Rental Contracts. VI.1 Bankcard Registration Fee VI.1.1 Under the Pay As You Go Framework Contract, a Rental Contract may only be established if the one-time Bankcard Registration Fee of gross 120 HUF was successfully collected from the User’s registered bankcard. Accordingly, it is an express condition of establishment of Pay As You Go Framework Contract (and associated Rental Contracts) that the funds available in the bank account linked to the bankcard used cover the amount of the Bankcard Registration Fee at the time of contracting. VI.1.2 The Bankcard Registration Fee is not collected to conclude Rental Contracts after the purchase of a pass: in that case, only the price of the selected MOL Bubi pass shall be deducted from the Client’s registered bankcard, which functions as the Bankcard Registration Fee. VI.1.3 The bankcard registered by the Client provides coverage for all fee-related claims resulting from Rental Contracts. BKK is authorised to enforce its arising claims directly from the bankcard. The registered bankcard serves to cover claims against the User for payment of fees; however, if the deposit should not prove to be sufficient to cover all claims against the User, the User shall be liable for full payment of the remaining claims. BKK may apply all legally available options for the enforcement of claims and of compensation for damages in order to collect fees owed to them arising from the User’s activities but not covered by the registered bankcard. Likewise, if it is for any reason - through no fault of BKK Zrt. - not possible to charge the registered bankcard, the User is required to repay the full amount of fees owed to BKK. VI.1.4 BKK is entitled to involve a third party as an intermediary in the management and collection of claims, who shall act in the name of and on behalf of BKK in the enforcement of claims, even without assigning the claim. In addition, BKK reserves the right to assign its legitimate claims to a third party in accordance with provisions 6:193-6:201 of the Civil Code. The User acknowledges and accepts that if BKK assigns its claim against the User to a third party or, even without assignment, involves a third party in the process of asserting or collecting the claim, BKK will transfer the personal data processed to the assignee or to third parties involved in the assertion or collection of the claim by BKK.
