La Giunta Esecutiva dell'Istituto Nazionale di Fisica Nucleare, riunita a Roma in data 19.12.2022, Premesso che
• con nota prot. AOO_LNF-2022-0000707 del 10.10.2022 (All. 1) è stato affidato al xxxx. Xxxxxxx Xxxxx, dipendente dei Laboratori Nazionali di Frascati dell’INFN, l’incarico di Responsabile Unico del Procedimento per l’acquisto della fornitura e posa in opera di due sorgenti RF ad alta potenza, di cui n. 1 (una) per l’operazione con Klystron Canon X-Band (11.994GHz) ad alta frequenza di ripetizione (ModelE37119) e n. 1 (una) per l’operazione con Klystron Canon C-Band (5.712GHz) ad alta frequenza di ripetizione (Model E37217) e relativa opzione avente ad oggetto la fornitura di parti di ricambio;
• con nota prot. AOO_LNF-2022-0000708 del 10.10.2022 (All. 2) è stato affidato l’incarico di Direttore dell’esecuzione del contratto al xxxx. Xxxxxxx Xxxxxx, dipendente dei Laboratori Nazionali di Frascati dell’INFN;
• con nota prot. AOO_LNF-2022-0000838 del 01.12.2022 (All. 3) è stato costituito l’ufficio a supporto del RUP composto dalla dott.ssa Xxxxx Xxxxxxx, dipendente dell’Amministrazione Centrale dell’INFN e dal xxxx. Xxxxxx Xxxxxxxxx, dipendente dei Laboratori Nazionali di Frascati dell’INFN;
• con relazione del 26.10.2022 (All. 4) il Responsabile Unico del Procedimento ha dichiarato che la Società SCANDINOVA è l’unica in grado di effettuare la fornitura sopra descritta, per le motivazioni in essa indicate;
• in data 04.11.2022 la Società SCANDINOVA ha presentato l’offerta economica, DOC-025632, di € 2.051.000,00, comprensiva dell’opzione di acquisto delle parti di ricambio, oltre IVA al 22% (All. 5)
• con il verbale del 01.12.2022 (All. 6) la Commissione Tecnica, nominata con Disposizione del Presidente dell’INFN n. 25001 del 21.11.2022, ha espresso parere positivo sulla congruità dell’offerta presentata dalla Società SCANDINOVA;
• con nota del 17.11.2022 (All. 7) il Direttore dei Laboratori Nazionali di Frascati, xxxx. Xxxxx Xxxxx, chiede di affidare la fornitura e posa in opera di due sorgenti RF ad alta potenza, di cui n. 1 (una) per l’operazione con Klystron Canon X-Band (11.994GHz) ad alta frequenza di ripetizione (ModelE37119) e n. 1 (una) per l’operazione con Klystron Canon C-Band (5.712GHz) ad alta frequenza di ripetizione (Model E37217) e relativa opzione avente ad oggetto la fornitura di parti di ricambio, a favore della Società SCANDINOVA, ai sensi dell’art. 63, comma 2, lettera b) n. 2 del d.lgs. 50/16, per un importo di € 2.051.000,00, oltre IVA al 22%;
• alla procedura in argomento è stato attribuito - dall’Autorità Nazionale Anticorruzione - ANAC - il Codice di Identificazione Gara (CIG) n. 9458024051;

Accertato che
• il presente intervento è inserito nel programma biennale degli acquisti di beni e servizi 2022/2023, per l’anno 2022, dell’Istituto, ai sensi dell'art. 21 del d.lgs. 50/2016 e s.m.i. - CUI: F84001850589202200228;
• la spesa complessiva di € 2.051.000,00, oltre IVA al 22%, per un totale di € 2.502.220,00, trova copertura nel bilancio 2022 dell’Istituto – Laboratori Nazionali di Frascati – sul preventivo EUPRAXIA_LAB, capitolo U2020104002 “Impianti”.;
DELIBERA
1. di approvare le Specifiche Tecniche (All. 9) e le Condizioni Contrattuali (All. 10) poste a base della procedura di affidamento della presente fornitura;
2. di affidare, ai sensi dell’art. 63, comma 2, lettera b) n. 2 del d.lgs. n. 50/2016 e s.m.i., la fornitura e posa in opera di due sorgenti RF ad alta potenza di cui n. 1 (una) per l’operazione con Klystron Canon X-Band (11.994GHz) ad alta frequenza di ripetizione (ModelE37119) e n. 1 (una) per l’operazione con Klystron Canon C-Band (5.712GHz) ad alta frequenza di ripetizione (Model E37217) a favore della SCANDINOVA, ai sensi dell’art. 63, comma 2, lettera b) n. 2 del d.lgs. 50/16, per un importo di € 2.051.000,00, oltre IVA al 22%, comprensiva dell’opzione di acquisto delle parti di ricambio;
3. di imputare la relativa spesa lorda di € 2.502.220,00 nel bilancio 2022 dell’Istituto – Laboratori Nazionali di Frascati – sul preventivo EUPRAXIA_LAB, capitolo U2020104002 “Impianti”;
4. di subordinare l’efficacia del presente atto all’accertamento dell’insussistenza, a carico del privato contraente, delle cause di divieto, sospensione, o decadenza di cui all’art. 67 del d.lgs. n. 159/2011 e s.m.i. ed alla verifica in capo alla suddetta Società dei requisiti di partecipazione alla gara;
5. di incaricare il Direttore dei Laboratori Nazionali di Frascati dell’INFN ad assumere l’impegno di spesa nel bilancio dell’Istituto, prima che intervenga la stipula, con la Società SCANDINOVA, del contratto specificativo delle obbligazioni delle parti.

Relazione Tecnica per la fornitura e posa in opera di due sorgenti RF ad alta potenza:
n. 1 (una) per l’operazione con Klystron Canon X-Band (11.994GHz) ad alta frequenza di ripetizione (Model E37119); n. 1 (una) per l’operazione con Klystron Canon C-Band (5.712GHz) ad alta frequenza di ripetizione (Model E37217); relative opzioni.

Presso i Laboratori Nazionali di Frascati esiste una consolidata esperienza nell'utilizzo di sistemi a radiofrequenza in banda S (f ~ 3 GHz) impiegati già nel LINAC di ADONE e successivamente in quelli di DAFNE e SPARC, ed una più recente ma ugualmente solida esperienza di sistemi operanti in banda C (f ~ 6 GHz) utilizzati per l'upgrade di energia di SPARC e per l'accelerazione degli elettroni in strutture acceleranti come nella gamma-factory ELI-NP. La tecnologia RF ad oggi più avanzata è costituita dalla banda X (f ~ 12 GHz) con la quale sono stati raggiunti sperimentalmente gradienti acceleranti fino a 100 MV/m ed oltre.
All’interno del progetto LATINO, si è dotato la facility TEX di un modulatore K400 è tra i modelli di nuova concezione prodotti da ScandiNova, l’unico in grado di garantire il funzionamento con il klystron in banda X (CPI Modello VKX8311A) alla massima potenza (a tensione nominale di 370 kV) ed una stabilità di impulso sul flat- top del segnale RF prodotto in uscita inferiore ai 50ppm.
Nell'ambito delle attività collegate all'iniziativa EuPRAXIA è prevista l’acquisizione di due sorgenti RF per il consolidamento della facility TEX.
A tal fine, si è scelto di procedere all’acquisizione di un klystron in banda X – con potenza di picco di 25 MW ed alta frequenza di ripetizione di 400 Hz prodotto dalla Canon (Modello E37119) e di un klystron in banda C – con potenza di picco di 20 MW ed alta frequenza di ripetizione di 400 Hz prodotto dalla Canon (Modello E37217).

La scelta di affidare alla società ScandiNova la fornitura delle sorgenti RF nel loro complesso è motivata dalle seguenti esigenze e condizioni di mercato:
1. Per facilitare il consolidamento della infrastruttura e ridurre tempi di posa in opera, si ritiene opportuno impiegare nella massima misura possibile gli stessi componenti e sotto-sistemi (come per esempio sistema di controllo) utilizzati all’interno dei progetti dei Laboratori Nazionale di Frascati per i quali il personale tecnico/scientifico è già formato. Modulatori RF ScandiNova sono ad oggi impiegati ed integrati nei sistemi delle facility SPARC e TEX del laboratorio.
2. Date le caratteristiche competitive dei klystron sopra descritti, la scelta di affidare alla ditta ScandiNova la fornitura di sorgenti complete “chiavi in mano” consente la verifica delle prestazioni dei klystron a potenza nominale durante i test di accettazione in fabbrica (FAT) sotto responsabilità della ditta stessa senza gravare sulla garanzia del klystron per l’INFN.
3. Le caratteristiche dimensionali richieste (minori di 2 m x 1,5 m) per allocare le due sorgenti RF presso la facility TEX, come mostrato nella seguente planimetria, sono state valutate in modo tale da: minimizzare il percorso del sistema di guide d’onda fino al bunker schermato; ottimizzare la distribuzione di potenza RF; consentire le operazioni di manutenzione e le vie di fuga dell’area.
Alla luce di queste valutazioni e considerate le offerte disponibili sul mercato, la ditta ScandiNova risulta essere l’unica possibile fornitrice di Modulatori compatti per gli ingombri richiesti.
4. La duplicazione di un sistema già esistente e ben funzionante è ritenuta la migliore garanzia in tal senso, perché consente di beneficiare al meglio delle conoscenze tecniche già acquisite del personale dei lavoratori che potrà trasferire in maniera diretta la propria esperienza e competenza non dovendo affrontare eventuali problematiche inedite.
A tal fine viene richiesto alla ditta ScandiNova (Opzione 1 del Capitolato Tecnico) la quotazione di una fornitura di componenti sostitutivi per eventuali riparazioni sui Modulatori, prodotti dalla stessa ditta, di cui i Laboratori Nazionali di Frascati sono già in possesso. In tal senso l’acquisto di due nuovi Modulatori prodotti dalla stessa ditta permette di ottimizzare le strategie di approvvigionamento delle scorte di componenti sostitutivi e la formazione del personale.
Considerate le argomentazioni illustrate nella presente relazione si dichiara che:
La scelta di affidare la fornitura alla ScandiNova è tecnicamente obbligata e che il fornitore proposto si configura come unico.

Quotation K300 RF Units for C- & X-band
Dear Sirs,
In response to your invitation to tender, dated 2022-10-27 with reference according to above and related to EUPRAXIA SPARC LAB project. ScandiNova Systems AB is pleased to offer a K300 Solid-State Klystron Modulator adapted to 25MW X-band klystron E37119 as per specification in Appendix 1. and a K300 Solid-State Klystron Modulator adapted to 20MW C-band klystron E37217 as per specification in Appendix 2. The quotation also includes options to buy-back the K2-2, 50MW, C-band and a spare part kit for the K300 modulators.

Conditions
Where the contract requirements clearly state otherwise, the following terms and conditions shall apply to this proposal:
Terms of delivery: CIP, Frascati Rome, Italy (Incoterms 2020), packaging included.
Price: All prices are in EUR at 2022 price level. (VAT, local taxes and customs duties are excluded, regardless of the delivery terms applicable).
Currency Rate: Prices above are based at the currency rate between EUR and SEK at the date of the quotation.
If the currency rate changes more than +/-3%, the prices and the payments above shall be adjusted accordingly.
Payment: 30% ARO, 30% after four months, 30% at completion of Factory Acceptance 10 % after delivery. All invoice payments are to be received by ScandiNova no later than 30 days from date of invoice. The product shall remain the property of the supplier until paid for in full.
Upon delay in payment: The Seller is, without limitation, entitled to cancel the order and be indemnified for any and all financial damage.
Delay by Purchaser: If the Purchaser, for any reason, cause a delay of the delivery of the ordered equipment, such delay shall be considered to be a delay under section 16 of the General Terms and Conditions (ORGALIME S 2012), meaning that any part of the purchase price payments delayed thereby, shall be paid. If the entire delivery is delayed, section 17 of the General Terms and Conditions (ORGALIME S 2012) shall apply.

The Corona situation and the conflict in Ukraine could impact any performance under contract or fulfilment of order/s by Scandinova. Since the effects are so difficult to overview and predict, Xxxxxxxxxx’x performance is subject to any effects from the Corona virus and/or COVID-19 being treated as force majeure circumstances entitling Scandinova as supplier to necessary adoptions including for example adjustment of delivery time. Scandinova will continuously monitor the situation and keep its customer updated of potential consequences and impacts, including any expected delays.
Warranty: For the K300 modulators, twelve (12) months from the date of delivery.
For the klystrons according to manufacturer conditions:
A. 15 months from the date of original Bill of Lading (B/L) or
B. 2000 hours (filament)
The warranty period will be terminated by condition A or condition B whichever occurs first.
XxxxxxXxxx’x liabilities for defects follows sections 22-37 in ORGALIME S 2012.

Vista la Disposizione N.25001 del Presidente dell’Istituto Nazionale di Fisica Nucleare Xxxx. Xxxxxxx Xxxxxxx del 29 Novembre 2022;
la Commissione Tecnica composta dal Presidente Xxxxx Xxxxxxx, e dai membri: Xxxxx Xxxxxxxxx e Xxxxxxx Di Xxxxxx si riunisce in data 01 dicembre 2022 in seduta telematica per valutare la congruità dell’offerta relativa alla fornitura in oggetto.
Nell'ambito delle attività collegate all'iniziativa EuPRAXIA è prevista l’acquisizione di due sorgenti RF per il consolidamento della facility TEX dei Laboratori Nazionali di Frascati.
Considerate le argomentazioni illustrate nella Relazione Tecnica del 26/10/2022 del Responsabile Unico del Procedimento Xxxx. Xxxxx Xxxxxxx per la fornitura e posa in opera di due sorgenti RF ad alta potenza e delle relative opzioni prodotte dalla ditta XxxxxxXxxx, la scelta di affidare la fornitura alla ScandiNova è tecnicamente obbligata e che il fornitore proposto si configura come unico.
Nel documento relativo all’offerta proposta dalla ditta XxxxxxXxxx risultano in dettaglio le offerte per:
A. Numero 1 sorgente K300 X-band Solid-State RF-unit
B. Numero 1 sorgente K300 C-band Solid-State RF-unit
C. Spese relative alla sicurezza come richieste dalla lettera di invito indicate come “Safety & Security Guarantee on site “

Il prezzo totale considerando tutti i punti da A ad D dell’offerta come richiesto nella comunicazione del RUP del 01 dicembre 2022, risulta essere in 2 051000,00 € (due milioni e cinquantuno mila euro), IVA esclusa.
Nella valutazione della congruità dell’offerta economica si fa riferimento a recenti acquisizioni di impianti similari ed in particolare si confrontano:
Il modulatore per l’impianto di potenza RF acquistato per il test di strutture in banda X del progetto LATINO e Il modulatore per l’impianto di potenza RF acquistato per il consolidamento di SPARC in banda C del progetto SABINA, entrambi acquistati dalla ditta SCANDINOVA.
Dal confronto dei costi dei suddetti modulatori e considerando la dichiarazione di fornitore unico relativo alle sorgenti RF fornita nella Relazione Tecnica del 26/10/2022 del Responsabile Unico del Procedimento, la commissione ritiene che:
il prezzo indicato nell’offerta per l’acquisto sia congruo

2.1 Introduction to INFN-LNF
The National Institute of Nuclear Physics (INFN) is the Italian research agency dedicated to the study of the fundamental constituents of matter and the laws that govern them, under the supervision of the Ministry of Education, Universities and Research (MUR). It conducts theoretical and experimental research in the fields of subnuclear, nuclear and astroparticle physics. Fundamental research in these areas requires the use of cutting-edge technology and instruments, developed by the INFN at its own laboratories and in collaboration with industries. 2.2 Introduction to TEX Facility
The TEX facility (TEst Stand for X-band) is an asset of the INFN-LNF realized in the framework of the preparatory activities related to the EUPRAXIA@SPARC_LAB project. It aims to demonstrate the feasibility and reliability of the X-band (11.994 GHz) radiofrequency (RF) technology for the realization of a linear accelerator. Currently it implements a single RF Source capable of delivering 50 MW Peak RF Power at 50 Hz that will be used for testing of RF components and accelerating structure prototypes at the X-band frequency. This facility is part of the LATINO Infrastructure, funded by the “Regione Lazio” that offers open access to external users to promote and increase the technology transfer between research centres and the surrounding industrial framework.
To guarantee more test capability on high gradient structure testing at 12 GHz, the installation of a new high repetition rate RF source in the TEX laboratory is required. Moreover, the test of this source (modulator and klystron) with higher repetition rate with respect to the actual source is of great interest in the framework of the EUPRAXIA@SPARC_LAB project and for the entire X-band users community. The chosen frequency of 12 GHz is also compatible to other studies within the member states notably at CERN, Trieste, and PSI who have chosen this “European” X- band frequency. Moreover, to upgrade the TEX testing capabilities also to other frequencies of interest and expand the possible users of the LATINO project, the installation of a C-band (6GHz) high repetition rate RF source is requested. The C-band frequency is very interesting in
the context of accelerators for medical applications and the development of innovative and more compact injectors for Linac. INFN thus strongly supports the development and production of these Sources through collaboration with industries.
The contract concerns the design, manufacturing, test, delivery and installation of two complete radiofrequency sources based on Solid-State Pulsed Modulator technology. The first in the X- band frequency range adapted for the high repetition rate X-band Canon klystron model E37119. The second in the C-band frequency range adapted for the high repetition rate C- band Canon klystron model E37217. The klystron tubes and the Solid-state modulators specifications must be compliant with those listed in table 1, 2, 5 and 6. The procurement must include, for both the sources, the entire RF Source assembly: Solid State Pulsed Modulator with all his auxiliary systems (filament, solenoid and ion pump power supplies, pulse transformer, control system, cooling system, trigger and interlock system) and the RF Klystron Tube, including focusing electromagnet, lifting devices and any transporting tools that might be required. In this respect, the technical specifications of the tubes and the solenoid focusing magnets, provided by Canon, must be considered part of the present tender technical specifications. As it will be described in more detail in chapter 7, two acceptance tests must be conducted for both the sources, one in factory before shipment (Factory Acceptance Test) and one on site (Site Acceptance Test). Both tests will be attended by INFN-LNF staff, in addition copies of the signed and completed acceptance tests sheets shall be provided together with RF power test curves for the klystron and lists of equipment used and their calibration data.
4 Technical Specifications of the X-band RF Source
4.1 General Description of the X-band RF Source
The RF Source shall be composed of:
- X-Band 25 MW high repetition rate (400Hz) klystron, Canon model E37119 (comply with the specifications listed in Tab.1);
- solenoid focusing magnet model Canon VT-68970 or equivalent adapted to work with the specified klystron:
- Klystron X-ray shield
- Klystron Lifting attachment
- high voltage solid state pulsed power modulator (negative polarity);
- transformer oil
- filament heater power supply;
- core bias power supply;
- solenoid focusing magnet power supply;
- ion pump and solenoid power supply;
- the cooling system with flow meter diagnostics;
- oil tank with oil leak retention tray and X-ray shielding;
- oil tank humidity sensor;
- mineral high voltage oil;
- a control-command system;
- Remote control via Modbus TCP
- Trigger and protection interlock system;
- Digitizer for Modulator diagnostics
- RF digitizer for monitoring RF signals (Forward and Reflected power) at the klystron output.
The RF driver amplifier will be provided by INFN-LNF. Free space in the modulator rack must be reserved for installing the RF driver amplifier model AM61-12S-66-61PR4 (Microwave Amps Ltd).
4.2 Specifications of the Klystron Tube Canon E37119
Canon tube, model E37119 (X-Band, 25 MW, 1.5µs, 400Hz) must be used as reference. The main requirements of the klystron are listed in table 2.

a) The RF working frequency of the tube is constant, and its value shall be 11.994 GHz with the minimum instantaneous bandwidth at -1dB being 10 MHz.
b) The klystron will be operated at a pulse repetition frequency of 400 Hz and at full power RF output power. On a pulse-to-pulse basis, the reflected RF power appearing at the output window(s) will not normally exceed 2 MW.
c) The input RF signal to the klystron is a quasi-rectangular pulse with rise and fall times of
<100 ns. The RF output pulse is 1.5 μs wide at -3 dB and is positioned within the flat part of the HV cathode pulse so that the later should be larger enough.
d) The klystron will be mounted vertically inside its focusing electromagnet and supported by a tank containing a mineral oil dielectric, into which the cathode assembly is immersed.
e) In operation at INFN-LNF, shielding against X-rays shall be provided around the klystron body. This should reduce the residual X-ray flux to less than 10 μSv/h, at a distance of 1 m from the outer surface of the tube when the tube is operated at full performances.
f) The klystron body, collector and RF window(s) are cooled using demineralised water whose pH value is between 6.5 to 7.5. The maximum input water temperature is 35 degree Celsius, with a maximum inlet water pressure of 8 bar for the klystron collector and 3 bar for the klystron RF window. The klystron should be equipped with Resistance Temperature Detectors (RTDs) 3 or 4 wire-type placed at least on output klystron cavities, on the body and on the output RF ceramic windows for the measurement of the cooling water temperature, and also for purpose of the klystron protection. A terminal output block should be provided with standard RTD connectors.
g) The klystron RF window(s) will operate with vacuum on the waveguide network side of the klystron at a pressure lower than 1.3e-6 mbar.
h) The manufacturer must specify the electrical requirements of the focusing electromagnet.
i) To prevent gun damage and arcs, maximum security thresholds for the voltage must be included for HV over voltage (1.05 x setting voltage) and inverse voltage. If a threshold
is exceeded, the RF power and the high voltage pulsed power supply must be turned off.
The procurement must include the focusing electromagnet Canon VT-68970 (or equivalent) specified to use with the high-power klystron E37119. This magnet should provide the proper shaped field to properly operate the klystron at nominal parameters i.e. maximum power and repetition rate.
The oil tank supports the klystron, and it will contain the gun and all high voltage elements of the modulator. The oil to be used is preferably Nytro 10XN. The tank shall be equipped with an expansion tank to control the oil level. A cooling system can be included to keep the oil temperature under 50 °C. The modulator shall include an additional retention tray in case of leakage from the main tank.
4.5 Specifications of the Pulsed Modulator
The modulator shall deliver a maximum high voltage pulse of 340 kV with a usable flat top of
1.5 µs and a pulse repetition rate of up to 400 Hz. Flat top is defined as the pulse exploitable region where the voltage ripple requirements (±1 % at nominal working point) are met.

If the minimum threshold is exceeded, the RF power and the high voltage pulsed power supply must be turned off to prevent beam interception damage. If the maximum threshold is exceeded, the cathode heater must also be turned off to prevent cathode damage. The filament power supply specifications are given in Table 4.

The provider must specify and notify to INFN-LNF, the maximum ratings for the solenoid electromagnet in terms of electrical specifications and cooling.
5 Technical Specifications of the C-band RF Source
5.1 General Description of the C-band RF Source
The RF Source shall be composed of:
- C-Band 20 MW high repetition rate (400Hz) klystron, Canon model E37217 (comply with the specifications listed in Tab.5);
- solenoid focusing magnet model Canon VT-68954 or equivalent adapted to work with the specified klystron:
- Klystron X-ray shield
- Klystron Lifting attachment
- high voltage solid state pulsed power modulator (negative polarity);
- transformer oil
- filament heater power supply;
- core bias power supply;
- solenoid focusing magnet power supply;
- ion pump and solenoid power supply;
- the cooling system with flow meter diagnostics;
- oil tank with oil leak retention tray and X-ray shielding;
- oil tank humidity sensor;
- mineral high voltage oil;
- a control-command system;
- Remote control via Modbus TCP
- Trigger and protection interlock system;
- Digitizer for Modulator diagnostics
- RF digitizer for monitoring RF signals (Forward and Reflected power) at the klystron output.
The RF driver amplifier will be provided by INFN-LNF. Free space in the modulator rack must be reserved for installing the RF driver amplifier model AM61-5.7S-56-56R (Microwave Amps Ltd).
5.2 Specifications of the Klystron Tube Canon E37119
Canon tube, model E37217 (C-Band, 20 MW, 2.5µs, 400Hz) must be used as reference. The main requirements of the klystron are listed in table 2.

j) The RF working frequency of the tube is constant, and its value shall be 5.712 GHz.
k) The klystron will be operated at a pulse repetition frequency of 400 Hz and at full power RF output power. On a pulse-to-pulse basis, the reflected RF power appearing at the output window(s) will not normally exceed 2 MW.
l) The input RF signal to the klystron is a quasi-rectangular pulse with rise and fall times of
<100 ns. The RF output pulse is 2.5 μs wide at -3 dB and is positioned within the flat part of the HV cathode pulse so that the later should be larger enough.
m) The klystron will be mounted vertically inside its focusing electromagnet and supported by a tank containing a mineral oil dielectric, into which the cathode assembly is immersed.
n) In operation at INFN-LNF, shielding against X-rays shall be provided around the klystron body. This should reduce the residual X-ray flux to less than 10 μSv/h, at a distance of 1 m from the outer surface of the tube when the tube is operated at full performances.
o) The klystron body, collector and RF window(s) are cooled using demineralised water whose pH value is between 6.5 to 7.5. The maximum input water temperature is 35 degree Celsius, with a maximum inlet water pressure of 8 bar for the klystron collector and 3 bar for the klystron RF window. The klystron should be equipped with Resistance Temperature Detectors (RTDs) 3 or 4 wire-type placed at least on the body and on the output RF ceramic windows for the measurement of the cooling water temperature, and also for purpose of the klystron protection. A terminal output block should be provided with standard RTD connectors.
p) The klystron RF window(s) will operate with vacuum on the waveguide network side of the klystron at a pressure lower than 1.3e-6 mbar.
q) The manufacturer must specify the electrical requirements of the focusing electromagnet.
r) To prevent gun damage and arcs, maximum security thresholds for the voltage must be included for HV over voltage (1.05 x setting voltage) and inverse voltage. If a threshold is exceeded, the RF power and the high voltage pulsed power supply must be turned off.
The procurement must include the focusing electromagnet Canon VT-68954 (or equivalent) specified to use with the high-power klystron E37217. This magnet should provide the proper shaped field to properly operate the klystron at nominal parameters i.e. maximum power and repetition rate.
The oil tank supports the klystron, and it will contain the gun and all high voltage elements of the modulator. The oil to be used is preferably Nytro 10XN. The tank shall be equipped with an expansion tank to control the oil level. A cooling system can be included to keep the oil temperature under 50 °C. The modulator shall include an additional retention tray in case of leakage from the main tank.
5.5 Specifications of the Pulsed Modulator
The modulator shall deliver a maximum high voltage pulse of 280 kV with modulator HV pulse length ≥3.8 µs and a pulse repetition rate of up to 400 Hz. The modulator HV pulse width (duration) shall be measured between the 75% point of the beam voltage pulse.
The power supply polarity is negative. The main specifications of the pulsed modulator are given in Table 6.

The solenoid power supply must be rated properly following the maximum ratings for the solenoid electromagnet VT-68954 realized by Canon (or equivalent). The provider must specify and notify to INFN-LNF, the maximum ratings for the solenoid electromagnet in terms of electrical specifications and cooling.
6 Fast protective Network, local control, states of operation, interlock and diagnostics systems
The following specifications must be considered valid for both sources.
The modulator needs a crowbar or other equivalent protective network in case of a klystron fault (electrical arc). When a discharge occurs, the energy dissipation in the klystron must be limited. In case of a klystron fault, a recovery period must be respected before pulsing again.
The control system to be provided shall be based on a Programmable Logic Controller (PLC) whose characteristics and model have to be communicated to INFN for approval. The slow changing signals are directly managed by the PLC. Faster signals are treated by “pulse surveyor” cards and the information will be sent to the PLC. Local supervision and control commands shall be made by a local Touch Panel. Personal security interlocks shall be treated by hard-wired interlocks.
RESET BUTTON (software): Used to clear an Interlock when the interlocking conditions has ceased to exist
The modulator system can be found in one of the four control status:
OFF, STANDBY (heater), HIGH VOLTAGE, TRIGGER
a) OFF status: the water cooling and the ion pump are on. The high voltage tank temperature is checked and the filament power supply is off.
b) STANDBY status: the klystron filament power is on. A delay of one hour for the klystron shall be respected. The ion pump currents and voltages are checked. The klystron electromagnet and all kind of coils needed for the modulator are on.
c) HIGH VOLTAGE status: STANDBY status and HVPS on ready to pulse.
d) TRIGGER status: the high voltage pulses are applied on the klystron.
The modulator shall also provide an external indication of the HV on/off status to be connected to the safety protection system.
The following measurements shall be available in local or remote mode:
a) Klystron cathode voltage and current (with calibrated voltage divider and current monitor, (Es. Xxxxxxx Current Transformer and Stangenes CVD)
b) Klystron filament voltage and current;
c) Electromagnet currents;
d) Ion pump voltage and current;
e) Inlet and outlet body water temperature;
f) Body water flow;
g) Body dissipated power;
h) Klystron Body temperature;
i) Collector water flow;
j) Inlet and outlet collector water temperature;
k) Oil temperature;
l) Recording of heater and high voltage hours shall be cumulative even after a power off of complete system.
This list is not exhaustive and additional measurement can be included based on manufacturer initiative.
All the interlock levels shall be available in local or remote. The supplier shall provide the complete list of the interlocks. The PLC shall store a historic of at least the last eight trips of the modulator indicating what fault caused each trip. These interlock occurrences shall be stored with a REAL time and date marker.
The following interlocks shall be hardwired into the system (and individually be identifiable) and not rely on just a software interlock to shut off the modulator:
a) Klystron water flow interlocks;
b) Solenoid water flow interlocks;
c) Filament voltage and current interlocks;
d) Klystron arc protection;
e) Ion pump current;
f) External interlocks such as machine access control;
g) VSWR
Multiple slots for external interlocks must be available that can be individually identifiable and switch the modulator to the required state. INFN will provide a complete list of the external signals together with a required number of spare slots. A provisional list is indicated below:

The PLC shall have an Ethernet module to communicate with the INFN-LNF network through Modbus protocol. The status and measurement readout of a subset of variable monitored by the modulator PLC system should be shared with the facility general control system. The variables to be included in the subset will be chosen by the INFN staff following technical discussions with the modulator manufacturer.
The supplier must communicate to INFN-LNF the final cooling and electrical requirements for the installation of the sources, in particular the total water flux required and total pressure drop of the cooling system of the two sources.
The X-band modulator rack should foresee a free space near the klystron in order to integrate the solid state driver amplifier AM61-12S-66-61PR4 realized by Microwave Amps Ltd and that will be provided by INFN-LNF. The driver should occupy 6 rack units.
The C-band modulator rack should foresee a free space near the klystron in order to integrate the solid state driver amplifier AM61-5.7S-56-56R realized by Microwave Amps Ltd and that will be provided by INFN-LNF. The driver should occupy 3 rack units.
7.1 X-band Klystron mechanical specifications
a) The tube must have a single output connection: WR90 international rectangular flange CERN type. Other types of flange must be discussed and agreed in advance with INFN. If at the output cavity of the klystron the power is splitted into two waveguides, in order to have two RF windows, the tube should include a combiner to present a single output flange.
b) The RF input connector must be WR90 flange UG-39/U compatible.
c) The tube must include the lifting tools for klystron and solenoid installation with crane.
d) The collector body, electron gun and modulator, shall be shielded by lead within the imposed envelope in such a way that the emission of X-rays from any klystron surface does not exceed 10 µSv/h @ 1 m from any klystron surface, under all operating conditions. This shielding must be local or attached to the klystron’s support (i.e. it must be part of the equipment). It must be easily removable to access the RF output flange.
7.2 C-band Klystron mechanical specifications
a) The tube must have a single output connection: WR187 KEK-Desy Flange Other types of flange must be discussed and agreed in advance with INFN. If at the output cavity of the klystron the power is splitted into two waveguides, in order to have two RF windows, the tube should include a combiner to present a single output flange.
b) The tube must include the lifting tools for klystron and solenoid installation with crane.
c) The collector body, electron gun and modulator, shall be shielded by lead within the imposed envelope in such a way that the emission of X-rays from any klystron surface does not exceed 10 µSv/h @ 1 m from any klystron surface, under all operating conditions. This shielding must be local or attached to the klystron’s support (i.e. it must be part of the equipment). It must be easily removable to access the RF output flange.
The ambient air temperature in the TEX environment is expected to vary between 15°C and 35°C.
The overall footprint of each RF source should not exceed 2 m by 1.5 m due to the physical and safety constraints, as shown planimetry below.

7.4 RF Radiation, EMI and Safety
The building where the modulators will be installed is accessible by INFN staff, even during operation. It is therefore of prime importance that provisions are made that nobody can be injured by high voltage connected to the klystron’s gun, ion pump and focusing solenoid. The magnetic stray field 1 m from the klystron axis shall not exceed 0.5mT; under all operating conditions the maximum RF and X radiation levels at any klystron surface shall not exceed 0.1mW/cm2 and 10 µSv/h @ 1m respectively. It is reminded that the supplier shall define the conditions for safe operation of the klystron.
The modulator shall be compliant to the LVD (2014/35/UE) and EMC European directive 2004/108/EC.
About harmonics and Low frequency EMC the modulator must comply:
a) IEC 61000 Electromagnetic compatibility
b) EN 00000-0-00 Limits for harmonic current produced by equipment connected to public low-voltage systems with input current > 16 A and ≤ 75 A for phase

Cabling shall be conforming to IS 23: Criteria and Standard Test Methods for the Selection of Electric Cables and Wires with Respect to Fire Safety and Radiation Resistance (2005) xxxxx://xxxx.xxxx.xx/xxxx/000000/XXXX_XXXXXXXX/X_XX00.xxx.
If the modulator requires an oil tank for the high voltage gun there shall be a mandatory oil retention tray incorporated in the design of the modulator.
7.5 Deviation from this technical specification
INFN reserves the right to make minor modifications to the specification before placing the contract. If, after the contract is placed, the contractor discovers that he has misinterpreted this technical specification, this will not be accepted as an excuse for deviation from it and the contractor shall deliver equipment in conformity with this technical specification at no extra cost.
8.1 Responsibility for design, components and performance
The contractor shall be responsible for the correct performance of all items supplied, irrespective of whether they have been chosen by the contractor or suggested by INFN. INFN's approval of the design and component choice does not release the contractor from his responsibilities in this respect.
If the contractor finds that any part of this technical specification is difficult, or costly to meet, it is free to propose an alternative solution, provided that the deviations from this technical specification, together with the reasons and advantages, are clearly indicated. INFN reserves the right to accept or reject the proposed alternative solutions without justification.
The bidder shall notify the delivery schedule not later than 3 months after the signature of the contract. In any case the duration of the contract is limited in 18 (eighteen) months from the signature.
8.2.1 Manufacture and Test Schedules
The contractor shall supply, within 3 months from the signature of the contract, a written programme detailing the manufacturing and testing schedules. The programme shall include preliminary dates for inspections and tests.
8.3.1 Contract Engineer
8.3.2 Progress Report
A written progress report shall be sent to INFN every six months until completion of the contract. In addition, a regular information exchange by telephone, email and videoconference is necessary.
8.4 Documentation Handling, Quality Control and Quality Assurance
The contractor must plan, establish and implement a documented quality assurance program that fulfils all the requirements described in this technical specification. Copies of the signed and completed acceptance tests sheets shall be provided together with RF power test curves, and lists of equipment and their calibration date, for the klystron.
The RF power source shall be delivered to the INFN-LNF infrastructure together with the following documentation in English:
a) Inspection Sheet of the klystron reporting the nominal ratings of the tube and at least the following power test curves:
1. Heater Voltage [V] vs Heater Current [A] Characteristics.
2. Heater Current [A] vs Cathode Current [A] Characteristics.
3. Transfer Characteristics (RF input power vs RF output power) for at least four different values of the Beam voltage [up to max nominal voltage].
4. Beam Voltage [kV] vs Cathode Current [A] Characteristics (at nominal heater parameters).
5. Waveforms of the beam voltage and cathode Current at nominal values.
b) The electrical and mechanical drawings of the Klystron;
c) The electrical and mechanical drawings of the Modulator;
d) The Acceptance Test Data Sheet and the Acceptance Test Procedure for both Factory Acceptance Test and Site Acceptance Test;
e) An operating and maintenance manual of the Klystron an Solenoid;
f) An operating and maintenance manual of the modulator;
g) An operating and maintenance manuals of commercial components if they exist;
h) A list of reference for components of replacement and, if possible, European sales offices;
i) Packing and unpacking manuals;
j) Any other useful documents.
The source will undergo a first series of tests at the manufacturer’s premises prior to delivery, and a second series of tests, constituting the acceptance tests, at INFN Frascati. Representatives of the manufacturer and INFN will participate in all tests. In addition INFN reserves the right to visit manufacturers’ premises (both tube and modulator supplier) at any time provided a written notification at least 15 working days in advance. Both the contractor and INFN shall give at least ten working days’ notice of the proposed date of any such tests. All testing of the source shall be done with reference to a test specification for that particular source. This specification shall be part of the Quality Assurance programme of the manufacturer, and together with the Test Acceptance Sheet will be used during the measurement and recording of the source test data at the manufacturers plant. Copies of the Test Specification, Manufacturing Specification and the Test Acceptance Sheet to be used shall be made available to INFN-LNF at least 1 month before the execution of the tests.
8.5.2 Klystron Factory Acceptance Test (K-FAT)
The klystron tube will be tested by the tube provider at his factory before the entire source factory acceptance test. INFN representatives shall participate to this test and all the test performance sheets and power curves plotted during this test, shall be provided to INFN. The test report shall contain test results that demonstrate conformity with all the requirements stipulated in chapter 4, table 1. 8.5.3 Source Factory Acceptance Test (S-FAT)
The manufacturer shall carry out a final test of the modulator and klystron together at his plant to ensure that the specified performances of the source are met. The source will be tested by the manufacturer in diode mode (without an RF signal at the input). INFN representatives will witness this final test and the recording of the data. INFN requires that a klystron manufacturers test specialist shall be present when the klystron will be put into service. INFN also reserve the right to ensure that only calibrated measuring and test equipment is used for these acceptance tests. Before the final test is made the source must have continuously operated for a period of 2 working days. Any pulse failures during this time must be recorded and brought to the attention of the INFN representative. Klystron and modulator operating parameters will be established.
8.5.4 Site Acceptance Test (SAT)
The tests at INFN Frascati, which will be carried out within 20 weeks of delivery of the source, are followed by a non-stop 100-hour run at rated output power. After the successful completion of the 100-hour run the unit is considered as accepted.
INFN requires that a klystron manufacturers test specialist shall be present when the klystron will be put into service at INFN-LNF. The tubes received on-site will be immediately tested by INFN- LNF staff for heater continuity, state of internal vacuum and a general visual inspection. Any tube not passing this basic reception test will be returned to the manufacturers for inspection and action. The Source will be tested on site using the same parameters for the nominal peak power output power test as recorded on the Klystron Factory Acceptance Test and at the Source Factory Acceptance test. The final acceptance test will be made with a water load under similar conditions as in the factory. Final acceptance by INFN of the Source will be after this on-site test has been successfully completed.
The supplier is responsible for the packing, the transport to the INFN-LNF infrastructure and the eventual customs formalities and taxes. It is agreed that the customer warranty for the source will start after SAT completion. The complete packaging will have to ensure a safe transportation and handling. The tube warranty will start after the klystron acceptance test at the klystron provider factory. The supplier will provide detailed instruction if special handling will be required.
8.6.1 Installation and Commissioning
INFN staff will prepare the units for the acceptance test on the Frascati site and the commissioning will be done in the presence of the contractor.
INFN requires that the manufacturer provides a warranty of 12 months for each RF sources after the SAT. Parts of a klystron and its accessories provided by the manufacturer must be guaranteed against defective materials or manufacturing. The guarantee period will start after the klystron acceptance test at the klystron provider factory. The warranty for the klystron shall be 12 months or at least 1500 hours of applied heater voltage.
The RF Source manufacturer shall provide together with the source also a spare part kit, for k- series modulators, containing:

Introduzione
In questo documento si enunciano le condizioni contrattuali per il contratto di acquisizione di due sorgenti RF ad alta potenza con frequenza di ripetizione di 400Hz di cui una equipaggiata con un klystron in banda-X da 25MW e l’altra con un klystron in banda-C da 20MW.
1 GARANZIA PROVVISORIA
Il concorrente dovrà presentare una garanzia provvisoria pari al 2% (due per cento) dell’importo a base di gara e con validità di 180 giorni dalla data di presentazione dell’offerta, ai sensi dell’art. 93 del d.lgs. n. 50/2016 e s.m.i.. L’importo della garanzia è ridotto in tutte le ipotesi previste dall’art. 93, comma 7, del d.lgs. 50/2016 e s.m.i..
2 VALIDITA’ OFFERTA
Le offerte devono avere una validità non inferiore a 90 giorni.
3 GARANZIA DEFINITIVA
L’esecutore del contratto è obbligato a costituire una garanzia definitiva secondo quanto previsto all’art. 103 del d.lgs. 50/2016 e s.m.i., mediante cauzione o fideiussione bancaria o polizza assicurativa. L’importo della garanzia è ridotto nel suo importo in tutte le ipotesi previste dall’art. 93, comma 7, del d.lgs. 50/2016 e s.m.i. E’ facoltà dell’offerente costituire la cauzione con le modalità di cui al co. 2 dell’art. 93.
L’atto fideiussorio deve prevedere espressamente la rinuncia al beneficio della preventiva escussione del debitore principale; la rinuncia all’eccezione di cui all’art. 1957, comma 2, del Codice Civile, nonché l’operatività della garanzia medesima entro 15 giorni, a semplice richiesta scritta dell’INFN.
La cauzione è prestata a garanzia dell’adempimento di tutte le obbligazioni del contratto e del risarcimento dei danni derivanti dall’eventuale inadempimento delle obbligazioni stesse, nonché a garanzia del rimborso delle somme pagate in più all’esecutore rispetto alle risultanze della liquidazione finale, salva comunque la risarcibilità del maggior danno verso l’appaltatore e cessa di avere effetto solo alla data di emissione del certificato di collaudo provvisorio o del certificato di regolare esecuzione.
L’Impresa si impegna a tenere valida ed efficace la garanzia per tutta la durata del contratto e a reintegrarla ove l’INFN se ne sia avvalso, entro 10 (dieci) giorni dalla richiesta. In caso di mancato reintegro il contratto si intende risolto, salvo il risarcimento del danno.
4 PENALI
In caso di mancato o inesatto o ritardato adempimento delle prestazioni contrattuali sarà applicata una penale pari al 0,3‰ dell’importo contrattuale per ogni giorno di ritardo con un massimo del 10%, secondo i criteri dettagliati nel Capitolato Tecnico.
La fissazione delle penali non preclude la risarcibilità di eventuali ulteriori danni o la risoluzione del contratto se l’ammontare delle penali raggiunge l’importo della garanzia definitiva.
5 TERMINI DI CONSEGNA
La fornitura dovrà essere consegnata secondo i tempi e le modalità indicate nel Capitolato tecnico franco INFN-LNF in Xxx Xxxxxx Xxxxx, x. 00 – Xxxxxxxx (Xxxx).
Le spese di imballaggio e trasporto sono a carico esclusivamente dell’operatore economico.
6 AUMENTI / DIMINUZIONI
L’INFN, ai sensi dell’art 106, commi 1 e 2 del D. lgs. n. 50/2016 e s. m. i. può ammettere variazioni al contratto, in aumento o in diminuzione; nel caso in cui la variazione sia fino alla concorrenza massima di un quinto del corrispettivo contrattuale indicato al precedente art. 5, ai sensi del comma 12 dell'art. 106 del D.lgs. n. 50/2016 e
s.m.i l’IMPRESA non può far valere il diritto alla risoluzione del contratto e si impegna ad eseguire, mediante atto di sottomissione delle modifiche richieste dal RUP/DEC/DL ed adeguatamente motivate, le prestazioni alle stesse condizioni del contratto principale. Oltre tale limite l’IMPRESA ha facoltà di risolvere il contratto
7 DURATA
Il Contratto avrà la durata di 18 mesi con decorrenza dalla data di stipula del contratto.
8 SUBAPPALTO:
L’Impresa potrà subappaltare le prestazioni contrattuali dietro autorizzazione dell’INFN, e in conformità all’art. 105 del d.lgs. 50/2016 e s.m.i., solo se lo avrà dichiarato in sede di offerta.
9 DIVIETO CESSIONE CONTRATTO
È fatto divieto all’Impresa di cedere, a qualsiasi titolo, il contratto, a pena di nullità della cessione medesima.
10 OBBLIGHI DELL’APPALTATORE
L’Impresa si impegna ad ottemperare a tutti gli obblighi derivanti da disposizioni legislative e regolamentari vigenti in materia di retribuzione, previdenza e assistenza.
L’Impresa si obbliga, inoltre, all’osservanza delle norme in materia di sicurezza sul lavoro, ai sensi del d.lgs. n. 81/2008 e s.m.i. L’Impresa si obbliga, per quanto compatibile, a far osservare ai propri dipendenti e Collaboratori il Codice di comportamento in materia di anticorruzione del personale INFN, pubblicato nella sezione “Amministrazione
trasparente” del sito istituzionale INFN. Nelle ipotesi di grave violazione delle disposizioni ivi contenute, l’INFN si riserva la facoltà di risolvere il contratto.
L’Impresa si obbliga al rispetto delle disposizioni di cui all’art. 53, comma 16-ter del d.lgs.
n. 165/2001 e s.m.i. in materia di conferimento di incarichi o contratti di lavoro ad ex dipendenti INFN, pena l’obbligo di restituzione dei compensi illegittimamente percepiti ed accertati in esecuzione dell’affidamento.
11 SOSTENIBILITA’ ENERGETICA ED AMBIENTALE
L’Impresa, ai sensi dell’art. 34 del D.Lgs. n. 50/2016 e s.m.i. si impegna ad effettuare le prestazioni oggetto del contratto in conformità ai criteri ambientali minimi adottati dal Ministero dell’Ambiente nell’ambito del Piano d’azione per la sostenibilità ambientale dei consumi nel settore della pubblica amministrazione.
12 ATTESTAZIONE DI REGOLARE ESECUZIONE
La verifica della conformità delle prestazioni eseguite a quelle pattuite sarà effettuata a cura del RUP ai sensi dell’art. 102, comma 2, del D.lgs. n. 50/2016 e s.m.i. ed entro 30 giorni dalla data di ultimazione delle prestazioni oggetto del contratto.
13 FATTURAZIONE E PAGAMENTI
Le fatture, da emettersi in formato elettronico, dovranno essere trasmesse tramite il sistema di Interscambio dell’Agenzia delle Entrate utilizzando il Codice Univoco Ufficio: WMXSWX
Il pagamento sarà effettuato entro 30 (trenta) giorni dall’adozione di ogni S.A.L. L’IMPRESA sarà autorizzata per iscritto da parte del Responsabile Unico del Procedimento, che avrà rilasciato il relativo Certificato di Pagamento non oltre 7 (sette) giorni dall’adozione di ogni S.A.L., ad emettere fattura in formato elettronico.
Il pagamento finale (dell’ultimo SAL) o il pagamento in unica soluzione (tipicamente per le forniture di beni), avverrà a seguito dell’esito positivo della verifica finale della conformità che sarà effettuata, in accordo a quanto previsto dall’art. 102 comma 2 del D.lgs. n. 50/2016 e s.m.i., entro 30 (trenta) giorni dalla data di ultimazione delle prestazioni oggetto del contratto.
Il pagamento sarà effettuato mediante bonifico su conto corrente dedicato del quale l’Impresa si obbliga a garantire la tracciabilità ai sensi della L. 136/2010 e s.m.i.
Il pagamento sarà, inoltre, subordinato alla verifica della regolarità contributiva e fiscale dell’Impresa.
14 RISOLUZIONE PER INADEMPIMENTO E RECESSO
Nel caso di inadempimento delle obbligazioni contrattuali secondo i criteri descritti nel Capitolato Tecnico, l’INFN si riserva il diritto di risolvere il contratto ai sensi e per gli effetti dell’art. 1456 c.c., con comunicazione scritta da inviarsi con raccomandata a/r, con un preavviso di 20 (venti) giorni.
Restano in ogni caso impregiudicati i diritti dell’INFN al risarcimento di eventuali danni e all’incameramento della garanzia definitiva.
L’INFN si riserva, inoltre, il diritto di recedere unilateralmente dal contratto in qualsiasi momento, con un preavviso di almeno 20 (venti) giorni da comunicarsi all’Impresa mediante raccomandata a/r.
In caso di recesso all’Impresa spetterà il corrispettivo limitatamente alla prestazione eseguita e al decimo dell’importo delle forniture non eseguiti ai sensi dell’art. 109 del d.lgs. n. 50/2016 e s.m.i., secondo i corrispettivi e le condizioni previsti nel contratto.
15 DANNI E RESPONSABILITA'
La responsabilità totale del Fornitore per danni o altro non potrà eccedere l'eventuale corrispettivo ricevuto per l'unità di prodotto o servizio fornito o da fornire, a seconda dei casi, con conseguente perdita o danno lamentato. In nessun caso il fornitore sarà responsabile per perdite o danni incidentali, consequenziali, indiretti, punitivi, speciali o esemplari di qualsiasi tipo, inclusi ma non limitati a mancati ricavi aziendali, mancati profitti, costi di fermo macchina o mancato utilizzo risultanti dai prodotti o servizi, comunque causati, siano essi basati su contratto, illecito o qualsiasi altra teoria giuridica. L'Acquirente rinuncia espressamente a qualsiasi diritto di recesso, annullamento o revoca dell'accettazione in relazione ai prodotti consegnati salvo quanto previsto al punto al precedente punto 12. La responsabilità verso terzi per lesioni personali, inclusa la morte, risultanti dai Prodotti non è influenzata dalle limitazioni di responsabilità stabilite nella presente Sezione.
16 GARANZIA
Per i beni oggetto del contratto, in base agli artt. 1490 e 1495 del c.c., l’appaltatore dovrà fornire idonea garanzia, non inferiore a 12 mesi e 1500 ore di funzionamento a condizioni nominali dalla consegna dei beni presso i LNF-INFN.
17 FORO COMPETENTE
Per eventuali controversie tra le Parti inerenti al Contratto, sarà competente in via esclusiva il Foro di Roma.

19 OPZIONI
Opzione n. 1: la stazione appaltante si riserva il diritto di ordinare un kit ulteriore come da punto 9.1 del capitolato tecnico al prezzo che verrà indicato nella presente offerta. Ai fini dell’art. 35, comma 4 del Codice, il valore massimo stimato dell’appalto, è pari ad € 70000,00 al netto di Iva e/o di altre imposte e contributi di legge, nonché degli oneri per la sicurezza dovuti a rischi da interferenze
Opzione n. 2 La stazione appaltante prevede- previa autorizzazione da parte degli organi INFN preposti- un’ulteriore offerta per l’acquisto da parte dell’operatore economico del Modulatore RF K2-2 iscritto al n. inventario 19968 dei Laboratori Nazionali di Frascati. L’ attivazione dell’opzione per il suddetto acquisto comporterà un ribasso sull’offerta per la fornitura oggetto di gara pari alla quotazione fatta dall’operatore economico del Modulatore RF K2-2 da acquistare da parte dell’operatore economico.

1. PROVISIONAL WARRANTY
The competitor must present a provisional guarantee equal to 2% (two percent) of the amount based on the tender and valid for 180 days from the date of submission of the offer, pursuant to art. 93 of Legislative Decree no. 50/2016 and subsequent amendments. The amount of the guarantee is reduced in all cases provided for by art. 93, paragraph 7, of Legislative Decree 50/2016 and subsequent amendments.
2. VALIDITY OF THE OFFER:
Offers must be valid for no less than 90 days.
3. DEFINITIVE WARRANTY
The executor of the contract is obliged to provide a definitive guarantee in accordance with the provisions of art. 103 of Legislative Decree 50/2016 and subsequent amendments, by means of a deposit or bank guarantee or insurance policy. The amount of the guarantee is reduced in its amount in all cases provided for by art. 93, paragraph 7, of Legislative Decree 50/2016 and subsequent amendments The bidder has the right to lodge the security in the manner referred to in par. 2 of art. 93.
The surety deed must expressly provide for the waiver of the benefit of the prior enforcement of the principal debtor; the waiver of the exception referred to in art. 1957, paragraph 2, of the Civil Code, as well as the effectiveness of the guarantee itself within 15 days, at the simple written request of the INFN.
The deposit is given to guarantee the fulfillment of all the obligations of the contract and the compensation for damages deriving from any non-fulfillment of the obligations themselves, as well as to guarantee the reimbursement of the sums paid in addition to the executor with respect to the results of the final settlement, without prejudice to in any case, the reimbursement of the greater damage to the contractor and ceases to have effect only on the date of issue of the provisional test certificate or certificate of regular execution.
The Company undertakes to keep the guarantee valid and effective for the entire duration of the contract and to reinstate it if the INFN makes use of it, within 10 (ten) days of the request. In the event of failure to reinstate the contract, the contract is considered terminated, subject to compensation for damage.
4. PENALTIES
In the event of failure or incorrect or delayed fulfillment of the contractual services, a penalty equal to 0.3‰ of the contractual amount will be applied for each day of delay with a maximum of 10%, according to the criteria detailed in the Technical Specifications.
The fixing of the penalties does not preclude the compensation of any further damages or the termination of the contract if the amount of the penalties reaches the amount of the definitive guarantee
5. TERMS OF DELIVERY:
The supply must be delivered according to the times and methods indicated in the Technical Specifications at INFN-LNF in Xxx Xxxxxx Xxxxx, x. 00 – Xxxxxxxx (Xxxx).
6. INCREASES / DECREASES:
INFN, pursuant to Article 106, paragraphs 1 and 2 of Legislative Decree n. 50/2016 and further modifications, can admit changes to the contract, increasing or decreasing; in the event that the variation is up to a maximum of one fifth of the contractual consideration indicated in the previous art. 5, pursuant to paragraph 12 of art. 106 of Legislative Decree.
n. 50/2016 and subsequent amendments, the COMPANY cannot assert the right to terminate the contract and undertakes to perform, by submitting the changes required by the RUP / DEC / DL and adequately motivated, the services under the same conditions as the main contract. Beyond this limit, the COMPANY has the right to terminate the contract.
7. CONTRACT DURATION:
The Contract will have a duration of 18 months with effect from the date of signing the contract.
8. SUBCONTRACTING:
The Company may subcontract the contractual services with the authorization of the INFN, and in accordance with art. 105 of Legislative Decree 50/2016 and subsequent amendments, only if this has been declared in the offer.
9. CONTRACT TRANSFER PROHIBITION:
It is forbidden for the Company to transfer the contract for any reason, under penalty of nullity of the transfer itself.
10. OBLIGATIONS OF THE CONTRACTOR:
The Company undertakes to comply with all the obligations deriving from the laws and regulations in force regarding remuneration, pension and assistance.
The Company also undertakes to comply with the rules on safety at work, pursuant to Legislative Decree no. 81/2008 and subsequent amendments. The Company undertakes, as far as compatible, to make its employees and collaborators observe the Code of Conduct on the anti-corruption of INFN staff, published in the "Transparent Administration" section of the INFN institutional website. In the event of a serious violation of the provisions contained therein, INFN reserves the right to terminate the contract.
The Company undertakes to comply with the provisions of art. 53, paragraph 16-ter of the legislative decree n. 165/2001 and subsequent amendments in the matter of conferring
assignments or employment contracts to former INFN employees, under penalty of the obligation to return the compensation illegally received and ascertained in execution of the assignment.
11. ENERGY AND ENVIRONMENTAL SUSTAINABILITY:
The Company, pursuant to art. 34 of Legislative Decree no. 50/2016 and subsequent amendments undertakes to carry out the services covered by the contract in accordance with the minimum environmental criteria adopted by the Ministry of the Environment as part of the Action Plan for the environmental sustainability of consumption in the public administration sector.
12. CERTIFICATION OF PROPER EXECUTION:
Verification of compliance of the services performed with those agreed will be carried out by the RUP pursuant to art. 102, paragraph 2, of the Legislative Decree. n. 50/2016 and subsequent amendments and within 30 days from the date of completion of the services covered by the contract.
13. BILLING AND PAYMENTS:
Invoices, to be issued in electronic format, must be sent through the exchange system of the Agenzia delle Entrate using the Unique Office Code: WMXSWX
Payment will be made within 30 (thirty) days of the adoption of each S.A.L. (progress of works). The COMPANY will be authorized in writing by the Sole Processor, who will have issued the relevant Payment Certificate no later than 7 (seven) days from the adoption of each S.A.L., to issue an invoice in electronic format.
The final payment (of the last SAL) or the lump sum payment (typically for the supply of goods), will take place following the positive outcome of the testing of the certificate of regular execution which will be carried out, in accordance with the provisions of art. 102 paragraph 2 of the Legislative Decree. n. 50/2016 and subsequent amendments, within 30 (thirty) days from the date of completion of the services covered by the contract.
Payment will be made by bank transfer to a dedicated current account which the Company undertakes to ensure traceability pursuant to Law 136/2010 and subsequent amendments.
Payment will also be subject to verification of the Company's tax and contribution regularity.
14. RESOLUTION FOR BREACH OF COMPLIANCE AND WITHDRAWAL:
In the event of non-fulfillment of contractual obligations according to the criteria described in the Technical Specifications, INFN reserves the right to terminate the contract pursuant to and for the purposes of art. 1456 of the Italian Civil Code, with written communication to be sent by registered letter with return receipt, with a notice of 20 (twenty) days.
In any case, INFN's rights to compensation for any damage and forfeiture of the definitive guarantee remain unaffected.
The INFN also reserves the right to unilaterally withdraw from the contract at any time, with a notice of at least 20 (twenty) days to be communicated to the Company by registered letter with return receipt. In the event of withdrawal, the Company will be
entitled to the consideration limited to the service performed and one tenth of the amount of the supplies not performed pursuant to art. 109 of Legislative Decree no. 50/2016 and subsequent amendments, according to the fees and conditions provided for in the contract.
15. DAMAGES AND LIABILITY
Supplier’s total liability in damages or otherwise shall not exceed the payment, if any, received by manufacturer for the unit of product or service furnished or to be furnished, as the case may be, resulting in the loss or damage claimed. In no event shall the supplier be liable for incidental, consequential, indirect, punitive, special or exemplary loss or damages of any kind, including but not limited to lost business revenue, lost profits, costs of downtime or loss of use resulting from supplier’s products or services, however caused, whether based on contract, tort or any other legal theory. Buyer expressly waives any rights of rescission, cancellation or revocation of acceptance with respect to delivered Products, except what it is stated in the previous point 12. Liability to third parties for bodily injury, including death, resulting from Products is not affected by the liability limitations stated in this Section.
16. WARRANTY:
For the goods covered by the contract, based on articles 1490 and 1495 of the Italian Civil Code, the contractor must provide a suitable guarantee, not less than 12 months and / or 1500 hours of functioning of the tube at nominal conditions.
17. JURISDICTION:
For any disputes between the Parties inherent to the Contract, the Court of Rome will be exclusively competent.
18. PROCESSING OF PERSONAL DATA:
Personal data will be collected and processed in accordance with EU regulation 2016/679 and Legislative Decree no. 196/2003 and subsequent amendments exclusively for the purposes of this proceeding and as indicated in the information available at the following web page: xxxxx://xxx.xxxx.xx/

19. OPTIONS:
Option No. 1: the contracting authority reserves the right to order an additional kit as mentioned in point 9.1 of the technical specifications at the price that will be indicated in this offer. For the purposes of art. 35, paragraph 4 of the Procurement Code, the maximum estimated value of the contract is € 70,000.00 net of VAT and / or other taxes and legal contributions, as well as safety charges due to risks from interference.
Option No. 2 The contracting authority provides - subject to authorization by the relevant INFN - a further offer for the purchase by the economic operator of the K2-2 RF Modulator
registered under no. 19968 inventory of the Frascati National Laboratories. The activation of the option for the aforementioned purchase will result in a discount on the offer for the supply subject to tender equal to the quotation made by the economic operator of the K2-2 RF Modulator to be purchased by the economic operator.
