--DIECISIETE: LA SEGUNDA PARTE certifica y someterá la evidencia y certificaciones que a dichos efectos le requiere la ODSEC que demuestren al momento de suscribir este Contrato que ha cumplido y no tiene deudas pendientes, está exento o tiene un plan de pago en cuanto a lo siguiente: a) Ha rendido sus planillas de contribuciones sobre ingresos durante los cinco (5) años previos a este Contrato y por el año corriente. b) No tiene deudas por tales conceptos, por contribución sobre la propiedad mueble o inmueble o por cualquier otro tipo de contribución, arbitrio o licencia con el Gobierno de Puerto Rico con algún municipio. c) No tiene deudas con el Departamento del Trabajo. d) No tiene deuda por concepto del pago xx xxxxxx del Fondo del Seguro del Estado. e) No está obligado a pagar una pensión de alimentos y que de al presente no adeuda cantidad alguna por tal concepto; o está acogido a un plan de pago cuyos términos cumple fielmente; según lo dispone la Ley Núm. 5 del 30 de diciembre de 1986, según enmendada. --DIECIOCHO: LA SEGUNDA PARTE certifica que no ha sido convicto de delitos contra la integridad pública, según definido en el código penal o malversación de fondos públicos y que no se ha declarado culpable de este tipo de delitos en los Tribunales del Estado Libre Asociado de Puerto Rico, en los Tribunales Federales o en el Tribunal de cualquier jurisdicción de los Estados Unidos de América. network and the quality of customers' wireless experience. may use location information to aggregate data from which End Users' personally identifiable information has removed or obscured. Such aggregate data may be used for a variety of purposes such as scientific and marketing research and services such as vehicle traffic volume is responsibility to notify CRUs on Customer's account that may collect and use location information from their Equipment. The Equipment is capable of purchasing and using optional goods, and sewices (at Customer's request or the request of a CRU on Customer's account) offered by or third that make use of the Equipment's location information ("Location-Based Sewices"). Customer should review, and will advise of CRUs to read, the Sales Information and the associated privacy policy for each Location-Based Service to learn how the location information will be used and protected. 10.8 411 Info. diredory assistance sewice (411) may use the location of Equipment to deliver relevant customized 411 information based upon an End User's request for a or other 411 sewice. Customer understands, and will advise of its CRUs, that by using this diredory assistance sewice, the CRU is consenting to use of the location information for such purpose. This location information may be disclosed to a third party to the directory assistance sewice and for no other purpose. Such location information will be retained only as long as is necessary to the relevant customized 411 information and will be discarded after such use. Customer and
its CRUs may refer to privacy policy at for additional details.
10.9 American Recovery and Reinvestment Act. Under certain funds provided under the American Recovery and Reinvestment Act of 2009 ("ARRA") may be to certain restrictions, requirements and reporting obligations. may be subject to of these restrictions, requirements and reporting obligations when Sewice, Equipment Supplemental Services are purchased with ARRA funds. order to comply with the restrictions, requirements and reporting obligations associated with the use of ARRA funds (if any), must be apprised of them before provisioning the Service, Equipment andlor Supplemental Sewices. Accordingly, the Service, Equipment Supplemental Sewices provided under this Agreement shall not be used support the performance of any poriion of a or program which has funded whole or part with grants, loans or payments made pursuant to the ARRA, without the prior written agreement of and Customer regarding any specifically applicable terms, conditions and requirements. Customer shall

12.1 Defined Terms. of the party's business or stock and may assign its right to receive payments hereunder. Subject to the foregoing, this Agreement will be binding upon the assignees of the respective

12.6 Confidentiality. The terms and conditions of this Agreement are confidential and will not be disclosed by a party to any third party without the other party's prior written consent (except that each party may disclose the terrns and conditions of this Agreement to its and, in the case of its agents and subcontractors, who a need to know the terms and conditions of the Agreement.) Nothing herein will prevent or Customer from supplying such information or making such statements or disclosures relating to this Agreement before any competent governmental authority, court or agency, oras such party may consider necessary in order to satisfy its obligations under applicable laws, regulations or generally accepted accounting without lirnitation, staternents or disclosures to such party's or accountants). Such party will furnish notice thereof to the other party prior to such disclosure unless such disclosure is in to a requirement or request from a court or governrnental agency regarding a criminal inquiry or matter, in which case no prior notice will be required.
