ADHESIÓN DE AUSTRALIA AL ACUERDO SOBRE CONTRATACIÓN PÚBLICA

El Comité de Contratación Pública,
Teniendo en cuenta el párrafo 2 del artículo XXIV del Acuerdo sobre Contratación Pública hecho en Marrakech el 15 xx xxxxx de 1994 (el "Acuerdo de 1994"), y el párrafo 2 del artículo XXII del Acuerdo sobre Contratación Pública de 1994 modificado por el Protocolo por el que se modifica el Acuerdo sobre Contratación Pública, hecho en Ginebra el 00 xx xxxxx xx 0000 (xx "Xxxxxxx modificado")1;
Teniendo en cuenta la Decisión del Comité de Contratación Pública sobre la adopción del texto del Protocolo por el que se modifica el Acuerdo sobre Contratación Pública, adoptada el 00 xx xxxxx xx 0000 (Xxxxxxxx 1 del documento GPA/113, de 2 xx xxxxx de 2012), y en particular sus párrafos 3 y 4;
Considerando la solicitud de adhesión al Acuerdo sobre Contratación Pública presentada por Australia, que figura en el documento GPA/129, de 2 xx xxxxx de 2015, y las consultas celebradas con las Partes en el Acuerdo sobre Contratación Pública, así como la documentación adicional presentada por Australia y las Partes a tal efecto;
Decide lo siguiente:
1. De conformidad con las disposiciones del párrafo 2 del artículo XXIV del Acuerdo de 1994 y del párrafo 2 del artículo XXII del Acuerdo modificado, Australia podrá adherirse al Acuerdo sobre Contratación Pública en las condiciones establecidas en la presente Decisión, incluidos sus anexos.
2. Australia presentará su instrumento de adhesión en el plazo de 12 meses desde la fecha de la presente Decisión, a menos que el Comité prorrogue el plazo para la presentación del instrumento.
3. El Acuerdo sobre Contratación Pública entrará en vigor para Australia el trigésimo día siguiente a la fecha de su adhesión, es decir, la fecha en que el Director General reciba su instrumento de adhesión, en el que se reproducirán las condiciones establecidas en la presente Decisión, incluido su anexo A.
4. De conformidad con el párrafo 4 de la Decisión del Comité de Contratación Pública sobre la adopción del texto del Protocolo por el que se modifica el Acuerdo sobre Contratación Pública, adoptada el 00 xx xxxxx xx 0000 (Xxxxxxxx 1 del documento XXX/000, xx 0 xx xxxxx xx 0000), Xxxxxxxxx estará obligada por dicho Protocolo a partir de la fecha de entrada en vigor del Acuerdo sobre Contratación Pública para ella.
1 En adelante, el Acuerdo de 1994 y el Acuerdo modificado se denominarán en conjunto "Acuerdo sobre Contratación Pública".
5. Australia proporcionará a todas las Partes en el Acuerdo sobre Contratación Pública acceso a la contratación comprendida en el Apéndice I, que figura en el anexo A de la presente Decisión, a partir de la fecha de entrada en vigor del Acuerdo sobre Contratación Pública para ella. A partir de esa fecha, las disposiciones que figuran en el anexo A pasarán a ser parte integrante del Acuerdo sobre Contratación Pública.
6. Los Anexos del Apéndice I correspondientes a Islandia, Liechtenstein, Noruega y la Unión Europea con arreglo al Acuerdo modificado serán aplicables con sujeción a las disposiciones que figuran en el anexo B de la presente Decisión, a partir de la fecha de entrada en vigor del Acuerdo sobre Contratación Pública para Australia. A partir de esa fecha, las disposiciones que figuran en el anexo B pasarán a ser parte integrante del Acuerdo sobre Contratación Pública.
7. Los Anexos del Apéndice I del Acuerdo de 1994 correspondientes a Suiza serán aplicables entre Australia y Suiza a partir de la fecha de entrada en vigor del Acuerdo sobre Contratación Pública para Australia hasta que el Protocolo por el que se modifica el Acuerdo sobre Contratación Pública, hecho en Ginebra el 30 xx xxxxx de 2012, haya entrado en vigor para Suiza. Los Anexos del Apéndice I correspondientes a Suiza con arreglo al Acuerdo modificado se aplicarán con sujeción a las disposiciones que figuran en el anexo C de la presente Decisión, a partir de la fecha de entrada en vigor del Acuerdo sobre Contratación Pública para Australia y, además, de la fecha de entrada en vigor de dicho Protocolo para Suiza. A partir de esa fecha, las disposiciones que figuran en el anexo C pasarán a ser parte integrante del Acuerdo sobre Contratación Pública.

GENERAL NOTES
The following General Notes apply without exception to this Agreement, including to Annexes 1 through 6.
1. The Agreement does not apply to:
a. any form of preference to benefit small and medium enterprises;
b. measures to protect national treasures of artistic, historic, or archaeological value;
c. measures for the health and welfare of Indigenous people;
d. measures for the economic and social advancement of Indigenous people; and
e. procurement of goods and services outside the territory of the procuring Party for consumption outside the territory of the procuring Party.
2. For greater certainty:
a. the Agreement does not apply to procurement funded by grants and sponsorship payments received from persons not listed in Annexes 1, 2 or 3;
b. the Agreement does not apply to procurement by a procuring entity from another government entity;
c. nothing in this Agreement precludes the procuring Party, or its procuring entities, from preparing, adopting or applying technical specifications required to protect sensitive government information, including specifications that may affect or limit the storage, hosting or processing of such information outside the territory of the procuring Party; and
d. a procuring entity may use limited tendering procedures for unsolicited innovative proposals under Article XIII:1.

2 Switzerland's terms of Australia's accession to the GPA will take effect only when: (i) the Agreement on Government Procurement has entered into force for Australia; and (ii) the Protocol Amending the Agreement on Government Procurement, done at Geneva on 30 March 2012, has entered into force for Switzerland.
