CHIEDE
di poter usare, a proprio rischio e pericolo, con/senza diritto di esclusiva in data _00-00-00-00 LUGLIO 2024 la pista dell'Autodromo Internazionale del Mugello, restando inteso e convenuto che MUGELLO CIRCUIT S.p.A. (di seguito, anche, “Autodromo”) si riserva il diritto di modificare o interrompere (temporaneamente o definitivamente), anche in corso della prova, l'uso della pista.
Il sottoscritto, in relazione alle richieste di cui sopra, dichiara:
1. Di utilizzare la pista alle condizioni previste dal Regolamento Generale dell’Autodromo, già debitamente accettato, e di adeguarsi in toto alle condizioni in esso contenute per l’uso del Piazzale Paddock e la permanenza all’interno dell’Autodromo, nonché ad ogni misura di sicurezza e nel rispetto delle ulteriori indicazioni che saranno fornite da MUGELLO CIRCUIT S.p.A. e dagli organizzatori dell’evento.
2. Di essere stato informato e di aver preso visione delle misure di sicurezza e dei servizi di pronto soccorso disponibili e di averli trovati idonei.
3. Di trovarsi, e che comunque si troverà, al momento dell’accesso e/o dell’uso della pista nelle condizioni psico-fisiche necessarie alla guida del mezzo, nel rispetto delle disposizioni del Codice della Strada, nonché dei regolamenti e delle prescrizioni delle Federazioni Sportive competenti.
4. Di essere a conoscenza che la circolazione all’interno della pista costituisce un’attività pericolosa per la quale, pertanto, si assume sin d’ora ogni responsabilità in relazione ai rischi che la stessa comporta.
5. Di essere a conoscenza e di accettare il fatto che il personale e/o comunque la Direzione dell’Autodromo possano in qualsiasi momento modificare, limitare e/o interrompere l’uso della pista e/o degli impianti, in ogni caso e a proprio insindacabile giudizio, rinunciando sin d’ora al riguardo ad ogni e qualsivoglia pretesa, anche risarcitoria, nei confronti di MUGELLO CIRCUIT S.p.A.
6. Di manlevare, entro i limiti previsti dalle leggi applicabili sia in nome proprio che per i suoi successori ed aventi causa a qualsiasi titolo, la MUGELLO CIRCUIT S.p.A., da ogni e qualsiasi obbligazione di corrispondere compensi di alcun genere, a titolo di risarcimento danni, indennizzi, rimborsi, ecc., nell'eventualità di un qualsiasi infortunio, qualunque sia la sua durata, il suo esito e le relative conseguenze che potessero occorrere al sottoscritto in occasione della prova, e ciò qualunque possa essere la causa dell'infortunio a chiunque imputabile, ivi compreso al sottoscritto, a MUGELLO CIRCUIT S.p.A., alla sua organizzazione, ai suoi preposti ed ai suoi dipendenti tutti, con espressa esclusione dei casi di dolo o colpa grave di MUGELLO CIRCUIT S.p.A., della sua organizzazione, dei suoi preposti e dipendenti tutti, nonché del personale di cui la stessa si avvarrà per l’esecuzione dei servizi connessi allo svolgimento dell’Evento.
7. Di manlevare, entro i limiti previsti dalle leggi applicabili, sia in nome proprio che per i suoi successori ed aventi causa a qualsiasi titolo, la MUGELLO CIRCUIT S.p.A. dalle pretese che potessero essere avanzate a qualsivoglia titolo da terzi, in conseguenza dell'uso da parte del sottoscritto della pista dell'Autodromo. Il sottoscritto solleva MUGELLO CIRCUIT S.p.A., il suo personale e le persone comunque addette all'Autodromo, da ogni e qualsiasi responsabilità che dovesse sorgere in conseguenza dell’attività che il sottoscritto intende effettuare all’interno dell’Autodromo, con espressa esclusione dei casi di dolo o colpa grave di MUGELLO CIRCUIT S.p.A., della sua organizzazione, dei suoi preposti e dipendenti tutti, nonché del personale di cui la stessa si avvarrà per l’esecuzione dei servizi connessi allo svolgimento dell’Evento.
8. Di avere una congrua copertura assicurativa personale contro qualsiasi infortunio, portante l'attestazione dei massimali, dell'avvenuto pagamento del premio, nonché della rinuncia alla rivalsa di cui all'art. 1916 del Codice Civile.
9. Il sottoscritto si impegna altresì:
▪ ad osservare e far osservare anche alle persone eventualmente trasportate e ad eventuali accompagnatori il Regolamento Generale dell’Autodromo e tutte le disposizioni impartite dal personale e dalla Direzione dell’Autodromo e a consentire, ora per allora, lo svolgimento di tutte le ispezioni ed i controlli che il personale e/o comunque la Direzione dell’Autodromo riterranno necessari e/o opportuni;
▪ a conformare la propria condotta di guida e/o a far conformare la condotta e/o il comportamento di eventuali soggetti trasportati oltre a quanto previsto al precedente punto, anche alle condizioni metereologiche, alla visibilità ed allo stato del manto della pista;
▪ ad utilizzare e far utilizzare a terzi eventualmente trasportati l’abbigliamento protettivo ed il casco omologato secondo quanto previsto dalla vigente normativa e/o dai regolamenti e dalle prescrizioni delle autorità sportive competenti.
10. Tutto ciò premesso, il sottoscritto dichiara inoltre:
▪ di aver preso visione e di accettare incondizionatamente il Regolamento Generale dell’Autodromo, in particolare le norme e cautele, nonché tutte le altre condizioni da osservarsi per l’uso della pista e dei relativi impianti/attrezzature;
▪ che il veicolo utilizzato è perfettamente idoneo all’attività che il sottoscritto intende effettuare, e che per quanto riguarda le emissioni sonore, rispetta quanto stabilito al par. 4.4 del Regolamento Generale dell’Autodromo.
▪ che si impegna, assumendosi qualsiasi responsabilità civile e penale verso terzi od aventi causa, a non concedere l'autorizzazione a circolare con il mezzo utilizzato a qualsiasi altra persona.
Il sottoscritto conferma espressamente tutto quanto sopra precede ad ogni effetto di legge.

INFORMATIVA PRIVACY
In ottemperanza alla vigente normativa in materia di trattamento dei dati personali, come definita dalle disposizioni contenute negli articoli 13 e 14 del Regolamento (UE) 2016/679 (“GDPR”), viene resa la presente informativa descrittiva delle attività di trattamento dei dati personali fatte da Mugello Circuit
S.p.A. (“Mugello Circuit”).
A - Finalità del trattamento dei Dati
I dati personali forniti nell’ambito del presente documento (“Dati”) saranno trattati per (i) fornire il servizio richiesto nonché (ii) per l’adempimento di ogni e qualsivoglia obbligo di legge in relazione ai servizi (di seguito, complessivamente, le “Attività”).
Le tipologie di Dati che Mugello Circuit elabora sono dati personali identificativi e di contatto da Lei forniti direttamente nell’ambito del presente documento.
B - Modalità del trattamento dei Dati
Il trattamento dei Dati verrà effettuato mediante idonei strumenti cartacei ed elettronici, con logiche strettamente correlate alle finalità del trattamento e, comunque, in modo da garantire la protezione, la riservatezza e la sicurezza dei Dati in conformità col GDPR.
C – Base giuridica del trattamento dei Dati
Il trattamento dei Dati avviene conformemente all’articolo 6 (1) (b) del GDPR, in conseguenza dell’esecuzione del contratto di appalto, nonché conformemente all’articolo 6 (1) (c) del GDPR, ossia per adempiere un obbligo legale al quale è soggetta Mugello Circuit.
D - Conseguenze dell'eventuale mancato conferimento dei Dati
Il conferimento dei Dati è in linea di massima facoltativo; tuttavia, il mancato conferimento dei Dati comporterà l’impossibilità di svolgere le Attività.
Il conferimento dei Dati è tuttavia obbligatorio nei casi espressamente previsti dalla legge e/o da disposizioni fiscali e amministrative; in tali ipotesi, il mancato conferimento dei Dati richiesti comporterà l’impossibilità per Mugello Circuit di adempiere ai corrispondenti obblighi, legali, amministrativi e/o fiscali.
E - Altri soggetti che possono trattare i Dati
I Dati potranno essere trattati da soggetti operanti per conto della Società ed in forza di specifici vincoli contrattuali (es. società di vigilanza e sorveglianza ecc.), in Paesi membri UE o extra UE.
I Dati potranno essere comunicati a terzi per adempiere ad obblighi di legge, per rispettare ordini provenienti da pubbliche autorità o per esercitare un diritto della Società in sede giudiziaria. I Dati non verranno altrimenti diffusi.
F - Trasferimento dei Dati al di fuori dello Spazio Economico Europeo
Nell'ambito dei rapporti contrattuali di Mugello Circuit, i Xxxx potranno essere trasferiti al di fuori del territorio dello Spazio Economico Europeo (“SEE”), anche mediante l'inserimento degli stessi in database gestiti da società terze, operanti per conto di Mugello Circuit. La gestione dei database ed il trattamento dei Dati sono vincolati alle finalità per cui gli stessi sono stati raccolti ed avvengono nel massimo rispetto del GDPR. Tutte le volte in cui i Dati dovessero essere oggetto di trasferimento al di fuori dello SEE, Mugello Circuit adotterà ogni misura contrattuale idonea e necessaria a garantire un adeguato livello di protezione dei Dati, inclusi - tra gli altri - gli accordi basati sulle clausole contrattuali standard per il trasferimento dei dati al di fuori dello SEE, approvate dalla Commissione Europea.
G - Titolare del trattamento dei Dati e Data Protection Officer
Titolare del trattamento è Mugello Circuit S.p.A., con sede legale in Xxx Xxxxx, 00, 00000 Xxxxxxxxx x Xxx Xxxxx (XX), Xxxxxx. Lei può contattare il Data Protection Officer del Gruppo Ferrari all’indirizzo e-mail xxxxxxx@xxxxxxx.xxx.
H - Conservazione dei Dati
I Dati relativi:
- a contabilità e fatturazione sono conservati per 11 anni anche in ottemperanza alla normativa fiscale applicabile;
- alla gestione degli accessi in autodromo sono conservati per 5 anni a tutela del patrimonio aziendale in caso di furti o illeciti di ogni tipo;
- al presente scarico di responsabilità sono conservati per 10 anni dall’evento a cui Lei ha preso parte;
- alle immagini in pista sono conservati per 5 giorni, salvo in caso di incidente per cui viene salvato il frammento del video con l’evento per 10 anni. I Dati potranno essere conservati per un periodo superiore, al fine di poter gestire eventuali contestazioni legate allo svolgimento delle Attività.
I – I diritti dell’interessato
A Lei sono riconosciuti i seguenti diritti:
1. diritto di accesso, ossia il diritto di ottenere da Mugello Circuit la conferma che sia o meno in corso il trattamento dei Dati e, in tal caso, di ottenerne l'accesso;
2. diritto di rettifica e cancellazione, ossia il diritto di ottenere la rettifica di Dati inesatti e/o l'integrazione di Dati incompleti o la cancellazione dei Dati per motivi legittimi;
3. diritto alla limitazione del trattamento, ossia il diritto a richiedere la sospensione del trattamento qualora sussistano motivi legittimi;
4. diritto alla portabilità dei dati, ossia il diritto di ricevere in un formato strutturato, di uso comune e leggibile i Dati, nonché il diritto di trasmettere i Dati ad un altro titolare del trattamento;
5. diritto di opposizione, ossia il diritto opporsi al trattamento dei Dati qualora sussistano motivi legittimi;
6. diritto di rivolgersi all'Autorità per la protezione dei dati personali competente in caso di trattamento illecito dei Dati, contattabile al sito web xxx.xxxxxxxxxxxxxx.xx.

Il termine per la risposta all’interessato è di un mese, estendibile fino a due mesi in casi di particolare complessità; l’esercizio dei diritti è, in linea di principio, gratuito; Mugello Circuit si riserva il dritto di chiedere un contributo in caso di richieste manifestamente infondate o eccessive (anche ripetitive), anche alla luce delle indicazioni che dovessero essere fornite dal Garante Privacy italiano.

REQUESTS
to use, at their own risk, with/without exclusive rights on JULY, 12-13-14 2024 the track of the Mugello International Circuit, it being understood and agreed that MUGELLO CIRCUIT SpA (hereinafter, also "Circuit") reserves the right to modify or interrupt (temporarily or permanently), even during the trial, the use of the track.
In relation to the above request the undersigned person declares:
1. To use the track under the conditions provided by the General Regulations of the Circuit, already duly accepted, and to comply in full with the conditions contained therein for the use of the Paddock Area and the stay inside the Circuit, as well as all safety and in compliance with the additional information that will be provided by XXXXXXX CIRCUIT S.p.A.. and the organisers of the event.
2. That he/she has read and been informed of the safety measures and first aid facilities available, and has approved them;
3. that at the time of accessing and/or using the track, he/she is in the mental and physical conditions necessary to drive a vehicle in accordance with applicable provisions of the Highway Code, and with the regulations and guidelines of the competent Competitive Federations;
4. that he/she is aware that driving on the track is a dangerous activity and therefore he/she accepts full responsibility for the risks involved.
5. that he/she is aware and accepts the fact that the personnel and/or in any case Management of the Circuit may, at any time, vary, limit and/or interrupt the use of the track and/or facilities at its discretion and hereby waives any and all claims, including compensation, against MUGELLO CIRCUIT SpA;
6. To indemnify, within the limits provided by the applicable laws, both on its own behalf and on behalf of its successors and assignees for any reason, MUGELLO CIRCUIT SpA from any and all obligations to pay compensation of any kind, as compensation damages, indemnities, refunds, etc., in the event of any injury and/or damage, whatever its duration, its outcome and related consequences that may occur to the undersigned company, its employees, and/or external contractors, and/or third party visitors, and to the users of the Event who use the track with the company's vehicles during the Event, whatever the cause of the injury and/or damage may be for anyone, including MUGELLO CIRCUIT SpA, its organisation, its supervisors and employees, except in the case of wilful misconduct or gross negligence on the part of MUGELLO CIRCUIT SpA, its organisation, its supervisors and employees as well as the personnel it employs to carry out the services connected with the Event.
7. That he/she indemnifies, within the limits established by applicable laws, both in his/her own name and for his/her successors and assignees for any reason, MUGELLO CIRCUIT SpA from the claims that could be advanced for any reason by third parties, as a consequence of the use by the undersigned of the track of the Circuit. The undersigned relieves MUGELLO CIRCUIT SpA, its personnel and the people in charge of the Circuit, from every and any responsibility that may arise as a consequence of the activity that the undersigned intends to carry out inside the Circuit, with express exclusion of cases of malice or gross negligence by MUGELLO CIRCUIT SpA, its organisation, its supervisors and employees, and by the personnel it will use for the performance of the services related to the Event.
8. that he/she has appropriate personal insurance cover against any incidents, attaching a copy confirming the cover limit, payment of the premium, as well as the waiver of recourse pursuant to Article 1916 of the Italian Civil Code.
9. The undersigned person shall also:
▪ observe, and ensure observance by any passengers and accompanying persons, of the Regulations and all instructions given by the personnel and in any case the Management of the Circuit and hereby allows any inspections or checks that such personnel and/or Management may consider necessary or appropriate;
▪ that he/she will adapt his/her driving, and/or will ensure that the behaviour of any passengers or accompanying persons conforms to the provisions of the above paragraph, to the weather conditions, visibility and track surface;
▪ that he/she will use and arrange for use by any passenger, the protective clothing and helmet approved in accordance with the applicable laws and regulations of the competent authorities.
10. In consideration of the foregoing, the undersigned person also declares:
▪ that he/she has read and unconditionally accepts the General Regulations of the Circuit, including the rules and precautions, and all other conditions to observe to use the track and relative facilities/equipment;
▪ that the vehicle used is fully suited for the activity the undersigned person intends taking part in, and as regards sound emissions, it meets the requirements in section 4.4 of the General Regulations of the Circuit.
▪ that he/she will not allow the vehicle to be driven by any other person, accepting all civil and criminal liability towards third parties or assigns.
The undersigned person expressly confirms all of the above, for all legal purposes.

PRIVACY POLICY
In compliance with current legislation on the processing of personal data, as defined by the provisions contained in Articles 13 and 14 of Regulation (EU) 2016/679 (“European privacy legislation [GDPR]”), this Privacy Statement describes the processing activities of personal data carried out by Mugello Circuit SpA ("Mugello Circuit").
A - Purpose of Data Processing
Personal data provided hereunder ("Data") will be processed to provide (i) providing the requested service as well as (ii) fulfilling any and all legal obligations in connection with the services (hereinafter, collectively, the "Activities").
The types of Data that Mugello Circuit processes are personal identification and contact data provided directly by you as part of this document.
B - Method of Data Processing
Your personal data will be processed using the appropriate printed and electronic, strictly in relation to the purposes and in a way that guarantees the protection, confidentiality and security of the data in accordance with the GDPR..
C - Legal basis for Data processing
Data processing takes place in accordance with Article 6 (1) (b) of the GDPR, in the performance of the contract, as well as in accordance with Article 6 (1) (c) of the GDPR, i.e. to fulfil a legal obligation to which Mugello Circuit is subject.
D - Consequences of refusal to provide Data
The provision of Data is in principle optional; however, if the Data is not provided, it will be impossible to carry out the Activities.
You are, in any event, required to provide Data in those cases expressly provided for by law and/or by tax and administrative provisions; in such cases, refusal to consent to the processing and disclosure of the Data as requested, will mean that Mugello Circuit is unable to fulfil the corresponding legal, administrative and/or fiscal obligations.
E - Other persons who may process the Data
The Data may be processed by persons working on the Company’s behalf and on the strength of specific contractual obligations in EU or non-EU countries.
The Data may be disclosed to third parties in order to fulfil legal obligations, to comply with orders of the authorities or to exercise a right of the Company in legal proceedings. The Data will not otherwise be disclosed.
F - Transfer of Data outside the European Economic Area
In the context of contractual relations of the Mugello Circuit, the Data may be transferred outside of the European Economic Area, and may also be included in databases operated by third-party companies working on Mugello Circuit's behalf. Management of databases and processing of Data is restricted to the purposes for which the data was collected and will take place in strict compliance with European privacy legislation.
Whenever the Data is to be transferred outside of the EEA, the company will take all the contractual measures that are necessary and appropriate to guarantee a suitable level of data protection including - among others - any agreements based on the standard contractual terms for transferring data outside the EEA, approved by the European Commission.

H - Data Retention
Data relating to:
- accounting and billing records are also kept for 11 years in compliance with applicable tax laws;
- the management of entries to the Circuit are kept for five years to protect the company's assets in case of theft or illicit acts of any kind;
- this disclaimer is kept for 10 years from the event in which you participated;
- the track images are kept for five days, except in case of an accident for which the fragment of the video with the event is saved for 10 years.
Data may be kept for a longer period, to manage any disputes relating to the Activities.
I - The rights of the Data Subject
You have the following rights:
1. the right of access, in other words, the right to obtain from Mugello Circuit, confirmation of whether the Data are being processed and if they are, to access them;
2. the right of rectification and erasure, the right to obtain rectification of inaccurate data and/or the integration of incomplete Data or the erasure of data for legitimate reasons;
3. the right to limit the data processing, in other words, the right to request suspension of processing if there are legitimate reasons;
4. the right to data portability, in other words, the right to receive the Data in a structured, commonly used and machine- readable format and send it to another data controller;
5. the right of objection, the right to object to the processing of Data if there are legitimate reasons;
The deadline for replying to the Data Subject is one month, which can be extended up to two months in particularly complex cases. The exercise of these rights is, in principle, free of charge; Mugello Circuit reserves the right to ask for a contribution in the event of manifestly unfounded or excessive (also repetitive) requests, also in light of the indications that the Italian Privacy Guarantor may provide.
