A Megállapodás célja és alkalmazási területe. A Felek jelen Megállapodást az Igénybe vevő földgázszállító rendszerhasználói jogosultságára tekintettel kötik meg, amelyben meghatározzák a Felek közötti - ÜKSZ szerinti - Informatikai Platformra vonatkozó kommunikáció feltételeit. A Szolgáltató a jelen Megállapodás létrejöttét követő harmadik (3.) munkanaptól biztosítja az Igénybe vevő részére az Informatikai Platformhoz történő hozzáférést, az Igénybe vevő pedig az Informatikai Platformhoz történő hozzáférés keretében jogosult az ÜKSZ-ben meghatározott informatikai szolgáltatások igénybevételére, így különösen a Szolgáltató által kezelt információ Igénybe vevőre vonatkozó, illetékesség alapú megtekintésére, valamint az Igénybe vevő ÜKSZ szerinti adatszolgáltatási kötelezettségeinek teljesítésére. A Felek rögzítik, hogy a Szolgáltató Üzletszabályzatában, valamint jogszabályban foglaltak alapján a Szolgáltató külön díjazás nélkül biztosítja az Igénybe vevő részére a jelen Megállapodás szerinti szolgáltatások igénybevételét. Jelen Megállapodás általános és diszkrimináció-mentes keretet biztosít a fenti informatikai szolgáltatások igénybevételére minden arra jogosult Igénybe vevő részére. A Megállapodás megkötése a földgázellátásról szóló törvény végrehajtásáról szóló 19/2009. (I 30) Korm. rendelet (továbbiakban: Vhr.) rendelkezése alapján az ÜKSZ rendszerhasználó általi elfogadásának minősül. 1. Aim and scope of the Contract This Contract shall be concluded by the Parties in view of the natural gas transmission network usage right of the User, in which the Parties shall lay down the conditions of communication between the Parties in respect of the Informatic Platform, as specified under the BCC. The Service Provider shall provide access to the Informatic Platform for the User as of the third (3rd) business day following the conclusion of this Contract, and the User shall be entitled to use the IT services specified under the BCC within the scope of the access to the Informatic Platform, with special regard to the User related, competence based viewing of the information managed by the Service Provider, and compliance with the User’s data supply obligations as per the BCC. The Parties state that based on those specified in the Business Code of the Service Provider and by the law, the Service Provider shall provide to the User the use of the services specified herein without separate charge. This Contract provides a general and non- discriminatory framework for the use of the above IT services for all eligible Users. Based on the provision of Decree No. 19/2009. (I.30.) on the implementation of the Act on natural gas supply (hereinafter: “IDecr”), the conclusion of the Contract shall be interpreted as the adoption of the BCC by the Network User. 2.
