrar ») is authorised to register Domain Names for generic extensions (Generic top level domain name – gTLDs) - « .com », « .net », « .org », « .info » and « .biz » - for certain national extensions (Country code top level domain name – ccTLDs) - « .fr », « .be » - for the European extension - « .eu » - and any new extension for which NordNet Registrar would apply for certification. Though NordNet Registrar may register Domain Names for new extensions, it will remain free to offer or not to offer inclusion of these extensions into the Contract.
The purpose of General Terms is to define conditions under which NordNet Registrar undertakes to register and maintain Domain Names registered with NordNet Registrar.
Registration and maintenance of Domain Names by NordNet Registrar will be Services provided by NordNet Registrar. Services will be subject to the General Terms of registration and maintenance of NordNet Registrar Domain Names and Special Terms of registration and maintenance of NordNet Registrar Domain Names applicable depending on the extension selected as defined in « Definitions » hereinafter.
In case General Terms should be in conflict with Special Terms, Special Terms will prevail.
Extra services may be provided to you either directly by NordNet Registrar (in particular by Xxxxxxx.xxx or XxXxxxxxXxxxxxxx.xxx) or by an external Service Provider. Whatever the Service provider may be, NordNet Registrar may not be held liable in case the Service Provider should fail to meet its obligations.
General and Special Terms of registration and maintenance of NordNet Registrar Domain Names will prevail over any such general terms, special terms or any other document of any type whatsoever as You may have submitted to us.
The simple fact of requesting completion of any Action from NordNet Registrar will be deemed to represent full acceptance of General and Special Terms of registration and maintenance of NordNet Registrar Domain Names as may be applicable on the date of the request for the Action (see « Application of Contract Terms »).
You undertake to carefully read the General and Special Terms of registration and maintenance of NordNet Registrar Domain Names and to submit to NordNet Registrar any such question as You may ask yourself.
You certify that you have the power, authority and capacity required to enter into and perform such obligations as herein provided.
1. DEFINITIONS
Save as may be otherwise specified, the following terms and expressions will have such meanings as may be given to them below if the first letter of each word of which they are made up is a capital letter, whether they may be in the singular or
plural in the General and Special Terms of registration and maintenance of NordNet Registrar Domain Names, including the recitals or any other document issued by NordNet Registrar on the subject matter of General Terms:
Actions: actions relating to such Domain Name as You may request from NordNet Registrar or your Service provider in application of the Contract which binds you to your Service provider (e.g.: Creation/Registration, Renewal, Deletion of the Domain Name, Modification of the Domain Name, Contacts, etc.).
Regulatory Authority or Registry: Organisations responsible for determining rules applicable to Domain Names and to the maintenance of one or more extensions (e.g.: « .com »; « .fr »).
Contract Terms or Contract: General terms of registration and maintenance of NordNet Registrar Domain Names (also called « General Terms ») and Special Terms of registration and maintenance of NordNet Registrar domain Names relating to the extension chosen (also called « Special Terms ») and appendices thereto as the case may be.
Special Terms: All rights, obligations and procedures specific to an extension included in a document entitled « Special Terms ».
Contacts: People representing the Domain Name holder, registered in the Whois base.
Creation / Registration: Act of reserving a Domain Name available with the relevant Registry and of registering information on the Domain Name (Registering entity, Contacts and DNS).
DNS (Domain Name Server): Technical maintenance server for the Domain Name used to match an IP address (address of a machine connected to the Internet) with a Domain Name and/or to use e-mail addresses based on the Domain Name.
Domain Name Modification: Act of correcting or replacing one or more information items (Registering entity, Contacts and/or DNS) relating to the Domain Name.
Domain Name: Chain of characters, composed of two items (i.e. name and extension selected by the Registering entity for registration thereof), providing simplified access to a Web Site, inter alia.
Service provider: Any such person as may act on behalf of the Domain name holder so as to perform operations on the Domain Name.
Alternative Dispute Settlement Procedure: extra-judiciary procedure for which rules vary depending on the relevant extension:
ADR (Alternative Dispute Resolution): rules on Dispute Settlement concerning .eu domains
PARL (Alternative Dispute Settlement Procedures): principles relating to extra-judiciary settlement of disputes on « .fr » Domain Names.
UDRP (Uniform Domain Name Dispute Resolution Policy – Guidelines governing standard settlement of disputes relating to Domain Names): standards as defined by ICANN, applicable to the settlement of disputes on Domain Names with international extensions via arbitration. These standards are complemented by RDRP’s (Rules for Uniform Domain Name Dispute Resolution Policy) which are rules defined by ICANN applicable to guidelines for the settlement of disputes relating to Domain Names with international extensions via arbitration.
Mass mailing: massive dispatch of e-mails not considered as Spamming, most often used to inform on or promote a product or service – also called electronic mailing or e-mailing.
Registrar: Centre of registration of Domain Names in charge of Actions on Domain Names registered with the same. Registering entity or Domain Name Holder: Individual or corporation registered as Domain Name Holder.
Renewal: Act of adding one or more years to the expiry date of registration of the Domain Name. Services: Registration and maintenance of Domain Names by NordNet Registrar.
NordNet Registrar Website: Website available at xxxx://xxx.xxxxxxx.xxx - « Espace Registrar » section
Spamming: massive, and sometimes repeated, dispatch of unwanted e-mails to people whom the sender never was in contact with, and whose e-mail addresses were captured in an improper way
Deletion: Act of deleting a Domain Name from the data bases of the relevant Registry to make it fall back into the public domain and make it available again for Registration.
Transfer: Act of importing (In-coming Transfer) or exporting (Out-going Transfer) the Domain Name of a Registrar to another and of registering with the same information relating to the Domain Name (Registering entity, Contacts and DNS).
Whois: Data base accessible on line used to display information on any given Domain Name.
2. PURPOSE
NordNet Registrar is responsible for completing or transmitting requests for Action relating to the Domain Name with the Registry or Regulatory Authority in charge of maintaining Domain Names for the relevant extension.
3. APPLICATION OF CONTRACT TERMS
You undertake to comply with and cause Contract Terms to be complied with by any individual or corporation involved in the Domain Name as Service Provider, agent or Contact.
Contract Terms are available over XxxxXxx.xxx – section : « General Terms » - or upon simple request from NordNet Registrar (See « Details » in the General Terms of registration and maintenance of NordNet Registrar domain names).
Contract Terms will immediately apply after the request for Registration or Transfer of a Domain Name has been initiated, as long as NordNet Registrar will be the Registrar thereof.
Each new request for Action will be independent from the initial application for Registration or Transfer and will therefore constitute a one-service Contract between NordNet Registrar and You.
If any Action is made on the Domain Name, general and special terms of registration and maintenance of NordNet Registrar Domain Names applicable will therefore be the terms existing on the date of the request for Action.
However, General and special terms of registration and maintenance of NordNet Registrar Domain Names as amended may be applied to any current Action when the amendment is required by a Registry and/or Regulatory Authority.
NordNet Registrar will reserve the option of modifying clauses included in Contract terms at any time, including upon the request of Registries or Regulatory Authorities.
Any modification will become applicable immediately after it has been published over xxxx://xxx.xxxxxxx.xxx – section: « General Terms ».
4. INDEPENDENT PARTIES
The Parties will act fully independently one from the other at any time and Contract Terms may not be deemed to generate any subsidiary or common entity or any relationship of subordination or representation (instructions, agency, commission…) between You and NordNet Registrar.
No exclusivity will be granted by either Party to the other Party under Contract Terms.
5. CONDITIONS APPLICABLE TO VARIOUS EXTENSIONS
For each extension, there is a Regulatory Authority and/or a Registry whose identity will be set forth below and in Special Terms.
You undertake to consult and comply with Special Terms relating to the relevant extension and to comply with any Alternative Dispute Settlement Procedure as may be adopted by Registries or Regulatory Authorities and initiated against the relevant Domain Name.

6. COMMUNICATION MEANS BETWEEN NORDNET REGISTRAR AND YOU
You may contact us as stated in « NordNet Registrar Details ».
You expressly accept that information transmitted by NordNet Registrar to enter into the Contract or information sent during performance thereof may be transmitted to you by E-mail save if any other method has been expressly provided.
E-mails sent at your e-mail address and/or at your Contacts’ addresses as transmitted to us by You will be deemed to have been received by You and/or your Contacts within seven (7) days from the date when they were dispatched by NordNet Registrar.
If you cannot consult your e-mail box for at least seven (7) days, You undertake to give notice thereof to NordNet Registrar by e-mail or by mail (see « NordNet Registrar Details »).
You also undertake to transmit to NordNet Registrar any such correspondence as You may have received or as you will receive from ICANN and/or the Registry and/or your former Registrar as the case may be.
7. SELECTION OF CONTACTS
The Domain Name Holder (Registering entity) should appoint one or more Contacts depending on the relevant extension. Contacts may have powers over the Domain Name.
You are to take all due care when appointing these Contacts, particularly the administrative Contact, as the case may be, as the administrative Contact has the power to represent you with respect to the Registrar, Registries, and any third party. NordNet Registrar may not be held liable for relationships maintained between You and your various Contacts.
8. INFORMATION
8.1. Information to be transmitted and updated
You are to provide to NordNet Registrar updated, complete and exact information concerning You and Your various Contacts.
This information includes the following:
- surname and first name
- or corporate name. The surname and first name of the individual authorised to represent the legal entity as the case may be,
- postal addresses,
- e-mail addresses,
- phone numbers,
- fax numbers as the case may be,
- valid DNS’s of Domain Name
You undertake to update your information and information concerning your various Contacts whenever this is required in a timely manner.
You are to provide to NordNet Registrar such information and/or documents as required by Registries or Regulatory Authorities based on the Action requested with respect to the Domain Name.
Information required for the performance of the various Actions relating to Domain Names will be specified by NordNet Registrar upon simple request and possibly in the General and Special Terms applicable to each extension as defined in « Definitions ».
NordNet Registrar will be free to terminate the Contract under such terms as determined in « Suspension – Termination » if You deliberately omit to
(i) provide to NordNet Registrar full, current and exact information,
(ii) to update such information rapidly whenever this may be required,
(iii) to respond within fifteen (15) days to requests from NordNet Registrar on the accuracy of:
- information relating to your details,
- and in general any such information as You may have transmitted to NordNet Registrar.
8.2. Accuracy of Information
NordNet Registrar is not under the obligation of verifying the accuracy of such information as You may transmit to us.
Concerning e-mail addresses, NordNet Registrar will not make any extra verification, including in case of recognised failure of the communication means used. In this respect, when NordNet Registrar receives an e-mail of the « mailer daemon » or « delivery failure » type, NordNet Registrar will not take this information into account to the extent where such information in response to one of its e-mails fails to definitively indicate that the e-mail address in question is no longer valid. NordNet Registrar may only ignore the former address after receiving a request for modification of the e-mail address in compliance with its procedure.
However, in application of any rule stipulated by Regulatory Authorities or Registries, NordNet Registrar may be requested to ensure that data which You have transmitted to NordNet Registrar is accurate at the time of the Registration or Transfer of the Domain Name, or during the contract relationship or upon completion of each Action with respect to the Domain Name.
You acknowledge that the fact of supplying inaccurate information, of failing to rapidly update information or of failing to answer requests from NordNet Registrar on information transmitted is a failure to comply with your obligations hereunder and therefore constitutes grounds for the termination of the Contract under such conditions as set forth in « Suspension - Termination ».
9. REQUEST FOR ACTIONS ON DOMAIN NAMES
Requests for Actions, including registration and renewal of a Domain Name, with the Registry may only be made through a Registrar acting in the name of the Registering entity.
When Your request for Action has been initiated, it may not be subject to any modification, save such exceptions as provided by General or Special Terms.
Requests for Action on a Domain Name will be subject to procedures which may be consulted with NordNet Registrar. These requests should be transmitted in compliance with provisions set forth in Contract Terms.
NordNet Registrar will reserve the right to reject any request for Action relating to the Domain Name as may seem to NordNet Registrar to be in conflict with the provisions of Contract Terms and rules adopted by Regulatory Authorities, Registries and/or by any other competent Authority (see "Right to reject" below) after any verifications as the case may be.
However, NordNet Registrar is not under the obligation of making any prior verification in this respect.
Requests for Action to be transmitted to the Registry or Regulatory Authority will be submitted via such technical means as it may impose upon NordNet Registrar.
Whatever the Action requested, NordNet Registrar will not be liable for any technical problems beyond its reasonable control met in the transmission or treatment of the request for Action by the Registry or Regulatory Authority.
You are informed that when a request for Action causes modification of information included in a Whois base, there may be an interval between completion of the Action and change in information included in this base. Indeed, information included in Whois bases will be periodically updated, so any Action made on a Domain Name can take time before being included into these bases.
10. REGISTRATION
10.1. Domain Name Availability
A Domain Name may appear as available when consulting the NordNet Registrar Website, when, in fact, it has already been reserved or is being reserved. In this case, Your request will be immediately or eventually rejected. Conversely, a Domain Name may appear to be reserved when in fact it has become available again. NordNet Registrar, or the Regulatory Authority, or the Registry referred to in the Special Terms may not be held liable as a result of effects as may be caused by this gap.
You may therefore only become the Holder of the Domain name after Registration has been validated by the Registry and/or Regulatory Authority.
If the Domain Name which You have requested has already been reserved during processing by the Registry, or if it is rejected during processing thereof due to any failure to comply with the Contract or rules adopted by the Regulatory Authority or Registry, the Domain Name may not be registered. You may ask for the registration of another Domain Name or reimbursement of registration expenses from NordNet Registrar where applicable, if You have directly paid registration expenses to NordNet Registrar. If you have paid registration expenses to NordNet Registrar through a Service provider, terms of repayment will be those defined with your Service Provider.
The rule of assignment of Domain Names is that of « first come, first served »; this means that the person first applying for the Registration of a Domain Name will become the Holder thereof, save as may be otherwise stipulated in the Special Terms applicable to the extension concerned.
10.2. Creation time
The Domain Name will only be registered after the date and time of processing by the Registry or Regulatory Authority responsible for centralising registrations. Submission by you of your application for Creation with NordNet Registrar will not entitle you to any special precedence.
NordNet Registrar will take all due care for your full request coming with any evidence to be transmitted to the Registry or Regulatory Authority within three (3) days from the date of receipt by the same of full and appropriate information and any documents required as specified in this Contract.
The period may be extended when creating, opening or enlarging an extension or changing conditions for the registration of Domain Names in the relevant extension.
You accept that NordNet Registrar’s service will commence within seven (7) days from the date when your payment was cashed in or when a valid means of payment was received, as NordNet Registrar may choose, subject to receipt by NordNet Registrar of information and/or documents required for the Creation of the Domain Name. In application of article L121-20-2, Code de la Consommation, no right of withdrawal may therefore be exercised.
10.3. Domain Name registration time
The term of registration of the Domain Name will be determined on the basis of the option which You have chosen when submitting your application for Creation.
At the end of this period, the Contract will be renewed under such terms as set out in « Renewal » and in the Special Terms of the relevant extension.
11. TRANSFER OF A DOMAIN NAME
11.1 Transfer of a Domain Name to NordNet Registrar – In-coming Transfer
As specified in definitions, a Transfer is the Action of changing Registrars. If the Registering entity wants NordNet Registrar to become the Registrar of the Domain Name, the following terms should be complied with.
11.1.1 In-coming Transfer Terms
The Domain Name for which You request a Transfer to NordNet Registrar should first be registered with another Registrar, and not be in the process of being deleted by its current Registrar.
Expenses and fees due should be directly paid to the former Registrar by you in addition to sums to be paid to the new Registrar.
Information on the Registering Entity of the Domain Name transmitted by you via the Transfer application form should be in line with information contained in the Registry’s Whois bases.
Finally, you are informed that processing of your application for Transfer is subject to compliance with such provisions as set out in the General Terms and Special Terms specific to each extension. You therefore undertake to transmit or have any information or document needed to Transfer the Domain Name as required by NordNet Registrar to be transmitted to NordNet Registrar in compliance with such rules as may be established by Registries or Regulatory Authorities.
Otherwise, processing of your Transfer application may not be successfully completed.
11.1.2. Transfer time
11.1.2.1 Submission of request for Transfer
NordNet Registrar will take all due care for your full application including all information requested and any supporting evidence to be transmitted to the Registry or Regulatory Authority within three (3) days worked from the date when your payment was cashed in or from the date when a valid means of payment was received, from the date of receipt of full and appropriate information and any documents and permissions required as specified in Contract Terms.
11.1.2.2. Validation of request for Transfer
Transfer of the Domain Name for the benefit of NordNet Registrar may be subject to validation (or absence of any opposition) of one or more contacts, of the current Registrar, Registry or Regulatory Authority and will only be effective from the date of receipt by NordNet Registrar of the official confirmation of the validation of the Transfer by the Registry or Regulatory Authority.
11.1.2.3. Transmission of Transfer outcome
NordNet Registrar undertakes to give notice of the Transfer outcome, whatever its nature, within not more than two (2) days worked from the date of receipt of the official notice of the Transfer outcome by NordNet Registrar.
11.1.3. Effects of In-coming Transfer
Domain Name registration time will be extended by one (1) year, immediately after the Transfer has been validated by the Registry or Regulatory Authority. The one (1) year period will start from the date of Transfer completion or expiry date of the Domain Name according to rules applicable to the relevant extension.
At the end of this period, the Contract will be renewed under such conditions as set out in « Renewal ».
You are also made aware of the fact that information transmitted via the Transfer application form will be included in our Whois bases, after Transfer of the Domain Name has been made for the benefit of NordNet Registrar.
11.2 Out-going Transfer
11.2.1 Out-going Transfer Terms
You may transfer your Domain Name to another registrar as long as:
- Registration of the Domain Name is valid
- The Domain Name is not being deleted
- You have paid all due sums, or sums to be due by you or outstanding sums to NordNet Registrar
- No dispute is pending with respect to your Domain Name
No repayment of registration expenses for the remaining period at the time of the Transfer will be granted by NordNet Registrar.
11.2.2 Consequences of Out-going Transfer
Immediately after the Out-going transfer has been completed, the Domain Name will no longer be maintained by NordNet Registrar and NordNet Registrar will no longer answer any of Your requests, including requests for Action.
Completion of the Out-going transfer will cause termination of the Contract between You and NordNet Registrar.
12. change IN registErING ENTITIES
Any change in Domain Name Registering Entities implies a change in Domain Name holding.
At the time of your request, the Domain Name should not be in the process of being Deleted or be subject to any request for Transfer.
Also, the relevant Domain Name should not be subject to any dispute, and expenses and fees due or to become due still owed by you should have been paid to NordNet Registrar either directly or through your Service Provider.
The standard document concerning change in Registering entities is available over NordNet Registrar’s Website or upon simple request from NordNet Registrar (See « Details » in the General Terms of registration and maintenance of NordNet Registrar domain names).
The former Registering entity’s signature affixed to the document concerning Change in Registering entities should be certified by a notary public or bailiff, save as may be otherwise provided in Special Terms applicable to the relevant extension.
NordNet Registrar will take all due care for your full request including relevant information and any supporting evidence as the case may be to be transmitted to the Registry or Regulatory Authority within three (3) days worked from the date of receipt of full and appropriate information and any documents and permissions required as specified in Contract Terms.
13. MODIFICATIONS OTHER THAN CHANGE IN REGISTERING ENTITIES
You may Modify information on said Domain Name, whether such information may be administrative (e.g. Contract amendments) or technical (e.g.: DNS modifications) for the full period of registration of the Domain Name with NordNet Registrar.
13.1. Conformity of request for Modification
The Domain Name in respect of which You request any Modification should first have been registered with NordNet Registrar, and not be in the process of being Deleted or be subject to any Out-going Transfer.
Any issue by you of a request for Modification of a Domain Name will be subject to compliance with such terms as determined in General and Special Terms specific to each extension. Processing of your request will be subject to compliance with Contract Terms.
You undertake to transmit or cause any information or documents required by NordNet Registrar to be transmitted to NordNet Registrar, in compliance with such rules as set out by Registries or Regulatory Authorities, as may be needed to Modify the Domain Name.
Otherwise, processing of your request for Modification may not be successfully completed.
13.2. Validations of Modifications
13.2.1. Modification of registering entity information
The procedure of Modification of information relating to the Registering entity is specific to each extension and detailed in the relevant Special Terms.
13.2.2. Modification of other information
Any request for Modification will be subject to the validation of technical and administrative Contacts and to the production of any document required in connection with procedures defined by NordNet Registrar as the case may be. NordNet Registrar will therefore take all due care for your request to be transmitted to Contacts within three (3) days following receipt by the same of a full request for Modification in compliance with NordNet Registrar’s requirements.
13.3. Modification registration time
Modifications will only be registered after validation from Contacts has been received under such conditions as specified for each extension by NordNet Registrar and/or Regulatory Authorities or Registries concerned or as the case may be, after any document required by NordNet Registrar and/or Regulatory Authorities or Registries concerned to consider the Modification has been received.
Modifications may be subject to extra processing by the Regulatory Authority or Registry concerned likely to result in an extended period for the registration of Modifications.
14. RENEWAL
14.1. Request for Renewal
Request for Renewal should be made not later than the day before the last day of Domain Name registration. You will be responsible for meeting this deadline.
Renewal will be made under such conditions as set out in General and Special Terms (including in "Time" and "Prices and payment") of NordNet Registrar, as they may apply on the date of your request for Renewal.
If You make a request for Xxxxxxx, it may not be subject to any cancellation.
At the time of Renewal, NordNet Registrar will reserve the right to ask You to confirm or enter again all or any part of information transmitted before.
In case you have not Renewed the Domain Name upon expiry of registration thereof, or if You have expressly given notice of your intention not to renew said Domain Name after various remainder e-mails to Domain Name Contacts, it will be deleted after its date of expiry within a period which may vary according to the extension concerned. The Domain Name will so become available again for Registration by any third party.
You will not be entitled to any compensation due to any consequences as may result from this.
14.2. Renewal Registration Time
The Domain Name will only be renewed after the service charge due for such Renewal has been cashed in or after a valid means of payment has been received as NordNet Registrar may choose, and after NordNet Registrar has processed full request for Domain Name Renewal.
NordNet Registrar will take all due care for your request to be transmitted to the Registry or Regulatory Authority within one
(1) day worked from the date when it has received full and appropriate information and any documents required as specified in Contract Terms.
14.3. Renewal Time
Time for Renewal of the Domain Name registration will be determined depending on the option which You have chosen when submitting the request for Renewal. Registrations may only be made for maximum 10-year periods; this means that the date of expiry of a Domain Name may never exceed 10 years. So, the renewal period requested plus remaining registration period may not exceed 10 years.
14.4. Renewal after date of expiry
You may renew the Domain Name registration for a period which may vary depending on the relevant extension as stated in Special Terms applicable to the relevant extension, either directly from the xxx.xxxxxxx.xxx Website – section: « Registrar »
- or through your Service provider and its Website as the case may be. An extra cost may be charged to you as stated in the e-mail and/or deletion notice as NordNet Registrar will send to You.
After said period, failing any registration renewal from You, Deletion of the Domain Name will be initiated.
15. DELETION
NordNet Registrar informs you that Deletion of the Domain Name concerned by Contract Terms will result in a number of effects including such major effects as listed in « Suspension – Termination ».
15.1. Terms of Deletion
A Domain Name registered with NordNet Registrar may be deleted at any time upon prior written request to be sent to NordNet Registrar by You.
Any request for Deletion should be made with NordNet Registrar by registered mail, return receipt requested. The request for Deletion should be made under such conditions as set out below:
For corporations:
- On headed notepaper showing the identity of the entity holding the Domain Name,
- signed by the representative of the entity authorised by said entity to carry out the deletion Action,
- whose signature was certified by a notary public or bailiff,
- with a copy of the national identity paper of said representative. For individuals:
- On plain un-headed paper signed by the Domain Name holder,
- Whose signature was certified by a notary public or bailiff,
- with a copy of a national identity paper.
NordNet Registrar may transmit to You a Deletion letter form upon simple request (See « Details »)
15.2. Deletion time
NordNet Registrar will take all due care for your Deletion request to be transmitted to the Registry or Regulatory Authority within three (3) days worked from the date of receipt by the same of said full and appropriate request and any documents required as specified in Contract Terms.
The Domain Name will only be deleted from the date and time of processing by the Registry or Regulatory Authority.
NordNet Registrar would like to draw your attention to the fact that the physical period of Deletion from the various bases, including Whois bases, can be relatively long.
15.3. Suspension of Deletion procedure
The Deletion procedure may be suspended depending on rules applicable to the relevant extensions. Suspension of the Deletion procedure will be processed under such Special Terms as may apply to the relevant extension as the case may be.
15.4. Effects of Domain Name Deletion
Deletion of the Domain Name will result in termination of the Contract between You and NordNet Registrar.
16. RIGHT OF REFUSAL
NordNet Registrar will reserve the right of rejecting any request for Action as may seem to NordNet Registrar to be in conflict with provisions of Contract Terms and rules adopted by Regulatory Authorities, Registries and/or any other competent Authority within seven (7) days from the date of full transmission of your request.
The Registry may also reject Your request and NordNet Registrar may not object to such rejection.
NordNet Registrar may not be held liable for any loss as You and/or the Domain Name Registering Entity may suffer as a result of these rejections.
17. COMPLIANCE WITH THIRD PARTIES’ RIGHTS
You declare that the Domain Name concerned by Contract Terms and use to be directly or indirectly made thereof, including through the Website operated under this Domain Name do not disturb public order and do not infringe upon the rights of a third party, any legislation or regulations applicable, including in terms of protection of young people under age (pornography, paedophilia, …), incitement to crime, misdemeanour or suicide, racial hatred, apology of crimes against humanity, right of publicity, copyright, trade mark law or other intellectual property rights, right to last name, right to first name or pseudonym, without limitation.
You also undertake to ensure that no Spamming operation is made or initiated through the Website operated under said Domain Name or e-mail addresses including all or any part of said Domain Name, whether to France or foreign countries.
Concerning mass mailing operations, You should also request NordNet Registrar’s prior authorisation for any dispatch. Failing any written answer from NordNet Registrar within fifteen (15) days, You should consider that permission has not been granted to you.
If these provisions are not met, You should pay to NordNet Registrar two (2) Euros exclusive of tax for each e-mail sent at this address following any Mass mailing or Spamming operation made by you.
You also undertake to use the NordNet Registrar Whois base in compliance with provisions included in the result page obtained. So, You should not use data collected:
- for commercial, advertising, marketing or business development etc., unwanted and mass communications using any means whatsoever unless these data match your own customers’ data; - for the mass and automated dispatch of data or requests to Registries or Registrars, unless they may be reasonably required for the registration or modification of Domain Names.
NordNet Registrar is not under the obligation of making any verification concerning compliance with third parties’ rights. You will therefore assume the consequences of any action from a third party relating to the lawfulness of the relevant Domain Name or information present in the Website operated under this Domain Name, including all expenses and sentences as may be charged to or decided against NordNet Registrar in this respect, including in case violation of any third party’s rights or legislation or regulations applicable may have been detected by NordNet Registrar.
NordNet Registrar will comply with the provisions of any decision given following any Alternative Dispute Settlement Procedure or legal decision which became final or enforceable as may, in particular, oblige NordNet Registrar to Delete, Block, Transfer the Domain Name or change Domain Name Registering entities as provided by « Disputes ».
NordNet Registrar will not owe any compensation to you.
In case of any dispute on a Domain Name between You and a third party, You may apply recourse to legal proceedings and remedy at law as defined by the Registries and/or Regulatory Authorities. NordNet Registrar informs You that NordNet Registrar will not handle these disputes and will call the third party to contact the Domain Name holder.
NordNet Registrar recommends that You ask for the advice of any expert having authority in such matters.
18. PRICES AND PAYMENT
If you have paid expenses for the registration of the Domain Name to NordNet Registrar through a Service Provider, conditions applicable to prices and to the payment will be those determined with your Service Provider.
18.1. Prices and Payment
Prices for such services as provided in these Contract terms will be available upon simple request from NordNet Registrar. The service charge price will be deemed to mean the price exclusive of tax applicable on the date of the request for Action on the relevant Domain Name. It will include expenses due to Regulatory Authorities or Registries for the extension of the relevant Domain Name. These prices may vary at any time.
NordNet Registrar will not provide any service until NordNet Registrar has received a valid means of payment or cashed in payment, as NordNet Registrar may choose.
The total price for the service charge will be due whenever you make a request for Action on any Domain Name falling into the scope of Contract Terms. The price paid will not be repaid, even if the Registry or competent Regulatory Authority should reject, suspend or cancel the Action on said Domain Name.
You are to pay the price for the Service provided by NordNet Registrar for the completion of the Action on the Domain Name, from the date when the Contract was entered into until its date of termination for whatever cause including if You do not use the Domain Name.
You are to pay your service charge using any means of payment as permitted by NordNet Registrar applicable on the date of the request for Action.
Payment can be made through your Service provider.
In case of fraudulent payment, NordNet Registrar will reserve the option of terminating the Contract in compliance with the article entitled « Suspension – Termination ».
Issue of the invoice and/or cashing of the payment will not certify that the Action has been made on the Domain Name.
Also, in case of any failure to transmit information and any documents as referred to in the General Terms or Special Terms for three (3) months from the date of request for Action on the Domain Name, NordNet Registrar will reserve the right not to repay the service charge relating to this request in case it may finally not be met as a result of the incomplete character of the request.
18.2. Payment Incidents
Any default in payment, including any cancelled payment by credit card will be considered as a delay in payment. Delay in the payment of any single invoice or instalment will cause:
- all sums which You owe to NordNet Registrar to be directly payable, fully in compliance with the law;
- possible suspension or termination of the performance of any existing Contract if NordNet Registrar deems so appropriate until sums owed by You to NordNet Registrar have been paid in full, under such terms as set out in « Suspension- Termination »,
- application by NordNet Registrar of interest at a legal rate equal to 12 % per annum, and this rate may not be less than
1.5 times the French legal interest rate.
If NordNet Registrar sends to you a formal demand to pay by registered mail due to any delay in payment, you will owe a sum to be determined as follows:
- four euros and fifty cents (€ 4.50) for each registered mail if you are a French resident,
- five euros and eighty-five cents (€ 5.85) for each registered mail if you are not a French resident.
This sum will come in addition to any other expenses or compensation due, including those provided for payment rejection expenses.
So, if You have opted for payment by direct debiting order, and your bank rejects the direct debiting order prepared in compliance with conditions applicable over xxxx://xxx.xxxxxxx.xxx, You will owe to NordNet Registrar rejection expenses of eight (8) euros for each rejection. If you live outside France, the sum may vary depending on Your country of residence. Values of rejection expenses may be obtained upon simple request from NordNet Registrar (see « NordNet Registrar Details
»). Failing any indication of a specific sum for rejection expenses in Your country of residence, eight (8) euros for each rejection will be due.
If NordNet Registrar was to make any reimbursement, this would only be made after all sums due have been irrevocably cashed in. Periods when You or your bank may revoke payment will be taken into account even after your account has been debited and the NordNet Registrar account has been credited.
19. TIME
Domain Name Maintenance by NordNet Registrar will commence on the date of validation of the Creation or In-coming Transfer of the Domain Name.
The term of maintenance of the Domain Name by NordNet Registrar will depend on the subscription period selected by you in case of Creation, or expiry date of the Domain Name registration in case of In-coming Transfer (See « Transfer »).
However, NordNet Registrar will no longer maintain the Domain Name in case of Deletion or Out-going Transfer of the Domain name in the process of being registered.
Renewal of Domain Name registration may be made at any time under such conditions as set out in "Renewal", thereby extending the period of maintenance of the Domain Name by NordNet Registrar by the Renewal term selected.
Domain Name maintenance by NordNet Registrar will automatically come to an end on the date of expiry of the Domain Name failing any renewal, on the date of Deletion of the Domain Name or Out-going Transfer thereof under such terms as set out by Registries or Regulatory Authorities.
NordNet Registrar would like to draw your attention to the fact that expiry of the Domain Name may not be the same as the date of expiry of your contract entered into with any Service provider with respect to the relevant Domain Name.
20. DATA
20.1. Personal data processing
Such processing will be made under the supervision of NordNet Registrar, whose details appear in "NordNet Registrar Details", as represented by its Chief executive officer.
You accept that NordNet Registrar will process, preserve and transmit personal data as stated below.
All information collected by NordNet Registrar is required to process and meet your requests for Action or various requests and any subsequent actions as may result from this by NordNet Registrar or its partners and Registries or Regulatory Authorities.
Such data should therefore necessarily be provided to NordNet Registrar, unless they should be described as optional. Any failure to provide an answer will prevent NordNet Registrar from performing all or any part of its service.
XXXXXXX REGISTRAR WILL RESERVE THE RIGHT TO TRANSMIT ALL PERSONAL INFORMATION RELATING TO YOU TO ANY SUCH AUTHORITIES OR PEOPLE AS SHOULD BE THE LEGAL RECIPIENTS OF INFORMATION OR ANY NORDNET REGISTRAR SUB-CONTRACTOR AS WOULD NEED THIS INFORMATION TO CARRY OUT OPERATIONS WITH WHICH IT WAS ENTRUSTED BY NORDNET REGISTRAR (INCLUDING MAINTENANCE, ASSISTANCE, RECOVERY,
…) AND ANY RELEVANT REGISTRY OR REGULATORY AUTHORITY.
The Registry or Regulatory Authority may transmit information to any person in connection with the performance of its engagement.
NordNet Registrar may also have to keep part of personal data relating to You so as to comply with its legal and regulatory obligations and transmit them where applicable under such terms as set out by the law.
In compliance with articles 32 et seq. of law dated 6 January 1978 called « Informatique et Libertés », You will have the following rights:
- Right to object to any processing of personal data relating to you for reasonable grounds;
- Right to object to any use of personal data relating to you for customer development purposes, including commercial development, by the person currently responsible for processing or any further processing, free of charge;
- Right to question the person in charge of personal data processing upon production of evidence supporting your identity, to obtain:
1. Confirmation that personal data relating to you are or are not subject to such processing;
2. Information on the purpose of processing, classes of personal data processed and recipients or classes of recipients to whom data are disclosed;
3. information on the transfer of personal data considered to a State which is not a member of the European Community where applicable;
4. disclosure of personal data relating to you and any information available behind such data in an accessible form;
5. Information used to know and object to the rationale underpinning automated processing in case any decision is made on the basis of the same, causing legal effects with respect to the person concerned. However, information disclosed to the person concerned should not affect copyright as referred to in the provisions of Chapter 1, Title IV, Book III, Code de la Propriété Intellectuelle. A copy of personal data will be delivered to the person concerned at his/her request. The person in charge of processing may subordinate delivery of this copy to the payment of a sum which may not exceed the cost of the copy. In case of risk of concealment or disappearance of personal data, the competent judge may order any measure to avoid this concealment or disappearance, including in xxxxxxxx.
- Right to require from the person in charge of processing that he/she should correct, complete, update, lock out or delete personal data relating to you where such data are inaccurate, incomplete, dubious, obsolete, or for which collection, use, disclosure, or preservation is banned as the case may be, if you produce evidence of your identity;
- Right to ask the person in charge of processing to justify that he/she performed operations required in application of the previous paragraph at no expense for you. If you obtain modification of the registration, you are entitled to obtain reimbursement of expenses for the cost of the copy as mentioned above;
- Right for the heirs of any deceased person producing evidence of their identity to require from the person in charge of such processing that he/she should take into account the death and make any updates as should be the consequence thereof to the extent where information of which they were made aware allows them to assume that personal data concerning the deceased person subject to processing have not been updated. Where heirs so request, the person in charge of processing should justify that he/she has completed operations required in application of the previous sub- paragraph at no expense for the person making the request.
You may exercise your rights by letter sent to NordNet Registrar at the address stated in « NordNet Registrar Details » or by e-mail at xxxxxxxxxxx@xxxxxxx.xxx.
All people whose personal data are preserved by NordNet Registrar have the same rights.
You undertake to secure the express prior consent of any third party whose personal data will be transmitted to NordNet Registrar by you for the collection of said data and operations conducted in application of this article by NordNet Registrar where applicable. You also undertake to notify to the same such information as included in this article, in particular, such rights as he/she may have and their terms of exercise. .
NordNet Registrar undertakes not to make any preservations, processing operations and transmissions as may be in conflict with such principles as stated above unless preservation should be imposed by existing regulations.
Similarly, NordNet Registrar will take all due care to protect personal data transmitted against any loss, poor use, non- authorised transmission or access. However, due to the little secured character of the Internet, NordNet Registrar may not be held liable for any access or interception of your personal data by a third party.
20.2. Ownership of Information and data base
You acknowledge that NordNet Registrar holds any right to data bases, information present therein, abstracts and compilations of these data bases throughout the world.
These bases may contain any such information as NordNet Registrar could have obtained without prejudice to the previous article on personal data processing in addition to such information as You have transmitted to NordNet Registrar concerning Contract Terms.
21. LicenSe
If the Entity Registering the Domain Name awards a license to use and/or operate its Domain Name(s) to any third party/parties, it will however remain the official holder of Domain Name(s), and should provide its own details and those of Contacts for Domain Name (s) which it undertakes to update as provided by « Information ».
Even though the Registering Entity has assigned the right to use and/or operate its Domain Name(s) to any third party/parties, it will assume responsibility for any action, claim and/or proceedings instituted by a third party, related to the following, without limitation:
- Registration of the Domain Name(s),
- Use of its Domain name(s),
- Technical operation of Domain name(s).
Similarly, in case of any action against the Registering Entity concerning any fraudulent or illegal registration and/or use and/or operation of the Domain name(s) for which the Registering Entity assigned the license, the Registering Entity undertakes to disclose the exact identity of the licensee to the person bringing the action. The Registering Entity therefore undertakes to permanently have available updated information on the licensee:
- For an individual: name, first name, postal address, e-mail address, phone number, fax number.
- For a legal entity: corporate name, registered office, e-mail address, registration number on public data bases (RCS, INSEE, …) and identification information and details of its legal representative (name, first name, title, postal address, e-mail address, phone number, fax number).
Disputes will be handled by the Registering entity and not by NordNet Registrar in any case whatsoever.
NordNet Registrar may therefore not be held liable in any case whatsoever as a result of any fraudulent or illegal registration and/or use and/or operation of Domain Name(s) registered by the Registering entity and/or in its name and for its own account. In this respect, the Registering Entity undertakes to indemnify, defend and guarantee NordNet Registrar under such conditions as referred to in « Indemnification ».
In addition, the Registering Entity undertakes to bear all costs and expenses as may result from these claims, actions or liabilities in any court whatsoever including counsels’ and lawyers’ fees and expenses.
22. POWERS
If the Domain Name is registered by a person acting as representative or agent (e.g. provider of Internet services, employee, advertising agency), the Domain Name should be registered in the name of the principal, who should therefore appear as Entity Registering the Domain Name.
You are to ensure that this provision is met. In no case NordNet Registrar may be held liable if the person whom You have appointed as agent is registered as Registering Entity.
However, as principal, the Registering Entity will remain bound by all conditions set out in Contract Terms and any other condition tacitly or expressly accepted by its agent.
The Registering Entity undertakes to directly or indirectly update its information as provided by « Information ».
23. FORCE MAJEURE
NordNet Registrar may not be held liable for any failure to perform all or any part of the Contract as a result of a case of Force majeure, if NordNet Registrar meets legal and case law conditions required for a case of Force majeure to be so described according to the laws of France, including in case of loss of data, transactions made through the Internet, discontinued NordNet Registrar services or access to the Internet or breakdown of receipt or transmission equipment for which NordNet Registrar is not responsible.
ALSO, NORDNET REGISTRAR MAY ASK FOR THE SUSPENSION OF THE CONTRACT IN THE FOLLOWING CASES, EVEN THOUGH THEY ARE ONLY PARTIAL, FOR WHATEVER CAUSE: - WITHDRAWAL OF THE ACCREDITATION AWARDED TO NORDNET REGISTRAR BY REGISTRIES AND/OR REGULATORY AUTHORITIES, - DISCONTINUED SUPPLY OF ENERGY, FAULT AND/OR DISCONTINUANCE IN TRANSMISSION NETWORKS INCLUDING ACCESS TO THE INTERNET, - BREAKDOWN AND/OR SABOTAGE OF TELECOMMUNICATIONS MEANS, ACTS OF COMPUTER HACKING, - FIRE, LIGHTNING, FLOODING AND OTHER ACT OF GOD, WATER DAMAGE, EXTRAORDINARY BAD WEATHER, DAMAGE, RIOT, WAR, UPRISING, TERRORIST ATTACK, EXPLOSION, ACT OF VANDALISM, - TOTAL OR PARTIAL STRIKE, LOCK-OUT, - DELAY FROM ITS SUPPLIERS OR SERVICE PROVIDERS, OR REGISTRIES OR REGULATORY AUTHORITIES, - BANS OR RESTRICTIONS FROM PUBLIC AUTHORITIES RELATING TO THE SUPPLY OF
TELECOMMUNICATIONS SERVICES, INCLUDING ANY DISCONTINUED SERVICE EXPRESSLY REQUESTED BY ANY COMPETENT ADMINISTRATIVE OR JURISDICTIONAL AUTHORITY.
These various events will constitute cases of Force Majeure, whether they may concern NordNet Registrar, its suppliers or service providers, the Registry or regulatory Authority.
A case of Force majeure will suspend obligations arising from Contract Terms for the whole duration of its existence.
If the case of Force majeure was to continue over thirty (30) consecutive days, it would entitle either party to fully terminate Contract Terms eight (8) days after sending a registered mail, return receipt requested, notifying this decision without compensation from either side.
24. LIMITED LIABILITY
WHERE NORDNET REGISTRAR HAS ACTED IN A REASONABLE WAY, NORDNET REGISTRAR WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INJURIES, LOSSES AND DAMAGES AS MAY OCCUR AS A RESULT OF THE FOLLOWING:
a) refusAL TO registEr A DOMAIN NAME FROM THE REGISTRY OR REGULATORY AUTHORITY,
b) SUSPENSION, MODIFICATION OR LOSS OF domain NAMe REGISTRATION BY THE REGISTRY OR REGULATORY AUTHORITY,
c) REGISTRATION OR USE OF A DOMAIN NAME IN CONFLICT WITH REGULATIONS APPLICABLE, PUBLIC ORDER OR THIRD PARTIES’ RIGHTS,
d) USE BY A THIRD PARTY OF THE RELEVANT domain NAMe,
e) USE BY A THIRD PARTY OF DATA TransmiTTED DURING registrAtION OR SUBSEQUENTLY,
f) dELAYED OR DISCONTINUED accEsS TO THE systEm OF registrATION OF domain NAMES,
g) FAILURE FROM YOU TO DISCLOSE documents AND/oR INFORMATION REQUIRED, dISCLOSURe OF ERRONEOUS information BY YOU oR FAILURE TO UPDATE Information RELATING TO YOU,
h) ANY errOr(s) oR omission(s) APPEARING IN PUBLIC DATA bases permIttING YOUR identification AND affectING PROPER REGISTRATION process OF YOUR DOMAIN NAME,
i) EvEnTs BEYOND THE rEasonable CONTROL OF NORDNET REGISTRAR,
j) POOR PROCESSING, dELAYED PROCESSING OR FAILURE TO PROCESS ANY REQUEST FOR REGISTRATION BY REGULATORY autHoritIes oR REGISTRIes,
k) POOR PROCESSING, dELAYED PROCESSING OF FAILURE TO PROCESS ANY modification BROUGHT TO A REGISTERED domain NAME BY REGULATORY autHoritIes OR REGISTRIes,
l) ANY ACTION OR OMISSION FROM REGISTRIes AND/OR REGULATORY autHoritIes,
m) ANY FAILURE FROM YOU OR YOUR SERVICE PROVIDER AS TO paYment OF ALL EXPENSES UNDER CONTRACT TERMS,
n) application OF PROVISIONS OF SUCH ALTERNATIVE DISPUTE SETTLEMENT PROCEDURES AS REFERRED TO IN « CONDITIONS APPLICABLE TO VARIOUS EXTENSIONS » AND « DISPUTES »,
o) APPLICATION BY NORDNET REGISTRAR OF THE POLICY OR RULES OF REGISTRIES OR REGULATORY AUTHORITIES,
p) ANY FAILURE OF transmission SYSTEMs BETWEEN YOU AND nORDNET REGISTRAR OR BETWEEN nORDNET REGISTRAR AND REGISTRIES OR REGULATORY AUTHORITIES,
q) FAILURE TO COMPLY WITH CONTRACT TERMS BY YOU OR IN gEnEral BY ALL contacts OF THE domain NAMe,
r) OPERATION OF THE WEBsite (INCLUDING CONTENTS OF THE HOSTED WEBsite) uNDER SUCH domain NAMe AS YOU HAVE registEreD,
s) spamming OR MASS MAILING operations MADE FROM AN E-MAIL aDdress MATCHING THE domain NAMe WHICH YOU HAVE registErED.
ALSO, NORDNET REGISTRAR MAY NOT BE HELD LIABLE FOR THE FOLLOWING CLASSES OF dAmages:
- CONSEQUENTIAL, SOMETIMES CALLED EXTRA-PATRIMONIAL OR MORAL DAMAGES,
- LOSS OF AN OPPORTUNITY, PROFIT MISSED, TRADING LOSS, LOSS OF TRADING PROFIT, LOSS OF CUSTOMERS,
commercial trouble, INJURY TO BRAND image,
WHATEVER THe type OF VICARIOUS LIABILITY Action BROUGHT, EVeN iF NORDNET REGISTRAR WAS GIVEN NOTICE OF THE POSSIBLE OCCURRENCE OF SUCH dAmages
IN ANY CASE, SAVE FOR BODILY INJURIES CAUSED TO PEOPLE, NORDNET REGISTRAR’S pEcuniarY LIABILITY WILL BE limitED TO THE PriCE OF ONE YEAR’S SUBSCRIPTION.
tHIS clause WILL BE applieD suBJECT TO ANY CONTRARY CLAUSES AS prOVIDED BY CERTAIN lEgislations. IN THIS casE, LIABILITY WILL BE limitED TO THE EXTENT PERMITTED BY SAID LAW applicable.
25. INDEMNIFICATION
You undertake to indemnify, defend, guarantee and hold harmless from your acts or omissions, NordNet Registrar and/or the Registry and/or any Regulatory Authority and/or ICANN and/or their subsidiaries and/or their managers, directors, employees, representatives and/or servants. You undertake to indemnify, defend and guarantee NordNet Registrar and/or the Registry and/or any Regulatory Authority and/or ICANN and/or their managers, directors, employees, representatives and/or servants in case of any claim, action, liability raised by a third party as a result of your acts or omissions. Finally, You will bear all costs and expenses as may arise from these claims, actions or liabilities raised including counsels’ and lawyers’ fees and expenses.
This indemnification may be added to that provided by alternative dispute settlement procedures as set out in « Conditions applicable to the various extensions » and « Disputes », and any provision as set out in other contracts which you may have entered into concerning the same Domain Name.
You accept that this obligation will survive for ten (10) years after the Contract has expired.
26. SUSPENSION – TERMINATION
26.1. Suspension, Deletion, Transfer, change in Registering entities as provided by Regulatory Authorities
You accept that the Domain Name concerned by Contract Conditions will be suspended, deleted or transferred, or that the Registering Entity will be changed in compliance with any rule adopted by a Regulatory Authority or by the Registry, so as to:
o correct errors committed by the Registry or Registrar when registering the Name; o settle disputes relating to the Domain Name; o respond to any failure to comply with your obligations.
26.2. Suspension by NordNet Registrar
26.2.1. suspension Procedure
In case of any failure to comply with any clause set out in Contract Terms, NordNet Registrar will reserve the right to suspend performance of Services until you have remedied such failure raised without notice or compensation.
Suspension will be notified by e-mail. NordNet Registrar will reserve the right:
- not to use this right of suspension and directly apply provisions set out in « Termination »,
- to apply provisions as set out in « Termination », even though NordNet Registrar had applied « Suspension » in the past for the same problems.
NordNet Registrar will be responsible for determining the appropriate penalty.
26.2.2. Effects of suspension
NordNet Registrar’s obligations to You will be suspended.
The relevant Domain Name will then be given the "Hold" status or any equivalent status, which will prevent completion of any Action to your Domain Name. NordNet Registrar will also reserve the option of blocking Domain Name operation.
Conversely, You are under the obligation of continuing to meet your obligations as you usually do.
26.3. Contract Termination
26.3.1. Termination without fault
Failing any fault from either party, the Contract may be fully terminated under such conditions as set out in « Renewal », « Out-going transfer », « Deletion », or « Force Majeure ».
The Contract may also be terminated to comply with a decision given following an Alternative dispute settlement procedure or a legal decision which became final or enforceable and might require Transfer or Deletion of the Domain Name in particular.
26.3.2. Termination for fault
In case either party should fail to meet any of its contract obligations, the other party may formally summon the defaulting party to comply with its commitments within fifteen (15) days.
If NordNet Registrar is responsible for any such failure, You are to send the formal demand to NordNet Registrar by registered mail, return receipt requested. Upon expiry of the period, if NordNet Registrar has failed to meet its obligations, You may fully terminate the Contract sending a second registered mail, return receipt requested. If You are responsible for any such failure, NordNet Registrar should send to You the formal notice by e-mail. Upon expiry of the period, if You have failed to comply with your obligations, NordNet Registrar may fully terminate the Contract sending a second e-mail.
However, in case the type of commitments which You have failed to meet should prevent You from remedying your fault, NordNet Registrar may fully terminate the contract immediately after the failure has been noted sending an e-mail.
Faults which may result in termination as decided by NordNet Registrar include, without limitation, those related to any failure to comply with any clause set out in Contract Terms by the Registering Entity (including any failure to give notice of full, current and exact information, failure to disclose supporting evidence, failure to update information whenever this may be required, failure to meet time scales imposed, failure to answer verification requests from NordNet Registrar on information relating to details transmitted and in general any such information as You may have transmitted to NordNet Registrar).
26.3.3. Effects of Contract Termination
NordNet Registrar informs you that it may, in particular, upon the date of termination of the Contract, or a few days later, initiate the Deletion of the relevant Domain Name and Services, and no notice will be required, excluding for cases of Out- going Transfer or change in Registering Entities. As a result of Domain Name Deletion, the Domain Name will become public again and so become available for registration under such conditions as established by the Registry or Regulatory Authority concerned.
Termination will also imply Deletion of the Domain Name from the relevant Registry’s or Regulatory Authority’s bases and therefore from Whois bases.
In case of Termination for fault as decided by NordNet Registrar, it will not be under the obligation of reimbursing to You any such sums as You may have already paid under the Contract. You will also remain liable for monies due for the full period requested for your subscription to the Contract, either directly or through your Service provider. These sums will be kept as closing costs.
You are informed that if you are bound to a Service provider, Termination of the Contract will not necessarily result in the end of Your subscription with this Service provider. Also, termination of Your subscription with Your Service provider will not necessarily result in termination of the Contract and therefore deletion of Your Domain Name.
27. DISPUTES
Excluding disputes raised by third parties against the Domain Name to be subject to an Alternative Dispute Settlement Procedure and excluding disputes relating to the Contract to be subject to such rules as set forth in « Legal Proceedings », the Registering entity will refer any dispute relating to registration, use and/or operation of a Domain Name to the court (i) of the domicile of the Registering entity or (ii) location of the Registrar’s registered office.
If legal proceedings or an Alternative Dispute Settlement Procedure relating to the registration, use and/or operation of a Domain Name maintained by NordNet Registrar should be instituted against the holder thereof, NordNet Registrar may have to block any Action from you relating to the Domain Name concerned upon request from the competent Authority.
27.1. Alternative Dispute Settlement Procedure
The Domain Name holder will be under the obligation of submitting to an Alternative Dispute Settlement Procedure in case any third party should raise violation of its rights with respect to the relevant Domain Name against the Domain Name holder.
So, as stated in « Conditions applicable to the various extensions », You undertake to submit to any Alternative Dispute Settlement Procedure as may be adopted by Registries or Regulatory Authorities based on the relevant extension.
In order to consult rules applicable on line, please refer to addresses stated in « Conditions applicable to the various extensions ». NordNet Registrar may also send these documents to you upon simple request from you.
You are informed that the various rules may be amended at any time.
NordNet Registrar will comply with the provisions of any decision given after an Alternative Dispute Settlement Procedure obliging NordNet Registrar to Modify (administratively and/or technically), Change Registering entities, Transfer or Delete a Domain Name falling into the scope of Contract Terms. In connection with an Alternative Dispute Settlement Procedure of the UDRP type, NordNet Registrar will meet a period of ten (10) days worked from the date when the Transfer, Registering entity change, or Deletion decision was notified before implementing said decision. NordNet Registrar will inform parties concerned by the decision and ICANN, as part of UDRP’s, of the effective date of this decision.
No Alternative Dispute Settlement Procedure will prevent the parties from referring the dispute to a court having jurisdiction to obtain a legal decision. In case legal proceedings should be instituted, they may result in a suspension of the Alternative Dispute Settlement Procedure.
27.2. Legal proceedings
Disputes concerning the Contract, whether it may be the formation, performance of termination thereof will be directly subject to legal proceedings and to the laws of France, excluding dispute rules provided by the laws of France on the one hand and non compulsory provisions of the laws of France as might be in conflict with the Contract on the other hand.
If you act in a capacity as trader, any such dispute as may arise between the Parties from their contract relationships, including from the interpretation, performance and termination of the Contract, will be exclusively referred to the commercial court of Roubaix-Tourcoing (France), which will have sole jurisdiction, as it is located in the territory of NordNet Registrar’s registered office, where the Contract was made, including in case of matters of special urgency, petition, introduction of third parties, or in case there is more than one defendant, whatever your place of residence and mode of payment accepted.
If you are an individual, any dispute relating to the Contract will be subject to rules of jurisdiction ratione materiae and competence of a court ratione loci as provided by the laws of France.
NordNet Registrar will meet the provisions of any legal decision as became final or enforceable obliging NordNet Registrar to administratively and/or technically Modify, Change Registering entities, Transfer or Delete a Domain Name falling into the scope of Contract Terms.
28. GENERAL PROVISIONS
28.1. Language of the Contract
French will be the official language of the Contract. In this respect, all notices referred to herein will be sent to You by NordNet Registrar in French.
Any translation of the Contract will be provided for your information only, to make it easier to understand for non French- speaking Registering entities or users of NordNet Registrar services. The French version only will therefore be authentic.
28.2. Dissemination of the Contract
You may not assign, transfer, delegate or license for any cause whatsoever the rights and obligations arising from the Contract to a third party without any prior notice in writing to NordNet Registrar. You undertake to comply with all formalities required for the consideration of the operation where applicable.
NordNet Registrar may assign, transfer, or delegate to any third party all or any part of its obligations or services. In case of assignment, delegation, or transfer, NordNet Registrar should then give you notice using any appropriate means, including via the publication of information over its Website.
NordNet Registrar will also be free to sub-contract to one or more third parties all or any part of obligations imposed upon NordNet Registrar by Contract Terms.
28.3. Severability
If all or any part of any provision of the Contract Terms should be cancelled, the validity of the remaining provisions of the Contract Terms would not be affected.
In this case, the Parties should substitute a valid provision in line with the spirit and purpose of Contract Terms for the cancelled provision to the fullest extent possible.
28.4. Tolerances
The fact for NordNet Registrar to refrain from using any remedy with respect to any failure - from You or in general from Contacts for the Domain Name(s) - to meet any of the obligations and commitments as provided under Contract Terms may not be deemed to be a waiver of the right to exercise said remedy with respect to this failure or any subsequent fault.
28.5. Headings
Headings for the articles of Contract Terms have been inserted for reference purposes only and have no contract value or special meaning proper.
28.6. Notices
All notices, communications, formal demands as provided by the General and Special Terms will be deemed to have been validly delivered to the recipient if they are sent:
- to NordNet Registrar by registered mail, return receipt requested at the address stated in « NordNet Registrar Details ».
- to You and/or your Contacts, by mail or by e-mail at such addresses as you may have transmitted to NordNet Registrar in compliance with Contract Terms.
28.7. Expenses
Each party will be obliged to pay all expenses and costs incurred by them respectively in connection with Contract Terms and operations planned by them, including fees and disbursements.

NordNet Registrar details SPECIAL TERMS OF REGISTRATION AND MAINTENANCE OF NORDNET REGISTRAR DOMAIN NAMES For « .eu » domains (Version 2, 18 April 2006) The purpose of these special terms applying to « .eu » domains is to specify conditions under which NordNet Registrar will be involved in Actions (e.g.: Request for Creation, Renewal, Modification, Transfer, Deletion) relating to such Domain Names as the Registering entity (“You”) holds or would like to register with a « .eu » extension.
NordNet Registrar is a technical service provider which entered into a membership agreement with EURid to handle requests for acts of administration of domain names in the « .eu » area, including registration of said domain names with XXXxx.
Special Conditions for « .eu » domains will be added to General Terms of registration and maintenance of NordNet Registrar Domain Names available over xxxx://xxx.xxxxxxx.xxx in the « General Terms » section, or upon simple request from NordNet Registrar (cf. « NordNet Registrar Details » in the General Terms of registration and maintenance of NordNet Registrar Domain Names).
In case of conflict between General terms and Special Terms, Special terms will prevail.
1. DEFINITIONS
The following words and expressions will complement those defined in the General Terms of registration and maintenance of NordNet Registrar Domain Names. Save as may be otherwise specified, they will have such meanings as may be given to them below if their first letter is a capital letter, whether in the singular or plural in the Special terms, including recitals or any other document issued by NordNet Registrar, relating to the subject matter of Special Terms.
EURid: « European Registry for Internet Domains », consortium constituting the .eu extension Registry. EC Rules on .eu:
- EC Rule No. 733/2002 from the European Parliament and Council, 22 April 2002, on the implementation of the first level
.eu domain (JOCE L 113, 30 April 2002 p.1);
- EC Rule No. 874/2004 from the Commission, 28 April 2004, setting out rules of general interest policy on the implementation and functions of the first level .eu domain and principles applicable in terms of registration (JOUE L 162, 30 April 2004 p.40) ;
- EC Rule No. 1654/2005 from the Commission, 10 October 2005, amending Rule No. 874/2004 setting out general interest rules relating to the implementation and functions of the .eu first level domain and principles applicable in terms of registration (JOUE L 266, 11 October 2005, p. 35).
Sunrise period rules: Rules applicable during the Sunrise period, also called « Registration Policy for .eu and terms and conditions for applications for Domain Names filed during the phased registration period ». These rules are accessible over xxx.xxxxx.xx.
EURid Rules: EURid Rules include the following documents published by XXXxx, accessible at xxx.xxxxx.xx :
(i) Terms and Conditions of registration of .eu Domain Names,
(ii) Policy of registration of .eu Domain Names,
(iii) Policy of registration for .eu and terms and conditions for applications for domain names filed during the phased registration period called « Rules of Sunrise period »,
(iv) Whois policy on .eu Domain Names,
(v) Rules on the settlement of disputes on .eu domains and,
(vi) EC rules relating to .eu.
2. ACCEPTANCE OF EURID RULES
As a result of just one request for Action made with NordNet Registrar with respect to any « .eu » Domain Name, You are deemed to have read and accepted EURid Rules as defined in « Definitions ».
You undertake to comply with their conditions. Any violation of EURid Rules may result in the Deletion of your Domain Name by the Registry or NordNet Registrar. You may not claim for any compensation on this matter.
EURid Rules may be subject to amendments. Notwithstanding General terms of registration and maintenance of NordNet Registrar Domain Names, any new version of EURid Rules will become effective 30 (thirty) days after publication thereof at xxx.xxxxx.xx, save as may be otherwise reasonably specified by the Registry. The version which may be raised against you will be the version applicable on the date of receipt by XXXxx of any request for Action relating to the Domain Name.
3. REQUEST FOR CREATION OF A DOMAIN NAME
Request for registration of a Domain Name with NordNet Registrar does not mean that the Domain name will be assigned to you.
3.1 – People authorised to register a Domain Name in the « .eu » area
the following classes of companies, organisations and individuals only will be authorised to register a Domain name in the «
.eu » area:
- any business having its registered office as specified in the articles of association, central administration or principal place of business in the European Community; or - any organisation established in the European Community, without prejudice to national laws applicable; or - any individual residing in the European Community.
If none of these conditions is met, the .eu Domain Name wanted may not be applied for.
If the condition no longer is met during the registration period, the .eu Domain Name may be deleted. You may have to provide evidence of this condition at any time.
3.2 – Availability of a Domain Name
A Domain Name is available when all three conditions below are concomitantly met:
a) it has not been registered before as Domain Name;
b) it is not reserved, blocked or stated in the Registry as « non registrable » in compliance with EC Rules on .eu, save as may be stipulated otherwise in EURid Rules;
c) it has not been subject to any request for registration during the phased registration period, save if the Registry has decided that it was available again in application of Sunrise Period Rules.
The European Commission has published lists used to know
(i) names blocked which may never be registered, and
(ii) names exclusively reserved to the european Commission or member states’ governments. Moreover, certain Domain Names are reserved for use of .eu. These lists are accessible at xxx.xxxxx.xx.
We would like to draw your attention to the fact that a Domain name may appear as available when in fact it has already been reserved or is in the process of being reserved. In this case, Your application will be immediately or eventually rejected.
3.3 – Technical requirements of a Domain Name
Names in conformity with the following cumulative technical requirements only may be registered as Domain Names. They should:
a) include not less than 2 characters selected among letters comprised between « A » and « Z » in the standard Latin alphabet, figures from « 0 » to « 9 » and hyphen (« - »);
b) include not more than 63 characters (exclusive of .eu suffix);
c) not start or end with a hyphen (« - »);
d) not include a hyphen (« - ») in the 3rd and 4th positions;
e) not be exclusively composed of an alpha-2 code (2 consecutive letters) representing a country, in compliance with .eu- related EC Rules.
TERM
The period of maintenance of the Domain Name by NordNet Registrar will depend on the subscription period selected by you in case of Creation, or date of expiry of the Domain name registration period in case of In-coming Transfer (See « Transfer »). However, NordNet Registrar will no longer maintain the Domain Name in case of Deletion or Out-going Transfer in the process of being registered.
You are informed of the fact that you may check the date of expiry of any .eu Domain Name at the xxx.xxxxx.xx address at any time.
5. CHANGE IN REGISTRARS (TRANSFER)
In case of In-coming Transfer, the Domain Name will retain its original date of expiry and will be renewed for an extra year immediately after the Transfer has been completed.
For any request for Transfer of the Domain Name, please contact NordNet Registrar (See « Details » in the General Terms of registration and maintenance of NordNet Registrar).
6. TRANSFER OF DOMAIN NAMES (CHANGE IN REGISTERING ENTITIES)
The Domain Name assignee should be authorised to register a Domain Name in the .eu area, in compliance with « People authorised to register a Domain Name in the « .eu » area » in these Special Terms.
You are to pay to EURid expenses for Change in Registering Entities through the Registrar of Your Domain Name.
For any request for Change in Registering Entities, please contact NordNet Registrar (cf. « Details » in the General Terms of registration and maintenance of NordNet Registrar).
7. REQUEST FOR MODIFICATION OTHER THAN CHANGE IN REGISTERING ENTITIES
In case of modification of Your details or Your Contacts’ details, You are to give notice thereof to NordNet Registrar in a timely manner. Otherwise, NordNet Registrar will be free to terminate the Contract under such conditions as provided in the General Terms of registration and maintenance of NordNet Registrar.
For any request for Modification of the Domain Name, please contact NordNet Registrar (See « Details » in the General Terms of registration and maintenance of NordNet Registrar).
8. REQUEST FOR DELETION
You may ask NordNet Registrar for Your Domain Name to be Deleted and NordNet Registrar will be responsible for transmitting your request to EURid. As the case may be, XXXxx will forthwith suspend the Domain Name for forty (40) days from:
The date mentioned in the request for cancellation, or The date when the request for cancellation was made if the date mentioned in the request for cancellation is prior to the same.
During this forty-day period, you may:
Ask NordNet Registrar to re-activate the suspended Domain Name,
Ask for a change in Registrars via your new Registrar. The Domain Name will be considered as tacitly re-activated where applicable.
If no reactivation or transfer occurs as described above during the forty-day period, the Domain Name will be included again in domain names available for registration.
Registration or renewal duties for the initial Domain Name may not, in any case whatsoever, be subject to repayment.
For any request for Domain Name Deletion, please contact NordNet Registrar (cf. « Details » in the General Terms of registration and maintenance of NordNet Registrar).
9. DISPUTES
9.1 Alternative dispute resolution procedure (ADR)
Where You apply for registration of an .eu Domain Name and in case of any action brought by a third party invoking any violation of his/her rights in respect of the relevant Domain name, You undertake to submit to ADR’s applicable to .eu.

You are made aware that ADR procedures may be modified at any time.
An ADR will not prevent the parties from referring the dispute to a court having jurisdiction to obtain a legal decision. If legal proceedings are instituted, they may result in suspension of the pending ADR.
9.2 – Legal Proceedings
Rules applicable in case of dispute relating to Special Terms are set out in « Disputes » in the General terms of registration and maintenance of NordNet Registrar domain Names.
10. DATA BASES
You accept that certain information items as You have disclosed may be published in Whois data bases.
If the Registering Entity is a corporation, this information will usually be as follows: corporate name, address, phone and fax numbers of Registering Entity, Technical Contact, e-mail address of the Registering Entity, language of any ADR against your Domain Name, technical information such as DNS’s or status of relevant Domain Name.
Optional information will be mentioned as is. Any other information should necessarily be disclosed for the proper performance of your request for Action.
If the Registering Entity is an individual, information published will be limited to the e-mail address of the Registering Entity, save if said Registering Entity should request otherwise. The Registering Entity may ask for the creation of a specific e-mail address for such publication in Whois bases and not have to transmit its personal e-mail address.

Comprometerse a mantener siempre actualizada la información facilitada en la solicitud, mediante el envío a ORANGE de una solicitud de cambio de los datos de un registro previo siempre que haya modificaciones en cualquiera de los datos consignados. El no hacerlo así puede dar lugar a que el dominio sea dado de baja (por ejemplo, por imposibilidad de comunicar con las personas que figuran como responsables de facturación, administrativo o técnico del dominio al no haber notificado cambios de sus datos de contacto o cambios de responsables).
Cuenta de correo asociada al dominio.
El servicio Dominio Propio lleva aparejada una (1) cuenta de correo asociada al dominio. Baja en el servicio.
Traslado del nombre de dominio a otro Proveedor de Servicios de Internet. La baja en el Servicio "Dominio Propio" conllevará necesaria y automáticamente la cancelación del resto de los servicios asociados, tales como las cuentas de correo electrónico asociadas al dominio propio.
Para el traslado del nombre de dominio a otro Proveedor de Servicios de Internet, será necesario
(i) la solicitud escrita del cliente por conducto fehaciente de cambio de ubicación del nombre de dominio
(ii) estar al corriente de los pagos del Servicio.
El cliente se compromete a hacer un uso lícito y diligente del nombre de dominio y, en particular, a abstenerse de hacer un uso incorrecto del mismo, tal y como se prohíbe en el apartado 3.3 de las CCGG de Internet de ORANGE. Asimismo, el Cliente se obliga a indemnizar a ORANGE, o en su caso, a los terceros que pudieran prestar el Servicio a través de ORANGE por los daños y perjuicios que se produzcan por el uso incorrecto del Servicio.
Gestión del servicio por el propio cliente.
El cliente tendrá asignados un “login” y un “password” que le permitirá gestionar a través de un panel de control, determinados aspectos del servicio, como redirigir el nombre de dominio a una página web alojada en los servidores de ORANGE, crear cuentas de correo o gestionar el alta y modificaciones de las funcionalidades del servicio.
Pago de los servicios
El pago deberá realizarse de forma anual. En el caso de que el Cliente decidiese causar baja en el servicio contratado con carácter previo al periodo de un año: · ORANGE no estará obligada a rembolsar al Cliente cantidad alguna del pago anual realizado, puesto que son servicios pre-pago anuales.

Los buzones tendrán un límite de espacio de 100 MB cada uno, reservándose ORANGE el derecho a modificar en cualquier momento este límite de espacio, mediante previo aviso al Cliente con una antelación de treinta (30) días.
Se exige para la contratación del Servicio una permanencia en el mismo de un año, renovándose de forma automática por el mismo periodo de tiempo y con la misma obligación de permanencia anual. Si el Cliente desea no renovar el contrato en la vigencia original o en cualquiera de sus prórrogas deberá comunicárselo a ORANGE por escrito, ya sea vía fax o correo certificado, con una antelación mínima de quince (15) días a la fecha de renovación del contrato.
La fecha de entrada en vigor será la fecha de alta en el Servicio. Una vez ORANGE reciba la solicitud del Cliente, se tramitará el alta en el Servicio.
PLAZO DE ACTIVACIÓN DEL SERVICIO CUENTAS DE CORREO: Un plazo máximo de 48 horas siempre que sean altas de cuentas asociadas a XxxxxxxXxxxxx.xx o asociadas al dominio propio del cliente.
CALIDAD DE LOS SERVICIOS CUENTAS DE CORREO
Cuando durante un período de facturación, un Cliente vea temporalmente interrumpido el servicio de Cuentas de Correo contratado, Orange tras estudiar el problema, le indemnizará si corresponde (empezando a contar los plazos desde el momento en que el Cliente comunique al S.A.C la existencia de ese problema) devolviéndole los importes facturados durante el plazo de tiempo en que el Cliente no tenga el servicio activo.
Adicionalmente Orange indemnizará al Cliente cuando se incumpla con el tiempo máximo de interrupción del servicio Cuentas de correo (entendido como la suma de tiempos transcurridos a lo largo de un período de facturación en el que se ha producido la rotura o inutilización del servicio) definido a continuación. Orange tras estudiar el problema le indemnizará si corresponde (empezando a contar los plazos desde el momento en que el Cliente comunique al S.A.C la existencia de esa interrupción del servicio).
El tiempo de interrupción máximo del presente servicio de Cuentas de Correo en un período de facturación (un mes) será de 48 horas naturales a contar desde que el Cliente haya contactado con nuestro S.A.C. para informar sobre la existencia del problema. Para clientes con productos de pago anual el tiempo de interrupción máximo del servicio será de 288 horas naturales durante el año. Para el computo total de las horas de indisponibilidad del servicio a lo largo del año se contabilizarán todas las incidencias reportadas al Servicio de atención al Cliente de Orange por el cliente durante el periodo de facturación (un año).
En los casos en los que Orange tras analizar la problemática ocurrida, haya concluido en que el tiempo máximo de interrupción al que se ha comprometido en el párrafo anterior ha sido efectivamente sobrepasado compensará al Cliente con el importe de 1 cuota del producto contratado. En caso de pago anual, Orange compensará al Cliente con el importe equivalente a 3 cuotas mensuales del producto contratado. La mencionada indemnización será efectiva en la factura correspondientes al período de facturación en el que se comunique y se valide la indemnización.
Los clientes que deseen solicitar esta indemnización deberán dirigir su reclamación en un plazo máximo de un mes a contar desde la finalización del mes en el que haya/n ocurrido la/s interrupción/es contactando con el S.A.C. de Orange en el número 000 000 000 indicando sus datos personales y del dominio y siendo imprescindible indicar el/los número/s de incidencia/s provisto por el S.A.C. de Orange en el momento de comunicar su avería.
En el caso de traslados de dominios, el cliente debe autorizar la petición de traslado por lo cual en este caso el plazo de activación dependerá de este hito y se calcula que será un plazo de una semana.
Gestión del servicio por el propio cliente. El cliente tendrá asignados un “login” y un “password” que le permitirá gestionar a través de un panel de control determinados aspectos del servicio, como dar de alta el número de paquetes de cuentas de correo que desee o modificar las funcionalidades del servicio.
El cliente acepta y autoriza que ORANGE le dirija mensajes a su cuenta de correo electrónico contratada con ORANGE, relativos a la información técnica, operativa y comercial acerca de los productos y servicios ofrecidos por ORANGE.
Se considerará terminantemente prohibido el uso de este Servicio para remitir mensajes utilizando una identidad falsa, camuflar en manera alguna el origen del mensaje, así como enviar correos electrónicos no solicitados por sus destinatarios de manera expresa con carácter masivo y/o repetitivo ("Spam"), todo ello sin perjuicio del resto de prohibiciones de usos incorrectos de los Servicios, previstas en las Condiciones Generales de Prestación de Servicios de Internet.
ORANGE podrá eliminar total o parcialmente el contenido de los buzones de correo electrónico que no presenten actividad de envío o recepción de mensajes durante noventa (90) días naturales consecutivos. Si el buzón de correo únicamente recibe mensajes, ORANGE lo considerará igualmente inactivo si el Cliente no accede a su buzón durante noventa (90) días naturales consecutivos.
Este Servicio incluye un soporte técnico 24 horas al día durante los 7 días de la semana en el teléfono de Atención al cliente 902 014 002.
Pago de los servicios
El pago deberá realizarse de forma anual. En el caso de que el Cliente decidiese causar baja en el servicio contratado con anterioridad a la finalización del periodo de permanencia de un año: · ORANGE no estará obligada a rembolsar al Cliente cantidad alguna del pago anual realizado.
3. ALTA EN BUSCADORES
Servicio de tramitación por ORANGE del alta de la dirección URL de la página web titularidad del Cliente, en aquellos buscadores que ORANGE ofrezca al Cliente en la oferta comercial vigente en cada momento.
La fecha de entrada en vigor del contrato será la fecha de alta en el Servicio. Una vez ORANGE reciba la solicitud del Cliente, se tramitará el alta en el Servicio.
Requisitos. q El Cliente debe ser titular de una página web con presencia en Internet. q Debe tratarse de una página con un contenido visible, no siendo válidas las páginas en construcción. q Únicamente se alojarán páginas cuyo contenido sea en lengua española o inglesa.
PLAZO DE ACTIVACIÓN DEL SERVICIO ALTA EN BUSCADORES: Un plazo máximo de 72 horas.
ORANGE no se hace responsable de aquellos aspectos del Servicio que dependan de la decisión y/o actuación de los buscadores; y no responderá en ningún caso de las consecuencias que de estas decisiones y/o actuaciones pudieran derivarse para el Cliente, como pudieran ser, a título de ejemplo y sin carácter exhaustivo, las siguientes: - El alta del Cliente en los buscadores mencionados está condicionada a la aceptación de la solicitud de alta por los propios buscadores.
Por este motivo, ORANGE no garantiza al Cliente el alta efectiva por el mero hecho de haberla solicitado.
Los buscadores deciden el momento de inclusión de las direcciones URL para que aparezcan tras la búsqueda que realicen los usuarios. ORANGE no garantiza al Cliente la fecha en la que será incluida su dirección URL en el buscador.
Los buscadores utilizan sus propios criterios que determinan el rango de ubicación de las direcciones URL tras la búsqueda que realicen los usuarios. Por este motivo, ORANGE no garantiza al Cliente el rango de ubicación en el que aparezca su dirección URL.
Los buscadores se reservan el derecho de dar de baja aquellos espacios web que no hayan sido visitados durante un periodo de tiempo. La duración de este plazo depende de cada buscador, e igualmente que la decisión de dar de baja el espacio web, escapa de la decisión y, por tanto, de la responsabilidad de ORANGE.
Y todas aquellas otras actuaciones de los buscadores ajenas a la decisión de ORANGE, que impidan, limiten o cancelen el alta de las direcciones URL titularidad de los Clientes.
En el caso de que se den este tipo de circunstancias, y se produzcan consecuencias que pudiesen afectar al Cliente, como por ejemplo: que el buscador rechace la solicitud del Cliente, que el buscador sitúe la dirección URL del Cliente en un rango de ubicación que no satisfaga las expectativas del Cliente, o mantenga su dirección URL durante un plazo que al Cliente le parezca insuficiente, así como todas aquellas otras situaciones análogas que pudiesen dañar los intereses del Cliente, ORANGE no responderá por las mismas. En estos casos, el Cliente no podrá exigir a ORANGE el reembolso de las cantidades abonadas por este Servicio.
Pago de los servicios
El pago se realizará por anticipado a la prestación del servicio.
4. PLANES DE ALOJAMIENTO
El servicio PLANES DE ALOJAMIENTO, supone la puesta a disposición del Cliente del uso compartido, entre otros varios Clientes, de la capacidad de procesamiento y almacenamiento de los equipos propiedad de ORANGE ubicados en sus instalaciones, que permitirá al Cliente alojar información y/o contenidos que serán accesibles a través de la Red Internet. Asimismo el Cliente dispondrá del uso compartido de otros servicios de valor añadido o Programas instalados en los equipos de ORANGE (en adelante FUNCIONALIDADES) pre-establecidas de conformidad con lo dispuesto en las presentes Condiciones Particulares de contratación de los Servicios Hosting y Dominios. Este servicio no incluye en ningún caso el mantenimiento y actualización de los contenidos, que instale el Cliente en los equipos propiedad de ORANGE.
Se podrá acceder a los Servicios de Alojamiento desde cualquier punto de la geografía española a través de la red Internet.

El Cliente reconoce que existen herramientas técnicas tales como virus, bombas lógicas, etc. que pueden llegar a dañar o eliminar la información o los contenidos alojados por parte del Cliente en los servidores de ORANGE. Asimismo, el Cliente reconoce que la posibilidad de acceso por Internet a los contenidos almacenados en ORANGE en virtud del presente Contrato, pueden ser utilizados por terceros para acceder ilícitamente a los sistemas informáticos de ORANGE y eliminar, dañar o reproducir los contenidos o información almacenados por el Cliente. Dada la continua evolución que experimentan estas herramientas técnicas y los mecanismos de acceso ilícito a los sistemas de información arriba mencionados, ORANGE no puede garantizar que los contenidos alojados por el Cliente no vayan a ser dañados, eliminados o reproducidos ilícitamente, no siendo por tanto ORANGE responsable de la integridad de los datos o reproducciones ilícitas realizadas en estas circunstancias. Con el fin de reducir las posibilidades de pérdida o acceso ilícito a datos o contenidos causados en las circunstancias arriba descritas, las Partes acuerdan que los contenidos del Cliente alojados en los sistemas informáticos de ORANGE estarán protegidos por los siguientes mecanismos de seguridad:
• Condiciones ambientales: temperatura, luz, espacio con un mínimo garantizado. Todos los servidores estarán conectados a equipos de energía alternativos (UPS/SAI/Grupo Electrógeno), para mantener el servicio en caso de fallo de la fuente principal.
• Seguridad. El Centro de Proceso de Datos podrá ser compartido con otros servidores de ORANGE y de clientes de ORANGE, con la independencia de acceso a los mismos. El acceso a los equipos de cliente situados en el Centro de Proceso de Datos de ORANGE está garantizado y sujeto a estrictas normas de seguridad actualmente actualizada en los servicios ORANGE, que contarán además con los siguientes elementos de seguridad:
- Cortafuegos (firewall)
- Detector de Intrusiones
- Detector de vulnerabilidad de servidores.
Asimismo, las partes acuerdan que ORANGE deberá mantener actualizados estos mecanismos de seguridad si bien estas actualizaciones requerirán que el Cliente provea a ORANGE de las herramientas de actualización adecuadas. La responsabilidad de ORANGE alcanzará únicamente a la implantación de las medidas de seguridad arriba señaladas. Por tanto, siempre y cuando ORANGE cumpla con estos deberes de seguridad, no será responsable de daños, pérdidas o accesos y reproducciones ilícitas a contenidos o información del Cliente que estén almacenados en sus sistemas en virtud del presente Contrato. ORANGE WANADOO no tendrá obligación alguna de llevar a cabo copias de seguridad de los contenidos almacenados por el Cliente. Sin embargo el Cliente reconoce que ORANGE podrá realizar reproducciones de los contenidos y/o datos almacenados en virtud del presente Contrato, siempre y cuando estas reproducciones se realicen con el fin de llevar a cabo copias de seguridad de los sistemas informáticos de ORANGE. Asimismo, en el caso de que algún comando del código utilizado por el Cliente no fuera estándar, ORANGE no se compromete a mantener la compatibilidad entre versiones del software de la plataforma de Alojamiento.
Protección de Datos.
En el caso de que el Cliente vaya a introducir datos de carácter personal en los sistemas informáticos de ORANGE en virtud del Servicio contratado: Las partes acuerdan que la prestación de los servicios objeto del presente Contrato pueden requerir del almacenamiento en las instalaciones de ORANGE y acceso por ésta a Ficheros con Datos de Carácter Personal de los que el Responsable el Cliente. Siendo esto así, y en cumplimiento del Art.12 de la L.O. 15/1999, de 13 de diciembre de Protección de Datos de Carácter Personal (LOPD), las partes acuerdan que no será considerado comunicación ni cesión de datos el acceso en su caso por ORANGE a los datos de carácter personal que el Cliente pueda tener albergados en los equipos de ORANGE, ya que dicho acceso, y el correspondiente tratamiento, pudiera ser necesario para realizar la prestación del servicio contratado. Es por ello que en el supuesto de tener que acceder a dichos datos, ORANGE sería considerada como el “encargado del tratamiento” de los datos del Cliente y, de acuerdo con ello, se establece expresamente que ORANGE únicamente tratará los datos conforme a las instrucciones del Cliente, que no los aplicará o utilizará con fin distinto al que figura en lo pactado entre las partes, ni los comunicará, ni siquiera para su conservación, a otras personas.
Asimismo, ORANGE se compromete a adoptar e implementar las medidas de seguridad a que se refiere el artículo 9 de la LOPD, que son las establecidas en el Real Decreto 994/1999, de 11 xx xxxxx, para los datos y ficheros objeto de este servicio. Una vez cumplida la prestación de servicios pactada, los datos de carácter personal serán destruidos o devueltos por ORANGE al responsable del tratamiento, al igual que cualquier soporte o documentos en que conste algún dato de carácter personal objeto del tratamiento.
En el caso de que el Cliente NO vaya a introducir datos de carácter personal en los sistemas informáticos de ORANGE en virtud del Servicio contratado: El Cliente declara que la utilización de los servicios prestados por ORANGE al amparo del presente Contrato, no conllevará en ningún caso, el almacenamiento en los sistemas informáticos de ORANGE de datos personales de acuerdo con la LOPD. Por consiguiente el Cliente librará a ORANGE de cuantas reclamaciones o sanciones se le dirijan como consecuencia de la vulneración por parte del Cliente de la LOPD en lo que se refiere a contenidos almacenados en ORANGE como consecuencia de la utilización de los servicios prestados por esta en virtud de este Contrato.
Pago de los servicios
El pago podrá realizarse bien de forma anual, o bien mensualmente. En el caso de que el Cliente decidiese causar baja en el servicio contratado con anterioridad a la finalización del periodo de permanencia de un año: ORANGE no estará obligada
a rembolsar al Cliente cantidad alguna de los pagos realizados y en el caso de pagos mensuales tendrá la obligación de continuar abonando a Wanadoo el servicio contratado hasta la finalización de la anualidad de permanencia.
CALIDAD DE LOS SERVICIOS DE PLANES DE ALOJAMIENTO
Cuando durante un período de facturación, un Cliente vea temporalmente interrumpido el servicio de Planes de Alojamiento contratado, Orange tras estudiar el problema, le indemnizará si corresponde (empezando a contar los plazos desde el momento en que el Cliente comunique al S.A.C la existencia de ese problema) devolviéndole los importes facturados durante el plazo de tiempo en que el Cliente no tenga el servicio activo.
Adicionalmente Wanadoo indemnizará al Cliente cuando se incumpla con el tiempo máximo de interrupción del servicio Planes de Alojamiento (entendido como la suma de tiempos transcurridos a lo largo de un período de facturación en el que se ha producido la rotura o inutilización del servicio) definido a continuación. Wanadoo tras estudiar el problema le indemnizará si corresponde (empezando a contar los plazos desde el momento en que el Cliente comunique al S.A.C la existencia de esa interrupción del servicio).

FUNCIONALIDADES DEL SERVICIO PLANES DE ALOJAMIENTO (HOSTING COMPARTIDO): 1.- DOMINIO PROPIO:
Funcionalidad regida por lo establecido en las presentes Condiciones Particulares de los Servicios HOSTING Y DOMINIOS, asociado siempre al espacio Web contratado. El Servicio de Traslado del Dominio estarán sujetas a las políticas vigentes del ICANN. El Cliente reconoce y acepta que dichas reglas no permiten el traslado o transferencia de los dominios en los primeros sesenta (60) días a contar desde la fecha de registro inicial.
2.- CUENTAS DE CORREO:
Esta Funcionalidad permite al Cliente el hospedaje de su correo electrónico (Mail Hosting) de conformidad con lo establecido en las presentes Condiciones Particulares de los Servicios HOSTING Y DOMINIOS, e incluyendo:
filtros contra virus en los correos y contra envíos masivos de publicidad no deseada.
Posibilidad de creación y modificación de sus buzones y direcciones de correo de forma sencilla. Crear carpetas y subcarpetas para guardar y clasificar grupos de correos.
Activar mensajes de respuesta automática de vacaciones
Definir y gestionar grupos de usuarios para facilitar el envío de correos Enviar correos programados con fecha posterior
Agenda y Calendario
3.- ALTA EN BUSCADORES:
Funcionalidad regida por lo establecido en las presentes Condiciones Particulares de los Servicios WANADOO ORANGE (1.300 aproximadamente), con reporte detallado de los mismos. El Cliente podrá acceder a este servicio una vez que tenga un registro de dominio y su site alojada.
4.- ESPACIO WEB CON FTP PROPIO:
Funcionalidad regida por lo establecido en las presentes Condiciones Particulares de los Servicios HOSTING Y DOMINIOS, sin que no obstante no sea de aplicación para este Servicio PLANES DE ALOJAMIENTO, las restricciones adicionales establecidas en dicho apartado, y por lo tanto pudiendo aplicarse plenamente :
- Un entorno WindowsNT,
- el uso de ASP's,
-uso de bases de datos: para catálogos, muestrario de artículos, gestión de clientes, páginas de datos dinámicas, MySQL y SQL Server, con las funcionalidades propias de las herramientas de gestión de las mismas (phpMyAdmin y MyLittleAdmin), si bien el mantenimiento, actualización y gestión remota del espacio en base de datos será a cargo del Cliente,
- Directorio CGI: pequeños programas para dar funcionalidades automáticas o interactivas a las páginas que se deseen: contador básico
formularios.
5.- Gestor de Servicios:
En función de la disponibilidad y medios técnicos de ORANGE encada momento, el Cliente podrá usar la Administración Delegada del Servicio, de forma que el Cliente podrá realizar la gestión remota de los elementos de su servicio, con un único administrador a través de un interfaz Web de acceso exclusivo al Cliente.

El Cliente podrá contratar dominios adicionales y más cuentas de correo, y se facturarán en líneas independientes, mediante solicitud a través del web xxxx://xxxxxxxx.xxxxxx.xx/xxxxxxxxx o bien a través del teléfono 000 000 000.
Condiciones Particulares de Prestación de los diferentes Servicios de Wanadoo Pro no comercializados actualmente.
Las presentes Condiciones Particulares serán de aplicación para aquellos clientes que en su día contrataron los servicios mencionados a continuación y que deseen renovarlos. No obstante estos servicios ya no se ofrecen y por lo tanto no pueden ser contratados.
1. ESPACIO WEB CON FTP PROPIO
Servicio de creación y gestión de páginas web. WANADOO pone a disposición del Cliente un espacio virtual en un servidor donde los clientes pueden alojar su página web. No existe limitación de MB de espacio, pudiendo escoger el Cliente entre las modalidades de alquiler de espacio web de hasta 5MB, hasta 10MB, hasta 15 MB y hasta 25 MB. Todo ello sin perjuicio de que en cualquier momento WANADOO pueda modificar esta oferta comercial.
La contratación del Servicio se realizará por un periodo de un año, renovándose de forma automática por el mismo periodo de tiempo. Si el Cliente desea no renovar el contrato deberá comunicárselo a WANADOO por escrito, ya sea vía fax o correo certificado, con una antelación mínima de quince (15) días a la fecha de renovación del contrato.
La fecha de entrada en vigor será la fecha de alta en el Servicio. Una vez WANADOO reciba la solicitud del Cliente, se tramitará el alta en el Servicio.

Este servicio supone un acceso vía FTP, que permitirá al Cliente actualizar y modificar sus páginas desde cualquier tipo de conexión a Internet. El Cliente tendrá la opción de utilizar CGI's propios WANADOO: gestión de contadores, enlaces dinámicos, explotación de bases de datos ASCII, libro de visitas, formularios, área privada. El cliente tiene la posibilidad de asociar el espacio web alojado en el servidor de WANADOO a un dominio WANADOO o a un dominio propio. El Cliente podrá ampliar la cuota de espacio contratada.
Si el Cliente desea que el espacio web contratado sea bajo dominio propio, es requisito de este servicio que el dominio propio esté alojado en WANADOO.
El Cliente se obliga a hacer un uso razonable del servicio bajo el principio de buena fe y con respeto a la legalidad vigente, así como a respetar las restricciones de uso de los servicios que determina WANADOO en el apartado 3.3 de sus CCGG de Internet. Adicionalmente, en el uso del Servicio Espacio Web con FTP propio, el Cliente deberá respetar las siguientes restricciones:
i. no está permitido el entorno WindowsNT, el uso de ASP's, los motores de búsqueda, ni bases de datos
ii. no está permitida la utilización de CGI's externos, sólo podrá hacerse uso de los CGI's preinstalados por WANADOO
iii. no está permitido el uso de programación FRONTPAGE.
WANADOO pone a disposición del Cliente un centro de atención telefónica 24 horas al día los 365 días del año en el número de teléfono 000 000 000.
2. CONEXIÓN RDSI+IP FIJA
Servicio de acceso a Internet a través una red digital “RDSI” (Red Digital de Servicios Integrados) mediante una IP fija. El Servicio “Conexión RDSI + IP fija” lleva consigo los siguientes servicios asociados: Diez (10) cuentas de correo electrónico con buzón de 100 Mb bajo el dominio “XXXXXXX.xx”. En el caso de que el cliente tenga contratado un dominio con WANADOO las cuentas de correo podrán crearse bajo el dominio del cliente, a elección de éste.
Espacio Profesional de 15 Mb para la publicación de páginas web.
Acceso vía FTP, que permitirá al Cliente actualizar y modificar sus páginas desde cualquier tipo de conexión a Internet. El Cliente tendrá la opción de utilizar CGI’s propios de WANADOO: gestión de contadores, enlaces dinámicos, explotación de bases de datos ASCII, libro de visitas, formularios, área privada. El cliente tiene la posibilidad de asociar el espacio web a un dominio propio.
La contratación del Servicio se realizará por un periodo de un año, renovándose de forma automática por el mismo periodo de tiempo. Si el Cliente desea no renovar el contrato deberá comunicárselo a WANADOO por escrito, ya sea vía fax o correo certificado, con una antelación mínima de quince (15) días a la fecha de renovación del contrato.
La fecha de entrada en vigor será la fecha de alta en el Servicio. Una vez WANADOO reciba la solicitud del Cliente, se tramitará el alta en el Servicio.

Pago de ambos servicios
El pago deberá realizarse por domiciliación bancaria de forma anual. En el caso de que el Cliente decidiese causar baja en el servicio contratado con carácter previo al periodo inicial mínimo de un año:
- en los casos del pago anual: WANADOO no estará obligada a rembolsar al Cliente las cantidades equivalentes al tiempo no consumido del servicio.
