El suscrito Xxxxx Xxxxxx Xxxxx mayor de edad, identificado con la cédula de ciudadanía No. 79.050.381 en su calidad de Jefe de Servicios y Relaciones Laborales de la Universidad de los Andes, Institución privada de educación superior, sin ánimo de lucro, con Personería Jurídica reconocida por el Ministerio de Justicia según Resolución 28 del 23 de febrero de 1949, debidamente delegado para la presente actuación por la Rectoría de la Universidad, y de conformidad con la política de "Atribuciones de Autoridad" aprobada por el Comité Ejecutivo del Consejo Directivo en sesión No. 198 - 06 del 8 de febrero de 2006, en adelante y para los efectos del presente contrato La Universidad, por una parte, y por la otra la persona cuyos datos aparecen a continuación:
The undersigned Xxxxx Xxxxxx Xxxxx of legal age, identified with citizenship identification card number79.050.381 in his capacity as Head of Services and Labor Relations of Los Andes University of Los Andes University, a non-profit private higher education institution, with Legal Capacity acknowledged by the Ministry of Justice pursuant to Resolution 28 of February 23rd, 1949, properly delegated to act on behalf of the Rector’s Office of the University, and in accordance with the “Authority Attributions” policy approved by the Executive Committee of the Board of Directors in session number 198 – 06 of February 8th, 2006, hereinafter and for the matters of this contract The University, on one side, and on the other side the person whose personal information appears below:

Quien en este contrato se denominará el empleado, se ha celebrado el contrato que se regirá por las siguientes cláusulas:
Who in this contract will be referred to as the employee, have entered into the contract which shall be ruled by the following clauses:
VIGENCIA. Las partes acuerdan que el presente contrato de trabajo tendrá vigencia únicamente siempre y cuando el Ministerio de Relaciones Exteriores de Colombia expida la Visa TP - 4 al señor __________ previo cumplimiento del lleno de los requisitos señalados en el Decreto 1067 de 2015 y la normatividad que lo adicione, modifique o complemente, y adicionalmente, mientras el empleado cuente con el permiso temporal para el ejercicio de su profesión en el país otorgado por la entidad competente.
PARÁGRAFO. De conformidad con lo señalado en la presente cláusula, las partes acuerdan que en caso de que el Ministerio de Relaciones Exteriores no renueve la Visa TP - 4 por cualquier razón, y/o no se renueve el permiso temporal exigido para el ejercicio de la profesión, el presente contrato de trabajo se dará por terminado de mutuo acuerdo, sin que se genere obligación de reconocer indemnización alguna al empleado, derivada de la forma de terminación del contrato, siempre y cuando las partes hayan actuado con diligencia para adelantar los trámites correspondientes.
VALIDITY. The parties agree that this employment contract will be valid only as long as the Colombian Ministry Of Foreign Affairs issues the TP - 4 Visa to Mr. /Mrs. _________ in full compliance with the requirements indicated in Decree 1067 of 2015 and the regulations which add to it, modify it or complement it, and additionally, as long as the worker has the temporary permit for the exercise of his/her profession in the country granted by the relevant authority.
PARAGRAPH. Pursuant to the indications in the present clause, the parties agree that in case the Ministry of Foreign Affairs does not renew the TP - 4 Visa for any reason, and/or the temporary permit for the exercise of his/her profession is not renewed, this employment contract will be terminated under mutual agreement, without generating obligation to pay any compensation to the worker, derived from the termination of the contract, as long as the parties have acted with diligence to carry out the corresponding procedures.
OBJETO DEL CONTRATO: La Universidad contrata los servicios personales del empleado y/o profesor y éste se obliga a poner al servicio de la Universidad toda su capacidad normal de trabajo, en forma exclusiva en el desempeño de sus funciones del cargo indicado anteriormente y en las labores anexas o complementarias a su oficio, de conformidad con las órdenes e instrucciones que le impartan la Universidad y sus representantes. A no prestar directa ni indirectamente servicios laborales a otros empleadores, ni a trabajar por cuenta propia en el mismo oficio y a no recibir por si o por interpuesta persona, durante la prestación de sus servicios, dineros o valores que deban ingresar a la Universidad a cualquier título.
OBJECT OF THE CONTRACT: The University hires the personal services of the Employee and/or Teacher and he/she undertakes to put all his/her normal work capability at the service of the University, exclusively in the performance of the functions of the previously indicated position and the enclosed or complementary tasks to his/her job, pursuant to the orders and instructions given by the University and its representatives. Not to provide, directly or indirectly, work services to other employers, or to work on his/her own in the same job and not to receive neither in person or through a third party, during the provision of his/her services, money or securities destined to the University under any title.
GASTOS DE TRASLADO. La Universidad se compromete a sufragar los gastos de traslado en que El Empleado y su familia incurra para radicarse en Colombia. De igual forma, La Universidad se compromete a sufragar los gastos de regreso a ______________ (país de origen o último lugar de residencia), de _____________ (El empleado) como los de su familia a la terminación del contrato de trabajo cuando su Visa TP - 4 sea cancelada, o ante una eventual deportación o expulsión. Esta obligación cesará para la Universidad cuando el extranjero obtenga Visa Temporal en las categorías de cónyuge o compañero de nacional colombiano, padre o madre de nacional colombiano o visa de residente, de conformidad con lo dispuesto en el Decreto 1067 de 2015.
TRANSPORTATION EXPENSES. The University commits to cover the transportation expenses incurred by the worker and his/her family to settle in Colombia. Equally, The University commits to cover the expenses for going back to ___________ (country of origin or country of previous residence), for both ____________ (The Worker) and his/her family once the employment contract has ended when his/her TP - 4 Visa is cancelled, or before an eventual deportation or expulsion. This obligation will cease for The University when the foreigner obtains a Temporary Visa in the category of spouse or partner of a Colombian citizen, father or mother of a Colombian citizen or resident Visa, pursuant to the provisions in Decree 1067 of 2015.
MODIFICACIONES AL CONTRATO: El empleado y/o Profesor acepta desde ahora los traslados y cambios de cargo u oficio que decida la Universidad siempre y cuando éstos no desmejoren sus condiciones laborales.
AMENDMENTS TO THE CONTRACT: The Employee and/or Teacher from now on accepts the transfers and changes of position or job decided by the University as long as these do not deteriorate his/her working conditions.
DURACION Y PERIODO DE PRUEBA: La duración y el periodo de prueba de este contrato son los arriba señalados. Durante el período de prueba cualquiera de las partes podrá terminarlo unilateralmente en cualquier momento sin que haya lugar al reconocimiento de las indemnizaciones de que trata el Art. 64 del C.S.T.
DURATION AND TRIAL PERIOD: The duration and trial period of this contract are the ones indicated above. During the trial period, any of the parties may terminate it unilaterally at any moment without giving rise to payment of the compensations mentioned in Art. 64 of the Substantive Labor Code.
REMUNERACIÓN: Las partes acuerdan la modalidad xx Xxxxxxx Integral como retribución mensual, esta suma de dinero anteriormente fijada, remunera el trabajo ordinario del empleado y/o profesor compensa el valor de las prestaciones tales como primas legales, cesantías, intereses sobre las cesantías, subsidios, así como de aquellos por concepto de recargos nocturnos, horas extras, festivos, dominicales, primas extralegales, suministro en especie y en general todos los pagos que se efectúen bajo las condiciones previstas en el artículo 14 de la Ley 50 de 1990. El monto prestacional mensual, igualmente indicado, equivale al 30%, factor que la Universidad ha determinado por considerarlo acorde con el valor de las prestaciones que ella cancela a los empleados.
REMUNERATION: The parties agree the modality of Integrated Salary as a monthly retribution. This previously fixed amount of money remunerates the ordinary work of the employeee and /or teacher and compensates the value of benefits such as legal premiums, redundancies, redundancy interests, subsidies, as well as those for the concept of night work surcharges, overtime, holidays, Sundays, extra-legal premiums, in-kind supplies and in general all the payments done under the conditions set forth in article 14 of Law 50 of 1990. The amount of the monthly benefits, equally indicated, is equivalent to 30%, factor which the University has determined for considering it pursuant to the value of the benefits paid to their employees.
JORNADA DE TRABAJO: El Empleado y/o Profesor se obliga a laborar la jornada laboral arriba señalada según el horario establecido por la Universidad, pudiendo hacer ésta los ajustes o cambios cuando lo estime conveniente.
TRABAJO NOCTURNO, SUPLEMENTARIO, DOMINICAL O FESTIVO: Todo trabajo suplementario o en horas extras y todo trabajo en día domingo o festivo en los cuales legalmente debe concederse descanso, mientras no sea labor que según la ley o el contrato, ha de ejecutarse así, debe ser autorizado por la Universidad previamente y por escrito. Cuando la necesidad de este trabajo se presente de manera imprevista e inaplazable, deberá ejecutarse y dar cuenta de él por escrito a la Universidad, dentro del término de 72 horas. La Universidad no reconocerá ni pagará el trabajo que no haya sido autorizado o avisado como queda dicho. Parágrafo: Si las funciones o el cargo desempeñados corresponden a las señaladas en el Reglamento Interno de Trabajo, el contrato o la Jurisprudencia, como funciones de dirección, confianza y manejo, se dará aplicación a la excepción prevista en el artículo 162 del c.s.t.
working hours: the Employee and/or Teacher undertakes to work during the working hours mentioned above according to the schedule established by the University, being it able to make adjustments and changes when it considers convenient.
NIGHT WORK, SUPLEMENTARY WORK, SUNDAYS OR HOLIDAYS: Any supplementary work or overtime and any work done on Sundays or holidays which have to be legally given as leave, as long as it is not work that according to the law or the contract, has to be executed this way, and it must be previously authorized in written form by the University. When the need for this work occurs in an unforeseen way and cannot be postponed, it shall be executed and notified in written form to the University, within the next 72 hours. The University will not acknowledge or pay the work which has not been authorized or notified as said. Paragraph: If the functions or the job performed correspond to those indicated in the Rules of Procedure, the contract or the Jurisprudence, as functions of direction, confidence and management, the exception foreseen in article 162 of the Substantive Labor Code will be applied.
VACACIONES: La Universidad, de conformidad con las disposiciones legales vigentes, lo mismo que con las políticas institucionales adoptadas para el efecto, concederá y liquidará al profesor/empleado las vacaciones a que haya lugar. No se concederán vacaciones anticipadas. Igualmente, y por mera liberalidad, podrá conceder descanso en días diferentes a domingos y festivos sin que tal ampliación constituya obligación patronal.
PARÁGRAFO: Para los efectos de la presente cláusula, se observará lo consignado en la política institucional de vacaciones según la cual la Universidad concederá vacaciones colectivas a profesores y no colectivas al personal de apoyo institucional, tanto de unidades académicas como administrativas.
VACATIONS: The University, pursuant to the prevailing legal provisions, as well as the institutional policies adopted for this effect, xxxx xxxxx and pay the teacher/worker the admissible vacation period. Anticipated vacation will not be given. Equally, and by mere gratuity, it may give time off on days different to Sundays and holidays without there being any obligation to the employer.
PARAGRAPH: For the effects of the present clause, the information found in the institutional vacation policies will be observed, according to which, the University will grant collective leave to teachers and non-collective to institutional support staff, for both academic and administrative units.
TERMINACIÓN UNILATERAL: Son justas causas, para dar por terminado este contrato, unilateralmente, además de las señaladas en el artículo 7 del Decreto 2351 de 1965 y las previstas en el Reglamento Interno de Trabajo de la Universidad, las siguientes: a) El hecho de que el Profesor/Empleado llegue embriagado al sitio de trabajo aún por la primera vez. b) El hecho de que el Empleado y/o Profesor abandone el sitio de trabajo sin permiso de sus superiores. c) La inasistencia a una sesión completa de la jornada de trabajo o más, sin excusa suficiente a juicio de la Universidad. d) La recepción por sí o por interpuesta persona de dineros o valores destinados a la Universidad a cualquier título, sin previa autorización para hacerlo. e) Cualquier violación a las obligaciones, deberes y prohibiciones de que trata el presente contrato y en especial a las previstas en el Reglamento Interno de Trabajo y a la legislación laboral vigente. f) El incumplimiento de su horario de trabajo. g) El hecho de revelar procesos técnicos, industriales, comerciales o información que la Universidad considere como reservados y que haya conocido con ocasión del servicio que preste para ésta. h) El vencimiento del término estipulado. i) Aprovecharse en su beneficio de los dineros que le sean entregados por la Universidad o sus representantes con destino a terceras personas para cancelar los compromisos económicos adquiridos con éstas.
PARÁGRAFO: En caso que las partes terminen unilateralmente el contrato sin justa causa, se dará cumplimiento a lo previsto en el artículo 64 del C.S.T., modificado por el Art. 28 de la Ley 789 de 2002.
UNILATERAL TERMINATION: Besides those indicated in article 7 of Decree 2351 of 1965 and those foreseen in the Rules of Procedure of the University, the following are considered just causes to terminate this contract: a) The fact that the Employee and/or Teacher attends the workplace under the effects of alcohol even for the first time. b) The fact that the Employee and/or Teacher leaves the workplace without permission of his/her superiors. c) The absence to one or more complete work sessions, without an acceptable excuse subject to the judgment of the University. d) The reception in person or through a third party of money or securities destined to the University under any title, without previous authorization to do it. e) Any violation committed by the teacher to the obligations and duties dealt with in this contract and especially to those set forth in the Rules of Procedure of the University and the current labor laws. f) Non-compliance of the working schedule. g) The fact of revealing technical, industrial, commercial processes or information which the University considers to be reserved and which he/she has learned due to the services provided to it. h) The expiry of the established time period. i) Taking advantage in his own benefit of the money which is given to him/her by the University or its representatives destined to third parties to pay economic obligations undertaken with them..
LIQUIDACIÓN DEL CONTRATO: En consideración a que toda liquidación y pago de salarios y prestaciones sociales exige varios días para obtener los datos contables, revisarlos, hacer la liquidación definitiva, ser aprobados por las partes, girar los cheques, etc, y en muchos casos es necesario hacer entrega del cargo y probar que el profesor/empleado no ha incurrido en acto que pueda afectar dicha operación, las partes convienen en fijar un plazo no superior a veinte (20) días hábiles que se considera razonable para estos efectos, contados a partir de la fecha de terminación del contrato; durante este lapso la Universidad procederá a liquidar y a pagar los salarios, indemnizaciones y prestaciones debidas sin que para ello incurra en xxxx ni quede obligada a la indemnización, en los términos del artículo 65 del C.S.T.
LIQUIDATION OF THE CONTRACT: Considering that every liquidation and payment of salaries and social benefits demands several days to obtain and check the accounting information, make the definite liquidation, be approved by the parties, write the checks, etc. and in many cases it is necessary to hand over the position and prove that the teacher/worker has not taken part in any activity that may affect such operation, the parties agree to fix a period not greater than twenty (20) business days which is considered to be reasonable for this effects, starting from the termination date of the contract; during this time period, the University will proceed to liquidate and pay the due salaries, compensations and benefits without incurring in debt or being obliged to make compensation, under the terms of article 65 of the Substantive Labor Code.
UTILIZACIÓN DE EQUIPOS DE SISTEMAS: Las partes convienen expresamente que cuando los Profesores y Empleados utilicen los equipos de sistemas de la Universidad para cualquier finalidad informática autorizada por la misma, les queda expresamente prohibido utilizar software que no cuente con la protección legal de los derechos de autor, es decir, los denominados comúnmente como "piratas", la violación a esta prohibición se califica de falta grave y dará derecho a la Universidad a imponer las sanciones previstas en la ley, en el contrato y en el Reglamento Interno de Trabajo, e inclusive la finalización del mismo por justa causa, aún por primera vez.
USE OF COMPUTERS AND SYSTEMS EQUIPMENT: The parties expressly agree that when the Teachers and Employees use the computers and computing equipment of the University for any purpose authorized by it, they are expressly forbidden to use software that does not have the legal protection of copyright, in other words, those known as “pirate”, the violation to this prohibition is considered a serious offence and the University will have the right to execute the sanctions foreseen by the law, the contract and the Rules of Procedure, and even the termination of the contract with just cause, despite it being the first time.
ACCESO AL PARQUEADERO: La Universidad le permitirá al profesor/empleado acceso al parqueadero siempre y cuando exista disponibilidad de cupo y se cancele el valor de la mensualidad establecida por la Universidad, que será descontado xxx xxxxxx mensual del profesor/empleado lo cual éste autoriza expresamente en los términos de los artículos 59 ord. 1 y 149 del C.S.T. La Universidad reajustará el valor mensual cuando a su juicio lo considere conveniente.
PARKING ACCESS: The University will allow the teacher/worker access to the parking lot as long as there is space availability and the monthly value established by the University has been paid, which will be deducted from the monthly salary of the teacher/worker which he/she expressly authorizes in the terms of articles 59 ord. and 149 of the Substantive Labor Code. The University will re-adjust the monthly value under its own judgment when considered convenient.
CONFIDENCIALIDAD: El Profesor y/o Empleado deberá guardar absoluta reserva sobre toda la información de cualquier tipo que se encuentre en bases de datos o en bancos de datos, que le sea dada a conocer en desarrollo de su relación laboral y, se compromete a conservar y mantener de manera estrictamente confidencial y no revelarla a terceros, incluyendo de manera enunciativa y no taxativa, las fórmulas, procedimientos, técnicas Know-How y demás informaciones en general a que puedan tener acceso, en orden a evitar perjuicios a la Universidad de los Andes derivada de una eventual infidencia en el manejo de la misma. PARÁGRAFO: La cláusula de confidencialidad del presente contrato, se deberá regir y estará sujeta a la reglamentación sobre Informaciones Confidenciales y Secretos Empresariales de que tratan los artículos 260 a 266 de la Decisión 486 de 2000 de la Comisión del Acuerdo xx Xxxxxxxxx, que creó un régimen común sobre propiedad industrial para los cinco países del Pacto Xxxxxx (hoy Comunidad Andina de Naciones- CAN).
CONFIDENTIALITY: The Teacher and/or Employee shall keep absolute confidentiality about all the information of any type found in databases or databanks, given to him/her during the development of his/her working relation and commits to keep it and maintain it in a strictly confidential manner and not to reveal it to third parties, including but not limited to formulas, procedures, know-how techniques and other general information to which they may have access, in order to avoid detriment to Los Andes University derived from an eventual breach of trust in its management. PARAGRAPH: The confidentiality clause of this contract, shall be ruled by and be subject to the regulations on Confidential Information and Corporate Secrets dealt with in articles 260 to 266 of Decision 486 of 2000 from the Commission of the Cartagena Agreement, which created a set of common rules on industrial property for the five countries of the Andean Pact (today Andean community of Nations – CAN).
DATOS PERSONALES. El Profesor/Empleado autoriza de manera libre y voluntaria a la Universidad a recopilar, utilizar, transferir, almacenar, consultar, procesar, y en general a dar tratamiento a la información personal que éste ha suministrado a La Universidad, de conformidad con lo dispuesto en el ley 1581 de 2012 y el Decreto Reglamentario 1377 de 2013 , la cual se encuentra contenida en las bases de datos y archivo de propiedad de La Universidad, para los fines internos que sean necesarios, tales como asuntos relacionados con su documento de identificación, número de identificación, nacionalidad, país de residencia, dirección, teléfono, estado civil, correo electrónico corporativo y personal, salario, y cuenta bancaria.
PERSONAL INFORMATION. The Teacher/Worker freely and voluntarily authorizes the University to collect, use, transfer, store, consult, process and in general to handle the personal information which he/she has provided to The University, pursuant to the provisions in Law 1581 of 2012 and Regulatory Decree 1377 of 2013, which is contained in the databases and the file property of the University, for the necessary internal purposes, such as issues related to his identification document, identification number nationality, country of residence, address, telephone, marital status, corporate and personal e-mail address, salary and bank account.
EFECTOS: Las partes manifiestan que no reconocerán validez a estipulaciones verbales relacionadas con el presente contrato, el cual constituye el acuerdo completo y total acerca de su objeto y reemplaza y deja sin efecto algún o cualquier otro contrato verbal o escrito entre las mismas partes con anterioridad.
EFFECTS: The parties express that they will not acknowledge any validity to verbal stipulations related to this contract, which constitutes the complete and total agreement regarding its object and replaces and renders completely void any other verbal or written agreement previously made between the same parties.
