OGGETTO: Approvazione dello schema di ``Agreement for Internship``, tra AgroSup Dijion - Institut National Supe`rieur des Sciences Agronomiques, de l`Alimentation et de l`Environnement - e l`Istituto Zooprofilattico Sperimentale delle Venezie, per lo svolgimento di tirocini curriculari.
Si sottopone al Direttore generale la seguente relazione del Responsabile della S.S. Affari Generali, Anticorruzione e Trasparenza.
Si premette che:
- in ottemperanza all’art. 9, comma 3, del D. Lgs. n. 106/2012 e all’art. 6 dell’Accordo per la gestione dell’Istituto Zooprofilattico Sperimentale delle Venezie, approvato dalla Regione del Veneto, dalla Regione Autonoma Friuli Venezia Giulia e dalle Province Autonome di Trento e Bolzano, rispettivamente, con Leggi n. 5/2015, n. 9/2015, n. 5/2015 e n. 5/2015, l’IZSVe può, mediante convenzioni, svolgere attività di supporto tecnico-scientifico e di stage nei corsi di laurea in medicina veterinaria, nelle scuole di specializzazione e nei dottorati di ricerca;
- per quanto attiene al settore della formazione, l’art. 1 del X.X. x. 142/1998 attuativo dell’art. 18, comma 1, xxxxx Xxxxx n. 196 del 24.6.1997 recante “Norme in materia di promozione dell’occupazione”, consente ad enti pubblici e privati, tra cui le Università, di promuovere tirocini di formazione ed orientamento in imprese a beneficio di coloro che abbiano già assolto l’obbligo scolastico per agevolarne le scelte professionali mediante la conoscenza diretta del mondo del lavoro, realizzando, in questo modo, utili momenti di alternanza studio-lavoro;
- lo stesso X.X., all’art. 4, comma 2, dispone che “... I tirocini sono svolti sulla base di apposite convenzioni stipulate tra i soggetti promotori e i datori di lavoro pubblici e

privati...” e, all’art. 8, che “Le presenti disposizioni sono estese ai cittadini comunitari che effettuino esperienze professionali in Italia...”.
Con ticket intranet n. 160799/2021, xx xxxx.ssa Xxxx Xxxxx, Direttore della “SCS1 – Microbiologia generale e sperimentale”, ha richiesto alla scrivente Struttura l’attivazione di una convenzione per lo svolgimento di tirocini curriculari da stipulare tra l’IZSVe e Agrosup Dijion
- Institut national superieur des sciences agronomiques de l’alimentation et de l’enrvironnement, con sede in Francia.
Al fine di disciplinare i criteri e le modalità di svolgimento del suddetto tirocinio, è stato concordato tra le parti lo schema di “Agreement for internship”, documento che si allega al presente provvedimento xxxxx parte integrante e sostanziale (allegato n. 1).
In base al suddetto accordo, l’IZSVe, in qualità di soggetto ospitante, si impegna ad accogliere, per il periodo dal 26.04.2021 al 27.08.2021, presso le proprie strutture, la studentessa Xxxxxxx Xxxxxx in tirocinio curriculare, sotto la supervisione xxxxx xxxx.ssa Xxxx Xxxxx, Direttore della “SCS1 - Microbiologia generale e sperimentale”. Gli obiettivi e le modalità del tirocinio sono indicati nel Pedagogical annex, allegato al citato accordo.
Ai sensi dell’art. 7 “Liability and Insurance” dell’Agreement in parola, gli oneri relativi alla copertura assicurativa per la responsabilità civile e contro gli infortuni, verranno sostenuti dalla tirocinante e da Agrosup Dijion. La tirocinante xxxx inoltre tenuta al rispetto del “Regolamento aziendale per la frequenza delle strutture dell’Istituto Zooprofilattico Sperimentale delle Venezie da parte di personale tirocinante e volontario”, approvato con DDG
n. 203/2015, e delle circolari interne emanate in materia.
La stipula della Convenzione in parola non comporta oneri economici per l’Istituto.
Tutto ciò premesso, sulla base degli elementi riportati dal referente dell’istruttoria, si propone al Direttore generale quanto segue:
1. di approvare lo schema di “Agreement for internship” tra Xxxxxxx Xxxxxx – Institut national superieur des sciences agronomiques de l’alimentation et de l’enrvironnement, rappresentato dal Head of Education and Student Life, Xxxx. Xxxxxxxxx Xxxx, e l’Istituto Zooprofilattico Sperimentale delle Venezie, rappresentato dal Direttore Generale e legale rappresentante pro tempore, Dott.ssa Xxxxxxx Xxxxx, documento che, unitamente al Pedagocical annex, si allega al presente provvedimento xxxxx parte integrante e sostanziale (allegato n.1);
2. di procedere, per l’effetto, alla stipula della suddetta convenzione, ai sensi degli artt. 15 e 16 dell’Accordo per la gestione dell’Istituto Zooprofilattico Sperimentale delle Venezie;
3. di dare atto che l’IZSVe, in attuazione dell’Agreement ed in qualità di soggetto ospitante, si impegna ad accogliere, per il periodo dal 26.04.2021 al 27.08.2021, presso le proprie strutture, la studentessa Xxxxxxx Xxxxxx in tirocinio curriculare, sotto la supervisione xxxxx xxxx.ssa Xxxx Xxxxx, Direttore della “SCS1 - Microbiologia generale e sperimentale”;
4. di prendere atto che gli oneri relativi alla copertura assicurativa per la responsabilità civile e contro gli infortuni verranno sostenuti dalla tirocinante e da Agrosup Dijion;

5. di prendere atto, altresì, che la tirocinante xxxx xxxxxx al rispetto del “Regolamento aziendale per la frequenza delle strutture dell’Istituto Zooprofilattico Sperimentale delle Venezie da parte di personale tirocinante e volontario”, approvato con DDG n. 203/2015, e delle circolari interne emanate in materia;
6. di prendere atto, infine, che la suddetta Convenzione non comporta oneri economici per l’Istituto.

VISTA la delibera del Direttore generale n. 372 del 14 ottobre 2020 con xx xxxxx xx xxxx.ssa Xxxxx Xxxxxxx è stata nominata Direttore sanitario dell’Istituto.
VISTA la delibera del Direttore generale n. 101 del 10 marzo 2021 con xx xxxxx il xxxx.
Xxxxxxx Xxxxxx è stato nominato Direttore amministrativo dell’Istituto.
ACQUISITO il parere favorevole del Direttore amministrativo e del Direttore sanitario per quanto di competenza, espresso ai sensi dell’art. 15, comma 3, dello Statuto dell’Istituto, adottato con delibera del CdA n. 16 del 3 agosto 2015 e approvato con delibera xxxxx Xxxxxx regionale del Veneto n. 1320 del 9 ottobre 2015.
VISTO l’Accordo per la gestione dell’Istituto Zooprofilattico Sperimentale delle Venezie tra la Regione del Veneto, la Regione Autonoma Friuli Venezia Giulia e le Province Autonome di Trento e Bolzano, approvato dai suddetti Enti, rispettivamente, con leggi n. 5/2015, n. 9/2015, n. 5/2015 e n. 5/2015.

The date which marks the end of the internship cannot be later than the 30 September of the year in progress, except by special dispensation.
Article 1. Purpose of the agreement
This agreement governs the host organization’s relationship with the educational institution and the intern
Article 2. Objective of internship
Internships provide students with the opportunity of enriching their academic preparation through complementary experiential education, in a view of earning a diploma or a certificate, and facilitating his professional integration. The intern will be given one or more tasks, in conformance with the educational plan established by AgroSup Dijon and approved by the host organization.
In no way whatsoever can the relationship between the Intern and the host organization be considered as professional employment. AgroSup Dijon and the host organization will establish the schedule based on the general training program being offered, the activities assigned and the skills to be acquired or developed: these elements are co-signed in the pedagogical annex (annex 1) which is an integral part of the agreement.
No internship agreement can be offered to replace an employee who is on leave, who has a suspended work contract or who has been laid off or dismissed. The internship must not be a work task done on a regular basis and which is expected of permanent staff members or fixed term staff members; it must not be used to fill a need for an increase in staff due to a temporary increase in the host organization’s activity or offered to fill in any seasonal jobs (article L 124-7 – Education code).
Article 3. Terms of internship
The weekly duration of the intern’s presence at the host organization will be 35 hours, on a full time, from Monday to Friday, access times: 8h – 18h.
If the intern’s presence at the host organization is to be required at night, or on Sunday or during a public holiday, specify the specific cases: Not required.
Article 4. Intern hosting and supervision
The intern will be supervised by the academic advisor, as designated in this agreement, as well as by the institution’s internship program office.
The internship supervisor appointed by the host organization in this agreement shall be responsible for supervising the intern and ensuring optimal conditions for the execution of the internship in accordance with specified educational requirements.
The intern is expected to complete his assignment and to let his supervisors know how his work is progressing and if he is confronted with any difficulties. The supervisors are to work closely together and inform each other of the progression of the internship and of any problems which have occurred; according to the modalities defined in pedagogical appendix (annex 1).
The intern shall:
- Carry out activities specified on the internship description, according to the pedagogical appendix (annex 1), respect working hours and environment, the host organization rules and regulation;
- Follow the supervisor’s instruction and refer to him/her should any problem arise;
- Respect in regard to workplace hygiene, security and health;
- Maintain secrecy on all matter coming to his/her knowledge in the exercise of his/her duties, such as data and/or information or knowledge regarding production process and products.
The intern shall be permitted to return to AgroSup Dijon during the internship period in order to take the courses specifically required by the program, or to attend meetings; the institution shall notify the host organization of the corresponding dates. The host organization may permit the intern to travel.
Any difficulties encountered in the execution and progress of the internship, whether observed by the intern or the internship supervisor must be brought to the attention of the academic advisor and the educational institution so that the issue can be resolved as quickly as possible.
Article 5. Stipend – Benefits
No stipend is foreseen for the execution of the internship.
Article 6. Social Welfare Coverage Framework
For the duration of his internship, the intern shall remain covered under his previous former social welfare protection framework. Internships conducted abroad shall be reported to the Social Security administration when required, prior to the intern’s departure. For internships conducted abroad, the following provisions shall apply, subject to their conformance with the legislation in effect in the host country and the laws governing the host organization.
Article 6.1 Health Insurance for intern working abroad
6.1.1 Coverage for French Students:
When applicable: the intern must ask for the form which entitles him to keep his rights to student medical coverage when abroad. For internship within the European Community (EEE) which are done by students who are citizens of a state belonging to the European Union, one must ask for the European Health Insurance Card (EHIC).
In all other cases:
Students who have had expenses concerning health costs abroad can be refunded by their mutual insurance company. This may be upon their return and on presentation of documentary evidence (receipts etc.): the refund will be based on rates of French health care and there may be a considerable difference in the rates.
* It is therefore strongly recommended for the student to take out a specific private health insurance, which is valid for the country and
valid for the duration of the internship with the organization of his/her choice (private insurance company, parent’s insurance company, etc.).
* Exception: if the organization provides medical coverage for the student according to measures set up by local law (6.2 see below), the student can then choose to benefit from this local medical coverage. Before making such a choice however, he should check to see what guaranties are provided for.
6.1.2 Health insurance provided by the host organization:
By checking or ticking the appropriate answer, the host organization indicates whether it provides health insurance coverage to the intern, according under local law :
YES (this is in addition to the rights provided by the French system which are maintained.)
NON (health coverage is solely provided by the rights which are maintained abroad and provided by the French system)
If neither box is checked off then 6.2.1. is applied.
6.2 Accident Coverage on the work site for the intern abroad
6.2.1. To be able to benefit from the French laws concerning coverage of accidents on the work site, the internship must :
• Be over a 12 month period at the most, extended periods included.
• Not have a remuneration which could give rights to coverage for accidents on the work site in the host country (an allowance or compensation is allowed up to 15% of the hours limited by the social security (see point 5) and subject to approval by the Primary Health insurance Agency).
• Take place exclusively in the organization signing this agreement.
• Take place exclusively in the host country which is cited in this agreement.
6.2.2. The notification of the work accident lies with AgroSup Dijon who must be informed by the host organization within 24 hours.
6.2.3. Coverage concerns the accidents occurring :
• Within the internship location and during internship working hours.
• On the normal commute to and from the intern’s residence in the foreign nation and the internship location.
• As part of an assignment provided by the intern’s host organization upon formal assignment mandate.
• During the first return trip from his domicile to his place of residence during the internship (travail on the internship start date).
• During the final return trip from his residence during the internship to his personal domicile.
6.2.4 In all cases,
• If the student is the victim of a work accident during the internship, the host organization must absolutely report this accident to AgroSup Dijon immediately.
Article 7. Liability and Insurance
7.1. Civil liability and Insurance
The host organization and the intern declare that they possess civil liability coverage.
The intern has taken out an insurance policy with the following organization: Matmut (contract n° 980 0021 25666 H 8F valid from 01/01/2021 to 01/01/2022).
For internships abroad or in overseas territories, the intern agrees to take out a travail assistance insurance contract (repatriation for health reasons, legal assistance, etc.) and an individual accident insurance policy. There is also an accident insurance policy provided by Xxxxxxx Xxxxxx.
7.2. Risks
The intern testifies upon his arrival at the internship that the different licenses or attestations are valid. He will inform the internship supervisor of any restriction concerning medical aptitude involving the internship. Upon his arrival, the internship supervisor will inform the intern of the risks linked to the activities, the use of vehicles, equipment, or premises used at the internship site based on an evaluation of the risks involved. The internship supervisor informs the intern about the use of individual protective regulation equipment which is useful and provides this equipment when needed. The internship supervisor also makes general protective equipment on the site of the host organization available to the intern.
Illnesses and accidents (accidents on the internship site and accidents due to transportation to the internship site) directly related to the activities of the internship: the student is covered by the insurance policy which is mandatory concerning professionally related illnesses and accidents as stated by the article L751 of the new Rural Code.
When the host organization makes a vehicle available to the intern, it is its responsibility to check beforehand that the car’s insurance policy includes coverage for its use by a student.
When the student is to use his own vehicle or a vehicle loaned by a third party for purpose of his internship, he shall expressly inform the insurer of the vehicle and, where applicable, pay the corresponding premium.
Note: illnesses or accidents having no direct link with the activities of the internship are covered by the Social Security system to which the intern adheres and possibly by a complementary insurance for any damages caused by the intern to the host organization.
Article 8. Discipline
The intern shall be subject to the applicable internal disciplinary and regulatory terms, of which he shall made aware prior to the start of the internship, particularly in regard to schedules and to health and safety regulations in effect at the host organization.
Disciplinary sanctions may only be imposed by decision of the educational institution. In such case, the host organization shall inform the academic advisor and the institution of the non-compliance and shall provide any supporting evidence.
In case of a particularly serious breach of discipline, the host organization reserves the right to terminate the internship, while respecting the provisions set forth in article 9 of this agreement.
Article 9. Duty of discretion and confidentiality
The duty of confidentiality must at all times be observed, with its specific aspects taken into account by the host organization. The intern and AgroSup Dijon commit to refrain from using the information collected or obtained by the intern, under any circumstances, for purposes of publication or disclosure to third parties without prior consent of the host organization, including in the internship report. This commitment applies not only to the internship period but shall extend after its conclusion as well. The intern commits to not retain, remove, or copy any documents or software of any kind belonging to the host organization, except upon approval from the latter. If the internship includes an oral or academic defense, the written document will be distributed only to the members of the jury and the oral exam will take into account this confidentiality.
This pledge is valid not only for the duration of the internship but after it has ended. Within the framework of confidential information which may be included in the report, the host organization may ask that the distribution of the report be restricted and even that specific, very confidential data be withdrawn.
Persons with a need to know shall be constrained by commitments to professional secrecy to refrain from any use or disclosure of the information in the report.
Article 10. Intellectual property
In accordance with the code of intellectual property, if the intern’s activities result in the creation of a work protected by copyright or industrial property (including software), and the host organization wishes to make use of such work with the intern’s approval, a contract must signed between the intern (the author) and the host organization.
The contract must specifically include the extent of the rights to be transferred, any possible exclusively requirements, the extended use, the media used and the duration of the transfer of rights, as well as, if applicable, the amount of compensation due to the intern for the transfer. This clause shall apply regardless if the host organization’s business structure.
Article 11. End of internship – Report - Evaluation
11.1. Internship certificate
At the end of the internship, the host organization shall issue a certificate, a template for which is included as an appendix hereto, indicating as a minimum the effective duration of the internship, and, if applicable, the amount of the stipend paid. The intern will need to produce this certificate as supporting documentation in applying for benefits under the general retirement insurance framework, as provided under article L. 351-17 of the social security code.
11.2. Internship quality
Once the internship has ended, the parties to this agreement are invited to submit an assessment of the quality of the internship. This document will not be taken into consideration in his evaluation, or in awarding his diploma or certificate.
11.3. Evaluation on the intern’s activity
Once the internship has ended, the host organization shall fill out an assessment form on the intern’s activity, which it will return to AgroSup Dijon.
11.4. Educational assessment procedures
The nature of the work to be provided (report, oral, …) is defined in pedagogical annex (annex 1).
11.5. Neither the academic supervisor from the host organization, nor any member of the host organization invited to visit AgroSup Dijon for purposes of the preparation, conduct and validation of the internship, may assert claim for reimbursement or compensation from AgroSup Dijon.
This agreement must be signed by all three parties at the latest on the first day of the internship, each signatory must keep a copy of this agreement. The date on which this agreement goes into effect is the date on which all parties have signed.

Subject of the internship: Writing of the international "One health" report

Modalities of supervision :
The pedagogical supervisor has to set up a procedure of follow-up of student (e-mail, telephone, …). He guides the student throught his (her) work placement / internship:
• to build the study project,
• to verify that the offered ways correspond to the necessary means to lead the study to its term
• to guide the acquisition of knowledge to bring to a successful conclusion the work (theoretical framework, method, …)
• to assure the rigor of the work, from the definition, to the method and the analysis, up to the writing (expression, argumentation) of the internship report

· the pedagogical tutor must evaluate the internship report and the oral with a second professor The final grade takes into account:
- the grade attributed to the internship report, by the pedagogical tutor (10 points)
- the grade attributed to the oral presentation by the jury (5 points)
- the grade attributed by the internship supervisor ( 5 points)

Internships abroad : Given the exceptional circumstances due to the Covid epidemia, it is understood between the signatories that they will have verified beforehand that :
- If the internship takes place face-to-face, a specific repatriation insurance is taken out by the intern for the return, in the event of confinement or other circumstances making impossible the internship pursuit.
