ASPECTOS GENERALES DE LA CONTRATACIÓN:
Art. 1 Objeto. El objeto de las presentes condiciones es regular el acuerdo contractual entre los expositores y la Asociación de Cuchillería y Afines de Albacete (APRECU); por el citado acuerdo, APRECU cede temporalmente al expositor un espacio dentro del certamen a cambio de que el expositor participe en el mismo, abonando un canon determinado y obligándose al cumplimiento de las presentes condiciones.
Art. 2 Partes Intervinientes. Se entiende por parte cada una de las personas físicas o jurídicas intervinientes en el presente y que suscriben el mismo. En adelante nos referiremos a ellas como APRECU u organización para referirnos a la Asociación de Cuchillería y Afines de Albacete y por otra al expositor o expositores.
Art. 3 Duración. Se celebrará el día 10 xx Xxxxx 2022.
Art. 4. Aceptación. Las partes intervinientes aceptan las presentes condiciones de participación y las disposiciones que para la organización del Certamen tome la Asociación.
4.1 La aceptación de la participación queda reservada APRECU, determinando si se ajustan o no las peticiones recibidas a las calidad del Certamen, en este último caso, se procederá a la devolución de las cantidades ya ingresadas. Queda reservado el derecho de admisión, sin que la Asociación esté obligada a manifestar las razones de su negativa, en tal caso se procedería a la devolución de las cantidades pagadas. Art. 5 Obligaciones de las Partes
5.1 Obligaciones del expositor Los expositores se obligan:
- A participar en el certamen.
- A aceptar las presentes condiciones de participación, disposiciones y normas de montaje/ desmontaje.
-A pagar en los plazos establecidos las cantidades dispuestas en el presente.
-Los productos a exponer deberán llevar la marca del fabricante. En el caso de exponer productos de diferentes fabricantes, deberá de informar, a través del contrato, a la organización.
-NO SE ADMITIRÁ PRODUCTOS SIN MARCA (no se considerará marca el nombre de la ciudad de origen o procedencia de ese producto).
5.2 Obligaciones de APRECU. La Asociación de Cuchillería y Afines, APRECU se obliga a: Ceder temporalmente al expositor un espacio dentro del Certamen y al cumplimiento de las presentes condiciones. Art. 6 Participación. Podrán solicitar su participación en el Certamen aquellas personas físicas o jurídicas cuyas actividades se consideren por la Asociación incluidas en los productos y sectores objetos de la manifestación. El expositor debe ser aprobado por un comité de expertos. Para ello es obligatorio enviar dos fotografías (por email) y enlace a página web.
Art. 7 Solicitud de participación y espacio. La solicitud de participación y espacio deberá formularse a través de la ficha adjunta, aceptando el expositor íntegramente las condiciones de participación.
Art. 8 Adjudicación de espacios. APRECU, adjudicará los espacios en función de la fecha de entrada de la solicitud al certamen cumplimentada con el pago correspondiente. La admisión de solicitudes quedará cerrada en el momento que no queden espacios comerciales disponibles.
Art. 9 Renuncia del expositor. La renuncia del expositor a la participación en el certamen es motivo de pérdida de la cantidad adelantada.
Art. 10 Canon de ocupación de espacios. Pago. Para participar en el certamen, el expositor abonará un CANON DE OCUPACIÓN DE ESPACIOS que será de 200 €+ IVA por mesa de venta directa (tamaño 1,80 x 80cm) o de 1000€+ IVA por stand (tamaño 4x2m). Los asociados de APRECU, tendrán descuentos sobre este coste. El canon de ocupación de espacios representa exclusivamente el alquiler del espacio contratado, desde la fecha señalada para el inicio del montaje, durante la celebración y hasta el plazo acordado por la Asociación para desmontaje y retirada de objetos en el certamen.
10.1 Plazo de inscripción: El plazo de inscripción para la contratación de espacios finalizará el día 25/04/2022.
10.2 Condiciones y forma de pago: Los abonos para la reserva xx xxxx expositora se realizarán en el momento de la firma del contrato, debiendo abonar el 100% del coste. Art. 11 Penalizaciones. Penalización por falta de pago: En caso de no realizar el pago en el plazo establecido, el expositor perderá todos los derechos sobre el espacio reservado, pasando dicho espacio a disposición de la organización que podrá ofertarlo a otras empresas. En todo caso no se autorizará la ocupación del espacio de exposición que no haya sido abonado en su totalidad en los plazos establecidos. Penalización por deterioro de las instalaciones. El expositor que cause cualquier deterioro en el espacio expositivo, deberá abonar los gastos derivados de los daños ocasionados.
Art. 12 Reclamaciones. Cualquier tipo de reclamación en relación con el certamen deberá comunicarse por escrito el mismo día en el que se produzcan las incidencias.
Art. 13 Desconvocatoria o suspensión. Por causas imputables a APRECU: Los expositores tendrán derecho a la devolución de las cantidades entregadas hasta dicho momento por desconvocatoria o suspensión, sin que el expositor pueda presentar reclamación alguna por presuntos daños como consecuencia de la anulación, desconvocatoria o suspensión del mismo. Por causas no imputables a la Asociación: Se considera que no es causa imputable a la Asociación la desconvocatoria o suspensión temporal, definitiva, total o parcial del certamen por razones de caso fortuito o fuerza mayor, entendiendo como tales además de las deniciones al uso, otras con origen en terceros tales como huelgas, cortes de suministro de agua y electricidad o casos de similar gravedad.
NORMATIVA XXX XXXXXXX
Art .14 Acceso expositores. A su llegada, la organización entregará al expositor la acreditación que será necesaria para acceder a las instalaciones del certamen durante la celebración de la muestra. La Organización se reserva el derecho de solicitarla cuando lo estime conveniente.
Art .15 Retirada de mercancías y desmontaje. Se realizará obligatoriamente una vez finalizado el Certamen La organización se compromete a facilitar una hora para el desmontaje.
Art. 16 Horario del certamen. 00 xx xxxxx 0000 :10:00h a 13:00h y de 16:00h a 18:00h. El horario puede sufrir cambios que serán debidamente informados a los expositores.
Art. 17 Actividades no permitidas. Además de lo dispuesto en las presentes condiciones no está permitido:
-La perforación del pavimento xxx xxxxxxx.
-Clavar, agujerear, pintar o utilizar cualquier material adhesivo en las paredes.
-Realizar actividades que supongan riesgo de accidente.
-La colocación de materiales u objetos en los espacios de otros expositores, en los pasillos, zonas comunes y entradas al recinto.
-Manipular dentro xxx xxxxxxx materias inflamables o peligrosas que puedan causar daños a terceros. OTRAS OBLIGACIONES
Art. 18 Cesión de espacios y derechos sobre espacios. Queda prohibida la cesión y el subarriendo total oparcial de los espacios a terceros así como los derechos de los mismos.
NORMATIVA EN MATERIA DE SEGURIDAD
Art. 19 Cumplimiento de la normativa en prevención de riesgos laborales. El expositor se compromete a cumplir la normativa vigente en materia de Prevención de Riesgos Laborales que sea de aplicación en relación con elementos expuestos, montaje, decoración, transporte de mercancías, y todos aquellos que procedan resultantes de las presentes condiciones.
Art. 20 Exención de responsabilidad. La Organización no se responsabilizará de las pérdidas producidas en el material y objetos depositados en cada stand por hurto, robo o daños en cualquier momento antes, después o durante el certamen. Tampoco se responsabiliza de los posibles daños causados a las personas con motivo de la celebración del certamen, ni de la seguridad y solidez de los stands y sus instalaciones y móviles. La Organización no se responsabiliza por pérdidas o daños originados por caídas de tensión o corte de suministro en la alimentación de corriente, renunciando los expositores en forma expresa al ejercicio de cualquier acción o reclamación por daños y perjuicios La Organización tiene un seguro de responsabilidad civil para los daños y perjuicios que pudiesen causarse por la misma a terceros involuntariamente de manera extracontractual, con las exclusiones y para los casos que en las presentes se determinan. Está cubierta la responsabilidad civil de explotación y la patronal en los términos que expresa el citado contrato de seguro.
NORMATIVA LEGAL:
Art. 21 Propiedad Intelectual y otros.
- Catálogo del certamen: La organización publicará un folleto informativo que recogerá la relación de todos los expositores. La inserción en este catálogo es de carácter gratuito, incluyendo dirección completa, especialidades, relación de productos expuestos, etc. Todo expositor puede disponer de ejemplares del mismo.
- Otros aspectos legales: El expositor autoriza a que los datos no personales de su empresa o actividad puedan ser publicados en formato papel, digital: Internet o cualquier otro soporte a efectos comerciales y/o de publicidad de las actividades que realice la Asociación.
PROTECCIÓN DE DATOS DE CARÁCTER PERSONAL
Art. 22. Normativa. En cumplimiento de la normativa vigente de Protección de Datos de Carácter Personal, los datos personales que la persona física y/o expositor nos suministre, serán incorporados a un fichero mixto con las siguientes finalidades: Contactar con las empresas expositoras mediante la persona de contacto que figura en el mismo. Gestión de clientes y/o proveedores; mantenimiento de la relación contractual, precontractual con gestión de tareas administrativas y otras; envío comunicaciones de interés para el solicitante y/o publicación en medios de comunicación. Autoriza expresamente a que sus datos sean cedidos a Organismos de la Seguridad Social, Registros Públicos, Administración Tributaria, otros Órganos de la Administración Pública, Entidades Bancarias entidades aseguradoras, Mutualidades y aquellas que procedan para el cumplimiento de la legalidad. El firmante acepta expresamente que sus datos se traten de la forma expuesta en este artículo. Puede ejercitar los derechos de acceso, rectificación, cancelación y oposición dirigiéndose por escrito a:

GENERAL CONDITIONS OF CONTRACT
Art. 1 Purpose: The purpose of these conditions is to regulate the contract agreement signed between the exhibitors and the Albacete Association of Cutlery (Aprecu); by this agreement temporarily cedes a space to the exhibitor within the event in exchange of the participation of the exhibitor in the event, prior payment of a determined payment fee, being obligated to comply with the conditions contained within this document.
Art. 2 Parties to the contract: Party is understood to be anyone of the natural or legal person which are participants, and signers of this contract. From now on, we will refer to the parties as APRECU or organization, in reference to the Albacete Association of Cutlery and the other in reference to the exhibitor or exhibitors.
Art. 3 Duration: T he 10th of June 2022.
Art. 4 Acceptance: The parties of the contract accept the participation conditions contained herein and the regulations which the Association establishes for the organization of the event.
4.1 The acceptance of participation is a right reserved to APRECU, who will decide if the applications received accomplish with the aims of the event. If this is not the case, any payments made will be duly returned. The right of admission is reserved, without the Association being obligated to give a reason for non- admission, in such case the payments made will be duly returned.
Obligations of the parties:
Art. 5.1 The exhibitors are obligated to:
- To participate in the event.
-To accept the conditions of participation, provisions and norms established by the organization.
-To pay within the timeframe established herein.
-The exhibitors mustn’t leave his exhibition space until the finalization of the event.
-The products of exhibition and sale, must contain the name brand of the knife manufacturer. If the exhibitor is exhibiting products from different manufacturers, he must communicate it to the Association.
-NO BRAND PRODUCTS WILL BE ADMITTED (the name of the city of origin or origin of that product will not be considered brand).
5.2 OBLIGATIONS OF APRECU The Association is obligated to cede temporarily a space within the eventand to comply with the conditions contained herein.
Art. 6 PARTICIPATION. May apply to participate in the event, those natural or legal persons whose activities are considered by the Association to be included among the products and sectors at which the event is aimed. The exhibitor shall be approved by an expert committee. For that, it’s mandatory to send two photographs (email) and website link.
Art. 7 Application for participation and space. The application for participation and space has to be submitted via the official form attached. By completing the form the exhibitor fully accepts the condition of participation as an indispensable requirement for the admission of the event.
Art. 8 Adjudication of spaces. Adjudication method: The spaces will be adjudicated on the basis of order of the receipt of the official application form with the corresponding payment.
The admission of applications will be closed immediately once there are no more commercial spaces available. Art. 9 Exhibitor waiver. The waiver of the exhibitor to participate in the event is considered a motive for the loss of madding payments.
Art. 10 Space occupation fee: Payment. In order to participate in the event, the exhibitor has to pay a SPACE OCCUPATION FEE of 200€ for an exhibiting/sales desk (size of sales desk 1, 80 x 60cm) or 1000€ for a stand(4x2 m ). APRECU’s members will have discounts. The space occupation fee represents exclusively the rental of the contracted space, from the date indicated for the beginning of the assembly, during the celebration and until the period agreed by the Association for dissembling and removal of objects in the contest.
10.1 Deadline. Payment to the Association for the services contracted will be adjusted to the deadline 25/04/2022.

Xxx. 00 Xxxxxxxxx. Penalty for non-payment. If payment is not received within the set deadline, the exhibitor will lose all the reserve rights of the space and it will be at the disposal of the organization which will be able to offer it to other companies. In any case, the space occupation will not be authorized until the total payment of the space within the established deadlines. Penalty for facilities damage. Any exhibitor causing damage to will be required to pay the expenses derivative from the damages.
Art. 12 Complaints. The complaints related with the event must be communicated in writing on the same day of the happening incident.
Art. 13 Cancellation or suspension. Due to reasons attributable to the Association: Exhibitors will have the right to have any amounts paid up to the date of cancellation or suspension refunded, without the exhibitor being able to present any claim for damages in consequence of the cancellation or suspension of the event. Due to reasons not attributable to the Association: Any partial or total cancellation or suspension of the event for acts of God or force majeure is not considered attributable to the Association, understanding as such, any other reason originated by third parties such as strikes, cuts in power or water supply or other cases of similar gravity.
EXHIBITION CENTRE REGULATIONS
Art. 14 Exhibitor Access. The exhibitor must carry on the accreditation all the time during the event. Aprecu, reserves the right to request the accreditation whenever they deem it necessary.
Art. 15 Disassembly: The exhibitions space must be disassembled once the event is finished and within a period of time established.
Art. 16 Schedule: June 10th 2022: 10:00 a.m. to 13 p.m. ; 16 p.m. to 18 p.m. The schedule may undergo changes that will be duly informed to the exhibitors.
Art. 17 Unpermitted activities: Apart from the provisions contained herein the following are not permitted:
- Nailing, making holes, painting or using any sticky material on the walls.
- Activities which may cause accidents.
- Placing materials or objects in the spaces of other exhibitors, in corridors, common areas and entrances of the installations.
- Handling inflammable or dangerous materials in the installations which could harm third parties. OTHER OBLIGATIONS
Art. 18 Leasing of spaces and rights over spaces. The partial or total lease or sublease of spaces and their rights to third parties is prohibited.
SAFETY REGULATIONS
Art. 19 Compliance with occupational health and safety regulations: accident and casualty prevention. The exhibitor agrees to comply with the current regulations in occupational health and safety which may be applied to exhibited elements, stand assembly, decoration, transport of goods, and all elements of the conditions contained herein.
Art. 20 Exemption of responsibility. Aprecu will not be held responsible for losses produced in materials and objects left in each stand, for robbery, theft or damage at any time: before, during or after the event. Aprecu will not be responsible for possible damage caused to people through the celebration of the event, nor for the safety and structural strength of the stands and their fixed or mobile installations. It is not responsible for loss or damage caused by voltage drops, or interruptions of the electricity supply, for which the exhibitors expressly waive the right to any legal action or claim for damage or loss. Aprecu holds an insurance policy of civil responsibility for damage or loss which might be cause to third parties either involuntarily or extra contractually, with the exceptions or
determined cases contained herein. The employers’ liabilities and operating liabilities are covered in the terms set out in the aforesaid insurance contract.
LEGAL REGUALTIONS:
Art. 21 Intellectual property and others:
- Event catalogue:
The Association will publish an official catalogue which will include a list of all the exhibitors. The inclusion in this catalogue is free of charge, including the complete address, specialties, brands, list of products exhibited, etc. Every exhibitor has the right to receive two copies of this catalogue.
- Other legal aspects:
The exhibitor authorizes the publication of non-personal information of his company and activities in paper or digital format: internet or any other media for business purposes and/or publicity of the activities carried out by the Association.
PROTECTION OF PERSONAL INFORMATION
Art. 22 Regulations. In compliance with the current regulations for the protection of personal information, the personal information provided by individuals and/or exhibitors, will be included in a mixed file for the following purposes: To contact the exhibiting companies through the contact person included in the information. Management of clients and suppliers; maintenance of pre-contractual and contractual relations with management of administrative tasks and others; sending of communication of interest to the applicant and for publication in the media.
