2) general purposes of provision and processing of data
All personal data acquired and / or requested, both prior to the establishment of the col- laboration / commercial relationship, and during the course of this, will be processed to satisfy your requests, for the proper fulfilment of administrative and legal obligations, to meet contractual obligations and, consequently, to verify the correct fulfilment of these obligations by the company ModenaFiere Srl, and allow the Company to exercise its entre- preneurial activities most closely related to its corporate purpose. In particular, personal data made available to ModenaFiere may be used for the following purposes:
a) The establishment and execution of the contractual relationship relating to your parti- cipation in the event (hereinafter the ‘Event’) as well as the fulfilment of all regulatory, tax and administrative provisions that are instrumental, functional, interrelated and / or otherwise useful for the purposes the establishment and execution of the contractual relationship (including the activities necessary for the ordinary management of the exhibition);
b) The fulfilment of legal obligations to which the Company is subject;
c) Direct sales of services similar to those purchased by you, pursuant to the provisions of art. 130, paragraph 4 of Legislative Decree No. 193/2003 as compatible. It will be possible for the Company to use the email coordinates provided by you. However, you may, at any time (initially or on the occasion of subsequent communications) oppose such processing also by means of a specific request made to the Data Controller;
e) Publication in the catalogue, on the website and in the related social media, in the event guide, in any press releases, communications also via email and promo mail related to the Event (including the carrying out of the activities necessary for the management of online and offline publication) publications in newspapers and / or specialised ma- gazines;
d) The elaboration of statistical studies and market research;
f) The sending of newsletters, informative, advertising and promotional material relating to the institutional and commercial activities carried out by ModenaFiere Srl through automated or traditional contact methods by the company and / or physical or legal entities that collaborate with the Company’s commercial activities, on the part of com- panies specialized in telemarketing, parent companies, subsidiaries and / or associa- tes of the BolognaFiere Group.
For the purpose of establishing and finalising the possible agreement / contract / col- laboration, the provision of data is mandatory for points a) and b); in case of refusal, therefore, it will not be possible to establish any relationship with the interested party. For the purposes referred to in c), d) and d), f), the subscription is, instead, optional.
3) processing methods
The data will be processed using methods and instruments suitable to guaranteeing con- fidentiality, and may be carried out by electronic or automated means (network compu- ters not accessible to the public) and through non-automated means (paper archives), both provided with adequate security measures, which custom passwords with exclusive access, personal identification codes and controlled access to archives, in compliance with article 32 REG. EU 679/2016.
4) communication and dissemination of data
Within the Company, staff, members of administrative bodies, company personnel, ex- ternal managers, persons in charge of the processing of personal data designated by the Company in the performance of their duties may be informed of personal data.
Personal data may be disclosed to any qualified individuals who provide the Company with services instrumental to the purposes indicated in art. 2 above, such as, but not limi- xxx to, parent companies, subsidiaries, investee companies and / or affiliates; suppliers, contractors, subcontractors, banks and / or insurance companies or other subjects and / or entities that provide the Company with services or services that are instrumental in the establishment and / or execution of any contractual relationship with the Company, and / or providing (on behalf of the Company or independently):
(i) the management and / or maintenance of websites and electronic and / or telematic tools used by the Company;
(ii) the elaboration of statistical and market research;
(iii) the organisation and staging of events, also of a promotional nature;
(iv) the sending of informative and / or promotional communications, also of a commer- cial nature, of advertising material and / or offers of goods and services in the manner indicated in art. 2 above;
(v) legal, tax, social security, accounting, organizational and commercial assistance;
(vi) auditing activities.
Under no circumstances may your data be transferred abroad.
5) DURATION OF DATA PROCESSING
Your personal data will be processed only for the time necessary to achieve the specific purposes for which they are processed and, in any case, for a period not exceeding 10 (ten) years.

TECHNICAL REGULATIONS AND CONDITIONS FOR PARTICIPATING IN THE EXHIBITION
1) PRELIMINARY NOTICE
The term “ModenaFiere” means ModenaFiere s.r.l. Xxxxx Xxxxxxxx 58 – 41123 Modena – P.I./C.F. 02320040369.
The term “Organiser” means: ModenaFiere s.r.l.

2) GENERAL CONDITIONS FOR PARTICIPATION
2.A) Admission to the Exhibition
The following are eligible as exhibitors:
a) Italian or foreign companies who exhibit their own products or services whi- ch come under the merchandise sectors of the Exhibition. If the production companies themselves cannot participate in the Exhibition, their specific or general authorised dealers, agents or representatives may be admitted.
The exhibitors are required to strictly comply with the tax and trade laws in force, besides abiding by the current regulations in social security, insurance, safety and sanitation.
b) The Trade Associations, the Public Bodies and the Organisations that institu- tionally carry out promotion, study, information and publicisation in the indu- stries concerned with the Exhibition.
The Organiser reserves the right to admit to the exhibition also Companies, Bodies and Organisations not stipulated in the previous paragraphs, as well as exclude from the exhibition certain services, products or samples, and to forbid the presentation of products, samples or services of the same com- pany on more than one stand of the same merchandise sector.
Admission to the exhibition will not be permitted to those who are debtors in any way to ModenaFiere or to third parties in competition with the organisa- tion.
The Exhibitor is obliged to indicate, on the Participation Application form, the goods which will be shown at the Exhibition. The exhibiting and sale of goods not indicated on the Participation Application form will result in closure of the stand by the Organiser.
In the case of collective participation, the applicant may not accommodate Exhibitors to which the Organiser has already communicated their non-com- pliance with requirements or obligations, also for other exhibitions, and failing this will be duty bound to the Organiser to ensure correct execution of the abo- vementioned requirements or obligations.
It is the right of the Organiser to decide on the admission or non-admission of exhibitors. This decision is taken based on/in consideration of the space available and the entitlements the Exhibitors have, of qualifications and every other circumstance deemed important in order to guarantee the good outcome of the Exhibition.
The decision is however free and discretional.
The Organiser is obliged to give a reason for excluding an applicant from parti- cipating in an exhibition should the Exhibitor make a formal petition for it within 30 days of the closure of the Exhibition. The Applicant is obliged to provide all other documentation which may be requested in order to decide on the accep- tance of the application and to ascertain – at any time- the respect he/she has for the Conditions for Participation in the Exhibition.
2.B) Participation in the Exhibition - Payments
Presentation of the Participation Application Form, which constitutes an irre- vocable proposal for the applicant, implies acceptance of the Technical Regu- lations and Conditions of Participation in the Exhibition and the Safety Regu- lations and every other rule relating to the organisation and functioning of the Exhibition and the Fair District. All the exclusive and general Dealers, Agents and Representatives must attach to their Participation Application form the list of the case that they represent and whose products they intend to exhibit.
The applications must be sent to the Organiser by and no later than the
25/08/2023.
Applications for admission must be submitted, under penalty of inadmissibility, filled in, signed, countersigned and accompanied by the down payment, the Pri- vacy Form and the Traceability Form of financial flows (where necessary), which are an integral part of the same.
The participation rates are indicated in the Application form.
Payment of the fees due for participation in the Exhibition must be made:
- 1/3 as a down payment upon signing the contract
- Balance due not later than 20/09/2023 and in any case before the first day of
the period of preparation of the stands
If the Application Form is accepted, the Organiser will send a formal notice of acceptance by certified mail. The invoices will be sent in pdf via e-mail to the e-mail address given for sending invoices to which it is obligatory to fill in and in
electronic format to the PEC indicated in the Application form.
If the payment is not duly made, the Organiser can consider the contract ter- minated by default of the participant, without the need for a Judge’s ruling or warning.
In this case, the Organiser will formally communicate to the subject concerned, and as well as being released from any commitment and being able to make the stand available and allocate it to other applicants, will have the right to payment in full as a penalty of the participation fee, as well as every other contractual amount, minus any sum already received for these fees, and with the exception of the right to compensation for any further damage.
2.C) Allocation of the Stands
The allocation of the stands is the exclusive and discretional responsibility of the Organiser. Any indications or special requests on the part of the Exhibitor are purely indicative, they may not constrain or effect the Participation Applica- tion and thus are to be considered as not confirmed.
Furthermore, the Organiser reserves the right to move, reduce the stand alre- ady allocated, or transfer it to another exhibiting area, without any right of the participant to indemnity or compensation of any sort. The Organiser is however obliged to communicate this to the Exhibitor.
Any total or partial transfer, even free, of the exhibiting area allocated is not permitted. In the case of substantiated breach, the Organiser may remove the goods introduced and displayed illicitly, at the risk and expense of the proprie- tor of the pitch.
2.D) Right of withdrawal
The Participant who, for legitimate proven impossibilities, is not able to take part in the Exhibition, may withdraw from the contract by documenting this im- pediment and communicating this fact to the Organiser by registered letter with receipt A.R. at least 30 days before the opening date of the Exhibition, without prejudice to the acquisition from ModenaFiere of the registration fee and 30% of the total amount of participation, and without prejudice to any further right to compensation for any greater damages.
If on the other hand this fact is communicated to the Organiser less than 30 days before the opening date of the Exhibition, the Exhibitor will be obliged to pay in full the participation fee, except the right of the Organiser to be reimbur- sed for any direct or indirect damage.
In this case, The Organiser may however make the stand available, also alloca-
ting it to other Exhibitors.
The Organiser may withdraw at his own discretion from the participation con- tract up to two weeks before the opening date of the Exhibition and, for reasons pertaining to the organisation of the exhibition and all its regular running, up to the day of opening. In this case, the Organiser will not be obliged to indemnity or compensation of any kind, but the Organiser will have to return the registra- tion fee and the participation amount that may have already been collected. If the communication of withdrawal is not duly given and the Exhibitor does not prepare his/her own stand, he/she will be deemed to be in breach of contract to all intents and purposes and will be obliged, not only to pay the registration fee and the entire amount of participation, but also to refund of the direct and indirect damages suffered by the Organiser. Also in this case, the Organiser may however make the stand available and allocate it to other Exhibitors.
3) POSTPONEMENT, REDUCTION, SUPPRESSION OF THE EXHIBITION
It is the discretional and unquestionable right of the Organiser to make altera- tions to the date of the Exhibition, without this giving the right to the Exhibitor to withdraw or however terminate the contract and free themselves from any commitment undertaken. Furthermore, the Organiser may reduce the Exhibition, or rather suppress it completely or in some areas of it, without thus being obli- ged to pay any indemnity, penalty or damages of any sort. In these cases, the Organiser must communicate all changes made in writing by registered letter or certified mail to be forwarded at least 15 days before the programmed opening date of the Exhibition.
3.A) Force majeure
Force majeure is defined as the occurrence of any event or circumstance (“Event of Force Majeure”) that prevents the fulfilment of one or more contractual obli- gations, if and to the extent it is demonstrated:
a) that the occurrence is beyond the parties’ reasonable control; and
b) that it could not reasonably have been foreseen at the time the contract was stipulated; and
c) that the effects of the occurrence could not reasonably have been avoided or overcome.
Unless proven otherwise, the conditions referred to in points a) and b) abo- ve are considered satisfied in the presence of the following occurrences: war (declared or not), invasions, actions by foreign enemies, large-scale military mobilisation in Italy or internationally; civil war, uprisings, rebellions and/or re- volutions, insurrections, acts of terrorism, sabotage or piracy; embargoes; need to obey any government law or order, expropriation, requisition, nationalisation;
plagues, epidemics, natural disasters or extreme natural events in general; explosions, fires, destruction of equipment, prolonged interruption of transport and/or transportation, of telecommunications, of the IT system or of the energy network; boycotts, strikes and lockouts, occupation of facilities.
If any Event of Force Majeure should occur, ModenaFiere will be relieved of its obligation to fulfil its contractual obligations and released from any liability for damages or any remedy for breach of contract starting from the moment in which the Event prevents such fulfilment, provided ModenaFiere gives the other party prompt notice of such circumstance. If prompt notice is not given, ModenaFiere will be relieved of its obligation and released from liability when the other party has received such notice; the other party may suspend fulfilment of its obligations starting on the date of such notice.
If the Fair must be postponed due to an Event of Force Majeure, ModenaFiere will retain the amounts already received (i.e., registration fee and other down payments, if any), which the Exhibitor may use – without any guarantee regar- ding rate changes – to participate in the Fair on the new dates.
If the Fair must be cancelled due to an Event of Force Majeure, ModenaFiere re- serves the right to withhold only the registration fee paid by Exhibitors to cover organisational and handling expenses incurred. All other monies received from Exhibitors shall be refunded, and in such case no exhibitor will have the right to seek any damages against ModenaFiere on any grounds or for any reason . If any Event of Force Majeure should occur, the Exhibitor will be relieved of its obligation to fulfil its contractual obligations and of any liability for damages or any remedy for breach of contract starting from the moment in which the Event prevents such fulfilment, provided the Exhibitor gives prompt and documented notice to ModenaFiere. If prompt notice is not given, the Exhibitor will be relie- ved of its obligation and released from liability when ModenaFiere has received such notice; ModenaFiere may suspend fulfilment of its obligations starting on the date of such notice.
If it is impossible for the Exhibitor to attend the Fair due to an Event of Force
Majeure, ModenaFiere will retain the amounts already received (i.e., registration fee and other down payments, if any), which the Exhibitor may use – without any guarantee regarding rate changes – to participate in a subsequent edition of the Fair .
It is hereby specified that if an Event of Force Majeure should occur, the deadli- nes for the notice required by Article 21 “Postponement, reduction or suspen- sion of the fair” will not be applied.
4) GENERAL PROVISIONS
4.A) Dates, location and times of the Exhibition
The Exhibition will take place on dates 3/4 October 2023. In the Fair District “ModenaFiere” with the times:
Tuesday 3 October from 9.00 to 18.00
Wednesday 4 October from 9.00 to 18.00
The Exhibitors may access the stands up to one hour before the opening time
to the public.
The Organiser reserves the unconditional right to modify the dates and opening
and closing times of the Exhibition.
4.B) Availability of the stands - delivery
The stands/spaces will be made available to the Exhibitors and/or Outfitters
in the days:
Monday 2nd October from 8.00 to 19.00
The stands must in any case be finished by 19.00 pm on the 2 October, in default of which the contract may be essere rescinded for non-compliance of the parti- cipant according to point.2D. The Exhibitor must ensure that their chosen stand organiser makes an effort to respect this deadline, by inserting in their contract a clause regarding the performance times to be observed.
4.C) Access to the Fair District during the period of preparation of the stands
Access to the Fair District will be allowed, using the activated vehicle passa- geways, exclusively to vehicles with the appropriate permit and to those people on board the said vehicles, providing they have an entrance pass.
The Exhibitor is responsible for the technical-professional requirements of the
companies that, will intervene in their name in the Fair District.
The Access of transport vehicles into the pavilions is forbidden; the only excep- tions permitted will be the electrical lift trucks or those with catalytic conver- ters, as well as explicitly authorised vehicles (in the case of objectively impos- sible alternatives for the unloading of particularly bulky or heavy materials).
Any parking near the pavilions must be limited strictly to the time necessary for loading and unloading goods and equipment: vehicles not used for these operations must be parked in the reserved areas of the car park. In particular unloading and parking of containers or detachable parts of non self-propelling vehicles is not permitted.
In order to speed up its service to the Exhibitors, the internal handler, supplier of ModenaFiere, will ensure the provision of trolleys and lift trucks, to be booked in advance using the appropriate form.
The organiser may define particular access criteria to the Fair District during the stand preparation, as well as limiting the access of vehicles and/or levying charges if vehicles should be parked outside spaces and/or times established. It shall, however, be understood that given the Covid 19 public health emer- gency, access procedures, technical provisions, assembly and removal of exhi- bition booths, and the overall manner in which the trade show is conducted may be subject to changes and/or revisions in the event of further regulatory provisions being issued by the authorities.
4.D) Removal of goods and materials from the stands. Return of the stands
The Access to the Fair District for the removal of the goods on display and the stand displays will be as follows:
Wednesday 4 October from 19.00 to 22.00
Thursday 5 October from 8.00 to 18.00
The access of motorvehicles to the areas and the pavilions will be regulated as
for the stand preparation work (see art. 4.C).
The clearing of the stand or the areas, wherever located, must be completed by 18 p.m. On the day 5 October. Failing this, measures will be taken considering how much waste material is left on the stand to be taken to the municipal dump and the Exhibitor shall be obliged to reimburse all the direct and indirect costs incurred for the clearing and removal and/or storage (up to a maximum of 10 days), as well as pay a penalty of € 200,00 plus VAT, per day except for any reimbursements for further damage.
The Exhibitors are obliged to return the facilities in the same conditions in whi- ch they were accepted.
The repair costs, for any damage caused, are at the expense of the Exhibitors.
4.E) Anti-theft surveillance – Responsibilities for theft and damage - Insurance – Exoneration of responsibility –Manleva Clause.
During the opening hours of the pavilions, the Exhibitor must guard their own stand directly or via their own personnel. The Exhibitor is obliged to man the exhibition stand, with their own staff throughout the whole opening period of the Exhibition. The Exhibitor is the sole guardian, for the whole period of the Exhibition (including the period of stand preparation and clearing) of all the materials, goods and furnishings present in the exhibition post.
As custodian of the exhibition post the Exhibitor undertakes to relieve Modena- fiere susbstantially and procedurally from any responsibility and keep it unble- mished by every loss, damage, responsibility, cost or expense, including legal expenses, arising from use of the stand and the exhibiting space allocated.
The Organiser, whilst providing for the entire duration of the Exhibition and all the days assigned for the preparation and clearing of the stands, a night and day surveillance service within the Fair District, is exonerated from any and every responsibility with regard to theft and/or damage which may occur (with regard) to the Exhibitor.
The Exhibitor will also be responsible to ModenaFiere for all direct and indirect damage which for whatever cause is attributable to him or to staff working for him, including any damage caused by stand preparation or by systems im- plemented by him or by third parties employed by him, even though tested by ModenaFiere.
The Exhibitor will benefit from the following insurance agreed with the Orga- niser:
a) cover All Risks (including fire and theft) for material and direct damage to furnishings, outfitting, equipment and goods on the stand, excluding money, valuables, precious items and similar and excluding software installed on computers or similar and excluding damage from non use of furnishings, outfitting, of equipment and goods for the duration of the Exhibition: cover
€ 10.000,00 on a first loss basis (including fire and theft), with absolute de- ductible of € 100,00 for each damage.
b) cover for Third Party Civil Liability, including any fire damage: single liability limit of € 10.000.000,00;
c) cover for Civil Liability towards workers: limit for accident/loss € 3.000.000,00 with a limit of € 2.000.000,00 per person;
d) waiver on the part of the Insurer of any breach towards all Exhibitors and
the Organiser.
The Insurance cover indicated above, included in the Participation Fee, is go- verned by the conditions and limitations that the Exhibitor may request from the Organiser of the Exhibition, and which will be shown in the documentation relating to the Exhibition itself. This cover does not exclude the responsibility the Exhibitor has for all the risks which according to the independent evaluation of the Exhibitor were not covered or which exceed the limits of the cover shown above. The Exhibitor themselves must see to the appropriate comprehensive cover.
In case of theft, the Exhibitor must make sure the insurers receive the relevant report made to the Public Authorities, within seven days of the closing of the Exhibition; failure to respect these dealines may lead to the loss of right to any indemnity.
The Insurer will also handle the management of accidents or loss and the sett- lement procedures at the end of the Exhibition according to the conditions sti- pulated in the aforementioned form.
In any case the Exhibitor shall undertake to insert in the integral cover the wai- ver of the insurer to any breach towards the Exhibitors and the Organiser, and failing this should releive them from every action that may be taken against them. In acknowledgement of the above, the Exhibitor, however, (for himself/ herself and for those working with or for him/her) expressly exonerates the Organiser from every responsibility for losses or damage which for whatever reason may happen in the exhibiting space allocated to them, during the Exhi- bition or during the preparation or dismantling of the stand, and for as long as they are there, assume all responsibility for any damage caused also to third parties by the management of the exhibiting space or anything entering that space, and not covered in the terms and methods indicated above or activated by the Exhibitor himself.
The Organiser declines every responsibility for consequential damage, damage
to image, loss of sales etc. Also, for direct damage, the Exhibitor accepts that the Organiser limits his/her responsibility to the limits and maximum liabilities of the insurance cover as stated above. The Exhibitor accepts these limitations of responsibility.
5) STAND OUTFITTING, PROHIBITIONS AND OBLIGATIONS
5.A) Definition of type of stand outfitting and approval procedures
The preparation of the stands, regardless of their surface area, is classified into:
- STANDARD preparation
- NON-STANDARD preparation
All stand preparation which includes even only one of the following characteri- stics are considered NON-STANDARD:
- equipped with “American” style trelliswork structures
- equipped with mezzanine with rooms on the first level, even if forbidden to
the public.
Furthermore, all stand preparation including structures created in external are- as with a surface area of over 100 sqm. will be deemed non-standard.
Considering that the Fair District of “ModenaFiere” have obtained the usability of the exhibition spaces according to a basic scheme of traditional stand pre- paration, or rather with parameters defined as STANDARD, it is obligatory for the Exhibitor who intends to propose stand preparation having even only one of the characteristics listed previously, to submit his project for non-standard stand preparation to the Organiser in sufficient time to receive approval.
For the non-standard stand preparations the static test is obligatory, which must be carried out by the authorised technician.
ModenaFiere reserves the right not to allow the setting up of non-standard stands if they have not received prior approval form the Technical Office of ModenaFiere.
The building of trelliswork structures (type “American”) of particular complexi- ty (by particular complexity we mean a structure in which at least one of the following conditions exists: overall extension over 32 m -calculating both the vertical structures and the horizontal-, free structural light over 8 m) as well as mezzanines, is however conditioned by the submission to the Organiser of the plan of the structure, signed by the authorised technician, supplied with a calculation report including the load conditions there will be in the assembling and disassembling phases, based on the intended method of construction, as well as the certificate of correct fitting, upon completion of work, signed by the authorised technician.
In any case, ModenaFiere has the right to examine the projects for the stands
which in terms of importance, size and potential risk are outside the standard parameters of traditional stand preparation; the Exhibitor is obliged to provi- de the technical papers and the names of the technicians responsible for the structural and preparation part as well as for the systems. An identical obliga- tion exists for the stands put up in the external areas.
It is the right of the Organiser to request the intervention of the Surveillance Commission for Public Performance venues, charging any resulting costs to the Exhibitor.
5.B) Outfitting of the stands
The Exhibitor must contain the outfitting of his stand to the area specifically allo- cated to him, identifiable by dividing walls, painted lines, or adhesive tape, where other references do not exist. The stand outfitting must not exceed the ideal level, passing through the central strip of tiles located at the edges of the stand. Inside the pavilions the stands must not exceed the standard height standard of 2m 85. In order to take into account the thicknesses due to raised flooring, lighting fixtures, supports for lighting fixtures also a traliccio, a further margin of 50 cm will be allowed on the height limit specified above, thus taking it to a maximum height of 3m, provided that the structures whose sides look onto the adjoining stands are perfectly finished and painted in a single tone neutral colour. In the rooms which look out onto the Galleria
Servizi the stand preparations must receive prior authorisation from the Tech-
nical Office of ModenaFiere. The stand outfittings of the Galleria Servizi (ser- vice passageway) must have practically zero fire risk. The glass walls in direct contact with the public must be in compliance with the current regulations and the norme UNI.
It is strictly forbidden to construct accessible raised platforms which exceed a height of 0,70 metres from the floor. Every responsibility regarding the sta- tics and the compliance of stand materials with the fire (anti-fire) regulations currently in force, is the exclusive responsibility of the Exhibitor, who expressly exonerates ModenaFiere for any damage arising from faulty planning and con- struction, including also the dimensions calculated from the detailed drawings of the occupied surfaces.
Any work which implies changes to the state of the fixtures and fittings and furniture of ModenaFiere (reinforcements, modifications, digging, holes made in the fixtures, in the walls, to the structures, in the columns, in the floors), may be carried out only with the prior written authorisation from ModenaFiere, at the cost of and under the responsibility of the participants. This responsibility remains chargeable to the exhibitor for the whole duration of the Exhibition up to the time of returning the stand or the area to ModenaFiere. Before the start of the work, the participant is obliged to pay to the Organiser the total amount of the cost to restore the stand/area to its original state, which the Organiser will then see to directly.
5.C) Prohibitions and Obligations
In particular it is forbidden for the Exhibitors to:
-apply loads or lean material against the pavilion structures, the walls, the li- ghting pilings, etc;
- attach or hang on the abovementioned components: posters, cables, panels, banners, stickers;
- in order to attach fitted carpet to the floor or similar materials, it is absolutely forbidden to use double-sided strong adhesive tape and with internal paper support or of weak consistency;
- damage any equipment belonging to ModenaFiere and the structures of the pavilions;
- abandon any debris materials and/or rubbish of any type;
- bring into the Fair District any explosive materials, detonating explosives, asphyxiants or however dangerous, as well as introduce or use compressed gas or liquid gas canisters, and inflate aerostatic balloons;
- use open flames (candles, chimneys, t-lights, etc…).
The Exhibitor assumes exclusively the civil and penal liability for any damage caused by non-observance of or violation of the current regulations and all the requirements stipulated in these Regulations and in the Safety Regulations, undertaking furthermore to keep ModenaFiere exempt from any requests for compensation received from third parties.
The Exhibitor must inform its own staff and any companies working for it in the Fair District of the requirements and the prohibitions of these Regulations and the Safety Regulations concerning the general conditions for participation in the Exhibition.
Failure to observe these regulations and those relevant regulations also in the general conditions for participation gives ModenaFiere the right to take pre- cautionary measures against the company, for example, with fire-extinguisher incorrectly positioned, which could mean, should supplementary measures to the global safety conditions be adopted, it would be charged with the corre- sponding costs which are calculated in advance at no less than € 300,00/form plus VAT or to court order the partial or total dismantling of the stand and the declaration of non usability of the stand itself.
It is specifically forbidden for exhibitors to:
- perform any kind of show or entertainment, of any nature whatsoever, even if limited within the stand or aimed at presenting the products without the prior written consent of the Organiser;
- transfer or exchange even a part of the stand;
- exhibit products contrary to the merchandise category of the stand, which ap- pears on the Application Form;
- exhibit advertising or samples even simply indicative, on behalf of companies
not listed on the Application Form and not represented;
- use any form of publicity outside their own stand within the Fair District. The distribution of advertising material is allowed only within the own exhibition area;
- cover or disguise the objects on display during the hours of opening to the public;
- abandon in the Fair District parts of the stand fitting, fitted carpet and any
other residual material;
- cause harassment or disturbance, in any form, to the regular running of the
Exhibition, on penalty of immediate exclusion from the Fair District;
- remain in the exhibition areas and in the entire Fair District, either exhibitors or their employees or clients at the closing time of the Exhibition, without special authorisation;
- start operations of dismantling the stand before closure of the Exhibition;
- smoke inside the exhibition pavilion (L. 16 January 2003, n. 3 G.U. n. 300 del 23 December 2004 art. 51);
- exhibit advertising or samples, even simply indicative, on behalf of companies
not listed on the Application form and not represented.
The technical bans, issued for reasons of safety to people and objects, as well as with the aim of preventing tampering with the furniture fixtures and fittings of the Fair District and the relevant requirements, contained in the Technical Regu- lations and Participation Conditions and Safety Regulations, are understood to be part of these General Contract Conditions, and the Exhibitor shall undertake to follow them closely.
Any deviations may be submitted, exclusively in writing, to the Organiser. The Exhibitor is obliged to:
- regulate himself and third parties working for him in the Fair District with the regulations regarding social security, accidents and work in general;
- follow the current fiscal regulations regarding commercial activity.
Should even one of the abovementioned prohibitions not be respected, that is, those mentioned in this article, the Organiser may apply sanctions and/or rescind the Contract of Participation in the Exhibition without the need for a judge’s ruling, but simply via any form of written communication presented to the Exhibitor at his/her stand. This implies immediate closure of the stand and withdrawal of the access permits to the Fair District, without detriment to the amounts due by the Exhibitor.
6) GENERAL SERVICES
6.A) Technical Assistance for the Exhibitors
The Organiser, via its own Exhibition Secretary, is at the disposal of the Exhibi- tors to provide all the technical briefings on the prearranged general services in the context of the Fair District. The services indicated below may be requested of the Official Suppliers:

It should be noted that:
The transport, goods loading and unloading services, and xxxxxx services within the Fair District, if the Exhibitors do not provide their own means “own or for exclusive own use”, are organised exclusively by the ModenaFiere provider. Fur- thermore, in the Fair District, the following services are available:
- Bancomat
- Catering services
6.B) Responsibility for services
ModenaFiere reglates but does not organise the services mentioned in point
6.A. And thus does not accept any personal responsibility regarding their per- formance.
Any complaints should be made in writing directly to the companies providing the services and should be communicated for information purposes only to ModenaFiere.
6.C) Technical Services
Within the limits of the systems at its disposal, ModenaFiere can provide a sup- ply of electrical energy, water and compressed air to every single stand.
6.D) Systems
For that concerning:

It is hereby specified that the relevant system must be requested using the ap- propriate form, on which the conditions of the service are indicated, the fees and the operational specifications.
The connection to the internet may only be carried out by the personnel of the companies employed by ModenaFiere, who will identify the supply point in his unquestionable judgement.
7) SPECIAL SERVICES
7.A) Exhibitor’s Passes and Discount Vouchers
By undersigning the Application form, the Exhibitor will have the right to Exhibi- tors Passes which must be printed with the personal name of the holder; Additional Passes, free tickets and car passes can be purchased using the form for the purchase of ADDITIONAL TITLES
7.B) Exhibitors Car park and car permits
Every Exhibitor, regardless of the area of their stand, will be given a car permits for exhibitor parking.
a) The car parks allocated to the Exhibitors will be suitably indicated.
b) The car park is strictly reserved for Exhibitors. Vehicles may obtain access only if they are displaying in the windscreen the Parking Permit “Exhibitors’ Carpark” (Parcheggio Espositori) issued by the Organiser.
c) Before entering the car park, all passengers not carrying an entrance pass must get out of the car. They must then duly obtain a ticket for entry at the ticket office.
d) Once the car has been parked, the Exhibitors may access the Exhibition via
the specially provided entrance.
Should these rules not be followed, ModenaFiere may transport the vehicle out- side the Fair District, into a guarded area at the risk and expense of the Exhibitor to whom the parking permit was released. ModenaFiere is exonerated from all responsibility for custody of the vehicle and will not be responsible for any da- mage or theft of any kind.
7.C) Sound transmission, payment of performing rights
It is forbidden for Exhibitors to play music and sounds which would disturb other Exhibitors and visitors, paying particular attention to the sound pollution regulations (the maximum limit allowed by Law) and does not relieve them from the obligation to conform also, at their own cost, to that stipulated by the laws currently in force regarding performing rights. Should the Exhibitor fail to observe these rules, the Organiser, in his unquestionable judgement, will take measures to ensure that they are respected.
For the execution of the necessary practices, those interested should make use
of the appropriate form included in the Various Forms File.
7.D) Payable forms of Advertising
Outside the allocated exhibiting area, every form of propaganda and advertising must be authorised and carried out exclusively via the Organiser and is subject to payment of the fee and related fiscal charges.
7.E) Intellectual property
Both the products and goods exhibited and the stand they are displayed on may not be photographed, drawn or otherwise reproduced without the authorisation of the respective Exhibitors and the Organiser.
The Organiser however, reserves the right to film, reproduce, distribute and au- thorise the filming, the reproduction and distribution of general and detailed views, internal and external, allowing and also carrying out the sale of the ma- terial.
8) SPECIAL REGULATIONS
8.A) Access with bags or suitcases
ModenaFiere will have the right to deny entry to the Fair district or single pavi- lions with bags, suitcases or other containers, ordering that these be deposited in the cloakroom (if open).
8.B) Ban on photographic and cinematographic filming, and access to the Fair district with recording/filming equipment.
It is strictly forbidden to enter the Fair district with cameras, movie cameras, video recorders, and any other type of recording or filming equipment without the express prior authorisation of the Organiser, and it is forbidden to use any equipment to photograph or film the interiors of the Fair District, the stands and the goods exhibited, without the prior consent of ModenaFiere and the owner of the stand.
The Organiser however reserves the right to record/film, reproduce, distribute and authorise the filming, reproduction and distribution of general and detai- led views, internal and external, allowing and also carrying out the sale of the material.
8.C) Access with dogs and other animals
Access is permitted to dogs and other animals in compliance with the current regulations.
In particular, the owner or holder, of a dog is obliged to observe the following safety measures:
- Dogs must be kept on a lead at all times, no longer than 1,50m whilst passing
through areas open to the public with the animal;
- Dogs must carry a muzzle at all times, hard or soft, to be applied to the dog in the case of risk to the safety of people or animals or upon request by the Authorities responsible.
8.D) Prohibition of offers or donations
Within the perimeters of the Fair District it is strictly forbidden for anyone to pro- xxxx any offers or donations for recognised organisations, begging, political or religious or biased propaganda, and however carry out activities not relating to the aims of the exhibition.
8.E) Temporary importing (optional)
The temporary importing of foreign goods or produce for exhibiting such as samples for the Exhibition is permitted, at the expense of the Exhibitor, via their own trusted shipping agent with exoneration of the Organiser and ModenaFiere from every responsibility for the work of the shipping agent.
8.F) Paid Advertising
Outside the allocated exhibiting area, every form of propaganda and adverti- sing must be carried out through the Organiser or through its licensees and is subject to payment of the fee and relevant fiscal charges.
8.G) Radio electrical Apparatus
The operators who intend to use radio electrical apparatus (two-way radio xxxx- xxxxxxxx, radiomicrophones, radiocameras, etc.) are obliged to use apparatus compliant with the regulations (directive 99/05 CE – brand CE) and to obtain the appropriate authorisation (Codice Comunicazioni Elettroniche art. 107- Electro- nic Communications Code art.107), where necessary, as well as operating wi- thin the radio bands permitted.
9) SURVEILLANCE POWER AND RIGHT OF INTERVENTION OF MODENAFIERE
ModenaFiere patrol to make sure that the regulations contained in the Tech- nical Regulations and Participation Conditions and in the Safety Regulations of the Fair District are abided by; it is obligatory for all those entering the Fair District to observe the provisions and requirements which ModenaFiere will pro- vide at the entrance and inside with the appropriate signs, with written notices, with loudspeaker announcements, and via the service personnel.
10) MODIFICATIONS TO THESE REGULATIONS
Any legislative or statutory regulation which may modify the rules of these Re- gulations is deemed to be automatically and immediately applicable even thou- gh the Technical Regulations and the Participation Conditions have not been changed or modified on those points.
Furthermore, it is the right of the Organiser to adopt at any time measures that it deems opportune and that the Exhibitor must immediately apply, with regard to fire prevention, accident and damage prevention, safety of participants and visitors. These latest measures may be communicated to the Exhibitors by any means and will prevail over the general provisions previously adopted.
11) SANCTIONS
Failure to observe the obligations established in these Regulations may result in the withdrawal of entry passes and the immediate removal from the Fair District of those persons responsible, as well as, if it is a question of Exhibitors and their collaborators, the temporary or definitive closure of the stand.
12) RELATIONS WITH MODENAFIERE
The Exhibitor acknowledges that the Exhibition will take place in the Fair District of ModenaFiere and undertakes to respect, and ensure that their team members respect, the prescribed regulations issued by the BolognaFiere group. The Exhi- bitor declares that he/she has examined the Ethics Code of the BolognaFiere group available on the website xxx.xxxxxxxxxxx.xx, as well as the M.O.G.C. EX Dlgs. 231/2001, and accepts and subscribes fully to them in the entirety of their content, aware of the possible consequences and sanctions arising from failure to conform to the principles and rules stipulated therein.
13) GENERAL REGULATIONS – NOMINATION OF HOME AD- DRESS – APPLICABLE LEGISLATIVE RULES – ITALIAN JURI- SDICTION AND LOCAL AUTHORITY COURT.
It is obligatory for the Exhibitor to follow any instructions that the (Fiscal Police) Guardia di Finanza, the Public Safety Authorities and those responsible for fire prevention, accident prevention and surveillance of premises open to the public should issue to ModenaFiere.
The Exhibitor and third parties working on his behalf in the Fair District must use staff with working relations, subordinate or independent, which meet the re- quirements of the current laws (in social security, insurance, fiscal terms etc.). The Exhibitor nominates his home address, for all legal purposes, as that of ModenaFiere and accepts, exclusively, Italian jurisdiction and the authority of the Court of Modena.
14) PROCESSING OF PERSONAL DATA
Information to the interested party pursuant to Article 13 and 14 of the REG. EU 679/2016 and provision of consent. The Or- ganizer (hereinafter, for the sake of brevity, the ‘Company’) under- takes to process the personal data you have made available in compliance with the provisions of Regulation (EU) 679/2016, as well as the guidelines and provi- sions of the Guarantor for data protection and any other applicable legislation. The personal data you have made available, in accordance with the consent to processing provided by you, may be processed for the purposes specifically indicated in the mandatory Privacy form, to be returned signed.
