Póliza de Responsabilidad Civil en EUA y Canadá (Excepto Alaska y Hawái) para Vehículos Registrados en México.

Los riesgos que pueden ampararse bajo esta póliza se definen en la cláusula primera de las condiciones generales de la cobertura y los términos de la contratación de este contrato, quedando sujetas a los límites máximos de responsabilidad que se indica en la carátula de esta póliza.

La vigencia del presente contrato se establece en la carátula de la póliza.

Para la interpretación y efectos del presente contrato, ambas partes quedan sujetas a la manera y términos acordados.

DEFINICIONES ‌

Para efectos de este contrato, las partes convienen en adoptar las siguientes definiciones:

1. Accidente Automovilístico: Colisiones, vuelcos y todo acontecimiento que provoque lesiones a una persona, y/o daños físicos a cualquier bien, incluyendo al Vehículo Asegurado producido por una causa externa, violenta, fortuita y súbita, ajena a la voluntad del Asegurado y/o conductor derivado del uso o conducción del Vehículo Asegurado.

2. Asegurado: La persona cuyo nombre y domicilio aparece en la carátula de la póliza o la persona que maneje el vehículo asegurado con el consentimiento expreso o tácito del propietario del mismo.

3. Ocupante. Cualquier persona dentro, entrando o bajando del vehículo asegurado con el consentimiento del asegurado. No se considerará ocupante a la persona que se encuentre sobre, subiendo o bajando de cualquier parte exterior del vehículo asegurado.

4. Daños corporales a terceros. Lesiones corporales, malestar, enfermedad o muerte como resultado del siniestro.

5. Daños materiales a terceros. Daños físicos, destrucción o pérdida de la(s) propiedad(es) de los terceros debido a un accidente con el vehículo asegurado.

6. Remolque: Vehículo con eje delantero y/o trasero no dotado de medios de propulsión y destinado para ser jalado por un vehículo automotor con fines recreativos.

7. Domicilio habitual: Se entiende como el domicilio habitual del Asegurado durante la vigencia de la póliza de seguro.

8. Terceros. Aquellos afectados por daños materiales o lesiones por el siniestro amparado por la póliza y que no son ni ocupantes ni el conductor del vehículo asegurado al momento del siniestro.

9. Vehículo asegurado. El automóvil de uso particular descrito en la carátula de la póliza, el

11. Turista. Ciudadano no estadounidense. Con una estancia en EE. UU. no mayor de 30 días consecutivos. Que no sea estudiante a tiempo completo ni tenga ningún tipo de empleo en EE. UU. Sin licencia estadounidense o canadiense.

CLÁUSULA 1a. ESPECIFICACIÓN DE COBERTURAS‌

1.1 RESPONSABILIDAD CIVIL ‌

Esta cobertura ampara los daños materiales o lesiones a terceros, por los cuales el asegurado sea legalmente responsable a consecuencia de un accidente automovilístico

Asimismo, en caso de una demanda civil contra el asegurado, la Compañía se compromete a defenderlo o a pagar los gastos y honorarios del juicio, e incluso a indemnizar los daños y perjuicios cubiertos en los términos de esta póliza de seguro de responsabilidad civil en el extranjero.

La compañía pagará todos los gastos legales de defensa en que se incurran. La responsabilidad de la compañía termina cuando el límite de responsabilidad para esta cobertura haya sido agotado. La compañía no cubrirá los daños materiales y/o lesiones a terceros que no estén cubiertos por la póliza de seguro de responsabilidad civil en el extranjero.

Asimismo, la compañía pagará al asegurado hasta $100 dólares americanos por día de trabajo perdido como consecuencia de asistir a audiencias o diligencias que se requieran, con un máximo de 5 días y presentando la documentación correspondiente que acredite su asistencia a dichas audiencias o diligencias.

Este contrato cubre la responsabilidad civil de cualquier remolque o equipo móvil de fines recreativos siempre y cuando se encuentre enganchado al vehículo asegurado y no exceda de 1500 libras de su capacidad de carga. No incluye casas rodantes.

Límite máximo de responsabilidad.

El límite máximo de responsabilidad de la compañía en esta cobertura se establece en la carátula de la póliza y opera como suma asegurada única para los diversos riesgos que se amparan en ésta.

Extensiones de Cobertura Estatal.

Mientras un automóvil asegurado esté en uso en cualquier estado de los Estados Unidos, aplicará lo siguiente: (1) Aumentaremos el Límite de Seguro para Cobertura de Responsabilidad Civil para cumplir con el límite o límites especificados por una ley de responsabilidad financiera

Exclusiones particulares Esta póliza no cubre:‌

1. Los vehículos que no sean residentes en México y cuyas placas no sean nacionales.

2. Los vehículos que no están incluidos en esta póliza.

3. Daños materiales o lesiones a terceros causados intencionalmente por el asegurado.

4. Daños materiales a bienes que sean propiedad del asegurado, del conductor, de sus familiares, empleados y/o representantes bajo su custodia o responsabilidad dentro del vehículo asegurado o vehículos involucrados. Así mismo, como lesiones a personas que residan en el mismo domicilio que el Asegurado.

5. Daños causados por el vehículo asegurado al utilizarlo como transporte público, de alquiler o de mercancías.

6. Vehículos diseñados para transitar fuera de caminos convencionales y que no estén sujetos a la matriculación de automóviles.

7. Cuando el vehículo de uso personal es empleado para negocios.

8. Cuando el vehículo sea usado para transportar cualquier tipo de material peligroso.

9. Los daños que cause el vehículo asegurado cuando:

a) Participe en competencias o pruebas de seguridad, de resistencia o velocidad.

b) Se utilice para fines de enseñanza o instrucción de su manejo o funcionamiento.

10. A las personas que se encuentren sobre, subiendo o bajando de la caja abierta del vehículo asegurado.

11. Daños causados por el sobrecargo del vehículo asegurado o someterlo a tracción excesiva con relación a su resistencia o capacidad. En estos casos, la compañía tampoco será responsable por daños causados x xxxxxxx, avenidas, cualquier vía pública y objetos o instalaciones subterráneas, ya sea por vibración o por el peso del vehículo o de su carga

12. Indemnizaciones al Asegurado por discapacidad, prestaciones por incapacidad o cualquier concepto mencionado por la Ley, como desempleo o leyes similares vigentes en el lugar del accidente.

B. Para efectos de esta cobertura, Asegurado o Persona Asegurada, significa:

1. La persona nombrada en el certificado de seguro de Qualitas Insurance Company o cualquier miembro de su familia mientras ocupen el vehículo asegurado o sean golpeados por un vehículo no asegurado; y/o

2. Cualquier otra persona ocupando el vehículo asegurado si éste está involucrado en un accidente con un vehículo no asegurado.

C. Vehículo no asegurado

I. Un vehículo no asegurado se refiere a un vehículo automotriz o remolque:

1. Que no tiene una póliza de seguro o fianza de responsabilidad vigente al momento de ocurrir el accidente.

2. Cuyo operador o propietario no puede ser identificado y que golpee:

a. A la persona nombrada en el certificado de seguro de Qualitas Insurance Company o algún miembro de su familia;

b. Un vehículo que la persona nombrada en el certificado de seguro de Qualitas Insurance Company o algún miembro de su familia estén ocupando; o

c. El vehículo descrito en el certificado de seguro de Qualitas Insurance Company.

3. Para poder obtener pago bajo este beneficio, si algún vehículo causa alguna lesión al asegurado y el propietario o conductor de dicho vehículo no puede ser identificado, un contacto físico real debe haber ocurrido entre el vehículo no identificado y la persona o propiedad del asegurado.

4. Que tenga una póliza o fianza de responsabilidad, pero cuya aseguradora o afianzadora se haya vuelto insolvente o haya negado cobertura respecto del accidente

5. Con seguro insuficiente. Esto significa un vehículo tiene una fianza o póliza de responsabilidad vigente y que provee cobertura al momento del accidente, pero cuyos límites de responsabilidad:

a. Son inadecuados para pagar el monto total de los daños que el asegurado legalmente tiene derecho a recuperar; o

b. Han sido reducidos por pagos de reclamaciones de forma tal que el asegurado no puede recuperar totalmente los daños a los que dicho asegurado tiene legalmente derecho

II. Un “vehículo no asegurado” no incluye a los siguientes tipos de equipo o vehículos:

1. Un vehículo propiedad del asegurado o conductor o de algún miembro de su familia que no

fines de lucro).

3. Por daños físicos mientras se esté conduciendo, ocupando o usando un vehículo propiedad del asegurado o conductor o de algún miembro de su familia que no esté enlistado en el certificado de seguro de Qualitas Insurance Company.

4. Por lesiones corporales derivadas de actos intencionales. La exclusión solo aplica a aquella persona cuyos actos intencionales le han causado un daño físico a sí misma.

5. Directa o indirectamente para beneficiar a algún asegurador o auto asegurador bajo alguna ley de compensación a empleados o similar.

6. Directa o indirectamente para beneficiar a conductores que aseguren propiedades.

7. Por los primeros 250 dólares causados como daño a la propiedad de cualquier asegurado como resultado de cualquier accidente.

8. A cualquier persona conduciendo u ocupando el vehículo asegurado sin el permiso del asegurado. (Esta exclusión no aplica a los miembros de la familia del asegurado o conductor del vehículo asegurado).

9. Para cualquier persona conduciendo el vehículo asegurado sin una creencia razonable de que dicha persona tiene derecho a hacerlo. (Esta exclusión no le aplica al asegurado o a algún miembro de su familia mientras utilicen el vehículo asegurado).

Límite máximo de responsabilidad.

A. Limitado a cantidades establecidas en el certificado de seguro de Quálitas Insurance Company. El límite de responsabilidad “por persona” indicado en el certificado es el máximo que la compañía pagará por todas las lesiones causadas por alguna persona en un solo accidente automovilístico. De igual manera, el límite de responsabilidad “por accidente” indicado en el certificado para beneficio de automovilistas no asegurados o con seguro insuficiente es el máximo que la compañía pagará por todas las lesiones causadas por un solo accidente automovilístico, independientemente del número de personas lesionadas.

B. El límite de responsabilidad está sujeto a pagos por personas legalmente responsables. Sujeto a los límites máximos establecidos en el certificado, el límite de responsabilidad de la compañía será el que resulte menor entre:

d) Servicio de ambulancia terrestre: Gastos por su uso.

e) Gastos funerarios.

Límite Máximo de Responsabilidad.

El límite máximo de responsabilidad de la Compañía en esta cobertura se establece en la carátula de esta póliza para cada persona por las lesiones físicas que hayan sufrido los ocupantes del vehículo asegurado y por cada evento o accidente, en caso de que el número de ocupantes rebase el establecido en la tarjeta de circulación del vehículo asegurado, el límite de responsabilidad se determinará en forma proporcional al número de ocupantes que resulten lesionados, sin sobrepasar la suma asegurada por accidente contratada.

Exclusiones Particulares Esta póliza no cubre:

1. Los gastos médicos o funerarios de los ocupantes del vehículo asegurado cuando éste sea utilizado para transporte público o transporte de mercancías.

2. A los ocupantes del vehículo asegurado cuando éste sea utilizado como lugar de residencia o alojamiento.

7. Los gastos médicos o funerarios de los ocupantes del vehículo asegurado, cuando transite fuera de caminos convencionales.

8. Los gastos médicos o funerarios del asegurado cuando el vehículo sea empleado en los negocios, incluyendo, entre otros:

a) Ventas

b) Reparaciones

c) Inspecciones

d) Almacenamiento

e) Distribución de productos

9. Daños al vehículo cuando:

a) Participe en competencias o pruebas de seguridad, de resistencia o velocidad.

b) Se utilice para fines de enseñanza o instrucción de su manejo o funcionamiento.

10. Lesiones corporales causadas a cualquier persona que use el vehículo asegurado sin el consentimiento expreso o tácito del asegurado.

11. Lesiones corporales sufridas por el o los ocupantes del remolque asegurado o del equipo móvil.

1.4. COBERTURA DE ASISTENCIA VIAL QUALITAS ‌

La Asistencia Vial de Emergencia está disponible las 24 horas del día, todos los días del año en los Estados Unidos de América y Canadá (excepto Alaska y Hawái). La cobertura comienza desde la fecha que aparece en la póliza que incluye este beneficio de Asistencia Vial de Emergencia de 24 horas y termina con el vencimiento de su póliza, salvo su previa cancelación.

A continuación, listamos las emergencias o servicios amparados sujetos a los trescientos dólares ($300.00) máximo por evento de remolque, colisión y asistencia de extracción y cien dólares ($100.00) máximo por evento para todos los demás beneficios de asistencia vial. Habrá un límite de dos (2) eventos por cada uno de los siguientes beneficios cubiertos en un período de doce

(12) meses de cobertura:

(1) Asistencia de remolque – Cuando el remolque sea necesario, el vehículo cubierto será remolcado al centro de servicio más cercano o cualquier ubicación solicitada por el asegurado, dentro de USA y hasta $300.00 dólares límite máximo de beneficio por evento.

(2) Asistencia por colisión – Si el vehículo cubierto está involucrado en una colisión o accidente y la asistencia de remolque sea requerida, Driven Solutions NO proporcionará ayuda para llevar su vehículo al taller más cercano o a cualquier lugar solicitado por el asegurado.

(3) Asistencia de extracción – La extracción de un vehículo se prestará cuando el vehículo cubierto quede atascado en una zanja o en otra área inaccesible, siempre y cuando dicha ubicación este máximo a cincuenta (50) pies de un camino pavimentado o carretera. El servicio de extracción no está cubierto cuando se conduce el vehículo cubierto fuera de una carretera o en superficies no pavimentadas.

(4) Servicio de batería – En caso de un fallo de batería, se pasará corriente para encender el vehículo.

(5) Asistencia para un neumático ponchado – El Servicio consiste en quitar el neumático ponchado del Vehículo Cubierto y su sustitución por un neumático de repuesto que se encuentre con el Vehículo Cubierto.

(6) Prestación de servicios para combustible, aceite, líquido y agua – Provee la entrega de un suministro de emergencia de combustible, aceite, líquido (marca indistinta) o agua para el vehículo cubierto en el sitio cuando el vehículo cubierto tiene una necesidad inmediata. Usted deberá pagar el costo del combustible u otro líquido a la entrega del mismo

(7) Asistencia de cerrajero - Si sus llaves están encerradas en el interior de su vehículo cubierto, se prestará asistencia para poder entrar al vehículo cubierto.

Remolque o servicio en las carreteras sin mantenimiento periódico, tales como playas de arena, campos abiertos, bosques y áreas designadas como no transitable debido a la construcción. Remolque por orden de un oficial de la ley relacionado a la obstrucción del tráfico, embalse, abandono, estacionarse ilegalmente, u otras violaciones de la ley. Servicios recibidos independientemente de Driven Solutions sin autorización previa de Driven Solutions Servicios Repetidos de un vehículo cubierto en la necesidad de mantenimiento de rutina o reparación. Sólo dos (2) Servicios Cubiertos por periodo de doce (12) meses de cobertura. ESTE SERVICIO DE ASISTENCIA VIAL NO ES REMBOLSABLE.

1. Solicitud de asistencia.

En caso de requerir asistencia y antes de tomar cualquier acción, el asegurado deberá llamar a los teléfonos de asistencia de RAMC que se le proporcionen, facilitando los siguientes datos:

a) Indicar el número telefónico donde RAMC podrá contactar con el asegurado o su representante, así como todos los datos que el gestor de asistencia le solicite para localizarlo.

b) Nombre y número del certificado o póliza asegurado.

c) Indicar el lugar donde ocurrió el incidente.

d) Descripción de los eventos sucedidos.

e) Si es familiar, indicar el parentesco.

f) Nombrar su abogado al designado por XXXX (en el caso en que aplique).

g) Proporcionar los elementos necesarios para encontrar la ubicación de la situación que requiere asistencia, así como cooperar con el debido seguimiento del asunto, acudiendo ante las autoridades respectivas.

h) Abstenerse de negociar o realizar gastos sin consultar primero con RAMC.

i) Notificar a RAMC cualquier cambio de domicilio.

j) El equipo médico y jurídico de XXXX tendrán libre acceso al historial y expedientes clínicos, así como a los antecedentes penales del asegurado para conocer su situación. Si tal acceso les

1. SOLICITUD DE ASISTENCIA. En caso de que se requiera asistencia y antes de tomar cualquier acción, el asegurado debe llamar a RAMC al 0-000-000-0000 dentro de los Estados Unidos y brindar la siguiente información:

1. Nombre completo del asegurado

2. Número de póliza de su seguro de automóvil y vigencia.

3. Indicar el lugar donde se encuentra y el número de teléfono en el cual se le puede contactar, o bien todos los datos necesarios para localizarlo y que el operador solicite.

4. Describir detalladamente el problema y el tipo de ayuda que se requiere.

2. PRECAUCIONES O MEDIDAS DE SEGURIDAD: el beneficiario y/o acompañante(s) están obligados a ejecutar todos los actos que tiendan a evitar o disminuir las situaciones de asistencia, así como abstenerse de hacer negociaciones o gastos sin haber consultado a RAMC previamente.

2.1. No se pagará el rembolso de los servicios contratados por el Asegurado sin el previo consentimiento de RAMC y sin que cumpla con los requisitos que se mencionan en la presente póliza, salvo en el caso de comprobada fuerza mayor que le impida comunicarse con la misma o con los terceros encargados de prestar dichos servicios.

3. RECLAMACIONES: Cualquier reclamación que resulte de un EVENTO y/o relativa a una situación de asistencia deberá ser presentada antes de salir de E.U.A. inmediatamente por teléfono al número sin costo designado en la póliza. Toda la documentación requerida deberá presentarse por escrito dentro de los 90 días naturales de la fecha en que se produzca el evento. RAMC efectuará los pagos e indemnizaciones a que se refiere esta póliza, siempre que ello no genere lucro para los asegurados.

EXCLUSIONES:

No se proporcionarán los beneficios de asistencia descritos en los siguientes casos:

a) Cuando el beneficiario y/o ocupante(s) no proporcionen información veraz y oportuna, que por su naturaleza no permita atender debidamente la situación.

b) Cuando el beneficiario y/o ocupante(s) no acrediten su personalidad como derechohabiente del servicio de asistencia.

c) Cuando el beneficiario y/o ocupante(s) incumplan cualquiera de las obligaciones indicadas en esta póliza.

de acuerdo con lo estipulado en esta póliza, no será en ningún caso responsable por las deficiencias en que incurran tales proveedores, no obstante que los mismos sean elegidos por Qualitas, cuenten con la adecuada titulación y sean competentes según los niveles del servicio del lugar, momento y circunstancia en que se presten los servicios.

m) No se considera avería para el servicio xx xxxx, bloqueo por alarma, servicios de mantenimiento, revisiones al automóvil, reparaciones mayores y reparaciones de partes realizadas directamente por el usuario o por terceros cuando éstas influyeran directamente en el accidente o descompostura del vehículo asegurado, baterías descargadas, gasolina, automóvil atascado en charcos y en arena.

n) No se remolcará el vehículo amparado con carga o con heridos, ni se harán maniobras si se encuentra atascado o atorado en baches o barrancos.

ñ) La fuga del usuario del lugar de los hechos.

o) Violaciones directas al Reglamento de Tránsito vigente y aplicable en la entidad federativa y/o a la Ley General de Vías de Comunicación aplicable y vigente en el lugar en que se encuentre.

Quedan excluidos los servicios cuando sean derivados directa o indirecta de:

i. Situaciones de asistencia ocurridas durante viajes realizados por el beneficiario y/o acompañante(s) en contra de la prescripción de un médico.

ii. Por suicidio y/o lesiones o secuelas ocasionadas por la tentativa del mismo.

iii. Por enfermedades o estados patológicos producidos por consumir voluntariamente alcohol, drogas, substancias tóxicas, narcóticos o medicamentos sin prescripción médica; tampoco se cubrirá la asistencia y/o gastos derivados de enfermedades mentales;

iv. Por hechos relacionados con la adquisición o uso de prótesis, anteojos o con motivo de embarazo.

v. No se dará servicio de traslado médico a mujeres embarazadas, durante los últimos

2. El asegurado debe cooperar con Driven Solutions, debe proveer toda la información necesaria y llenar todos los documentos necesarios para que se pueda proveer el servicio necesario.

3. El Asegurado por ningún motivo deberá hacer negociaciones o incurrir en ningún gasto sin antes consultar con Driven Solutions y obtener su aprobación, salvo los casos de excepción estipulados en este documento.

4. El Asegurado debe tomar las medidas pertinentes para prevenir cualquier daño o para disminuir los efectos de cualquier acto en el que sea necesario el servicio provisto en este contrato.

Las partes acuerdan que una vez satisfechos los requisitos de procedencia de la reclamación

ante LA ASEGURADORA, RAMC los hará llegar a LA ASEGURADORA para la restitución del importe acreditado.

CLÁUSULA 2a. RIESGOS NO AMPARADOS‌

Este seguro en ningún caso ampara:

2.1 Los daños ocasionados a terceros, en sus bienes y/o personas, que resulten de la amenaza o descarga, dispersión o escape de contaminantes, contenidos en cualquier medio, que se encuentren:

a) Siendo transportados, remolcados o maniobrados por el auto asegurado, o

b) Guardados, expuestos, tratados o procesados dentro o sobre el auto asegurado.

directamente por tal alteración, volcadura o daño.

Este seguro tampoco cubre pérdidas, costos o gastos que resulten de requerimientos o peticiones gubernamentales en las que soliciten al asegurado probar, revisar, limpiar, remover, contener, tratar de desintoxicar o neutralizar contaminantes.

2.3 Los daños ocasionados a terceros, en sus bienes y/o personas, derivados xx xxxxxx, haya sido o no declarada o de cualquier acto o condición incitado por la guerra, incluyendo guerra civil, insurrección, rebelión o revolución.

2.4 Multas penales ni daños punitivos ni ejemplares o sentencias, que no deriven de la responsabilidad civil cubierta.

2.5 Vehículos que no sean residentes en México y cuyas placas no sean nacionales.

2.6 Si el Asegurado o cualquiera de sus representantes celebra convenio o pacto con el o los involucrados, en cualquier accidente, sin el consentimiento otorgado por escrito por la compañía.

2.7 Para el caso de que este seguro haya sido contratado en la modalidad de “Tarjeta de Prepago”, cuando el vehículo asegurado sea conducido por persona menor de 21 años o mayor de 75.

2.8 A personas que sean ciudadanos y/o residentes norteamericanos y/o a personas cuyo domicilio habitual sea EE.UU.

CLÁUSULA 3a. PRIMA Y OBLIGACIONES DE PAGO‌

3.1 Prima.

La prima vence en la fecha de inicio de vigencia de la póliza y deberá ser pagada en el plazo que más adelante se indica.

3.2 Lugar de Pago.

La cesación de los efectos del contrato por falta de pago no aplica cuando el asegurado haya adquirido su póliza mediante la modalidad de “Tarjeta de Prepago”. El seguro de Responsabilidad Civil en el Extranjero, en su modalidad de “Tarjeta de Prepago”, comenzará su vigencia a partir del momento en que el asegurado se comunique a los teléfonos que aparecen en la tarjeta respectiva y se le proporcione el número de confirmación correspondiente.

3.4 Comisiones.

Durante la vigencia de la póliza, el contratante podrá solicitar por escrito a la compañía le informe el porcentaje de la prima que, por concepto de comisión o compensación directa, corresponda al intermediario o persona moral por su intervención en la celebración de este contrato. La institución proporcionará dicha información, por escrito o por medios electrónicos, en un plazo que no excederá xx xxxx (10) días hábiles posteriores a la fecha de recepción de la solicitud.

CLÁUSULA 4a. OBLIGACIONES DEL ASEGURADO.‌

4.1 En caso de siniestro el asegurado se obliga a:

a) Precauciones.

Al ocurrir un siniestro, el asegurado tendrá la obligación de ejecutar todos los actos que tiendan a evitar o disminuir el daño. Si no hay peligro en la demora, deberá pedir instrucciones a la compañía.

La compañía de seguros cubrirá los gastos efectuados por el asegurado que no sean públicamente improcedentes y emitirá el pago por adelantado de acuerdo con las siguientes instrucciones.

Si el asegurado no cumple con las obligaciones que señala el párrafo inmediato anterior, la obligación de la compañía se limitará a indemnizar al asegurado por el daño sufrido, únicamente hasta el valor al que habría ascendido, si éste hubiera cumplido con dichas obligaciones.

b) Aviso de siniestro.

Al ocurrir algún siniestro cubierto por la póliza, el asegurado tendrá la obligación de dar aviso a la compañíalo antes posible, salvo causas de fuerza mayor o caso fortuito, debiendo de notificarlo antes de salir de los Estados Unidos de Norteamérica o Canadá.

4.2 En caso de reclamaciones o demandas que se presenten contra el asegurado con motivo de siniestro, el asegurado se obliga a:‌

a) Aviso de reclamación: Comunicar a la compañía y enviar la documentación necesaria tan pronto tenga conocimiento de la reclamación o demandas recibidas por él o por sus representantes, a cuyo efecto, le remitirá los documentos o copia de los mismos que con ese motivo se le hubieren entregado.

La falta de cumplimiento a esta obligación por parte del asegurado liberará a la compañía de cubrir la indemnización que corresponda a la cobertura afectada por el siniestro. La compañía no quedará obligada por reconocimiento de adeudos, transacciones o cualquiera otro acto jurídico de naturaleza semejante, hechos o concertados sin el consentimiento de ella. La confesión de la materialidad de un hecho no podrá ser asimilada al reconocimiento de una responsabilidad

b) Cooperación y asistencia del asegurado con la compañía

El asegurado se obliga, x xxxxx de la compañía, en todo procedimiento civil que pueda iniciarse en su contra con motivo de la responsabilidad cubierta por el seguro:

- A proporcionar los datos y pruebas necesarios que le hayan sido requeridos por la compañía para su defensa, en caso de ser esta necesaria o cuando el asegurado no comparezca.

- A ejercer y hacer valer las acciones y defensas que le correspondan en derecho.

- A comparecer en todo procedimiento civil.

- A otorgar poderes a los abogados que la compañía designe para que lo representen en los citados procedimientos civiles, en caso de que no pueda intervenir en forma directa en todos los trámites de dichos procedimientos.

4.3 Obligación de comunicar la existencia de otros seguros.

El asegurado tendrá la obligación de informar por escrito inmediatamente a la compañía la existencia de todo seguro que contrate o hubiere contratado con otra compañía, sobre el mismo riesgo y por el mismo interés, indicando el nombre de la aseguradora y las coberturas, de acuerdo con el artículo 100 de la Ley Sobre el Contrato de Xxxxxx.

Conforme al artículo 102 de la Ley Sobre el Contrato de Seguro, en caso de existir otro u otros seguros amparando el mismo interés asegurable, celebrados de buena fe, en la misma o en diferentes fechas y por una suma total superior al valor del interés asegurado, serán válidos y obligarán a cada institución aseguradora hasta el valor íntegro del daño sufrido dentro de los límites de responsabilidad que hubieren asegurado.

CLÁUSULA 6ª INDEMNIZACIÓN POR XXXX x x

En caso de que la compañía, a pesar de haber recibido los documentos e información que le permitan conocer el fundamento de la reclamación que le haya sido presentada, no cumpla con la obligación de pagar la indemnización, capital o renta en términos del artículo 71 de la Ley sobre el Contrato de Seguro, quedará obligada a pagar al asegurado, beneficiario o tercero dañado en los términos del artículo 276 de la Ley de Instituciones de Seguros y de Fianzas, una indemnización por xxxx de acuerdo a lo establecido en dicho artículo.

Los intereses correspondientes deberán computarse desde el día siguiente al vencimiento del plazo a que se refiere el artículo 71 de la Ley sobre el Contrato de Seguro.

CLÁUSULA 7ª PÉRDIDA DEL DERECHO A SER INDEMNIZADO.‌

Las obligaciones de la compañía quedarán extinguidas:

- Si se demuestra que el Asegurado, el conductor o el tercero dañado, con el fin de hacerla incurrir en error, disimulan o declaran inexactamente hechos que excluyan o puedan restringir las obligaciones de la Compañía, de acuerdo a lo establecido en los artículos 8, 9, 10, 47 y 48 de la Ley sobre el Contrato de Seguro.

- Si hubiere en el siniestro dolo o mala fe del asegurado, conductor o tercero dañado o cualquiera de los representantes de éstos.

- Si se demuestra que el asegurado, conductor o tercero dañado, o cualquiera de los representantes de éstos, con el fin de hacerla incurrir en error, no proporcionan oportunamente la información relacionada al origen, clarificación y consecuencia del siniestro a la compañía.

- La utilización del vehículo es diferentes a los especificados en la póliza que implique una agravación esencial del riesgo, de conformidad con los artículos 52 y 53 de la Ley sobre el Contrato de Seguro.

CLÁUSULA 8ª TERMINACIÓN ANTICIPADA DEL CONTRATO ‌

Las partes convienen expresamente en que este contrato podrá darse por terminado anticipadamente mediante notificación por escrito. Cuando el Asegurado lo dé por terminado, la compañía tendrá derecho a la parte de la prima que corresponda al periodo durante el cual el seguro hubiere estado en vigor, de acuerdo a la tarifa diaria registrada ante la Comisión Nacional de Seguros y Fianzas.

Cuando la compañía lo dé por terminado, lo hará mediante notificación por escrito al asegurado,

CLÁUSULA 10ª COMPETENCIA ‌‌‌

En caso de controversia, el reclamante podrá acudir a la oficina de reclamaciones de la entidad aseguradora o en las oficinas centrales o delegaciones de su elección de la Comisión Nacional para la Protección y Defensa de los Usuarios de Servicios Financieros (CONDUSEF). Si dicha comisión no es designada como árbitro, será competente el juez del domicilio de la citada delegación.

CLÁUSULA 11ª COMUNICACIONES ‌

Cualquier declaración o comunicación relacionada con el presente contrato deberá enviarse a la compañía por escrito a su domicilio. En el caso de que el domicilio de las oficinas de la compañía sea diferente al que conste en la póliza expedida, se notificará al asegurado el nuevo domicilio para toda la información y avisos que deban enviarse a la compañía y para cualquier otro efecto legal.

Los requerimientos y comunicaciones que la compañía debe hacer al asegurado o a sus beneficiarios, tendrán validez si se hacen en el último domicilio registrado por la compañía.

CLÁUSULA 12ª IDIOMA ‌

En caso de que esta póliza se traduzca a otro idioma, para efectos de interpretación prevalecerá el texto en Inglés.

CLÁUSULA 13ª ARTÍCULO 25 DE LA LEY SOBRE EL CONTRATO DE SEGURO ‌

Si el contenido de la póliza o sus modificaciones no concordaren con la oferta, el asegurado podrá pedir la rectificación correspondiente dentro de los 30 días que sigan al día en que reciba la póliza.

Transcurrido este plazo se considerarán aceptadas las estipulaciones de la póliza.

quedará registrado de manera automática en el sistema de la compañía.

En todo momento, el asegurado o contratante podrá consultar e imprimir las condiciones generales y modelo de clausulado que correspondan al seguro contratado, accediendo a la página xxx.xxxxxxxx.xxx.xx.

Si el asegurado o contratante por cualquier motivo, no recibe o no puede obtener los documentos referidos en párrafos anteriores dentro de los 30 días naturales siguientes a su contratación, deberá acudir a las oficinas de Quálitas, Compañía de Seguros, S.A. de C.V. o llamar al centro de atención telefónica de la compañía al 800 800 2021 para que se le indique en razón de su domicilio, la ubicación del lugar al que deberá acudir a recoger su carátula de póliza y todos los documentos relacionados con el seguro contratado.

En caso de que el último día de plazo señalado en el párrafo anterior sea inhábil, la entrega de la documentación se realizará el día hábil inmediato siguiente.

El Asegurado o Contratante podrá solicitar la cancelación de su póliza de seguro, o la no renovación automática a través del prestador de servicios con quien efectuó la contratación, o por medio de Quálitas, Compañía de Seguros, S.A. de C.V., según corresponda, en un plazo de 24 (veinticuatro) horas a 10 (diez) días hábiles posteriores a la solicitud, debiendo recabar el prestador de servicios o Quálitas la firma del asegurado o contratante para dejar constancia de haber recibido el endoso correspondiente o podrá llamar al Centro de atención telefónica de la compañía al teléfono 000 000 0000, para recibir asesoría.

Los números telefónicos para la atención de siniestros son: 800 800 28 80, 800 288 6700.

Asimismo, el número telefónico para la atención de quejas por parte de la unidad especializada es el 55 5002-5500.

En cumplimiento a lo dispuesto en el artículo 202 de la Ley de Instituciones de Seguros y de Fianzas, la documentación contractual y la nota técnica que integran este producto de seguro quedaron registradas ante la Comisión Nacional de Seguros y Fianzas a partir del día 5 xx xxxxx de 2010, con el número RESP-S0046-0018-2009/CONDUSEF- G-010886-009.

AVISO DE PRIVACIDAD INTEGRAL CLIENTES

Por el término “terceros autorizados” o “terceros afectados” no deberá entenderse el concepto de “tercero” que señala la ley aplicable.

3. INDICACIÓN EXPRESA DE LOS DATOS SENSIBLES A TRATAR: Quálitas tratará también datos sensibles (datos de salud, características personales y físicas, género y datos biomédicos), que en su caso se requieran.

• Finalidades del tratamiento de datos personales de Visitantes: VIDEOVIGILANCIA Y FOTOGRAFIA. -Toda persona que ingrese a cualquiera de las instalaciones de Quálitas, podrá ser videograbada y/o fotografiada por nuestras cámaras de seguridad respecto de los cuales se guardaran registros que podrán ser utilizados tanto para salvaguardar la seguridad del visitante, como la del personal, teniendo como propósito el monitoreo remoto en tiempo real de los inmuebles y así atenuar cualquier condición de riesgo emergente, así como llevar un control de acceso a nuestras instalaciones.

4.2. FINALIDADES SECUNDARIAS DEL TRATAMIENTO. - Cuando Usted sea un tercero afectado de una póliza corporativa (contratada por una empresa) o cliente, sus datos personales podrían ser tratados para las siguientes finalidades secundarias:

🞎 Cuando nuestros asegurados, directamente o a través de nuestros intermediarios de seguros, nos soliciten información de los terceros afectados por algún siniestro, con el fin de analizar el siniestro, y en su caso llevar a cabo planes, pláticas y programas de prevención de riesgos.

🞎 En el caso de flotillas, nuestros asegurados o nuestros intermediarios de seguros nos soliciten información para determinar porcentajes de siniestralidad, con el fin de definir si en la renovación se incrementará el costo de la póliza o puede otorgarse un descuento.

🞎 Con fines de mercadotecnia, publicidad, prospección comercial y en su caso para brindarle los beneficios adicionales a su póliza, por medios físicos o electrónicos, ya sea personalmente o por conducto de intermediarios de seguros.

🞎 Invitarlo a participar en concursos, actividades recreativas o altruistas sin fines de lucro.

🞎 Evaluar la calidad del servicio y realizar estudios estadísticos, así como contactar a sus

5. TRANSFERENCIAS DE DATOS:

Quálitas podrá realizar transferencias de datos personales sin requerir el consentimiento del Titular, ya sean nacionales o internacionales, en los casos previstos en el Artículo 37 de la LFPDP o en cualquier otro caso de excepción previsto por la misma u otra legislación aplicable, así como a:

• Sociedades relacionadas o subsidiarias, con la finalidad de ofrecerle otros productos y servicios;

• Empresas afiliadas, subsidiarias y/o terceras empresas que formen parte del “Grupo”, y/o con las que mantengamos una relación jurídica y/o sean nuestros socios comerciales, que operan bajo las mismas políticas internas en materia de protección de datos personales; para los fines previstos en el presente Aviso de Privacidad.

• Autoridades mexicanas y extranjeras, con la finalidad de dar cumplimiento a nuestras obligaciones derivadas xx xxxxx, tratados o acuerdos internacionales como institución de seguros, obligaciones tributarias, así como para el cumplimiento de notificaciones o requerimientos oficiales o de carácter judicial.

• Su agente de seguros y/o administrador de riesgos para dar cumplimiento a la relación jurídica con Quálitas.

• Contratantes del seguro, producto o servicio, para dar cumplimiento a las obligaciones derivadas del contrato.

• Cualquier entidad con la que hayamos celebrado un acuerdo jurídico vinculante con la finalidad de dar cumplimiento a obligaciones contractuales.

5.1. Por petición de:

i. Clientes corporativos (personas xxxxxxx), que requieran datos de terceros afectados con el fin de preparar reportes o llevar a cabo estadísticas, los datos a que se refiere este aviso podrán ser transferidos a:

• Intermediarios en operaciones de seguros, para determinar porcentajes de siniestralidad, con el fin de definir si en la renovación se incrementará el costo de la póliza o puede otorgarse algún descuento, así como para preparar reportes, estudios o estadísticas para sus clientes, en relación con los destinatarios o beneficiarios finales de las pólizas de seguro (como Usted, si fuere el caso).

🞎 En caso de que no desee que sus datos personales sean transferidos a intermediarios de

6. MECANISMOS PARA SOLICITAR EL EJERCICIO DE LOS DERECHOS ARCO Y REVOCACIÓN DEL CONSENTIMIENTO, ASÍ COMO OPCIONES Y MEDIOS QUE OFRECE QUÁLITAS PARA LIMITAR EL USO O DIVULGACIÓN DE LOS DATOS PERSONALES:

Usted podrá solicitar al Departamento de Datos Personales de Quálitas, el Acceso, Rectificación, Cancelación y Oposición al tratamiento de sus Datos Personales, así como la limitación de su uso y revocación del consentimiento, de forma escrita en el domicilio señalado en el numeral I del presente Aviso o al correo electrónico xxxxxxxxxxxxxxx@xxxxxxxx.xxx.xx, de conformidad con lo establecido en los Procedimientos que se encuentran disponibles en la página de internet xxx.xxxxxxxx.xxx.xx en la sección “Aviso de Privacidad”. GENERAL CONDITIONS

PRELIMINAR ‌

The Company and insured have agreed to contract the coverage and insured amounts that appear on the front page of this policy.

The covered risks under this policy, appears in the first clause of general conditions of coverage and terms of contraction which are subordinated to maximum liability limits described are indicated in the title page of the policy.

The validity of this contract is set forth in the front page of the policy.

For the interpretation and effects hereof, the parties shall be subject to the manner and terms in which they agreed to be obligated.

DEFINITIONS ‌

For this contract effects, the following definitions are agreed by interested parties:

1. Car Accident: Collisions, rollovers, and any event that causes injury to a person, and/or physical damage to any property, including the Insured Vehicle, caused by an external, violent, fortuitous, and sudden cause, beyond the insured's and/or driver's control, arising from the use or operation of the Insured Vehicle.

2. Insured: Person whose name and address appears on the front page of the policy or the person who drives the insured vehicle with expressed permission or implied consent of the owner.

3. Occupant. Any person within, getting on or off the insured vehicle, with or without previous consent of the owner, will not be considered an occupant a person that is above, getting on or off any external part of insured vehicle.

4. Bodily Injury to third Parties. Body injuries, uneasiness, disease, or death originated by vehicle accident.

5. Third Parties Property Damage. Damage, destruction or loss the properties of third parties, caused by an accident of insured vehicle.

6. Trailer: Vehicle with front and/or rear axle not equipped with propulsion means and intended to be towed by a motor vehicle for recreational purposes.

7. Usual Residence. It is understood as the insured´s usual residence during the policy.

8. Third Parties. Parties injured in its property or body that makes a claim under the coverage of the policy, neither occupants nor driver by the time of insured vehicle accident.

9. Insured Vehicle. The personal use an automobile, described in the declaration page of the policy with license plates issued by Mexican authorities.

10. Insured Motorcycle. It means any motorcycle, motorized bicycle, scooter, motorized tricycle, described in the policy that are primarily designed to operate on public roads and have at least

full-time student or employed in the US in any way. No US or Canadian License.

CLAUSE 1. SPECIFICATION OF COVERAGE ‌

1.1 LIABILITY ‌

This policy covers Insured legal responsibility against damages to third parties or its properties and/or persons provoked by insured automobile accident.

Furthermore, the Company in case of civil sue against insured, agrees to defend or pay for expenses and loss fees in a trial or even more is obligated to compensate damages covered under the terms of this Civil Liability International Insurance Policy

The Company will pay all the legal expenses related to defense incurred in trial. The Responsibility of the Company ends up when the limit of liability in this policy is reached. The Company will not cover the damages to third parties in its properties and/or persons which are not covered by herein Civil Liability International insurance policy.

Also, the Company will pay the Insured an amount up to $100 American dollars per day of lost work, as result of attending hearings or required diligence, with a maximum of 5 days by submitting the correspondent documentation that proves its attendance to the aforementioned trial.

This insurance policy contract covers the civil responsibility of any Trailer or mobile equipment if is for recreation purposes, and it is hooked to the insured vehicle and does not exceed 1500 pounds of its charge capacity. No motor homes.

Maximum Liability limit.

The Company’s maximum limit of responsibility under this coverage is stated on the title page of the policy and operates as a unique insured amount, for diverse risks that are covered under this policy.

Particular Exclusions ‌

This policy does not cover:

1. Vehicles that are not garaged in Mexico and whose license plates are not issued by Mexican authorities.

2. Vehicles not scheduled under this policy.

3. Damages caused intentionally by Insured to a third party and/or its properties.

4. Driver, their relatives, employees and/or representatives of insured and insured properties material damage and properties under their custody or safekeeping, within the insured vehicle or vehicles engaged to it. Likewise, injuries to persons residing at the same address as the Insured.

5. Damages caused by insured vehicle when using it as public or merchandise transportation.

6. Vehicles designed to transit outside conventional roads. Not subject to motor vehicle registration.

7. When vehicle for personal use is used for business use/purposes.

8. When a vehicle for personal use is used to transport any type of hazardous material.

9. The damage of insured vehicle caused by:

a) Joining Competitions, security, strength or racing.

b) Using it for teaching, driving or operating lessons.

10. People above, getting on or off the external part of insured vehicle truck bed.

11. Damage caused for overloading or submitting insured vehicle to excessive traction bond with its resistance or capacity, in these cases the Company will neither be responsible for damages caused to bridges, avenues, any public road and objects or underground installations, caused by vibrations or as consequence of vehicle’s weight load.

12. Compensations to Insured disability, incapacity benefits or any concept mentioned by Law, such as unemployment or similar laws in force at the location of the accident.

In order for this benefit to be applicable, the liability of the Driver or owner towards an injured party shall proceed from the ownership, maintenance or use of an uninsured vehicle.

Any claim for damages related with a legal proceeding initiated without the consent of the Company shall not be mandatory thereto. If there was a dispute as to whether the vehicle has insurance or not, the Company shall have to prove it. Any accident occurring with an uninsured vehicle is covered only if such accident has occurred while the policy has been in force.

B. For purposes of this coverage, Insured or Policy Holder shall mean:

1. The person appointed in Qualitas Insurance Company's Insurance certificate or any member of his/her family while they occupy the insured vehicle, or are hit by an uninsured vehicle; and/or

2. Any other person occupying the insured vehicle if it has been involved in an accident with an uninsured vehicle.

C. Uninsured Vehicle

I. An uninsured vehicle shall mean a vehicle or trailer:

1. That does not have an insurance policy or liability bond in force upon the occurrence of the accident.

2. Whose operator or owner cannot be identified and hitting:

a. The person appointed in Qualitas Insurance Company's Insurance certificate or any member of his/her family.

b. A vehicle that the person appointed in Qualitas Insurance Company's Insurance certificate, or any member of his/her family is occupying; or

c. The vehicle described in Qualitas Insurance Company's Insurance certificate.

3. In order to obtain payment from this benefit, if the vehicle causes an injury to the Insured, and the owner or Driver of such vehicle cannot be identified, a real physical contact must have occurred between the unidentified vehicle and the person or property of the Insured.

4. That has a policy or liability bond, but whose insurance or bonding company has become insolvent or has denied coverage regarding the accident.

5. With insufficient insurance. This means a vehicle having a liability bond or policy in force and that provides coverage upon occurrence of the accident, but which limits of liability:

a. Are inadequate to pay the total amount of damages that the Insured is legally entitled to recover; or

b. Have been reduced by payment of claims in such a manner that the Insured cannot fully recover the damages to which the Insured is legally entitled.

II. An “Uninsured Vehicle” does not include the following types of equipment or vehicles:

1. A vehicle owned by the Insured or Owner or any member of his/her family that is not listed in Qualitas Insurance Company's Insurance Certificate.

4. For corporal injuries derived from intentional acts. The exclusion only applies to such a person whose intentional acts have caused physical damages only to such person.‌

5. Directly or indirectly to benefit any insurer or auto-insurer under any compensation law to employees or similar.

6. Directly or indirectly to benefit Drivers that insure properties.

7. For the first $250 dollars caused damage to the property of any insured as a consequence of any accident.

8. To any person driving or occupying the insured vehicle without the authorization from the Insured (this exclusion does not apply to the members of the family of the Insured or Driver of the insured vehicle).

9. To any person driving the insured vehicle without a reasonable belief that such a person is entitled to do so (this exclusion does apply to the Insured or members of his/her family while they utilize the insured vehicle.

Maximum Limit of Liability.

A. Limited to Quantities Established in Qualitas Insurance Company's Insurance Certificate. The limit of liability “per person” indicated in the Certificate is the maximum that the Company shall pay for all injuries caused by any person in a one automobile accident. Likewise, the limit of liability “per accident” indicated in the Certificate for the Benefit of Uninsured Drivers or with Insufficient Insurance, is the maximum that the Company shall pay for all injures caused by a single automobile accident, irrespective of the number of injured people.

B. The Limit of Liability is Subject to Payments by Legally Liable Persons. Subject to the maximum limits set forth in the Certificate, the limit of liability of the Company shall be the less between:

1. The difference between the amount of injuries caused to the Insured and the amount paid thereto by the damages, by or on behalf of the legally liable persons; and

2. The limits of liability available for this coverage under this policy.

3. Any payment under this coverage made to any Insured, shall reduce the amount it has to recover for the same damages under the Civil Liability Coverage or the Medical Expenses for Occupants section of this policy.

Maximum Liability limit.

The maximum limit of responsibility of the Company in this coverage for each person caused by physical injuries suffered by occupants of the vehicle and for each event of accident is established on the title page of this policy in the case the number of occupants exceeds what is established on the circulation card on insured vehicle, the limit of responsibility will decrease in proportion of the number of occupants damaged, that does nor over exceeds the insured amount contracted for accidents.

Particular Exclusions.

This policy does not cover:

1. Medical or funeral expenses of insured vehicle occupants of it are used for public or merchandise transportation.

2. Insured vehicle occupants when it is used for living or residence.

3. When insured uses a different vehicle than the insured one.

4. The insured intentionally caused the accident.

5. Medical or funeral expenses caused by:

- Nuclear weapons discharge even by accident

- War declared or not

a) Sales

b) Repairs

c) Inspection

d) Storage

e) Product distributors

9. The damage of insured vehicle caused by:

a) Joining Competitions, security, strength, or speed tests.

b) Using it for teaching, driving or operating lessons.

10. Bodily injuries caused by any person who uses the insured vehicle without the express or implied consent of the Insured.

11. Corporal injuries suffered by the occupant/s of insured trailer or mobile equipment.

1.4. QUALITAS ROAD ASSISTANCE COVERAGE ‌

Road Emergency Assistance is available 24 hours every day of the year in the United States of America and Canada (except Alaska and Hawaii). Its coverage shall begin since the date which appears on the policy that includes this 24-hour Road Emergency Assistance benefit and ends on the expiration of its policy, except in the event of previous cancellation. You will only be required to pay for the uncovered costs or expenses exceeding three hundred dollars ($300.00) maximum per event of Towing, Collision and Extraction Assistance and one hundred dollars ($100.00) maximum per event for all other benefits of road assistance. The coverage extends to You, the policy holder, for the vehicle listed in the insurance policy, hereinafter referred to as “Covered Vehicle”. Service shall be provided to any driver of a Covered Vehicle and it shall be a Covered Emergency under these Terms and Conditions.

All Road Emergency Assistance services are provided by Driven Solutions.

the nearest garage or to any location requested by the Insured.

(3) Extraction Assistance – The Extraction of a vehicle shall be provided when the Covered Vehicle is stuck in a ditch or other unaccessible area, provided that such location is maximum fifty

(50) feet away from a paved road. The extraction service is not covered if the Covered Vehicle is driven outside of a paved road or surface.

(4) Battery Service- If there is damage to the battery, the vehicle shall be jumped started.

(5) Flat Tire Assistance – If the Service consists in removing the flat tire from the Covered Vehicle and changing it for a spare tire found in the Covered Vehicle.

(6) Fuel, Oil, Liquid and Water Services – Consisting of the emergency delivery of fuel, oil, liquid or water for the Covered Vehicle on site when the vehicle has an immediate necessity. You shall pay for the cost of the fuel or other liquid upon delivery thereof.

(7) Locksmith Assistance - If the keys are forgotten inside the Covered Vehicle, assistance to open the Covered Vehicle shall be provided.

EXCLUSIONS:

The following concepts are not included as part of the provision of emergency road assistance services: The coverage shall not be provided in case of emergencies derived from the use of toxic substances or drugs, or the use of the covered vehicle in a criminal act. Cost of parts/spare parts, spare keys, liquids, lubricants or fuel, cost of installation of products or materials. Towing when it is not an emergency or other non-emergency service. Any service available through a warranty of a valid manufacturer or service. Non-emergency assembly or substitution of tires for snow or chains. Move snow from around the vehicle. Tire Repair. Motorcycles, trucks with capacity of one and a half tons (U.S.A.), taxis, limousines or other commercial vehicles. Recreational vehicles (including motorized Rvs), trailers for camping, moving homes, or any other towing vehicle. Every tax, fee or penalty. The damage or uselessness due to fire, flood or vandalism. Towing from or repair work performed at a service station, garage or repair workshop. Towing assistance provided by others different than a service station or licensed garage; vehicle storage expenses. Service in a vehicle that is not in a safe condition to be towed or obtain service or that may cause damages to the vehicle that will be towed or be serviced. Towing or service in roads without periodical

g) Provide the necessary elements to locate the situation, as well as cooperate with the follow-up of the event before the corresponding authorities.

h) Abstain from negotiating or incurring in expenses without consulting with RAMC

i) Notify RAMC about the changes of address.

j) The medical and legal team of RAMC shall have free access to the history and clinical files, as well as to the criminal backround of the Insured in order to know his/her situation; if such access is denied, RAMC shall not be obligated to render any of the Assistance Services.

k) Any other document requested by RAMC, provided it is reasonable in terms of law. It is Insured's responsibility to carry out the claim properly.

OBLIGATIONS OF THE BENEFICIARY AND/OR COMPANION(S).

1. ASSISTANCE REQUEST. In case of an assistance request and before beginning any action, the Insured shall call RAMC at 0-000-000-0000 within the USA, and provide the following information:

1. Full name of the Insured.

2. Number of the automobile's insurance policy and expiration date.

3. Indicate the telephone number at which he/she may contact Insured or else, all information necessary to locate him/her and that the assistant may request.

4. Detailed description of the situation and type of help that is needed.

2. PRECAUTIONS OR SAFETY MEASURES: the beneficiary and/or companion(s) are required

EXCLUSIONS:

The following assistance benefits shall not be provided:

a) When the beneficiary and/or occupant(s) do not provide true and timely information that, due to their nature, does not allow due assistance of the situation.

b) When the beneficiary and/or occupant(s) do not prove their entitlement to receive the assistance service.

c) When the beneficiary and/or occupant(s) breach any of the obligations indicated in this

policy.

d) When the driver of the vehicle does not identify himself as the beneficiary or occupant.

e) When the beneficiary is not at the place where the events occurred.

f) When the insured vehicle has been illegally introduced to the country.

g) When the assistance situation arises due to fraud or bad faith of the insured or driver of the vehicle or is caused by an intentional act.

h) For bad or unlawful use of the vehicle without the consent of the Insured, such as in the case of theft, breach of trust.

i) Vehicles with modifications different than the original manufacturing, if they directly influenced the accident or repair.

j) The assistance and/or expenses of the vehicle's occupants that are transported for free as a consequence of the so called “rides" or "auto stops".

k) Qualitas shall not be responsible for delays or breaches caused by force majeure or for the administrative characteristics or policies of the place where the services shall be rendered.

l) The providers rendering the assistance services may be independent contractors, by reason of which Qualitas shall be responsible for the provision of services pursuant to this policy, shall not be responsible for deficiencies in which such providers incur, notwithstanding that they are chosen by Qualitas, they have adequate credentials and are competent based on the levels of service of the place, moment and circumstance in which the services are rendered.

m) It shall not be considered a breakdown for purposes of the towing service, the alarm blockage, maintenance works, automobile revisions, major repairs and repair of parts

companion(s) against a doctor's prescription.‌

ii. Suicide and/or injuries or sequels caused by the attempt thereof.

iii. Sicknesses or pathological states produced by the voluntary ingestion of alcohol, drugs, toxic substances, narcotics or medicines without prescription; also, the assistance and/or expenses derived from mental sicknesses shall not be covered;

iv. Acts related with the acquisition or use of prothesis, glasses or pregnancy.

v. No medical transportation shall be given to pregnant women during the last 90 days of their pregnancy.

vi. During nature phenomena of extraordinary character, such as floods, earthquakes, volcano eruptions and cyclones;

vii. During acts and/ or situations deriving from terrorism, riot or popular rebellions;

viii. Situations or acts of armed forces or safety groups, even if they occur in times of peace;

ix. As a result of acts related with radioactive energy, or any other cause of force majeure.

DELIVERY OF DOCUMENTS.

Under the terms and conditions of the Policy, the Insured shall deliver as soon as possible to the person(s) appointed by QUALITAS, the citations, claims, experiments, judicial orders, notices, as well as any other correspondence or legal documentation received from the administrative or judicial authorities and that are directly or indirectly related with the events covered by this contract.

RESPONSIBILITIES OF THE INSURED.

1. The Insured shall report any need of assistance as soon as possible by calling the toll-free number that is provided.

2. The Insured shall cooperate with Driven Solutions, deliver all information required and fill necessary documentation so that the required service can be provided.

3. The Insured in no case shall decide or incur in any expense without consulting with Driven Solutions and obtaining its approval, except in the cases specifically indicated in this document.

4. The Insured shall take all pertinent measures to prevent any damage or to diminish the effects of any act in which it the service provided for in this contract is necessary.

2.1 Damages caused to third parties in its properties and/or persons, caused by threat, discharge, scatter or pollution escape, anywhere contained, that are:

a) Being transported, towed, or maneuvered by insured car, or

b) Kept exposed, treated, or processed inside or above the car.

Exception made for subparagraph b) of this exclusion does not applies to damages provoked by gas, lubricants, fluids, exhausted gas or other similar contaminated that are necessary of come from a bad mechanical or electrical hydraulics functioning in its parts or in itself:

> Pollution escape, discharge, seepage or leaked directly from a designated part of the car by its manufacturer to contain, store, receive or dispose it.

2.2 Damage caused by pollution in any moment of charge or discharge. Exception made to the paragraph above; this exclusion will not apply if:

- Damages are provoked by pollution or the medium that involves it, for being activated

altered, tip over or damaged as result of the maintenance or use of insured vehicle and:

- If discharge, seepage, leaked or escape of the pollution is caused directly by that alteration, tipped over or damaged.

The policy does not cover losses costs or expenses that comes from requirements or government petition requested by insured to prove, review, clean, remove, contain, detoxify or neutralize pollution.

2.3 Damages caused by third parties in their property, and/or persons, provoked by war declared or not or any act or condition related to war; including civil war, insurrection, rebellion or revolt.

2.4 Criminal fine nor punitive harm nor exemplary, not related with cover civil liability.

2.5 Vehicles that do not reside in Mexico and whose plates are not national.

2.6 If insured or his/her representatives holds a settlement or pact with implicated one/s,

CLAUSE 3. PREMIUM AND PAYMENT OBLIGATION ‌

3.1 Premium

Premium expires on the effective date of the policy, and be paid in the term mentioned later on.

3.2 Place of Payment.

Agreed premiums shall be paid in the Company’s offices against receipt issued by the Company except for the case that the policy was purchased through a prepaid card.

3.3 Lack of payment will finalize the Agreement

If policy is not paid in the 30 calendar days after the effective date of the policy, contract effects will automatically cease at 12:00 a.m. of the last payment day.

The ending of the effects of the contract for lack of payment, does not apply when insured acquired the policy through prepaid card. Civil Liability International Insurance Policy in the modality of prepaid card will be in force at the moment the insured communicate by phone call the numbers that appear in the credit card and give the correspondent confirmation number.

3.4 Commissions

During policy’s in force, the holder can make a written request for the Company to ask for the percentage of the premium that corresponds to individual or society agent for the concept of commissions or direct compensation in this insurance policy contract. The Company will send the information data by electronic mediums, written in a term that will not exceed 10 working days after request’s reception.

CLAUSE 4. INSURED OBLIGATIONS ‌

4.1 In claims insured is obligated to:

a) Precautions.

When an accident occurs insured will have the obligation to perform any act that avoids or diminishes damage. If no danger comes from delay, he/her will may ask for guidance of the Company.

must notify it before leaving the United States of America or Canada.

c) Notice to authorities.

In case of accident the insured is forced to inform correspondent authorities. The lack of compliment of this insured’s obligation, will release the Company to cover the indemnification drift by the accident.

4.2 In the case of claims or sues against insured originated by injuries, the insured has the obligation of:

a) Claims notice: Notify the company and send the necessary documentation as soon as you become aware of the claim or demands received by you or your representatives, for which purpose, you will send the documents or copies thereof that have been delivered to you for that purpose.

Lack of compliance with the aforementioned paragraph will release the Company to cover the indemnification drift by accident. The Company will not become obligated for debt recognition transactions or any other legal act with similar nature, facts without Company’s consent. The confession of a material act cannot be acknowledged as liability recognition.

b) Cooperation and assistance of insured in respect of the Company

Holder of the policy is obligated in any civil procedure against him/her bond to civil liability covered in this Policy and at the Company’s cost to:

- Provide data and necessary proof required by the Company for the defense, in case it is necessary or insured do not attend the hearings.

- Exercise and perform actions and defenses according to his/her right by law.

- To attend all civil trial hearings.

- Xxxxx xxxxxx of attorney on half of Company’s lawyers designated to represent him/her in civil trail, in case he/her will not be able to intervene directly.

4.3. Obligation to inform the existence of other insurances.

The Insured will have the obligation to immediately inform the Company by written the existence of all insurance that he/her contracts or had been contracted with another Company, for the same risk and for the same interest, indicating name of the Insurance Company, and coverage in accordance

CLAUSE 5. GEOGRAPHICAL LIMIT AND OPERATION OF INSURANCE ‌

The coverage under this policy, applies in case of accidents occurred within United States of America and Canada territory, during policy’s effects.

This policy does not provide coverage for accidents occurring in Mexico.

CLAUSE 6. MORATORIUM INDEMNITY ‌

In the case that the Company, despite of receiving the documents and information that allows to know the origin of the claim, does not fulfill the obligation to pay the indemnification, capital or rent in terms of article 71 of Insurance Contract Law, will be forced to pay the Insured, beneficiary or third parties damaged a default indemnification in the terms of article 276 of Ley de Instituciones de Seguros y de Fianzas.

The correspondent interests will have to be computed to last day of termination of the term established on article 71 of Insurance Contract Law.

CLAUSE 7. LOSS OF THE RIGHT TO BE INDEMNIFIED.‌

Obligations of the Company will be extinguished:

- If it is prove that Insured, driver, o third party damaged, make false or erroneous declarations or statements with the purpose of exclude or restrained the obligations of the Company in accordance to articles 8, 9, 10, 47 and 48 of Insurance Contract Law.

- If in the claim the insured, driver, third party or representatives declares with bad faith or fraud.

- If it is prove that insured, driver, third party or representatives do not provide requested information related to the origin, clarification and consequence of the accident to the Company with the purpose of it committing a mistake.

- If the use or service of the vehicle is different than the agreed in the policy and that implies an essential increase in the risk according to articles 52 and 53 of Insurance Contract Law.

CLAUSE 8. EARLY TERMINATION OF THE CONTRACT.‌

Parties agree that this contract could have an early termination only by a written advice. When the Insured finishes the contract, the Company will have right to the part of the premium that corresponds to the period that the policy was going to be in force, according to the daily tariff

CLAUSE 10. COMPETENCE ‌‌‌

In case of controversy, the claimant could complaint before the Claims office of the Insurance Company or at central offices or delegations of its choice of National Commission for the Protection and Defense of Financial Services Users (CONDUSEF), if that Commission is not designated as arbitrator, the judge of the domicile of the aforementioned delegation will be competent.

CLAUSE 11. COMMUNICATION ‌

Any declaration or communication bond to this contract will have to be sent to the Company written, to its address. In the case that the domicile of the offices of the Company is different than the one in the policy, the new address will be notified to insured, for all the information and notices that will be notified to the Insured that must be sent to the Company and for any other legal effect.

The requirements and communications that the Company must made to Insured or beneficiaries, will have validity if they are made to the last address of the Company.

CLAUSE 12. LANGUAGE ‌

If a translation of the policy to another language is needed, for the effect of interpretation the text in English will prevail.

CLAUSE 13. ARTICLE 25 OF INSURANCE CONTRACT LAW ‌

If the contents of the Policy or its modifications do not meet with the offered, the Insured could request for the correspondent changes within the thirty (30) days after the date of reception of the Policy.

Once this period of time has expired, the stipulations of the policy will be considered accepted.

In the event that the last day of the above referenced period is a holiday, the document delivery will be done the following working day.

The insured or contracting party can request the cancellation of the insurance policy, or the non automatic renewal thru the service provider who contracted the insurance, or by Qualitas, Compañia de Seguros, s.a. de c.v., as applies in a term of 24 (twenty four) hours to 10 (ten) working days following the request, the service provider will request the insureds or contracting party’s signature as proof of having received the corresponding endorsement or telephone the company’s call center at 000 000 0000, to receive counseling.

• Brokers in insurance transaction, to determine accident rate percentages, aimed at defining if the cost of the policy will be increased in the renewal or if a discount may be granted, as well as for preparing reports, research or statistical analyses for its customers regarding addressees or end beneficiaries of the insurance policies (just like You, if it was de case).
