Contratto di Noleggio
1 – Tvr Moto S.n.c. di Xxxxx Xxxxxxx & Xxxxxxxx Xxxx (qui di seguito denominata LOCATORE) consegna al locatario (qui di seguito denominato CLIENTE) la motocicletta che ha il serbatoio pieno di carburante al rientro dovrà essere riconsegnato con il serbatoio pieno di carburante, altrimenti verrà addebitato un supplemento per il servizio di rifornimento pari al costo dello stesso, più il carburante), è dotato della carta verde assicurativa e di tutti i documenti necessari, incluso il certificato e il contrassegno di assicurazione, nonché degli altri accessori. Il Cliente prendendo la motocicletta, riconosce che la medesima è in ottimo stato di manutenzione ed idoneo all’uso pattuito.
2 - Il locatore garantisce che contro la responsabilità civile del Cliente e di qualsiasi altra persona autorizzata a condurre la motocicletta (come da contratto) è in vigore una normale polizza assicurativa che prevede una garanzia con massimale unico di Eur 1.220.000,00 per danni alle cose o animali, e di Eur 6.070.000,00 a persone. In caso di eccedenza dal predetto massimale il Cliente si assume la responsabilità esclusiva e personale esonerando il Locatore nei confronti di terzi. La polizza non copre i danni subiti dal guidatore salvo espressa richiesta del Cliente a pagamento come da contratto, né la sua responsabilità civile per i danni riportati dai terzi trasportati, così come specificato nella polizza di assicurazione, le cui clausole e condizioni il Cliente dichiara di accettare e di impegnarsi a rispettare.
3 - OBBLIGHI DEL CLIENTE
Il Cliente si obbliga: a) a condurre il veicolo, e a custodirlo assieme agli accessori e documenti, diligentemente e nel rispetto di tutte le norme di legge; b) a curarne la manutenzione ordinaria, l’ingrassaggio, il controllo dei livelli dei lubrificanti e l’olio dei freni; c) a procedere all’oblazione anche successivamente alla riconsegna del veicolo di qualsiasi contravvenzione incorsa durante la locazione e a rimborsare il Locatore di qualsiasi altra spesa sostenuta ed in ogni caso la semplice notificazione del verbale di contestazione della multa, dà diritto al Locatore di addebitare forfettariamente la somma di Eur 35,00 per spese inerenti. Il Cliente accetta sin d’ora di pagare tale cifra a mezzo di carta di credito tipo Visa, American Express, etc.; d) a tenere indenne il Locatore da qualsiasi pretesa avanzata da terzi per danni da essi subiti nei beni trasportati o comunque trovatisi sul veicolo. Il Cliente riconosce di non essere titolare di alcun diritto reale sulla motocicletta e di non poterne, pertanto, disporre neanche a guisa di pegno.
4 -Il Cliente si impegna a non condurre od usare la motocicletta, e a non permettere e/o tollerare che altri lo conduca od usi; a) in uno stato diverso da: Italia, Francia, Germania, Spagna, Portogallo, Andorra, Città del Vaticano, San Marino, Principato di Monaco, Svizzera, Belgio, Olanda, Svezia, Danimarca, Norvegia, Finlandia, Liechtestein, Corsica, Inghilterra, Irlanda, Lussemburgo; b) inoltre, senza escludere gli obblighi del precedente punto a), ove non sia valida la carta assicurativa o dove vi siano disordini politici; c) per il trasporto di persone o di cose; d) competizioni o prove di velocità; e) in eccesso di velocità; f) per uno scopo contrario alla legge; g) se si tratta di persona non indicata a pag.1 della lettera di noleggio o in stato di ebrezza; h) se si tratta di persona che ha fornito al Locatore informazioni false circa la propria età, nome, indirizzo, luogo e data di riconsegna del veicolo a fine nolo. Il cliente si obbliga a non consentire in alcun caso che il veicolo sia condotto da persona di età inferiore a 21 anni o superiore a 73 anni, o priva di patente di guida valida nello stato nel quale il veicolo è condotto. In ogni caso il cliente è tenuto ad osservare la normativa prevista dal nuovo codice della strada.
5 - Il Cliente si obbliga a risarcire il Locatore di qualsiasi danno per qualsiasi ragione occorso al veicolo in ogni caso di sinistro avvenuto, senza una collisione con altro veicolo. Il Cliente si obbliga a risarcire al Locatore tutti i danni occorsi alla vettura ed alle successive sostituzioni di vetture oggetto del presente contratto. Qualora il danno sia avvenuto senza che violasse alcuna delle obbligazioni contrattualmente assunte e comunque senza sua colpa, la responsabilità del Cliente è tuttavia limitata alla franchigia dovuta in ogni caso all’incidente, stabilita dal tariffario vigente al momento della sottoscrizione del presente contratto, di cui dichiara di aver preso visione. Per avvalersi di tale limitazione di responsabilità il cliente è però tenuto a comunicare tassativamente nelle successive 24 ore per iscritto una relazione dettagliata o compilare il modello C.I.D. (constatazione amichevole), di cui il veicolo è provvisto, dell’avvenuto incidente. Siglando l’apposito riquadro nella lettera di noleggio, si acquista la Copertura Danni da Collisione (Cop. Xxxxx); il Cliente così è liberato dalle obbligazioni del presente articolo, qualora si tratti di danni occorsi in una collisione con un altro veicolo identificato e purché avvenuti senza violazione di norme penali, del codice della strada, e di alcuna delle obbligazioni previste dagli artt. 3 e 4 delle presenti condizioni generali. Non rientrano nella copertura danni: le ruote e i copri ruote, la parte sottostante del veicolo, lo smarrimento dei documenti del veicolo, nonché i danni derivanti dal rifornimento effettuato con carburante diverso da quello previsto per il veicolo noleggiato. Il Cliente si obbliga a rimborsare in contanti o ad autorizzare l’incasso mediante carta di credito finanziaria per l’intero ammontare della franchigia prevista per ogni singola vettura prima dell’inizio del noleggio a titolo cauzionale. L’importo depositato verrà restituito o sbloccato, in caso di autorizzazione ad incassare su carta di credito finanziaria, alla fine del noleggio se la vettura verrà riconsegnata integra e senza danni, in caso contrario il deposito verrà trattenuto per intero. In caso di incidente con ostacoli fissi, con automezzo o altro non identificato, al Cliente verranno addebitati di danni subiti dal veicolo e inoltre un importo secondo le nostre tariffe ufficiali pari a quello che sarebbe stato dovuto se il noleggio fosse proseguito per un periodo pari al tempo necessario per l’esecuzione delle riparazioni (tale periodo sarà determinato secondo le tabelle dell’ANIA in vigore al momento della consegna). In ogni caso il Cliente rimane responsabile per la franchigia stessa prevista dalle condizioni anche se ha acquistato e firmato per l’assicurazione copertura danni da collisione. L’addebito relativo ai pezzi di ricambio, manodopera o traino, s’intende ai prezzi di listino delle case fornitrici, oltre un importo secondo le nostre tariffe ufficiali pari a quello che sarebbe stato dovuto se il noleggio fosse proseguito per un periodo pari al tempo necessario per l’esecuzione delle riparazioni (tale periodo sarà determinato secondo le tabelle dell’ANIA in vigore al momento della consegna).
6 - Qualora accade un incidente, il Cliente si obbliga:
a) a informare immediatamente con una Mail con ricevuta di consegna o con una PEC il Locatore, trasmettendogli nelle successive 24 ore una relazione dettagliata compilata sul modulo accluso ai documenti del veicolo;
b) informare la più vicina autorità di Polizia e farsi rilasciare una copia del rapporto che deve essere inoltrata alla stazione di noleggio entro 24 ore;
c) compilare una constatazione amichevole di incidente in tutte le sue parti, firmarla e farla firmare alla controparte, prendendo nota dei nomi e degli indirizzi delle parti e dei testimoni, dei numeri di targa di tutti gli autoveicoli coinvolti, dei dati relativi all’assicurazione e alla proprietà di tali autoveicoli;
d) fornire al Locatore qualsiasi altra notizia utile;
e) seguire le istruzione che il Locatore fornirà relativamente alla custodia alle riparazioni del veicolo.
Nel caso in cui il Cliente non presenta la constatazione amichevole di incidente compilata in ogni sua parte, e firmata dalla controparte, insieme al rapporto compilato dalla Polizia o dalle Autorità del luogo, il Cliente rimane responsabile di tutti i danni del veicolo. Il Cliente è tenuto al pagamento dei danni in caso di sinistro anche se potenzialmente attivo se non può comunicare tutti i danni delle controparti. Numero di patente, nome, targa, numero di polizza, etc.
7 - Il Cliente si obbliga a riconsegnare il veicolo e le chiavi nel luogo ed entro la data indicata a pagina uno della lettera di noleggio o comunque appena il Locatore gliene faccia richiesta, con i medesimi accessori e nel medesimo stato nel quale l’ha ricevuta. Qualora il veicolo non sia riconsegnato al Locatore entro tale data, il Locatore potrà riprendere possesso materiale del veicolo in qualsiasi modo, anche contro la volontà del Cliente, e quest’ultimo sarà tenuto a rimborsarlo delle spese sostenute, anche mediante addebito su carta di credito. Il Locatore in questo caso è esonerato da qualsiasi responsabilità in ordine o eventuali oggetti che il Cliente abbia lasciato all’interno.
8 - Il Cliente si obbliga a corrispondere al Locatore, su sua richiesta, la tariffa chilometrica e la tariffa a tempo; la tariffa dovuta qualora il veicolo sia riconsegnato in luogo diverso dal luogo pattuito; IVA in vigore al momento della chiusura del contratto; la somma necessaria per riportare all’originario livello il serbatoio di benzina e/o gasolio, nonché le speciali tariffe previste per la “COPERTURA DANNI ”, la “COPERTURA FURTO E INCENDIO”, l’“ASSICURAZIONE PERSONALE”, Xxxxxxxxxx Xxxxx/Incendio/Danni e per il servizio di rifornimento se dovute. La tariffa chilometrica è determinata mediante lettura del contachilometri. Il Cliente è tenuto a controllare periodicamente che il contachilometri funzioni e si obbliga a far conoscere immediatamente al Locatore difetti di funzionamento, seguendo, in tal caso, le istruzioni che gli saranno impartite. Se al momento della riconsegna, il contachilometri appare manomesso o guasto, la tariffa chilometrica è determinata sulla base di una percorrenza di 250 chilometri al giorno oltre al danno provocato. Tutte le volte che si deve commisurare una tariffa al numero dei giorni, il termine “GIORNO” definisce un periodo di 24 ore, o frazione decorrente dal momento nel quale il veicolo è stato consegnato al Cliente, a meno che, la tariffa non preveda diversamente.
In ogni caso se il cliente lascia la vettura di qualsiasi gruppo in una stazione diversa da quella dove è iniziato il noleggio, sarà applicato il supplemento per i viaggi a lasciare (VAL) in base alle tariffe vigenti.
a) Deposito cauzionale che varia da € 750 a € 1500 da depositare tramite carta di credito/Contanti/Bonifico istantaneo, corrispondete alla franchigia assicurativa. In caso di furto/Danni il cliente risponde fino al 15% del valore del veicolo
b) Xxxxxx rimborso è previsto per rientri anticipati. Per recessi contrattuali in alta stagione, non saranno contemplati rimborsi. Per recessi contrattuali in bassa/ media stagione, il rimborso sarà del 50% fino a 2 giorni prima dell'inizio noleggio.
9 - Chi stipula la locazione in nome e per conto di un terzo risponde in solido con questi della piena osservanza degli obblighi contenuti a Lettera di Noleggio. Il Cliente risponde, in ogni caso, delle azioni ed omissioni di chiunque conduca il veicolo.
10 - In caso di furto o incendio del veicolo il Cliente si obbliga a denunciare il fatto alle Autorità di Polizia ed a consegnare al Locatore copia autentica della denuncia. In tal caso il nolo è dovuto fino alla data di consegna della copia della denuncia, alla tariffa concordata del noleggio o alla tariffa in vigore se la denuncia viene consegnata dopo la data di rientro prevista. Insieme con la copia della denuncia il Cliente dovrà riconsegnare al Locatore le chiavi del veicolo e dell’eventuale antifurto. Qualora egli non le riconsegni, sarà facoltà del Locatore esigere il pagamento di una somma pari all’intero valore del veicolo. Il Cliente si impegna quindi, su richiesta del Locatore, a pagare l’importo predetto. La polizza incendio e furto copre il valore del veicolo in eccedenza alla franchigia in vigore al momento della sottoscrizione del presente contratto. Il Cliente rimane responsabile della franchigia fissa, anche se ha accettato e acquistato l’assicurazione danni. Il Cliente dovrà versare l’intero ammontare della franchigia in vigore al momento dell’inizio del noleggio a titolo cauzionale, o autorizzarne l’incasso mediante carta di credito finanziaria. Questo importo verrà restituito o sbloccato alla fine del noleggio se il veicolo verrà riconsegnato integro e senza danni.
In caso di furto o incendio, anche parziale, la franchigia verrà trattenuta o incassata per intero.
11 - Sarà emessa fattura soltanto quando questa sia stata richiesta al momento della sottoscrizione del contratto di noleggio ed il Cliente abbia dichiarato codice fiscale o partita IVA.
12 - Esoneri, esclusioni, controversie, varie - Il Locatore non è responsabile nei confronti del Cliente o di qualsiasi altro soggetto per i danni subiti di qualsivoglia natura, incluso il pregiudizio economico alle persone o ai beni a causa di guasti, furti, incidenti stradali, tumulti, incendi, terremoti, guerre o causa di forza maggiore. Gli oggetti da chiunque lasciati sull’autoveicolo si intendono abbandonati ed il Locatore non è tenuto a custodirli né a restituirli.
13 - Il Locatore autorizza il Cliente a condurre la vettura all’estero, previa richiesta ed autorizzazione, (vedi art. 4 delle presenti Condizioni Generali), in regime di temporanea esportazione, escluso nei paesi dove esiste lo stato di guerra o disordini politici.
14 - Nessuna modifica può essere apportata alle presenti Condizioni Generali.
15 - Il pagamento dell’intero ammontare del noleggio è dovuto al momento della consegna del veicolo e del relativo contratto. Trascorso il termine pattuito, il Locatore è autorizzato ad emettere nota di addebito per interessi al tasso annuo ufficiale di sconto maggiorato di 8 punti, salvo il risarcimento dei maggiori danni, con decorrenza della data di stipulazione del noleggio.
16 - Atti vandalici: tutti i danni conseguenza di atti vandalici compiuti durante il periodo in cui il veicolo è stato in possesso del cliente, sono imputabili a quest’ultimo, che sarà tenuto al loro immediato risarcimento.
17 - Il testo in italiano delle presenti Condizioni Generali prevale in caso di divergenza sul testo inglese perché si presume che esso esprima tutta la volontà delle parti.
18 - Per qualsiasi controversia fra le parti è competente il Foro di Cuneo.

DELAYED CHARGE AGREEMENT
Il/La sottoscritto/a titolare della carta _ _- - -_ _utilizzata al momento del noleggio riconosce ed accetta sin d'ora tutte le spese (carburante, franchigie assicurative, multe o danni) rilevate o riscontrate dopo la consegna della vettura, ed autorizza Tvr Moto S.n.c. di Xxxxx Xxxxxxx & Xxxxxxxx Xxxx ad addebitarle sulla propria Carta di Credito.

Informativa e richiesta di consenso al trattamento dei dati personali ai sensi del D. Lgs. 196/2003.
In Ottemperanza agli obblighi previsti da Decreto Legislativo 30 giugno 2003 n.196 in maniera di trattamento dei dati personali, con la presente intendiamo informarLa/VI che la società Tvr Moto S.n.c. di Xxxxx Xxxxxxx & Xxxxxxxx Xxxx, con sede Legale a Fossano (CN) sottoporrà a trattamento i dati personali che riguardano Lei/Voi. Il trattamento dei dati personali sarà effettuato esclusivamente in ottemperanza agli adempimenti di legge connessi a norme civilistiche, fiscali, contabili e alla gestione amministrativa del rapporto contrattuale della presente. Nel rispetto dell’art. 13 (informativa), art.7 (diritto di accesso ai dati personali ed altri diritti) che qui si intendono integralmente riportati, il cui testo (artt. 7 e 13) viene consegnato alla parte in separata stampa. I dati saranno trattati manualmente e/o con l’ausilio di strumenti informatici idonei a garantire i limiti di sicurezza e riservatezza previsti dall’art.11 del D. Lgs. 196/2003. Il titolare del trattamento dei dati è la scrivente società.

Rental Agreement
1 – Tvr Moto S.n.c. di Xxxxx Xxxxxxx & Xxxxxxxx Xxxx (hereinafter referred to as LESSOR) delivers to the lessee (hereinafter referred to as CUSTOMER) the motorcycle that has a full tank of fuel upon return must be returned with a full tank of fuel, otherwise a supplement will be charged for the refueling service equal to the cost of the same, plus fuel), is equipped with the green insurance card and all the necessary documents, including the certificate and insurance sticker, as well as other accessories. 2 - The lessor guarantees that against the civil liability of the Customer and of any other person authorized to drive the motorcycle (as per the contract) a normal insurance policy is in force which provides for a guarantee with a single ceiling of Eur 1,220,000.00 for damages to things or animals, and Eur 6,070,000.00 per person. In the event of exceeding the aforementioned ceiling, the Client assumes exclusive and personal responsibility, exempting the Lessor from third parties. The policy does not cover damages suffered by the driver unless expressly requested by the Customer for payment as per the contract, nor his civil liability for damages caused by transported third parties, as specified in the insurance policy, the terms and conditions of which the Customer declares to accept and undertake to comply.
3 - CUSTOMER'S OBLIGATIONS
The Customer undertakes: a) to drive the vehicle, and to keep it together with the accessories and documents, diligently and in compliance with all the provisions of the law; b) to take care of its ordinary maintenance, greasing, checking the levels of lubricants and brake oil; c) to proceed with the payment even after the return of the vehicle of any contravention incurred during the lease and to reimburse the Lessor for any other expenses incurred and in any case the simple notification of the notification of the fine, entitles the Lessor to charge a lump sum the sum of EUR
35.00 for related expenses. The Customer hereby agrees to pay this amount by credit card such as Visa, American Express, etc.; d) to indemnify the Lessor from any claim made by third parties for damages suffered by them to the goods transported or in any case found on the vehicle. The Customer acknowledges that he is not the owner of any real right to the motorcycle and therefore cannot dispose of it even as a pledge.
4 - The Customer undertakes not to drive or use the motorcycle, and not to allow and/or tolerate others to drive or use it; a) in a country other than: Italy, France, Germany, Spain, Portugal, Andorra, Vatican City, San Marino, Principality of Monaco, Switzerland, Belgium, Holland, Sweden, Denmark, Norway, Finland, Liechtenstein, Corsica, England , Ireland, Luxembourg; b) furthermore, without excluding the obligations of the previous point a), where the insurance card is not valid or where there are political unrest; c) for the transport of people or things; d) competitions or speed tests; e) excess speed; f) for an unlawful purpose; g) in the case of a person not indicated on page 1 of the rental agreement or in a state of alcohol; h) in the case of a person who has provided the Lessor with false information regarding their age, name, address, place and date of delivery of the vehicle at the end of the rental. The customer undertakes not to allow the vehicle to be driven by a person under the age of 21 or over 73, or without a valid driving license in the state in which the vehicle is being driven. In any case, the customer is required to observe the regulations set forth in the new highway code.
5 - The Client undertakes to compensate the Lessor for any damage to the vehicle for any reason whatsoever in any case of accident that occurred, without a collision with another vehicle. The Customer undertakes to compensate the Lessor for all damages to the vehicle and subsequent replacements of vehicles covered by this contract. If the damage occurred without violating any of the contractual obligations assumed and in any case without his fault, the Customer's liability is however limited to the deductible due in any case to the accident, established by the tariff in force at the time of signing this contract, of which declares having read. In order to take advantage of this limitation of liability, however, the customer is required to communicate a detailed written report within the next 24 hours or fill in the C.I.D. (amicable statement), with which the vehicle is equipped, of the accident. By signing the appropriate box in the rental agreement, you purchase Collision Damage Coverage (Cop. Damages); the Customer is thus released from the obligations of this article, in the case of damages that occurred in a collision with another identified vehicle and provided that they occurred without violation of penal rules, of the highway code, and of any of the obligations provided for by articles 3 and 4 of these general conditions. The damage coverage does not include: wheels and wheel covers, the underside of the vehicle, loss of vehicle documents, as well as damage resulting from refueling with fuel other than that provided for the rented vehicle. The Customer undertakes to reimburse in cash or to authorize the collection by financial credit card for the entire amount of the deductible foreseen for each individual vehicle before the start of the rental as a security. The deposited amount will be returned or released, in the event of authorization to collect on a financial credit card, at the end of the rental if the car is returned intact and without damage, otherwise the deposit will be retained in full. In the event of an accident with fixed obstacles, with an unidentified vehicle or other vehicle, the Customer will be charged for damages suffered by the vehicle and also an amount according to our official rates equal to what would have been due if the rental had continued for a period equal to the time required to carry out the repairs (this period will be determined according to the ANIA tables in force at the time of delivery). In any case, the Customer remains responsible for the same deductible provided for by the conditions even if he has purchased and signed up for collision damage coverage insurance. The charge relating to spare parts, labor or towing means the list prices of the supplier companies, plus an amount according to our official rates equal to what would have been due if the rental had continued for a period equal to the time necessary for carrying out the repairs (this period will be determined according to the ANIA tables in force at the time of delivery).
6 - If an accident occurs, the Renter undertakes:
a) to immediately inform the Lessor by e-mail with delivery receipt or certified e-mail, sending him a detailed report filled in on the form attached to the vehicle documents within the next 24 hours;
b) inform the nearest police authority and obtain a copy of the report which must be forwarded to the rental station within 24 hours;
c) complete an accident report in all its parts, sign it and have it signed by the other party, taking note of the names and addresses of the parties and witnesses, the registration numbers of all the vehicles involved, the insurance data and the ownership of such motor vehicles;
d) provide the Lessor with any other useful information;
e) follow the instructions that the Lessor will provide regarding the custody of the vehicle for repairs.
In the event that the Customer fails to present the friendly accident report completed in all its parts, and signed by the other party, together with the report compiled by the Police or the local Authorities, the Customer remains responsible for all damages to the vehicle. The Customer is
required to pay the damages in the event of an accident even if potentially active if he cannot communicate all the damages of the counterparties. Driving license number, name, license plate, policy number, etc.
7 - The Client undertakes to return the vehicle and keys to the place and by the date indicated on page one of the rental agreement or in any case as soon as the Lessor requests it, with the same accessories and in the same state in which it was received . If the vehicle is not returned to the Lessor by that date, the Lessor may retake physical possession of the vehicle in any way, even against the will of the Customer, and the latter will be required to reimburse him for the expenses incurred, including by debiting a credit card . In this case, the Lessor is exempt from any responsibility in order or any objects that the Client has left inside.
8 - The Customer undertakes to pay the Lessor, upon his request, the kilometer rate and the time rate; the fee due if the vehicle is returned to a place other than the agreed place; VAT in force at the time of closing the contract; the sum necessary to restore the petrol and/or diesel tank to its original level, as well as the special rates provided for the "DAMAGE COVERAGE", the "THEFT AND FIRE COVERAGE", the "PERSONAL INSURANCE", Theft/Fire/ Damages and for the refueling service if due. The kilometer rate is determined by reading the odometer. The Renter is required to periodically check that the odometer is working and undertakes to immediately inform the Lessor of malfunctions, following, in this case, the instructions that will be given to him. If, upon return, the odometer appears to have been tampered with or faulty, the kilometer rate is determined on the basis of a mileage of 250 kilometers per day plus the damage caused. Whenever a rate must be commensurate with the number of days, the term "DAY" defines a period of 24 hours, or a fraction starting from the moment in which the vehicle was delivered to the Customer, unless the rate provides otherwise .In any case, if the customer leaves the car of any group in a station other than the one where the rental began, the supplement for one-way trips (VAL) will be applied based on the current rates.
a) Security deposit ranging from € 750 to € 1500 to be deposited by credit card / cash / instant transfer, corresponding to the insurance deductible.
In case of theft/damage, the customer is liable up to 15% of the value of the vehicle
b) No refund is foreseen for early returns. For contractual cancellations in high season, no refunds will be contemplated. For contractual cancellations in low/medium season, the refund will be 50% up to 2 days before the start of the rental.
9 - Whoever stipulates the lease in the name and on behalf of a third party is jointly liable with the latter for full compliance with the obligations contained in the Rental Agreement. In any case, the Customer is liable for the actions and omissions of anyone driving the vehicle.
10 - In the event of theft or fire of the vehicle, the Customer undertakes to report the fact to the Police Authorities and to deliver an authentic copy of the report to the Lessor. In this case, the freight is due up to the delivery date of the copy of the report, at the agreed rental rate or at the rate in force if the report is delivered after the scheduled return date. Together with the copy of the report, the Customer must return the keys to the vehicle and any burglar alarm to the Lessor. If he does not return them, the Lessor will be entitled to demand payment of a sum equal to the entire value of the vehicle. The Client therefore undertakes, at the request of the Lessor, to pay the aforementioned amount. The fire and theft policy covers the value of the vehicle in excess of the deductible in force at the time of signing this contract. The Customer remains responsible for the fixed deductible, even if he has accepted and purchased the damage insurance. The Customer must pay the entire amount of the deductible in force at the time of the start of the rental as a deposit, or authorize its collection by credit card. This amount will be returned or released at the end of the rental if the vehicle is returned intact and undamaged.
In the event of theft or fire, even partial, the deductible will be withheld or collected in full.
11 - An invoice will be issued only when this has been requested at the time of signing the rental contract and the Customer has declared his tax code or VAT number.
12 - Exemptions, exclusions, controversies, miscellaneous - The Lessor is not liable towards the Client or any other person for damages of any kind whatsoever, including economic damage to people or property due to breakdowns, thefts, road accidents riots, fires, earthquakes, wars or force majeure. Objects left by anyone in the vehicle are considered abandoned and the Lessor is not required to keep them or return them.
13 - The Lessor authorizes the Customer to drive the car abroad, upon request and authorization, (see art. 4 of these General Conditions), under a temporary export regime, except in countries where there is a state of war or political unrest.
14 - No modifications can be made to these General Conditions.
15 - Payment of the entire rental amount is due upon delivery of the vehicle and the relative contract. Once the agreed term has elapsed, the Lessor is authorized to issue a debit note for interest at the official annual discount rate increased by 8 points, subject to compensation for greater damages, effective from the date of stipulation of the rental.
16 - Vandalism: all damages resulting from xxxxxxxxx committed during the period in which the vehicle was in the customer's possession are attributable to the latter, who will be required to pay immediate compensation.
17 - The Italian text of these General Conditions prevails in case of divergence over the English text because it is presumed that it expresses all the will of the parties.
18 - The Court of Cuneo is competent for any dispute between the parties. Signature for acceptance
DELAYED CHARGE AGREEMENT
The undersigned _ holder of the - -_ -_ card used at the time of rental acknowledges and accepts from now on all expenses (fuel, insurance deductibles, fines or damages) detected or found after delivery of the car, and authorizes TVR Moto S.n.c. di Xxxxx Xxxxxxx & Xxxxxxxx Xxxx to debit their credit card.

In compliance with the obligations established by Legislative Decree 30 June 2003 n.196 in terms of personal data processing, we hereby intend to inform you/VI that the company Tvr Moto S.n.c. di Xxxxx Xxxxxxx & Xxxxxxxx Xxxx, with registered office in Fossano (CN) will process the personal data concerning you. The processing of personal data will be carried out exclusively in compliance with the legal obligations connected to civil, fiscal, accounting regulations and to the administrative management of the contractual relationship hereof. In compliance with the art. 13 (information), art.7 (right of access to personal data and other rights) which here are understood to be fully reported, the text of which (articles 7 and 13) is delivered to the party in separate printing. The data will be processed manually and/or with the aid of IT tools suitable for guaranteeing the limits of security and confidentiality provided for by article 11 of Legislative Decree 196/2003.
