Resumen The international procurement instrument (IPI), first proposed in 2012 (proposal revised in 2016), is designed to facilitate reciprocal opening of procurement markets in non-EU (third) countries. It is intended to be deployed when a third country closes its public procurement markets to EU bidders. Tenderers from such countries could subsequently be subject to measures lowering their chances of successfully bidding in the EU, and could even be excluded from public procurement procedures altogether. Parliament is expected to vote during the June 2022 plenary session on an agreement reached between the co-legislators in trilogue negotiations.

Resumen EU-China relations are increasingly affected by growing Sino-United States strategic competition. The Xxxxx Administration considers China a strategic competitor to confront, rather than a country with which to engage. The EU, on the contrary, refers to China as a strategic partner and, despite persistent and considerable differences in position in some areas, continues to engage. The United States’ current preference for bi and unilateralism, and withdrawal from multilateral arrangements, which the EU considers vital elements of a rules-based international order, create openings for China to fill the gap. For the EU, this implies the need to seek issue-based alliances and to strengthen strategic cooperation with China on issues of common interest to reach and uphold multilateral solutions to global and regional challenges. Since 2013, the 2003 EU-China comprehensive strategic partnership has been broadened and deepened in line with the EU-China 2020 Strategic Agenda for Cooperation. This has led to a high degree of institutionalisation of EU-China ties, with an ever-growing number of dialogue formats that cover political, economic and people-to-people relations, but whose tangible results vary significantly. Notwithstanding the frequency of political exchanges and successful cooperation on key global challenges, such as the nuclear deal with Iran and climate change, the economic pillar has remained the core of the relationship. As China is rapidly climbing the value-added ladder, trade is an area of cooperation where complementarity is shifting fast towards competition. Friction is unavoidable as two fundamentally different economic systems interact, and each side has its own understanding of what 'free' trade, 'fair' trade, 'reciprocity' and a 'level playing field' means. Given the wide diversity of EU Member States' interests and perceptions, which third countries may easily exploit for their own gains, the EU has struggled to come forward with a unified response to China-led initiatives. The European Parliament resolution on the state of play of EU-China relations adopted in September 2018 includes a critical assessment of China's foreign and domestic policies, including human rights, as well as of progress on the implementation of the EU-China strategic partnership.

Resumen This report independently assesses the EU-Japan Economic Partnership Agreement. We find that the EPA establishes an ambitious framework to further liberalise and better organise trade, covering goods, services, intellectual property and investment, tariff- and non-tariff measures, and regulatory cooperation. Given its depth and breadth, and that it is unprecedented in including provisions on corporate governance, SMEs, and climate change, the EPA is set to become a benchmark for future trade agreements. Joining two open economies with high income levels and regulatory standards, the agreement is expected to generate benefits by boosting trade within sectors, minimising sectoral relocation and negative employment effects. Agri-food, textiles and leather products are where the EU can expect to make the greatest gains. Furthermore, the EPA will boost the EU’s economic presence and political relevance in the Asia-Pacific area. Going beyond its economic benefits, the agreement also has significant non-economic implications. Reinforced cooperation will enhance the ability of both parties to shape the course of global developments in a manner that better reflects their shared interests and values, such as their commitment to a rule-based global trade system and the fight against global warming.

Resumen Directive 2011/7/EU on late payments in commercial transactions (Late Payment Directive, (LPD)) strengthened European regulations first introduced in 2000 in favour of creditors. In addition to statutory interest, the application of which is still not automatic, maximum periods were established for payments in business-to-business transactions and those with public authorities, limiting contractual freedom, which is often abused by stronger companies. Following the largely correct transposition into national law, the situation continues to vary between Member States with regard to average payment periods (especially from public authorities), and the level of implementation of additional voluntary measures (such as prompt payment codes). In the absence of harmonised measurement methods, business surveys and consultations indicate improving practices, but the attribution of this development to the LPD cannot be separated from broader economic contexts and cultural aspects easily. Further exchange of best practices and better monitoring of their effectiveness might facilitate future developments in the area of late payments, including legislative action.

Resumen In September 2016, the Commission tabled a proposal for a new Financial Regulation which would replace the current one (together with its Rules of Application), as well as amend 15 other sectoral instruments each containing financial rules. The Commission justifies its proposal by the need to simplify EU financial rules and make them more flexible. In April 2018, the BUDG and CONT committees approved the outcome of trilogue negotiations on the main part of the proposal for a new Financial Regulation, and that is expected to be voted in plenary in July 2018. Prior to that, in December 2017, the co-legislators had already adopted part of the proposal relating to the reform of five sectoral regulations within the common agricultural policy. Public procurement is a complex issue with the potential to strongly influence the EU economy. With the aim of discussing the main challenges related to this topic and the recently proposed draft regulation of the European Commission, the workshop was hosted by Mr Xxxxxx Xxxxxx, MEP.

Resumen International trade agreements have the potential to help breaking the vicious circle of corruption in economies based on privileged connections rather than fair competition. They increase competition in the removal of tariffs and so diminish the power of rentier companies which influence domestic regulation in their favour. They also contribute to a fairer business environment through their transparency provisions. Trade openness, red tape reduction and fiscal transparency, especially transparency of procurement, play positive roles in widening control of corruption. They can be more easily influenced by external actors than the other important control of corruption factors: judicial independence, freedom of the press or the demand from civil society for good governance. This study ordered by the INTA Committee argues that indirect good governance policies which increase competition and subvert power and economic monopolies or quasi monopolies are far more effective than direct anticorruption policies, which in relying on domestic implementation tend to fall into the vicious circle again. The study presents options characterised as an ‘economist’s approach’ with an apparently more modest but effective good governance package, a ‘lawyer’s’ approach’ with firm anticorruption language but unenforceable provisions even in EU countries (on bribery, for instance), and a ‘holistic’ approach where the EU would coordinate across international trade, promotion of norms and development aid. The three options may be used alternatively, depending on the degree of development and quality of governance of the trading partner. The study was presented at a workshop of the INTA committee on 24 January 2018.

Resumen This study analyses provisions of the EU-Singapore Free Trade Agreement concluded in May 2015 ('EUSFTA'). It compares EUSFTA with other 'new-generation' free trade agreements, such as the EU-Republic of Korea and the EU- Canada Comprehensive Economic and Trade Agreement.
Overall, EUSFTA adopts a WTO+ approach and as a result significantly liberalises trade between the EU and Singapore compared to the current trade relationship. The study finds that a number of tariff and non-tariff barriers to trade in goods and services that currently exist between the parties will be reduced or removed on EUSFTA's entry into force.
XXXXXX, as with other 'new-generation' FTAs negotiated by the EU, adopts a comprehensive approach, and contains innovative provisions on investment, intellectual property rights, competition and public procurement. It also contains provisions which reflect growing concerns about the impact of global trade, such as those on trade and sustainable development.
With regard to EUSFTA's potential impact on trade, the economic modelling estimates an increase of around 10 % in trade volumes and greater volumes of foreign direct investment between the EU and Singapore as a result of the agreement. It also concludes that XXXXXX should lead to small increases of the gross domestic products of the EU and Singapore (0.06 % and 0.35 %, respectively).
The responses of a wide-range of EU and Singaporean stakeholder consultation reveal that, in general, XXXXXX is viewed positively and is considered a very ambitious agreement, which will offer new opportunities for trade and investment in the EU and Singapore. However, some concerns have been raised, especially by small and medium- sized enterprises.
The implications of the result of the Opinion of the Court of Justice of the EU in case 2/15 of 2017, on whether the EU had exclusive competence to sign and conclude XXXXXX alone, is also analysed in detail.
The study recommends, notably, monitoring closely that commitments taken under sustainable development provisions are implemented and used effectively in practice.

Resumen Following the political agreement in principle reached in July 2017, a final accord on the EU-Japan Economic Partnership Agreement (EPA) was announced on 8 December 2017. The Commission aims that the agreement come into effect before the end of its mandate in 2019, after the approval of the Council and the European Parliament.
However, negotiations on investment protection standards and investment protection dispute resolution will continue.

Resumen With its strategy paper entitled ‘Trade for all’ in 2015, the Commission launched an EU trade policy that focussed on values such as human rights, workers’ rights, environmental protection and sustainable development. The idea was that free trade should be fair for both consumers in Europe and for citizens elsewhere. This approach was pursued in bilateral trade negotiations and in legislative proposals on, for example, conflict minerals, dual-use goods or the investment court system. But by the end of 2016 the tenor of the debate on international trade had changed, shifting the focus to national interests and fairness for consumers and producers at home. The UK’s decision to withdraw from the EU and the election of President Xxxxx in the US, together with the expiry of the clause recognising China’s non- market economy status, contributed to this shift. The European Parliament has played a crucial role in shaping the direction of EU trade policy. While its 2015 resolution on the Transatlantic Trade and Investment Partnership (TTIP) set the values-based trade agenda, its resolutions in 2016 and 2017 on China’s market economy status and global value chains reflected the shift in values. The Commission is seeking to balance free and fair trade but new challenges lie ahead, notably in the EU’s neighbourhood: Russia, the Eastern Partnership, Turkey and the UK’s withdrawal from the EU.

Resumen Despite the achievements of single market integration, many non-tariff barriers (NTBs) persist, preventing realisation of its full economic potential. These arise from laws, technical regulations and practices, and create obstacles for trade. NTBs can be of a general character, such as problems with the implementation and enforcement of EU law at the national level, missing or differing e-government solutions, or complex VAT requirements in intra-EU trade. NTBs can also be sector-specific and concern only specific markets for goods, services or retail. Accordingly, the EU is tackling NTBs with a mix of general and sectoral initiatives, often cutting across various policy areas. The Xxxxxxx Commission, now at the mid-term of its mandate, made deepening the single market one of its main priorities. The Commission's single market and digital single market strategies address many NTBs. However, greater Member State involvement, stronger monitoring, and increased political emphasis on the single market are likely to be needed to remove the barriers and deepen single market integration. NTBs are also increasingly mentioned in the context of debates on the United Kingdom's withdrawal from the European Union. The impacts of Brexit on the single market and NTBs are as yet unclear, but early analysis points to the likelihood of legal uncertainty and the need to address a multitude of often challenging issues.

Resumen This in-depth analysis addresses the implications of several scenarios of the UK withdrawing from the EU in relation to the EU Customs Union, the Internal Market law for Goods and Services, and on Consumer Protection law, identifying the main cross-cutting challenges that have to be addressed irrespective of the policy choices that will be made in due course. The analysis takes the fully-fledged EU membership as a point of departure and compares this baseline scenario to a membership of the UK in the European Economic Area (EEA), the application of tailor-made arrangements, as well as the fall-back scenario, in which the mutual relationship is governed by WTO law. Following an analysis of the EU legal framework defining the withdrawal of a Member State from the EU the study develops an analytical framework that allows for the identification of the legal impact of different Brexit scenarios on policy fields falling within the ambit of the IMCO Committee. In this context, the general impact of the EEA model, the tailor-made model and the WTO model on key pieces of the currently existing acquis communautaire in these policy areas are highlighted.

Resumen This report assesses the openness of public procurement markets in key third countries of interest to the EU. It provides a comparative overview of the regulatory and market access characteristics of the US, Brazil, India, China, Japans’ procurement markets, with reference to the procurement regulation and enforcement within the EU. The report assesses the available data on both the de jure and de facto levels of openness of these markets to put forward some conclusions of value to policy making both within the EU and in its trading relations with key third countries.
This assessment concludes that the lack of comprehensive comparable data on procurement contract awards, particularly at the sub-central level, is not a trivial challenge for policy makers. Nevertheless, it is evident that the liberalisation of procurement markets continues to take place on a strictly reciprocal basis – linked to the offensive interests of governments. Given the slow-down in negotiating mega-regional agreements with comprehensive procurement chapters, the WTO Government Procurement Agreement remains the most efficient and transparent forum for undertaking further liberalisation in public procurement.
From arbitration to the investment court system (ICS): The evolution of CETA rules

Resumen After a public consultation on proposed reforms to investment protection and the investor-dispute settlement framework of the Transatlantic Trade and Investment Partnership (TTIP) with the United States of America, the European Parliament requested the replacement of the traditional arbitration framework with a new court system. The European Commission and Canada subsequently renegotiated the relevant provisions of the Comprehensive Economic and Trade Agreement (CETA) to establish a new investment court system (ICS). The ICS departs substantially from the arbitration model, in particular on the appointment of judges. Procedurally the ICS remains similar to treaty-based arbitration proceedings and retains all the innovations introduced in the early draft of CETA. Those innovations aim, among other things, to prevent ‘forum shopping’ and abuse of the system. Some of the innovations introduced will require further decisions in CETA’s established Committees, such as on the code of conduct and decisions on appellate body judges. Some concerns raised regarding the basis for differences between ISDS and domestic court systems persist in the ICS context. These relate both to the different treatment between foreign and domestic investors, and to uncertainty regarding the compatibility of the ICS system with the principle of autonomy of the EU legal order. On this last point, however, the ICS framework can be distinguished for various reasons from past opinions on the European and Community Patent Court and the EU’s accession to the European Convention on Human Rights.

Resumen This paper examines the implications of the UK’s departure from the EU for the EU-UK legal relationship in the field of public procurement. It assesses, in comparison with the position under EU membership, the implications of four approaches found in the EU’s relationships with other trading partners: the EEA model; the GPA model; and, between these two, what we call an “EEA-minus” approach and a “GPA-plus” approach. It also notes the procurement-specific issues that may need to be addressed in any withdrawal agreement (or later transition arrangement).

Resumen Public procurement and the purchasing of services, works and supplies cover about 14 % of European gross domestic product (GDP). Procurement initiatives, tools and guidance therefore have tremendous power and make products and services greener and more sustainable. The assessment carried out in this study provides results on the applicability of ongoing initiatives and shows how they contribute to the European Commission´s Action Plan on the Circular Economy. With the proposed recommendations the involved parties are offered possibilities and options for a better approach in the future.

Resumen According to a recent evaluation of the Clean Vehicles Directive performed by the European Commission, the directive seems to raise concerns about whether the incentives included in it actually reach their intended aim, notably to increase the demand for and deployment of cleaner vehicles. Indeed, performing the evaluation was a complicated task, due to the significant data gaps that were found. This was particularly true when evaluating the implementation of the directive and its associated impacts, notably due to the lack of structural monitoring at EU or Member State level and the limited amount of published research and stakeholder positions available. Yet, regardless of the insufficient data, the directive appears to have had little impact with regard to incentivising a market uptake of clean vehicles and has therefore had a very limited impact on reducing the greenhouse gas emissions and air pollutants emitted from publicly procured vehicles. Ultimately, the Commission decided to revise rather than withdraw the directive, In this review process, the Commission would ensure that some appropriate reporting requirements are included in the directive. In addition, as there appear to be some barriers to the use of the monetisation methodology, the Commission would be able to consider to further develop the information available on the Clean Vehicle Portal and to provide contracting authorities with further guidance. Finally, the scope could be improved for making the directive more effective and efficient.

Resumen EU-Canada negotiations for a Comprehensive Economic and Trade Agreement (CETA) started in May 2009 and were declared concluded at the EU-Canada Summit on 26 September 2014. The agreement's overall aim is to increase flows of goods, services and investment to the benefit of both partners. For the EU, CETA represents the first comprehensive economic agreement with a highly industrialised Western economy. Except for a few sensitive agricultural products, the agreement would remove practically all tariffs on goods exchanged between the two partners. Canada would substantially open up its public procurement at both federal and sub-federal level, thereby eliminating a major asymmetry in access to each other's public procurement markets. The EU succeeded in securing protection for a large number of European Geographical Indications (GIs) on the Canadian market. Provisions on sustainable development should ensure that trade and investment do not develop to the detriment of, but rather support, environmental protection and social development. CETA was signed by the EU and Canada on 30 October 2016. The Council decision on signature was only reached after difficult discussions, so that a total of 38 statements and declarations by Member States, the Commission and the Council, as well as a Joint Interpretative Instrument accompany that Council decision. The European Parliament has launched the consent procedure, with Xxxxx Xxxxxxx (EPP, Latvia) as rapporteur. The vote in the Committee on International Trade (INTA) is scheduled for 24 January 2017, and the vote in plenary for the February part-session in Strasbourg (13 to 16 February). Second edition. Los autores están de acuerdo con el amplio consenso tanto por parte de la UE como parte de Chile en relación con la eficacia del Acuerdo de Asociación, pero señalan que, en caso de ampliar el acuerdo con Chile, se debería retomar la esencia de los antiguos acuerdos de la UE en lugar de limitarse a seguir el «modelo TLCAN». El estudio también incluye un análisis comparativo entre el acuerdo UE-Chile y los actuales acuerdos comerciales que la UE y Chile están negociando con terceros países.

En este contexto, se analizan las necesidades y expectativas, tanto de la UE como de México, con respecto a cualquier futuro acuerdo, haciendo especial hincapié en ámbitos que van más allá del comercio de bienes y servicios, tales como la contratación pública, la inversión y la cooperación regulatoria. Resumen This note seeks to provide an initial analysis of the strengths and weaknesses of the European Commission's Impact Assessment (IA) accompanying the above proposal, submitted on 12 December 2015 and referred to Parliament's Committee on Internal Market and Consumer Protection. While considerable effort has clearly been put into preparing this report and to providing information in a transparent manner, the length and level of detail do not always support clear analysis of the problem definition and clear explanation of the methodology. Although the Commission consulted widely on the issue of accessibility and made use of external expertise, the data used appears rather old. Moreover, the views of disabled citizens, who are meant to be the major end-beneficiaries of the proposal, are not explicitly apparent and could perhaps have been better reflected throughout the IA. A more detailed exploration of social considerations to counterbalance the largely economic analysis would have been welcome, despite the internal market focus of this proposal. Resumen The study points that reducing business costs and regulatory and market barriers is necessary to complete the Single Market. However, monitoring of barriers and costs in the EU is piecemeal and unsystematic, quantification and clear identification of barriers and costs is lacking, which makes prioritisation of policy actions difficult. Resulting costs of slow reform process and vague initiatives with uncertain time horizons in the area of e-commerce alone amount to
€748 billion. As indicated by examples of Estonia and South Korea, ICT and e-government can be particularly efficient in reducing these costs and barriers.

Resumen Corruption is a phenomenon with significant negative consequences for the EU and its Member States. This research paper uses a mix of methodologies to quantify the overall costs of corruption in the EU in economic, social and political terms. The findings, based on new analysis, suggest that corruption costs the EU between €179bn and €990bn in GDP terms on an annual basis. Current anti-corruption measures relevant to Member States and the EU as a whole are described and their effectiveness in reducing the levels of, and opportunities for, corruption are assessed. Eight potential areas for EU action are identified that might address the barriers to the effectiveness of current measures.
The costs of non-Europe are calculated in relation to two of these, as well as in relation to the implementation of recently created EU laws.

Resumen The Single Market remains incomplete despite the significant progress achieved since its creation in 1993. During the economic and financial crisis the project has been reinvigorated in an effort to create much needed growth and jobs. The majority of research indeed suggests that the Single Market has increased EU GDP and had many positive effects on the economy, such as the creation of new trade and intensifying investment and innovation. Some researchers argue, however, that the results delivered by the Single Market are below initial expectations and that trade and economic integration lost momentum, especially in pre-2004 Member States. Many hurdles, such as gaps in legislation, administrative obstacles, ineffective implementation and poor enforcement of EU law continue to prevent the unlocking of the full potential of a genuine European market where goods, people, services and capital circulate unhindered. Consequently, one of the ten main priorities of the current European Commission is the creation of a deeper and fairer Single Market. In order to revise and modernise the project, the Commission proposed a new Single Market Strategy comprising a set of targeted legislative and non-legislative actions to be launched in 2016 and 2017. The Strategy received mostly favourable comments from stakeholders, who welcomed its focus on implementation, enforcement, and facilitating SME growth and cross-border trade. They also stressed the need for the rapid tabling of concrete proposals.

Resumen Las diez rondas de negociaciones sobre la Asociación Transatlántica de Comercio e Inversión UE-EE.UU. (ATCI) celebradas en los dos últimos años han dado pocos resultados. Desde que se iniciaron las conversaciones —que generaron muchas expectativas— en junio de 2013, los negociadores han evitado abordar contenidos reales o tratar cuestiones difíciles. Los objetivos políticos del mandato de la UE y los expresados por el Parlamento Europeo en su reciente Resolución sobre la ATCI, así como los objetivos del Congreso de los EE.UU. tal como se especifican en la Trade Promotion Authority (TPA) Act (Ley sobre la autoridad para promoción del comercio (APC)) han sido claros: todos recomiendan eliminar los aranceles y desmantelar las barreras no arancelarias para avanzar en la liberalización de los mercados transatlánticos y promover unos índices más elevados de crecimiento y creación de empleo. A principios de octubre de 2015, las Partes negociadoras presentaron por fin propuestas actualizadas sobre cómo eliminar los aranceles. También tendrán que presentar propuestas sobre el acceso a mercados de contratación pública e iniciar conversaciones sobre el nuevo Sistema de Tribunales de Inversiones (STI), como propuso la comisaria de Comercio Xxxxxxx Xxxxxxxxx el 16 de septiembre de 2015. La Asociación Transpacífica (ATP), el otro gran acuerdo comercial que ha tenido ocupados a los negociadores estadounidenses (de hecho, en mayor medida que la ATCI), se acordó el 5 de octubre de 2015. Habrá que agilizar considerablemente el proceso si se quiere concluir las negociaciones de la ATCI antes de que el presidente estadounidense Xxxxxx Xxxxx abandone el cargo, habida cuenta de que el proceso de negociación podría verse afectado con la entrada de un presidente menos favorable al comercio.

Resumen Between 2012 and 2014, EU Member States awarded 113,749 contracts, related to EU funds, amounting to 116.17 billion EUR. Approximately 90% of these contracts (by value) were awarded to contract operators within the respective Member State. There were 2,882 cross-border contracts amounting to approximately 9.14 billion EUR. Italy and Spain accounted for 35% of all cross-border contracts by value. Poland, Romania, and Slovakia were the top cross-border buyers (5.5 billion EUR). Road infrastructure contracts dominated (by value) cross-border contracting in Poland, and rail-related contracts were predominant in Hungary.

It has been drafted following the Internal Market and Consumer Protection (IMCO) Committee's first "scrutiny session" with the European Commission, on 23rd June 2015, focussing on this directive.

Resumen Against the backdrop of the long-term decline in European defence budgets, the deteriorating security context just beyond Europe's borders and the worsening relationship with Russia have been seen as providing a wake-up call to European leaders regarding the necessity to adapt the EU's foreign and security policy to the new challenges and deepen their defence cooperation. At the major debate on defence scheduled to take place at the June 2015 European Council meeting, the EU's Heads of State or Government are expected to assess the progress achieved so far in the area of security and defence, and task the High Representative/Vice-President of the Commission with the review of the 2003 European Security Strategy. However, expectations of the outcome on security and defence issues have not been raised too high, not least given the other significant points on the agenda of the European Council (fight against terrorism, the Transatlantic Trade and Investment Partnership, euro area economic governance). The most recent Council Conclusions on CSDP, of 18 May 2015, will most probably represent the basis for discussions and for the outcome. On the other hand, a series of proposals on how to effectively boost European defence cooperation, including from the President of the European Commission, some EU Member States, as well as the defence industry and various think-tanks, might still raise the level of ambition of the European Council decisions.

There is an opportunity to negotiate better access for EU suppliers. Resumen Over recent decades Civil Society Organisations (CSOs) – a term used to capture all forms of collective organisation outside the government and business sectors – have grown in both number and impact on policy-making, both at EU and national levels. In consequence, CSOs have come under pressure to demonstrate that they use the public resources they are given in an efficient, accountable and transparent manner.
A number of proposals to address these topics have been discussed over the years. However, only a few of those proposals have been translated into law; and even fewer of these, after being implemented, have offered an effective solution to the issue of financial accountability of the third sector. The debate between scholars, institutions and practitioners is still ongoing. In the meantime, the third sector at the European level remains regulated by a combination of European norms, quasi-legal tools, and self-regulatory initiatives.
Efforts to tackle financial mismanagement by CSOs are frustrated by the absence of clear legal definitions at EU level, by the opacity of the information available on CSOs through EU databases and by excessive bureaucracy.

Resumen In its conclusions on the Common Security and Defence Policy, the December 2013 European Council stressed the importance of ensuring the full and correct implementation and application of the two defence Directives of 2009. The present study intends to provide the Parliament with an initial perspective regarding the state of implementation of the Directive 2009/81/EC on defence and security procurement (Part.1) and the Directive 2009/43/EC on intra-European Union transfers of defence-related products (Part.2). It undertakes a first assessment of national practices, through qualitative and statistical analysis. It identifies the complex points and obstacles, which, if not overcome, may well call into question the Directives’ expected beneficial effects.

Resumen The term 'public-private partnership' (PPP) is used to describe a broad and varied spectrum of cooperative relationships between public actors (governments, agencies and international organisations, or a combination thereof) and private actors (companies or not-for-profit entities). There is therefore no standard global definition of precisely what a PPP is. PPPs have increased in number over the past decade. This has given rise to concerns regarding the exposure of PPPs to the risk of conflicts of interest. Such risks may arise, for example, with the possibility that preference is given to national tenderers or applicants whenever a contract is awarded by the public contracting authorities; or through the possibility that weaker actors may be excluded from participating in a PPP because of the preference given a priori to stronger actors. The EU attempts to strike a balance by combining broad definitions of conflicts of interest with a number of legal tools tailored to identifying, managing and resolving specific conflicts. The legal tools currently in place to avoid conflicts of interest in this context can be divided into two broad categories. Hard- law tools include provisions for ensuring that public officials perform their duties in a fair and unbiased way. These rules apply along the entire decision-making process concerning PPPs. To complement such rules, a vast array of soft-law tools is also in place, including criteria to guide decisions of public actors on support to enterprises or financial intermediaries, support for internationally recognised guidelines and principles, and commitment towards voluntary initiatives to increased fiscal transparency.

Resumen The EU-Canada Comprehensive Trade and Economic Agreement (CETA) – covering a plethora of issues, including market access, tariffs and non-tariff barriers – has elicited varied reactions from stakeholders. Business associations on both sides of the Atlantic have strongly supported the deal and its aim to boost economic relations between the partners. On the other hand, some civil society groups, trade unions and agricultural associations have voiced hesitations about some of the deal’s provisions and its impact on the agricultural sector, the job market and quality of public services. CETA negotiations have also provided civil society an opportunity to discuss indirectly related issues, including visa policies, data privacy and the EU ban on the trade in seal products. Both the European and Canadian Parliaments have actively monitored the negotiations and provided opportunities for stakeholders to express their opinions. While consultation and public outreach now appears to have resolved most hurdles, criticism about the negotiations’ transparency and inclusiveness – as well as concerns about the inclusion of investment protection clauses – have not entirely abated. Turkey and Canada’s partners in the North American Free Trade Agreement (the US and Mexico) also have distinct reasons to fear the impact of CETA on their own economies.

Resumen This study offers a series of provisional estimations of the potential gains to the European Union economy that could be generated over time from pursuing the ten-point plan presented by Xxxx-Xxxxxx Xxxxxxx to the European Parliament before he was elected President of the European Commission in July 2014. It forms part of a series of studies being undertaken on the potential added value from European-level initiatives advocated in resolutions of the European Parliament. The text covers seven of the ten guidelines proposed by the Commission President, where quantification can be attempted: A deeper and fairer Internal Market with a strengthened industrial base; A connected Digital Single Market; A deeper and fairer Economic and Monetary Union; A resilient Energy Union with a forward- looking climate change policy; A reasonable and balanced Free Trade Agreement with the United State; Europe as a stronger global actor; An area of justice and fundamental rights based on mutual trust. This attempt to quantify the economic potential of the political guidelines presented by Xxxx-Xxxxxx Xxxxxxx, can be read in conjunction with the exercise of Mapping the Cost of Non-Europe 2014-19, which has so far been published by the European Added Value Unit in March and July 2014.

Resumen The Comprehensive Economic Trade Agreement (CETA) between the EU and Canada, on which negotiations were concluded at the EU-Canada Summit in Ottawa on 26 September 2014, will be a 'first' in many areas. The agreement will be the EU's first with another highly industrialised country to facilitate market access for goods, services and investment by abolishing almost all tariffs and reducing a wide array of non-tariff barriers. CETA is also the first agreement to have been negotiated with a sound chapter on investment protection, (including Investor-State Dispute Settlement (ISDS) provisions) – an area that is, since the entry into force of the Lisbon Treaty, an EU competence. The EU and Canada have agreed to improve regulatory cooperation without compromising existing safety standards, and CETA includes protection for more than 145 food products with geographical indications (GIs). The agreement preserves the governments' right to regulate in the public interest.
The European Parliament will be asked to give its consent to this agreement and to the parallel Strategic Partnership Agreement (SPA) – a process that is likely to take two years. This will give the Parliament sufficient time to weigh potential public concerns – which today are focussed principally on trade and investment negotiations with the US, but may spill over onto this agreement with Canada.

Resumen Cost of Non-Europe Reports identify the possibilities for economic or other gains and/or the realisation of a ‘public good’ through common action at EU level in specific policy areas and sectors. This Cost of Non-Europe Report seeks to analyse the costs for citizens, businesses and relevant stake-holders of remaining gaps and barriers in the European Single Market, building on and updating the 1988 Cecchini Report, which quantified its potential benefits. One of the key benefits of the Single Market was expected to arise in the context of public procurement. This particular study - the fourth in a series - updates the analysis presented in the Cecchini Report, estimates the value of savings to the public purse that have been achieved to date through European legislation on public procurement, and discusses the extent to which future savings might be achieved (in particular following approval of the proposals for new public procurement directives in January 2014).

Resumen The US Congress is mandated by the US Constitution to exercise a regulatory and oversight role in international trade.
It also has a role to play in negotiating external trade agreements, exercising its oversight, legislative and advisory functions. To date, the Congress has played an active role in the negotiations on the Transatlantic Trade and Investment Partnership (TTIP), overseeing the negotiations, gathering the views of key stakeholders during hearings and events it has organised, and flagging issues it considers politically important. While the US Congress has been broadly supportive of the negotiations, there appears to be no political consensus at the moment on the key issues under consideration, including the potential desirability and likely impact of the measures under discussion.

Resumen This research paper examines the appropriateness and validity of the methodology behind the European Commission’s Impact Assessment (IA) of the Transatlantic Trade and Investment Partnership (TTIP), focusing in particular on the underlying economic model, a computable general equilibrium (CGE). The methodology applied by CEPR for this economic modelling is analysed in depth, together with the assumptions used to make the TTIP amenable to an economic appraisal. The research paper also compares the IA on the TTIP with selected previous empirical economic assessments of EU trade agreements and with a set of alternative studies on the TTIP itself. In reading our findings, two central caveats should be kept in mind that affect any analysis of the CGE model included in the European Commission's Impact Assessment. First, the TTIP is a rather unusual bilateral trade agreement; and second, the TTIP is so wide-ranging that an alternative approach, such as the so-called 'partial' (equilibrium) approach
– already a second-best solution – would be totally inappropriate to the case under examination.

Resumen Despite the global economic crisis of 2008 and the spectacular rise of new emerging powers, the European Union (EU) remains one of the world's leading economies.
The EU's trade policy has fundamentally changed in recent years. One of the founding and most influential members of the World Trade Organisation (WTO), the EU has been compelled to acknowledge that the multilateral approach that it had adopted for many years has not yielded genuine progress. In response, the EU launched a new strategy to combine its multilateral approach with renewed efforts to forge bilateral trade deals.
The traditionally technocratic approach of the EU’s trade policy was radically changed by the entry into force of the Lisbon Treaty in 2009; with this treaty, the Commission lost its unilateral control in the domain, while the European Parliament gained an important voice.

Resumen The report 'Preparing for Complexity - The European Parliament in 2025', presented by the Secretary General of the European Parliament in January 2013, identified the core set of problematic issues in defence policy as a) duplication,
b) lack of a common strategic view and c) lack of a clear vision for the future.
The purpose of this paper is to develop these considerations and to focus on the benefits of greater cooperation at European level. Setting out the economic argument of the added value of Europe in defence, and the current cost to the Member States of ‘non-Europe’, can highlight the need to build on the structures, systems and under-utilised legal bases that have been put in place in recent years.
Cost of Non-Europe reports examine policy areas or sectors of strategic importance where the possibilities for greater efficiency or the realisation of a 'public good' through common action at EU level are potentially significant. The case for more Europe is perhaps more compelling in defence than in almost any other policy area, given that no single Member State can achieve an optimal level of security without cooperation. The costs involved go beyond the purely economic, and include political and opportunity costs.

Resumen This paper assesses the substance of EU preferential trade agreements compared to those of the United States, EFTA and Japan. The topic is important because of the growth of PTAs but also because PTAs are destined to remain at centre stage. The debate on PTAs is not therefore about whether and how they might grow in importance but rather how they reflect trade policy preferences of the parties and how preferential and multilateral approaches will interact. While PTAs can promote liberalisation in particular sectors and help generate economic growth, preferential liberalisation will always be second best to multilateral liberalisation on an MFN basis because of the trade and investment diversion inherent in preferential deals. In this light, the paper proposes policy recommendations for the EU, covering, first, the broad objectives and desired outcomes of EU trade policy in general, second, the overall framework of EU PTA policy; and third, specific, sectoral, goals of EU PTA policy.

Resumen The project ‘Security of eGovernment systems’ aimed at assisting policymakers in discerning policy options for meeting future challenges in securing eGovernment systems. The project focused on upcoming challenges of eGovernment security in delivering public services across borders. Through identifying key security barriers and enablers, the project points to promising avenues of policy development in an environment of rapidly changing ICTs and changing socio-economic concerns in the EU.

Resumen This note seeks to provide an initial analysis of the strengths and weaknesses of the European Commission's Impact Assessment (IA) accompanying its proposal to the Council to authorise the opening of negotiations on a Transatlantic Trade and Investment Partnership between the European Union and United States of America, submitted on 12 March 2013.
The European Union and the Unites States together account for about half of the world GDP (47%) and one third of global trade flows. They are each other's main trading partners and enjoy the largest bilateral trade relationship in the world.
On 13 February 2013, the EU and the US leaders decided to take their economic relationship to a higher level by agreeing to launch negotiations for a comprehensive trade and investment partnership, which will aim to go beyond the classic approach of removing tariffs and opening markets on investment, services and public procurement. According to the Commission, the successful conclusion of such an agreement, which would be the biggest bilateral trade and investment deal ever negotiated, could add 0.5% to the EU's annual economic output.

Resumen Ensuring that public procurement markets are transparent and open to international competition is one of the most challenging aspects of trade policy. Countries may have statutory or de jure preferences for national companies or more likely, purchasing entities exercise de facto discrimination in favour of local suppliers. The Single Market Programme has resulted in public procurement in the EU become relatively transparent and thanks to liberal investment policies foreign suppliers can freely established in the EU to serve procurement markets. The EU has also made commitments under the Government Purchasing Agreement (GPA) that are more or less in line with the coverage of the EU Directives. As a consequence it has sought to persuade other WTO members to make equivalent commitments, but with only partial success. Some progress has been made at the plurilateral level in the shape of greater coverage by existing signatories to the GPA. The EU has also managed to negotiate the inclusion of public procurement in recent free trade agreements (FTAs), but access to major emerging markets such as India, China and Brazil remains an issue. After a good deal of debate the Commission has proposed the draft Regulation with the aim of harmonising the treatment of third country suppliers by EU purchasing entities and enhancing the EU’s leverage in negotiations. The Regulation will serve the purpose of enhancing EU leverage, but experience with previous efforts to open markets suggests that genuine competitive procurement markets requires ‘buy in’ on the part of key economic and political interests in the country concerned. It is not clear that this is the case in the emerging markets or developing countries. Although there are difficulties measuring how open markets, are issues of reciprocity for the EU arise in selected sectors rather than the EU procurement market being generally more open than other major markets. Resumen A growing proportion of European citizens care more and more about contributing towards sustainable economic and social development in developing countries through their purchasing preferences, notably buying fair trade. This concern of consumers for fair trade, more common in western European Member States than in the rest of the EU, has been relayed by civil society, local authorities, and also echoed at EU level by the EU institutions, notably the European Parliament.

Resumen Este estudio investiga la relación entre dos grandes áreas de interés público: contratación pública y política de cohesión. Comienza explicando cómo y cuándo se aplica la contratación pública en el contexto de la política de cohesión. Más adelante, se analiza la situación actual en la UE, la transposición de los reglamentos de contratación en las legislaciones nacionales y las reformas que se están llevando a cabo dentro del ámbito legal. El tema principal de este estudio es la importancia de la contratación en la política de cohesión de la UE. Se han utilizado también ejemplos representativos de experiencias prácticas que sirven de complemento a la información obtenida a través del trabajo documental. Además, para redactar la serie de recomendaciones que se encuentra al final del estudio, han sido de utilidad varias entrevistas con profesionales de la política de cohesión.

Resumen European standards can contribute to the development of the European internal market. EU standardisation is managed by independent organisations promoting cooperation amongst industry, users, public authorities and other interested parties on a voluntary basis. Despite the European Standardisation System's success, there are a number of challenges still to be addressed: greater participation of societal stakeholders in the standardisation process; use of standards in the services sector; improved access to EU standards; use of standards in public procurement; and reinforcement of EU's role in international standardisation.
