障害者権利条約の締結

障害者権利条約とは

国連総会で、「障害者権利条約」（正式名称：「障害者の権利に関する条約」）が採択されたのは、 2006 年12 月のことです。この条約は、障害者の人権や基本的自由の享有を確保し、障害者の固有の尊厳の尊重を促進することを目的として、障害者の権利を実現するための措置等について規定し

ており、障害者に関する初めての国際条約です。その内容は、条約の原則（無差別、平等、社会への包容等）、政治的権利、教育・健康・労働・雇用に関する権利、社会的な保障、文化的な生活・スポーツへの参加、国際協力、締約国による報告等、幅広いものとなっています。

条約作成に至る国際的な経緯

障害者権利条約が採択されるまでに国連では様々な取組が行われました。1975 年には「障害者の権利宣言」が採択され、翌1976 年には1981年を「国際障害者年」とすることが決議されました。1982 年には「障害者に関する世界行動計画」と「国連障害者の十年」（1983 年～1992 年）決議が採択されました。1993 年には「障害者の機

会均等化に関する標準規則」が採択され、障害者の社会的障壁を取り除くべきとの理念が示されました。2001 年12 月の国連総会では、「障害者の権利及び尊厳を保護・促進するための包括的・総合的な国際条約」決議が採択され、国際条約を起草するための「アドホック委員会」を設置することが決まりました。

“ 私たちのことを、私たち抜きに決めないで”

条約の起草交渉は、政府間で行われることが通例ですが、このアドホック委員会では、障害者団体は傍聴できるだけでなく、発言する機会も設けられました。それは、障害者の間で使われているスローガン「“Nothing About Us Without Us”

（私たちのことを、私たち抜きに決めないで）」に表れている、障害者が自身に関わる問題に主体的に関与するとの考え方を反映し、名実ともに障害者のための条約を作成しようという、国際社会の総意の表れでした。日本の政府代表団は、障害当事者を顧問に迎え、起草交渉に積極的に関与したほか、日本から延べ200 人にのぼる障害者団体の関係者が国連本部（ニューヨーク）に足を運び、実際にアドホック委員会を傍聴しました。2002 年か

ら8 回にわたるアドホック委員会を経て、2006年12 月13 日、障害者権利条約が国連総会で採択されました。2008年5月3 日、障害者権利条約は、効力発生の要件が整い発効しました。

6 障害者権利条約

“締結の前に、国内法の整備を”

日本は、障害者権利条約が採択された翌年の 2007年9月28 日に条約に署名しました。一方、条約の締結（批准）については、国内の障害当事者等から、条約の締結に先立ち国内法の整備を始めとする障害者に関する制度改革を進めるべきとの意見が寄せられました。政府は、これらの意見も踏まえ、2009 年12 月に内閣総理大臣を本部長、全閣僚をメンバーとする「障がい者制度改革推進本部」を設置し、集中的に障害者に関する制度改革を進めていくこととしました。これを受けて、障害者基本法の改正（2011 年8 月）、障害者総合支援法の成立（2012 年6 月）、障害者差別解消法の成立と障害者雇用促進法の改正（2013 年6 月）

等、様々な制度改革が行われました。このように、条約の締結に先立って国内の障害者制度を充実させたことについては、国内外から評価する声が聞かれています。

日本の障害者権利条約の締結

2013 年6 月の障害者差別解消法の成立をもって、一通りの障害者制度の充実がなされたことから、同年10 月、国会において日本の障害者権利条約の締結について議論が始まりました。そして、同年11 月19 日には衆議院本会議において、12月4 日には参議院本会議において、日本の障害者権利条約の締結が全会一致で承認されました。これを受けて、2014 年1月20 日、日本は条約の批准書を国連に寄託し、日本は141 番目の締約国・機関となりました。

条約締結後の取組

日本が障害者権利条約を締結したことにより、障害者の権利の実現に向けた取組が一層強化されることが期待されます。内閣府に設置されている「障害者政策委員会」は、国内の障害者施策が障害者権利条約の趣旨に沿っているかとの観点からモニタリングを行うことになりました。また、日本は、条約に基づく義務の履行等についての報

告を、条約に基づき設置されている「障害者の権利に関する委員会」に提出し、同委員会は、その報告の内容について審査を行うことになりました。さらに、障害者に関する国際協力も一層推進されることが期待されており、日本は国連の場や ODA 等を通じて、世界の障害者の権利向上に貢献していきます。

条約の主な内容

障害者権利条約における障害のとらえ方

従来の障害のとらえ方は、障害は病気や外傷等から生じる個人の問題であり、医療を必要とするものであるという、いわゆる「医学モデル」の考え方を反映したものでした。一方、障害者権利条約では、障害は主に社会によって作られた障害者の社会への統合の問題であるという、いわゆる「社会モデル」の考え方が随所に反映されています。これは、例えば、足に障害をもつ人が建物を利用しづらい場合、足に障害があることが原因ではな

条約の第2 条（定義）では、障害者の人権と基本的自由を確保するための「必要かつ適当な変更及び調整」であって、「均衡を失した又は過度の負担を課さないもの」を「合理的配慮」と定義しています。これは、例えば車椅子用に段差に渡し板を敷いたり、窓口で筆談や読み上げ等により理解を助けること等が当たります。そして、障害に基づく差別には「合理的配慮の否定」が含まれます。また、

国連の議論においては、主に1980 年代の様々な取組を通じて障害に対する知識と理解が深まり、障害者の医療や支援に対するニーズ（リハビリテーション等）と障害者が直面する社会的障壁の双方に取り組む必要性が認識されるようになり、この条約もそうした認識に基づき作成されました。

第4 条（一般的義務）では、締約国に障害者に対する差別となる既存の法律等を修正・撤廃するための適切な措置をとることを求めているほか、第5 条

（平等及び無差別）では、障害に基づくあらゆる差別を禁止することや、合理的配慮の提供が確保されるための適当な措置をとることを求めています。この「合理的配慮の否定」を障害に基づく差別に含めたことは、条約の特徴の一つとされています。

意思決定過程における障害当事者の関与

条約の第4 条（一般的義務）では、締約国は障害者に関する問題についての意思決定過程において、障害者と緊密に協議し、障害者を積極的に関与させるよう定めています。また、第35 条（締約国による報告）では、条約に基づき設置されている「障害者の権利に関する委員会」に対する報告を

作成するに当たり、先の第4 条の規定に十分な考慮を払うこととされています。

これらの規定には、いわゆる“Nothing About Us Without Us”（私たちのことを、私たち抜きに決めないで）の考え方を背景として、障害当事者の声を重視するというこの条約の特徴が表れています。

8 障害者権利条約

施設・サービス等の利用の容易さ

条約の第9 条（施設及びサービス等の利用の容易さ）では、締約国は、障害者が輸送機関、情報通信等の施設・サービスを利用する機会を有することを確保するため、適当な措置をとることを定めています。この措置には、施設・サービス等の利用の容易さに対する妨げ・障壁を特定し、撤廃することが含まれます。

自立した生活・地域社会への包容

条約の第19 条（自立した生活及び地域社会への包容）では、締約国は、全ての障害者が他の者と平等の選択の機会をもって地域社会で生活する平等の権利を有することを認め、障害者が、この権利を完全に享受し、地域社会に完全に包容され、参加することを容易にするための効果的かつ適当な措置をとることを定めています。

教育

条約の第24 条（教育）では、締約国は教育についての障害者の権利を認めることを定めています。障害者が精神的・身体的な能力等を可能な最大限度まで発達させ、自由な社会に効果的に参加することを可能とすること等を目的として、締約国は障害者を包容するあらゆる段階の教育制度や生涯学習を確保することとされています。

また、その権利の実現に当たり、障害に基づいて一般的な教育制度から排除されないこと、個々の

条約に関する日本の取組

障害者とは

日本では、2011 年の改正前の障害者基本法では、障害者は「身体障害、知的障害又は精神障害（以下「障害」と総称する。）があるため、継続的に日常生活又は社会生活に相当な制限を受ける者」と規定されていました。

障害者権利条約における関連規定を踏まえ、 20 1年に障害者基本法が改正され、いわゆる「社会モデル」の考え方を反映し、障害者は「身体障害、知

条約の第2 条（「障害に基づく差別」の定義）や第 5 条（平等及び無差別）の規定に関して、日本では、

2011 年の障害者基本法の改正時に、同法の「基本原則」に「差別の禁止」が規定され、障害者が社会的障壁の除去を必要とし、そのための負担が過重でない場合は、その障壁を除去するための措置が実施されなければならないことが定められました。

この規定を具体化する法律が障害者差別解消法です。この法律は、全ての国民が障害の有無によって分け隔てられることなく、相互に人格と個性を尊重し合いながら共生する社会の実現に向けて、障害を理由とする差別を解消することを目的としています。この法律では、障害を理由とする差別を「不当な差別的取扱い」と「合理的配慮の不提供」

的障害、精神障害（発達障害を含む。）その他の心身の機能の障害（以下「障害」と総称する。）がある者であつて、障害及び社会的障壁により継続的に日常生活又は社会生活に相当な制限を受ける状態にあるもの」と規定されました。同様に、社会的障壁についても「障害がある者にとつて日常生活又は社会生活を営む上で障壁となるような社会における事物、制度、慣行、観念その他一切のもの」と規定されました。

とは、障害があるというだけで、商品やサービスの提供を拒否するような行為をいい、国の行政機関や地方公共団体、事業者の区別なく禁止されています。また、障害者等から何らかの配慮を求める意思の表明があった場合に、その実施が負担になりすぎない範囲で「合理的な配慮」を行うことも求められており、この合理的な配慮を欠くことで障害者の権利利益が侵害される場合は、これも差別に当たるとされています。具体的に何が不当な差別に当たり、どのようなことが合理的な配慮として求められるのかは、個々の状況で判断されるため、この法律では、対

応要領や対応指針で具体例を示すこ

意思決定過程における障害当事者の関与

日本では、2011 年の障害者基本法の改正で障害者、障害者の自立・社会参加に関する事業の従事者及び学識経験者から構成される「障害者政策委員会」が設置されました。同委員会は障害者基本計画の策定に当たり「調査審議し」、また、同計画の実施状況を監視し、必要に応じて「内閣総理大臣又は関係各大臣に対し意見を述べる」こと等が定められています。

10 障害者権利条約

条約の第9 条（施設及びサービスの利用の容易さ）に関して、日本では「どこでも、誰でも、自由に、使いやすく」というユニバーサルデザインの考え方に基づいて高齢者、障害者等の移動等の円滑化の促進に関する法律（バリアフリー法）が制定されています。この法律には、建築物や旅客施設、車両等を新設等する際に、バリアフリー基準に適合させること等が定められています。このようなハード面の取組に加え、バリアフリー化の促進に関する国民の理解を深め協力を求める「心のバリアフリー」についても定めら

れています。

このほかユニバーサル社会の実現に向け、ICT（情報通信技術）による歩行者の移動支援や、障害者を含む誰もが安心して旅行を楽しむこ

条約の第19 条（自立した生活及び地域社会への包容）に関して、障害者基本法では、障害の有無にかかわらず共生する社会の実現を図るに当たって旨とするべき事項として「全て障害者は、社会を構成する一員として社会、経済、文化その他あらゆる

また、同法では、国及び地方公共団体は、障害者が「医療、介護、保健、生活支援その他自立のための適切な支援を受けられるよう必要な施策」を講じることが義務付けられています。これに関連して、障害者総合支援法に基づき、地域において暮らすことができるよう、障害福祉サービス等の充実が図られています。

障害者権利条約 11

条約に関する日本の取組

教育

条約の第24 条（教育）に関して、障害者を包容する教育制度（いわゆるインクルーシブ教育システム）とは、障害のある児童がその潜在能力を最大限に発達させ、自由な社会に効果的に参加できるようにするという教育理念のもと、障害のある児童と障害のない児童とが可能な限り一緒に教育を受けられるよう配慮することと考えられています。日本では、同条の内容を踏まえ、2011 年に障 害者基本法が改正され、「可能な限り障害者である

雇用

日本では、条約の第27 条（労働及び雇用）の趣旨を踏まえ、2013 年6 月に障害者雇用促進法が一部改正され、雇用分野における障害者差別の禁止や、精神障害者を障害者の法定雇用率の算定基礎に加えること等が盛り込まれました。

国や地方公共団体では、知的障害者を非常勤職員として雇用し、一定の業務経験の後に企業への就職を目指す「チャレンジ雇用」が進められています。障害者の雇用に伴う事業主の負担を軽減するた め、障害者雇用納付金制度が設けられ、法定雇用率を未達成の企業からは納付金を徴収し、法定雇用率を超えて障害者を雇用している企業には障害者雇用調整金が支給される等様々な助成が行われ

ています。

2013 年4 月からは、障害者優先調達推進法の

児童及び生徒が障害者でない児童及び生徒と共に教育を受けられるよう配慮」すること等が新たに規定されました。

2013年に、学校教育法施行令が改正され、従来、一定の程度以上の障害のある児童生徒は特別支援学校への就学が原則とされ、小中学校への就学は例外だったものが、障害の状態等を踏まえ、総合的な観点から就学先を決めるようになりました。

さらに、一人ひとりのニーズに応じたきめ細かな指導を行うため、通級指導の教員の増員や、特別支援教育支援員の経費に対する地方財政措置が行われています。また、障害のある児童等に対する個別の教育支援計画や個別の指導計画の作成が進められているほか、弱視の児童等のための拡大教科書等の普及促進、教育・医療・福祉・保健・労働といった関係機関の連携等による、発達障害を含む障害のある児童に対する支援に必要な様々な施策が進められています。

制定を受け、国や地方公共団体、独立行政法人等の公的機関による障害者就労施設等からの優先的な購入も行われています。このほか、全国障害者技能競技大会「アビリンピック」の開催を通じて、広く社会の障害者に対する理解と認識が深められ、雇用の促進が図られています。

12 障害者権利条約

文化・スポーツ

条約の第30条（文化的生活、レクリエーション、余暇及びスポーツへの参加）に定められている障害者の芸術活動に関して、芸術活動に取り組む障害者やその家族、支援者等に対する具体的な支援等の振興が進められています。

また、障害者も楽しめる舞台芸術公演、展覧会

国際協力

日本はこれまで、障害者施策に関する技術や経験を数多く蓄積してきました。これらを、政府開発援助（ODA）の活動を通じて開発途上国の障害者施策に役立てることは、極めて有効であり、重要です。条約の第32 条（国際協力）を踏まえ、障害と開発に関する国際協力がこれまで以上に進められています。具体的には、鉄道建設や空港建設にバリアフ リー設計を取り入れる等の有償資金協力、リハビリテーション施設の整備等の無償資金協力、障害者の社会参加に関する研修員の受入れや専門家・ JICA（国際協力機構）ボランティアの派遣等の技術協力が行われています。また、日本NGO 連携無償資金協力を通じた、障害者への職業訓練等の、草

の根レベルの支援も行われています。

これらの協力においては、障害当事者を中心とする意思決定や実施が重視されており、日本の協力によりタイのバンコクに設立された「アジア太平

等も各地で開催されるようになっています。国立劇場や国立美術館、国立博物館等では、障害者の入場料の割引や無料措置が行われているものもあります。また、全国各地の劇場や美術館、博物館でも、車いす用のトイレやエレベーターの設置等、環境改善が進められています。

障害者スポーツに関しては、2011 年に成立したスポーツ基本法において、障害者の自主的かつ積極的なスポーツを推進するとの理念が掲げられています。同法を受けて、障害者スポーツ指導者の養成、全国障害者スポーツ大会の開催等、障害者スポーツの裾野を拡大するとともに、パラリンピックやデフリンピック等の競技大会への派遣や、トップアスリートに対する強化支援等の障害者スポーツにおける国際競技力向上が図られています。

洋障害者センター」、ODA 事業として初めて盲ろう当事者が専門家として派遣された、ウズベキスタンでの「タシケント市における盲ろう者のコミュニケーション支援」等、様々な事業で約10 年間に延べ100 人以上の障害当事者が派遣されています。こうした直接的な援助のほか、国連における協 力や地域協力のため、国連アジア太平洋経済社会委員会（ESCAP）を通じた活動支援等も行われて

います。

障害者権利条約 13

条約の実施に関する仕組み

国内の仕組み ― 条約の実施を監視するための枠組み―

条約の第33 条（国内における実施及び監視）は、締約国が自国の法律上・行政上の制度に従って「条約の実施を監視するための枠組み」を自国内に設置することを定めています。

日本では、この規定を念頭に2011 年に障害者基本法が改正され、障害者、障害者の自立・社会参加に関する事業の従事者及び学識経験者から構成される「障害者政策委員会」が設置されています。委員は内閣総理大臣により任命されますが、その構成については、同委員会が様々な障害者の意見を聴き障害者の実情を踏まえた調査審議が行えるよう配慮されることが定められています。

同法では、政府は障害者施策の総合的かつ計画的な推進を図るため、障害者基本計画を策定することが定められています。障害者政策委員会は、この障害者基本計画の作成・変更について調査審議を行い、必要に応じて内閣総理大臣又は関係各大臣に対して意見を述べることとされています。ま

た、同委員会は障害者基本計画の実施状況を監視し、必要に応じて内閣総理大臣又は内閣総理大臣を通じて関係各大臣に勧告を行うこととされています。どちらの場合も、同委員会は関係行政機関の長に対して、資料の提出等の協力を求めることができます。このような機能を通じて、同委員会は条約の実施を監視することになります。

この「条約の実施を監視するための枠組み」は、

「合理的配慮の否定」に関する規定と同様、これまでの人権条約には見られない新たな規定であり、障害者権利条約の特徴ということができます。

国際的な仕組み ― 障害者の権利に関する委員会―

条約の第35 条（締約国による報告）では、締約国は、条約に基づく義務を履行するためにとった措置等に関する包括的な報告を「障害者の権利に関する委員会」に提出することを定めています。この報告の作成に当たっては、公開された透明性のある過程を踏むことを検討するとともに、障害者の関与につ

いて十分な考慮を払うことが求められています。

「障害者の権利に関する委員会」は、締結国から選ばれた18 人の専門家から構成され（第34 条）、締結国による報告を検討し、報告について提案や勧告を行うこと（第36 条）が定められています。この仕組みにより、締約国は条約の実施について国際的に審査されることになります。

障害者の権利に関する条約

CONVENTION ON THE RIGHTS OF PERSONS WITH DISABILITIES

前文 Preamble

この条約の締約国は、

（a） 国際連合憲章において宣明された原則が、人類社会の全ての構成員の固有の尊厳及び価値並びに平等のかつ奪い得ない権利が世界における自由、正義及び平和の基礎を成すものであると認めていることを想起し、

（b） 国際連合が、世界人権宣言及び人権に関する国際規約において、全ての人はいかなる差別もなしに同宣言及びこれらの規約に掲げる全ての権利及び自由を享有することができることを宣明し、及び合意したことを認め、

（c） 全ての人権及び基本的自由が普遍的であり、不可分のものであり、相互に依存し、かつ、相互に関連を有すること並びに障害者が全ての人権及び基本的自由を差別なしに完全に享有することを保障することが必要であることを再確認し、

（d） 経済的、社会的及び文化的権利に関する国際規約、市民的及び政治的権利に関する国際規約、あらゆる形態の人種差別の撤廃に関する国際条約、女子に対するあらゆる形態の差別の撤廃に関する条約、拷問及び他の残虐な、非人道的な又は品位を傷つける取扱い又は刑罰に関する条約、児童の権利に関する条約及び全ての移住労働者及びその家族の構成員の権利の保護に関する国際条約を想起し、

（e） 障害が発展する概念であることを認め、また、障害が、機能障害を有する者とこれらの者に対する態度及び環境による障壁との間の相互作用であって、これらの者が他の者との平等を基礎として社会に完全かつ効果的に参加することを妨げるものによって生ずることを認め、

（f） 障害者に関する世界行動計画及び障害者の機会均等化に関する標準規則に定める原則及び政策上の指針が、障害者の機会均等を更に促進するための国内的、地域的及び国際的な政策、計画及び行動の促進、作成及び評価に影響を及ぼす上で重要であることを認め、

（g） 持続可能な開発に関連する戦略の不可分の一部として障害に関する問題を主流に組み入れることが重要であることを強調し、

（h） また、いかなる者に対する障害に基づく差別も、人間の固有の尊厳及び価値を侵害するものであることを認め、

（i） さらに、障害者の多様性を認め、

（j） 全ての障害者（より多くの支援を必要とする障害者を含む。）の人権を促進し、及び保護することが必要であることを認め、

（k） これらの種々の文書及び約束にもかかわらず、障害者が、世界の全ての地域において、社会の平等な構成員としての参加を妨げる障壁及び人権侵害に依然として直面していることを憂慮し、

The States Parties to the present Convention,

(a) Recalling the principles proclaimed in the Charter of the United Nations which recognize the inherent dignity and worth and the equal and inalienable rights of all members of the human family as the foundation of freedom, justice and peace in the world,

(b) Recognizing that the United Nations, in the Universal Declaration of Human Rights and in the International Covenants on Human Rights, has proclaimed and agreed that everyone is entitled to all the rights and freedoms set forth therein, without distinction of any kind,

(c) Reaffirming the universality, indivisibility, interdependence and interrelatedness of all human rights and fundamental freedoms and the need for persons with disabilities to be guaranteed their full enjoyment without discrimination,

(d) Recalling the International Covenant on Economic, Social and Cultural Rights, the International Covenant on Civil and Political Rights, the International Convention on the Elimination of All Forms of Racial Discrimination, the Convention on the Elimination of All Forms of Discrimination against Women, the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the Convention on the Rights of the Child, and the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families,

(e) Recognizing that disability is an evolving concept and that disability results from the interaction between persons with impairments and attitudinal and environmental barriers that hinders their full and effective participation in society on an equal basis with others,

(f) Recognizing the importance of the principles and policy guidelines contained in the World Programme of Action concerning Disabled Persons and in the Standard Rules on the Equalization of Opportunities for Persons with Disabilities in influencing the promotion, formulation and evaluation of the policies, plans, programmes and actions at the national, regional and international levels to further equalize opportunities for persons with disabilities,

(g) Emphasizing the importance of mainstreaming disability issues as an integral part of relevant strategies of sustainable development,

(h) Recognizing also that discrimination against any person on the basis of disability is a violation of the inherent dignity and worth of the human person,

(i) Recognizing further the diversity of persons with disabilities,

( j) Recognizing the need to promote and protect the human rights of all persons with disabilities, including those who require more intensive support,

(k) Concerned that, despite these various instruments and undertakings, persons with disabilities continue to face barriers in their participation as equal members of society and violations of their human rights in all parts of the world,

（l） あらゆる国（特に開発途上国）における障害者の生活条件を改善するための国際協力が重要であることを認め、

（o） 障害者が、政策及び計画（障害者に直接関連する政策及び計画を含む。）に係る意思決定の過程に積極的に関与する機会を有すべきであることを考慮し、

（p） 人種、皮膚の色、性、言語、宗教、政治的意見その他の意見、国民的な、種族的な、先住民族としての若しくは社会的な出身、財産、出生、年齢又は他の地位に基づく複合的又は加重的な形態の差別を受けている障害者が直面する困難な状況を憂慮し、

（q） 障害のある女子が、家庭の内外で暴力、傷害若しくは虐待、放置若しくは怠慢な取扱い、不当な取扱い又は搾取を受ける一層大きな危険にしばしばさらされていることを認め、

（r） 障害のある児童が、他の児童との平等を基礎として全ての人権及び基本的自由を完全に享有すべきであることを認め、また、このため、児童の権利に関する条約の締約国が負う義務を想起し、

（s） 障害者による人権及び基本的自由の完全な享有を促進するためのあらゆる努力に性別の視点を組み込む必要があることを強調し、

（t） 障害者の大多数が貧困の状況下で生活している事実を強調し、また、この点に関し、貧困が障害者に及ぼす悪影響に対処することが真に必要であることを認め、

（u） 国際連合憲章に定める目的及び原則の十分な尊重並びに人権に関する適用可能な文書の遵守に基づく平和で安全な状況が、特に武力紛争及び外国による占領の期間中における障害者の十分な保護に不可欠であることに留意し、

（v） 障害者が全ての人権及び基本的自由を完全に享有することを可能とするに当たっては、物理的、社会的、経済的及び文化的な環境並びに健康及び教育を享受しやすいようにし、並びに情報及び通信を利用しやすいようにすることが重要であることを認め、

（w）個人が、他人に対し及びその属する地域社会に対して義務を負うこと並びに国際人権章典において認められる権利の増進及び擁護のために努力する責任を有することを認識し、

（x） 家族が、社会の自然かつ基礎的な単位であること並びに社会及び国家による保護を受ける権利を有することを確信し、また、障害者及びその家族の構成員が、障害者の権利の完全かつ平等な享有に向けて家族が貢献することを可能とするために必要な保護及び支援を受けるべきであることを確信し、

(l ) Recognizing the importance of international cooperation for improving the living conditions of persons with disabilities in every country, particularly in developing countries,

(m) Recognizing the valued existing and potential contributions made by persons with disabilities to the overall well-being and diversity of their communities, and that the promotion of the full enjoyment by persons with disabilities of their human rights and fundamental freedoms and of full participation by persons with disabilities will result in their enhanced sense of belonging and in significant advances in the human, social and economic development of society and the eradication of poverty,

(n) Recognizing the importance for persons with disabilities of their individual autonomy and independence, including the freedom to make their own choices,

(o) Considering that persons with disabilities should have the opportunity to be actively involved in decision-making processes about policies and programmes, including those directly concerning them,

(p) Concerned about the difficult conditions faced by persons with disabilities who are subject to multiple or aggravated forms of discrimination on the basis of race, colour, sex, language, religion, political or other opinion, national, ethnic, indigenous or social origin, property, birth, age or other status,

(q) Recognizing that women and girls with disabilities are often at greater risk, both within and outside the home, of violence, injury or abuse, neglect or negligent treatment, maltreatment or exploitation,

(r) Recognizing that children with disabilities should have full enjoyment of all human rights and fundamental freedoms on an equal basis with other children, and recalling obligations to that end undertaken by States Parties to the Convention on the Rights of the Child,

(s) Emphasizing the need to incorporate a gender perspective in all efforts to promote the full enjoyment of human rights and fundamental freedoms by persons with disabilities,

(t) Highlighting the fact that the majority of persons with disabilities live in conditions of poverty, and in this regard recognizing the critical need to address the negative impact of poverty on persons with disabilities,

(u) Bearing in mind that conditions of peace and security based on full respect for the purposes and principles contained in the Charter of the United Nations and observance of applicable human rights instruments are indispensable for the full protection of persons with disabilities, in particular during armed conflicts and foreign occupation,

(v) Recognizing the importance of accessibility to the physical, social, economic and cultural environment, to health and education and to information and communication, in enabling persons with disabilities to fully enjoy all human rights and fundamental freedoms,

(w) Realizing that the individual, having duties to other individuals and to the community to which he or she belongs, is under a responsibility to strive for the promotion and observance of the rights recognized in the International Bill of Human Rights,

(x) Convinced that the family is the natural and fundamental group unit of society and is entitled to protection by society and the State, and that persons with disabilities and their family members should receive the necessary protection and assistance to enable families to contribute towards the full and equal enjoyment of the rights of persons with disabilities,

（y） 障害者の権利及び尊厳を促進し、及び保護するための包括的かつ総合的な国際条約が、開発途上国及び先進国において、障害者の社会的に著しく不利な立場を是正することに重要な貢献を行うこと並びに障害者が市民的、政治的、経済的、社会的及び文化的分野に均等な機会により参加することを促進することを確信して、

次のとおり協定した。

第一条 目的

この条約は、全ての障害者によるあらゆる人権及び基本的自由の完全かつ平等な享有を促進し、保護し、及び確保すること並びに障害者の固有の尊厳の尊重を促進することを目的とする。

障害者には、長期的な身体的、精神的、知的又は感覚的な機能障害であって、様々な障壁との相互作用により他の者との平等を基礎として社会に完全かつ効果的に参加することを妨げ得るものを有する者を含む。

第二条 定義

この条約の適用上、

「意思疎通」とは、言語、文字の表示、点字、触覚を使った意思疎通、拡大文字、利用しやすいマルチメディア並びに筆記、音声、平易な言葉、朗読その他の補助的及び代替的な意思疎通の形態、手段及び様式（利用しやすい情報通信機器を含む。）をいう。

「言語」とは、音声言語及び手話その他の形態の非音声言語をいう。

「障害に基づく差別」とは、障害に基づくあらゆる区別、排除又は制限であって、政治的、経済的、社会的、文化的、市民的その他のあらゆる分野において、他の者との平等を基礎として全ての人権及び基本的自由を認識し、享有し、又は行使することを害し、又は妨げる目的又は効果を有するものをいう。障害に基づく差別には、あらゆる形態の差別（合理的配慮の 定を含む。）を含む。

「合理的配慮」とは、障害者が他の者との平等を基礎として全ての人権及び基本的自由を享有し、又は行使することを確保するための必要かつ適当な変更及び調整であって、特定の場合において必要とされるものであり、かつ、均衡を失した又は過度の負担を課さないものをいう。

「ユニバーサルデザイン」とは、調整又は特別な設計を必要とすることなく、最大限可能な範囲で全ての人が使用することのできる製品、環境、計画及びサービスの設計をいう。ユニバーサルデザインは、特定の障害者の集団のための補装具が必要な場合には、これを排除するものではない。

第三条 一般原則

この条約の原則は、次のとおりとする。

（a） 固有の尊厳、個人の自律（自ら選択する自由を含む。）及び個人の自立の尊重

（b） 無差別

（c） 社会への完全かつ効果的な参加及び包容

（d） 差異の尊重並びに人間の多様性の一部及び人類の一員としての障害者の受入れ

（e） 機会の均等

（f） 施設及びサービス等の利用の容易さ

（g） 男女の平等

（h） 障害のある児童の発達しつつある能力の尊重及び障害のある児童がその同一性を保持する権利の尊重

(y) Convinced that a comprehensive and integral international convention to promote and protect the rights and dignity of persons with disabilities will make a significant contribution to redressing the profound social disadvantage of persons with disabilities and promote their participation in the civil, political, economic, social and cultural spheres with equal opportunities, in both developing and developed countries,

Have agreed as follows:

Article 1 Purpose

The purpose of the present Convention is to promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity.

Persons with disabilities include those who have long-term physical, mental, intellectual or sensory impairments which in interaction with various barriers may hinder their full and effective participation in society on an equal basis with others.

Article 2 Definitions

For the purposes of the present Convention:

“Communication” includes languages, display of text, Braille, tactile communication, large print, accessible multimedia as well as written, audio, plain-language, human-reader and augmentative and alternative modes, means and formats of communication, including accessible information and communication technology;

“Language” includes spoken and signed languages and other forms of non spoken languages;

“Discrimination on the basis of disability” means any distinction, exclusion or restriction on the basis of disability which has the purpose or effect of impairing or nullifying the recognition, enjoyment or exercise, on an equal basis with others, of all human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field. It includes all forms of discrimination, including denial of reasonable accommodation;

“Reasonable accommodation” means necessary and appropriate modification and adjustments not imposing a disproportionate or undue burden, where needed in a particular case, to ensure to persons with disabilities the enjoyment or exercise on an equal basis with others of all human rights and fundamental freedoms;

“Universal design” means the design of products, environments, programmes and services to be usable by all people, to the greatest extent possible, without the need for adaptation or specialized design. “Universal design” shall not exclude assistive devices for particular groups of persons with disabilities where this is needed.

Article 3 General principles

The principles of the present Convention shall be:

(a) Respect for inherent dignity, individual autonomy including the freedom to make one’s own choices, and independence of persons;

(b) Non-discrimination;

(c) Full and effective participation and inclusion in society;

(d) Respect for difference and acceptance of persons with disabilities as part of human diversity and humanity;

(e) Equality of opportunity; (f) Accessibility;

(g) Equality between men and women;

(h) Respect for the evolving capacities of children with disabilities and respect for the right of children with disabilities to preserve their identities.

第四条 一般的義務

１ 締約国は、障害に基づくいかなる差別もなしに、全ての障害者のあらゆる人権及び基本的自由を完全に実現することを確保し、及び促進することを約束する。このため、締約国は、次のことを約束する。

（a） この条約において認められる権利の実現のため、全ての適当な立法措置、行政措置その他の措置をとること。

（b） 障害者に対する差別となる既存の法律、規則、慣習及び慣行を修正し、又は廃止するための全ての適当な措置（立法を含む。）をとること。

（c） 全ての政策及び計画において障害者の人権の保護及び促進を考慮に入れること。

（d） この条約と両立しないいかなる行為又は慣行も差し控えること。また、公の当局及び機関がこの条約に従って行動することを確保すること。

（e） いかなる個人、団体又は民間企業による障害に基づく差別も撤廃するための全ての適当な措置をとること。

（f） 第二条に規定するユニバーサルデザインの製品、サービス、設備及び施設であって、障害者に特有のニーズを満たすために必要な調整が可能な限り最小限であり、かつ、当該ニーズを満たすために必要な費用が最小限であるべきものについての研究及び開発を実施し、又は促進すること。また、当該ユニバーサルデザインの製品、サービス、設備及び施設の利用可能性及び使用を促進すること。さらに、基準及び指針を作成するに当たっては、ユニバーサルデザインが当該基準及び指針に含まれることを促進すること。

（g） 障害者に適した新たな機器（情報通信機器、移動補助具、補装具及び支援機器を含む。）についての研究及び開発を実施し、又は促進し、並びに当該新たな機器の利用可能性及び使用を促進すること。この場合において、締約国は、負担しやすい費用の機器を優先させる。

（h） 移動補助具、補装具及び支援機器（新たな機器を含む。）並びに他の形態の援助、支援サービス及び施設に関する情報であって、障害者にとって利用しやすいものを提供すること。

（i） この条約において認められる権利によって保障される支援及びサービスをより良く提供するため、障害者と共に行動する専門家及び職員に対する当該権利に関する研修を促進すること。

２ 各締約国は、経済的、社会的及び文化的権利に関しては、これらの権利の完全な実現を漸進的に達成するため、自国における利用可能な手段を最大限に用いることにより、また、必要な場合には国際協力の枠内で、措置をとることを約束する。ただし、この条約に定める義務であって、国際法に従って直ちに適用されるものに影響を及ぼすものではない。

３ 締約国は、この条約を実施するための法令及び政策の作成及び実施において、並びに障害者に関する問題についての他の意思決定過程において、障害者（障害のある児童を含む。以下この３において同じ。）を代表する団体を通じ、障害者と緊密に協議し、及び障害者を積極的に関与させる。

４ この条約のいかなる規定も、締約国の法律又は締約国について効力を有する国際法に含まれる規定であって障害者の権利の実現に一層貢献するものに影響を及ぼすものではない。こ

Article 4 General obligations

1. States Parties undertake to ensure and promote the full realization of all human rights and fundamental freedoms for all persons with disabilities without discrimination of any kind on the basis of disability. To this end, States Parties undertake:

(a) To adopt all appropriate legislative, administrative and other measures for the implementation of the rights recognized in the present Convention;

(b) To take all appropriate measures, including legislation, to modify or abolish existing laws, regulations, customs and practices that constitute discrimination against persons with disabilities;

(c) To take into account the protection and promotion of the human rights of persons with disabilities in all policies and programmes;

(d) To refrain from engaging in any act or practice that is inconsistent with the present Convention and to ensure that public authorities and institutions act in conformity with the present Convention;

(e) To take all appropriate measures to eliminate discrimination on the basis of disability by any person, organization or private enterprise;

(f) To undertake or promote research and development of universally designed goods, services, equipment and facilities, as defined in article 2 of the present Convention, which should require the minimum possible adaptation and the least cost to meet the specific needs of a person with disabilities, to promote their availability and use, and to promote universal design in the development of standards and guidelines;

(g) To undertake or promote research and development of, and to promote the availability and use of new technologies, including information and communications technologies, mobility aids, devices and assistive technologies, suitable for persons with disabilities, giving priority to technologies at an affordable cost;

(h) To provide accessible information to persons with disabilities about mobility aids, devices and assistive technologies, including new technologies, as well as other forms of assistance, support services and facilities;

(i ) To promote the training of professionals and staff working with persons with disabilities in the rights recognized in the present Convention so as to better provide the assistance and services guaranteed by those rights.

2. With regard to economic, social and cultural rights, each State Party undertakes to take measures to the maximum of its available resources and, where needed, within the framework of international cooperation, with a view to achieving progressively the full realization of these rights, without prejudice to those obligations contained in the present Convention that are immediately applicable according to international law.

3. In the development and implementation of legislation and policies to implement the present Convention, and in other decision-making processes concerning issues relating to persons with disabilities, States Parties shall closely consult with and actively involve persons with disabilities, including children with disabilities, through their representative organizations.

4. Nothing in the present Convention shall affect any provisions which are more conducive to the realization of the rights of persons with disabilities and which may be contained in the law of a State Party or

の条約のいずれかの締約国において法律、条約、規則又は慣習によって認められ、又は存する人権及び基本的自由については、この条約がそれらの権利若しくは自由を認めていないこと又はその認める範囲がより狭いことを理由として、それらの権利及び自由を制限し、又は侵してはならない。

５ この条約は、いかなる制限又は例外もなしに、連邦国家の全ての地域について適用する。

第五条 平等及び無差別

１ 締約国は、全ての者が、法律の前に又は法律に基づいて平等であり、並びにいかなる差別もなしに法律による平等の保護及び利益を受ける権利を有することを認める。

２ 締約国は、障害に基づくあらゆる差別を禁止するものとし、いかなる理由による差別に対しても平等かつ効果的な法的保護を障害者に保障する。

３ 締約国は、平等を促進し、及び差別を撤廃することを目的として、合理的配慮が提供されることを確保するための全ての適当な措置をとる。

４ 障害者の事実上の平等を促進し、又は達成するために必要な特別の措置は、この条約に規定する差別と解してはならない。

第六条 障害のある女子

１ 締約国は、障害のある女子が複合的な差別を受けていることを認識するものとし、この点に関し、障害のある女子が全ての人権及び基本的自由を完全かつ平等に享有することを確保するための措置をとる。

２ 締約国は、女子に対してこの条約に定める人権及び基本的自由を行使し、及び享有することを保障することを目的として、女子の完全な能力開発、向上及び自律的な力の育成を確保するための全ての適当な措置をとる。

第七条 障害のある児童

１ 締約国は、障害のある児童が他の児童との平等を基礎として全ての人権及び基本的自由を完全に享有することを確保するための全ての必要な措置をとる。

２ 障害のある児童に関する全ての措置をとるに当たっては、児童の最善の利益が主として考慮されるものとする。

３ 締約国は、障害のある児童が、自己に影響を及ぼす全ての事項について自由に自己の意見を表明する権利並びにこの権利を実現するための障害及び年齢に適した支援を提供される権利を有することを確保する。この場合において、障害のある児童の意見は、他の児童との平等を基礎として、その児童の年齢及び成熟度に従って相応に考慮されるものとする。

第八条 意識の向上

１ 締約国は、次のことのための即時の、効果的なかつ適当な措置をとることを約束する。

（a） 障害者に関する社会全体（各家庭を含む。）の意識を向上させ、並びに障害者の権利及び尊厳に対する尊重を育成すること。

There shall be no restriction upon or derogation from any of the human rights and fundamental freedoms recognized or existing in any State Party to the present Convention pursuant to law, conventions, regulation or custom on the pretext that the present Convention does not recognize such rights or freedoms or that it recognizes them to a lesser extent.

5. The provisions of the present Convention shall extend to all parts of federal States without any limitations or exceptions.

Article 5 Equality and non-discrimination

1. States Parties recognize that all persons are equal before and under the law and are entitled without any discrimination to the equal protection and equal benefit of the law.

2. States Parties shall prohibit all discrimination on the basis of disability and guarantee to persons with disabilities equal and effective legal protection against discrimination on all grounds.

3. In order to promote equality and eliminate discrimination, States Parties shall take all appropriate steps to ensure that reasonable accommodation is provided.

4. Specific measures which are necessary to accelerate or achieve de facto equality of persons with disabilities shall not be considered discrimination under the terms of the present Convention.

Article 6 Women with disabilities

1. States Parties recognize that women and girls with disabilities are subject to multiple discrimination, and in this regard shall take measures to ensure the full and equal enjoyment by them of all human rights and fundamental freedoms.

2. States Parties shall take all appropriate measures to ensure the full development, advancement and empowerment of women, for the purpose of guaranteeing them the exercise and enjoyment of the human rights and fundamental freedoms set out in the present Convention.

Article 7 Children with disabilities

1. States Parties shall take all necessary measures to ensure the full enjoyment by children with disabilities of all human rights and fundamental freedoms on an equal basis with other children.

2. In all actions concerning children with disabilities, the best interests of the child shall be a primary consideration.

3. States Parties shall ensure that children with disabilities have the right to express their views freely on all matters affecting them, their views being given due weight in accordance with their age and maturity, on an equal basis with other children, and to be provided with disability and age-appropriate assistance to realize that right.

Article 8 Awareness-raising

1. States Parties undertake to adopt immediate, effective and appropriate measures:

(a) To raise awareness throughout society, including at the family level, regarding persons with disabilities, and to foster respect for the rights and dignity of persons with disabilities;

（b） あらゆる活動分野における障害者に関する定型化された観念、偏見及び有害な慣行（性及び年齢に基づくものを含む。）と戦うこと。

（c） 障害者の能力及び貢献に関する意識を向上させること。

２ このため、１の措置には、次のことを含む。

（a） 次のことのための効果的な公衆の意識の啓発活動を開始し、及び維持すること。

（i） 障害者の権利に対する理解を育てること。

（ii） 障害者に対する肯定的認識及び一層の社会の啓発を促進すること。

（iii）障害者の技能、長所及び能力並びに職場及び労働市場に対する障害者の貢献についての認識を促進すること。

（b） 教育制度の全ての段階（幼年期からの全ての児童に対する教育制度を含む。）において、障害者の権利を尊重する態度を育成すること。

（c） 全ての報道機関が、この条約の目的に適合するように障害者を描写するよう奨励すること。

（d） 障害者及びその権利に関する啓発のための研修計画を促進すること。

第九条 施設及びサービス等の利用の容易さ

１ 締約国は、障害者が自立して生活し、及び生活のあらゆる側面に完全に参加することを可能にすることを目的として、障害者が、他の者との平等を基礎として、都市及び農村の双方において、物理的環境、輸送機関、情報通信（情報通信機器及び情報通信システムを含む。）並びに公衆に開放され、又は提供される他の施設及びサービスを利用する機会を有することを確保するための適当な措置をとる。この措置は、施設及びサービス等の利用の容易さに対する妨げ及び障壁を特定し、及び撤廃することを含むものとし、特に次の事項について適用する。

（a） 建物、道路、輸送機関その他の屋内及び屋外の施設（学校、住居、医療施設及び職場を含む。）

（b） 情報、通信その他のサービス（電子サービス及び緊急事態に係るサービスを含む。）

２ 締約国は、また、次のことのための適当な措置をとる。

（a） 公衆に開放され、又は提供される施設及びサービスの利用の容易さに関する最低基準及び指針を作成し、及び公表し、並びに当該最低基準及び指針の実施を監視すること。

（b） 公衆に開放され、又は提供される施設及びサービスを提供する民間の団体が、当該施設及びサービスの障害者にとっての利用の容易さについてあらゆる側面を考慮することを確保すること。

（c） 施設及びサービス等の利用の容易さに関して障害者が直面する問題についての研修を関係者に提供すること。

（d） 公衆に開放される建物その他の施設において、点字の表示及び読みやすく、かつ、理解しやすい形式の表示を提供すること。

（e） 公衆に開放される建物その他の施設の利用の容易さを促進するため、人又は動物による支援及び仲介する者（案内者、朗読者及び専門の手話通訳を含む。）を提供すること。

(b) To combat stereotypes, prejudices and harmful practices relating to persons with disabilities, including those based on sex and age, in all areas of life;

(c) To promote awareness of the capabilities and contributions of persons with disabilities.

2. Measures to this end include:

(a) Initiating and maintaining effective public awareness campaigns designed:

(i) To nurture receptiveness to the rights of persons with disabilities;

(ii) To promote positive perceptions and greater social awareness towards persons with disabilities;

(iii) To promote recognition of the skills, merits and abilities of persons with disabilities, and of their contributions to the workplace and the labour market;

(b) Fostering at all levels of the education system, including in all children from an early age, an attitude of respect for the rights of persons with disabilities;

(c) Encouraging all organs of the media to portray persons with disabilities in a manner consistent with the purpose of the present Convention;

(d) Promoting awareness-training programmes regarding persons with disabilities and the rights of persons with disabilities.

Article 9 Accessibility

1. To enable persons with disabilities to live independently and participate fully in all aspects of life, States Parties shall take appropriate measures to ensure to persons with disabilities access, on an equal basis with others, to the physical environment, to transportation, to information and communications, including information and communications technologies and systems, and to other facilities and services open or provided to the public, both in urban and in rural areas. These measures, which shall include the identification and elimination of obstacles and barriers to accessibility, shall apply to, inter alia:

(a) Buildings, roads, transportation and other indoor and outdoor facilities, including schools, housing, medical facilities and workplaces;

(b) Information, communications and other services, including electronic services and emergency services.

2. States Parties shall also take appropriate measures:

(a) To develop, promulgate and monitor the implementation of minimum standards and guidelines for the accessibility of facilities and services open or provided to the public;

(b) To ensure that private entities that offer facilities and services which are open or provided to the public take into account all aspects of accessibility for persons with disabilities;

(c) To provide training for stakeholders on accessibility issues facing persons with disabilities;

(d) To provide in buildings and other facilities open to the public signage in Braille and in easy to read and understand forms;

(e) To provide forms of live assistance and intermediaries, including guides, readers and professional sign language interpreters, to facilitate accessibility to buildings and other facilities open to the public;

（f） 障害者が情報を利用する機会を有することを確保するため、障害者に対する他の適当な形態の援助及び支援を促進すること。

（g） 障害者が新たな情報通信機器及び情報通信システム（インターネットを含む。）を利用する機会を有することを促進すること。

（h） 情報通信機器及び情報通信システムを最小限の費用で利用しやすいものとするため、早い段階で、利用しやすい情報通信機器及び情報通信システムの設計、開発、生産及び流通を促進すること。

第十条 生命に対する権利

締約国は、全ての人間が生命に対する固有の権利を有することを再確認するものとし、障害者が他の者との平等を基礎としてその権利を効果的に享有することを確保するための全ての必要な措置をとる。

第十一条 危険な状況及び人道上の緊急事態

締約国は、国際法（国際人道法及び国際人権法を含む。）に基づく自国の義務に従い、危険な状況（武力紛争、人道上の緊急事態及び自然災害の発生を含む。）において障害者の保護及び安全を確保するための全ての必要な措置をとる。

第十二条 法律の前にひとしく認められる権利

１ 締約国は、障害者が全ての場所において法律の前に人として認められる権利を有することを再確認する。

２ 締約国は、障害者が生活のあらゆる側面において他の者との平等を基礎として法的能力を享有することを認める。

３ 締約国は、障害者がその法的能力の行使に当たって必要とする支援を利用する機会を提供するための適当な措置をとる。

４ 締約国は、法的能力の行使に関連する全ての措置において、濫用を防止するための適当かつ効果的な保障を国際人権法に従って定めることを確保する。当該保障は、法的能力の行使に関連する措置が、障害者の権利、意思及び選好を尊重すること、利益相反を生じさせず、及び不当な影響を及ぼさないこと、障害者の状況に応じ、かつ、適合すること、可能な限り短い期間に適用されること並びに権限のある、独立の、かつ、公平な当局又は司法機関による定期的な審査の対象となることを確保するものとする。当該保障は、当該措置が障害者の権利及び利益に及ぼす影響の程度に応じたものとする。

５ 締約国は、この条の規定に従うことを条件として、障害者が財産を所有し、又は相続し、自己の会計を管理し、及び銀行貸付け、抵当その他の形態の金融上の信用を利用する均等な機会を有することについての平等の権利を確保するための全ての適当かつ効果的な措置をとるものとし、障害者がその財産を恣意的に奪われないことを確保する。

第十三条 司法手続の利用の機会

１ 締約国は、障害者が全ての法的手続（捜査段階その他予備的な段階を含む。）において直接及び間接の参加者（証人を含む。）として効果的な役割を果たすことを容易にするため、手続上の配慮及び年齢に適した配慮が提供されること等により、障

(f) To promote other appropriate forms of assistance and support to persons with disabilities to ensure their access to information;

(g) To promote access for persons with disabilities to new information and communications technologies and systems, including the Internet;

(h) To promote the design, development, production and distribution of accessible information and communications technologies and systems at an early stage, so that these technologies and systems become accessible at minimum cost.

Article 10 Right to life

States Parties reaffirm that every human being has the inherent right to life and shall take all necessary measures to ensure its effective enjoyment by persons with disabilities on an equal basis with others.

Article 11 Situations of risk and humanitarian emergencies

States Parties shall take, in accordance with their obligations under international law, including international humanitarian law and international human rights law, all necessary measures to ensure the protection and safety of persons with disabilities in situations of risk, including situations of armed conflict, humanitarian emergencies and the occurrence of natural disasters.

Article 12 Equal recognition before the law

1. States Parties reaffirm that persons with disabilities have the right to recognition everywhere as persons before the law.

2. States Parties shall recognize that persons with disabilities enjoy legal capacity on an equal basis with others in all aspects of life.

3. States Parties shall take appropriate measures to provide access by persons with disabilities to the support they may require in exercising their legal capacity.

4. States Parties shall ensure that all measures that relate to the exercise of legal capacity provide for appropriate and effective safeguards to prevent abuse in accordance with international human rights law. Such safeguards shall ensure that measures relating to the exercise of legal capacity respect the rights, will and preferences of the person, are free of conflict of interest and undue influence, are proportional and tailored to the person’s circumstances, apply for the shortest time possible and are subject to regular review by a competent, independent and impartial authority or judicial body. The safeguards shall be proportional to the degree to which such measures affect the person’s rights and interests.

5. Subject to the provisions of this article, States Parties shall take all appropriate and effective measures to ensure the equal right of persons with disabilities to own or inherit property, to control their own financial affairs and to have equal access to bank loans, mortgages and other forms of financial credit, and shall ensure that persons with disabilities are not arbitrarily deprived of their property.

Article 13 Access to justice

1. States Parties shall ensure effective access to justice for persons with disabilities on an equal basis with others, including through the provision of procedural and age-appropriate accommodations, in order to facilitate their effective role as direct and indirect

２ 締約国は、障害者がいずれの手続を通じて自由を奪われた場合であっても、当該障害者が、他の者との平等を基礎として国際人権法による保障を受ける権利を有すること並びにこの条約の目的及び原則に従って取り扱われること（合理的配慮の提供によるものを含む。）を確保する。

第十五条 拷問又は残虐な、非人道的な若しくは品位を傷つける取扱い若しくは刑罰からの自由

１ いかなる者も、拷問又は残虐な、非人道的な若しくは品位を傷つける取扱い若しくは刑罰を受けない。特に、いかなる者も、その自由な同意なしに医学的又は科学的実験を受けない。

２ 締約国は、障害者が、他の者との平等を基礎として、拷問又は残虐な、非人道的な若しくは品位を傷つける取扱い若しくは刑罰を受けることがないようにするため、全ての効果的な立法上、行政上、司法上その他の措置をとる。

第十六条 搾取、暴力及び虐待からの自由

１ 締約国は、家庭の内外におけるあらゆる形態の搾取、暴力及び虐待（性別に基づくものを含む。）から障害者を保護するための全ての適当な立法上、行政上、社会上、教育上その他の措置をとる。

２ また、締約国は、特に、障害者並びにその家族及び介護者に対する適当な形態の性別及び年齢に配慮した援助及び支援（搾取、暴力及び虐待の事案を防止し、認識し、及び報 する方法に関する情報及び教育を提供することによるものを含む。）を確保することにより、あらゆる形態の搾取、暴力及び虐待を防止するための全ての適当な措置をとる。締約国は、保護事業が年齢、性別及び障害に配慮したものであることを確保する。

３ 締約国は、あらゆる形態の搾取、暴力及び虐待の発生を防止するため、障害者に役立つことを意図した全ての施設及び計画が独立した当局により効果的に監視されることを確保する。

４ 締約国は、あらゆる形態の搾取、暴力又は虐待の被害者となる障害者の身体的、認知的及び心理的な回復、リハビリテーション並びに社会復帰を促進するための全ての適当な措置（保護事業の提供によるものを含む。）をとる。このような回復及び復帰は、障害者の健康、福祉、自尊心、尊厳及び自律を育成する環境において行われるものとし、性別及び年齢に応じたニーズを考慮に入れる。

2. In order to help to ensure effective access to justice for persons with disabilities, States Parties shall promote appropriate training for those working in the field of administration of justice, including police and prison staff.

Article 14 Liberty and security of person

1. States Parties shall ensure that persons with disabilities, on an equal basis with others:

(a) Enjoy the right to liberty and security of person;

(b) Are not deprived of their liberty unlawfully or arbitrarily, and that any deprivation of liberty is in conformity with the law, and that the existence of a disability shall in no case justify a deprivation of liberty.

2. States Parties shall ensure that if persons with disabilities are deprived of their liberty through any process, they are, on an equal basis with others, entitled to guarantees in accordance with international human rights law and shall be treated in compliance with the objectives and principles of the present Convention, including by provision of reasonable accommodation.

Article 15 Freedom from torture or cruel, inhuman or degrading treatment or punishment

1. No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment. In particular, no one shall be subjected without his or her free consent to medical or scientific experimentation.

2. States Parties shall take all effective legislative, administrative, judicial or other measures to prevent persons with disabilities, on an equal basis with others, from being subjected to torture or cruel, inhuman or degrading treatment or punishment.

Article 16 Freedom from exploitation, violence and abuse

1. States Parties shall take all appropriate legislative, administrative, social, educational and other measures to protect persons with disabilities, both within and outside the home, from all forms of exploitation, violence and abuse, including their gender-based aspects.

2. States Parties shall also take all appropriate measures to prevent all forms of exploitation, violence and abuse by ensuring, inter alia, appropriate forms of gender- and age-sensitive assistance and support for persons with disabilities and their families and caregivers, including through the provision of information and education on how to avoid, recognize and report instances of exploitation, violence and abuse. States Parties shall ensure that protection services are age-, gender- and disability-sensitive.

3. In order to prevent the occurrence of all forms of exploitation, violence and abuse, States Parties shall ensure that all facilities and programmes designed to serve persons with disabilities are effectively monitored by independent authorities.

4. States Parties shall take all appropriate measures to promote the physical, cognitive and psychological recovery, rehabilitation and social reintegration of persons with disabilities who become victims of any form of exploitation, violence or abuse, including through the provision of protection services. Such recovery and reintegration shall take place in an environment that fosters the health, welfare, self-respect, dignity and autonomy of the person and takes into account gender- and age-specific needs.

５ 締約国は、障害者に対する搾取、暴力及び虐待の事案が特定され、捜査され、及び適当な場合には訴追されることを確保するための効果的な法令及び政策（女子及び児童に重点を置いた法令及び政策を含む。）を策定する。

第十七条 個人をそのままの状態で保護すること

全ての障害者は、他の者との平等を基礎として、その心身がそのままの状態で尊重される権利を有する。

第十八条 移動の自由及び国籍についての権利

１ 締約国は、障害者に対して次のことを確保すること等により、障害者が他の者との平等を基礎として移動の自由、居住の自由及び国籍についての権利を有することを認める。

（a） 国籍を取得し、及び変更する権利を有すること並びにその国籍を恣意的に又は障害に基づいて奪われないこと。

（b） 国籍に係る文書若しくは身元に係る他の文書を入手し、所有し、及び利用すること又は移動の自由についての権利の行使を容易にするために必要とされる関連手続（例えば、出入国の手続）を利用することを、障害に基づいて奪われないこと。

（c） いずれの国（自国を含む。）からも自由に離れることができること。

（d） 自国に戻る権利を恣意的に又は障害に基づいて奪われないこと。

２ 障害のある児童は、出生の後直ちに登録される。障害のある児童は、出生の時から氏名を有する権利及び国籍を取得する権利を有するものとし、また、できる限りその父母を知り、かつ、その父母によって養育される権利を有する。

第十九条 自立した生活及び地域社会への包容

この条約の締約国は、全ての障害者が他の者と平等の選択の機会をもって地域社会で生活する平等の権利を有することを認めるものとし、障害者が、この権利を完全に享受し、並びに地域社会に完全に包容され、及び参加することを容易にするための効果的かつ適当な措置をとる。この措置には、次のことを確保することによるものを含む。

（a） 障害者が、他の者との平等を基礎として、居住地を選択し、及びどこで誰と生活するかを選択する機会を有すること並びに特定の生活施設で生活する義務を負わないこと。

（b） 地域社会における生活及び地域社会への包容を支援し、並びに地域社会からの孤立及び隔離を防止するために必要な在宅サービス、居住サービスその他の地域社会支援サービス（個別の支援を含む。）を障害者が利用する機会を有すること。

（c） 一般住民向けの地域社会サービス及び施設が、障害者にとって他の者との平等を基礎として利用可能であり、かつ、障害者のニーズに対応していること。

第二十条 個人の移動を容易にすること

締約国は、障害者自身ができる限り自立して移動することを容易にすることを確保するための効果的な措置をとる。この措置には、次のことによるものを含む。

5. States Parties shall put in place effective legislation and policies, including women- and child-focused legislation and policies, to ensure that instances of exploitation, violence and abuse against persons with disabilities are identified, investigated and, where appropriate, prosecuted.

Article 17 Protecting the integrity of the person

Every person with disabilities has a right to respect for his or her physical and mental integrity on an equal basis with others.

Article 18 Liberty of movement and nationality

1. States Parties shall recognize the rights of persons with disabilities to liberty of movement, to freedom to choose their residence and to a nationality, on an equal basis with others, including by ensuring that persons with disabilities:

(a) Have the right to acquire and change a nationality and are not deprived of their nationality arbitrarily or on the basis of disability;

(b) Are not deprived, on the basis of disability, of their ability to obtain, possess and utilize documentation of their nationality or other documentation of identification, or to utilize relevant processes such as immigration proceedings, that may be needed to facilitate exercise of the right to liberty of movement;

(c) Are free to leave any country, including their own;

(d) Are not deprived, arbitrarily or on the basis of disability, of the right to enter their own country.

2. Children with disabilities shall be registered immediately after birth and shall have the right from birth to a name, the right to acquire a nationality and, as far as possible, the right to know and be cared for by their parents.

Article 19 Living independently and being included in the community

States Parties to the present Convention recognize the equal right of all persons with disabilities to live in the community, with choices equal to others, and shall take effective and appropriate measures to facilitate full enjoyment by persons with disabilities of this right and their full inclusion and participation in the community, including by ensuring that:

(a) Persons with disabilities have the opportunity to choose their place of residence and where and with whom they live on an equal basis with others and are not obliged to live in a particular living arrangement;

(b) Persons with disabilities have access to a range of in-home, residential and other community support services, including personal assistance necessary to support living and inclusion in the community, and to prevent isolation or segregation from the community;

(c) Community services and facilities for the general population are available on an equal basis to persons with disabilities and are responsive to their needs.

Article 20 Personal mobility

States Parties shall take effective measures to ensure personal mobility with the greatest possible independence for persons with disabilities, including by:

（a） 障害者自身が、自ら選択する方法で、自ら選択する時に、かつ、負担しやすい費用で移動することを容易にすること。

（b） 障害者が質の高い移動補助具、補装具、支援機器、人又は動物による支援及び仲介する者を利用する機会を得やすくすること（これらを負担しやすい費用で利用可能なものとすることを含む。）。

（c） 障害者及び障害者と共に行動する専門職員に対し、移動のための技能に関する研修を提供すること。

（d） 移動補助具、補装具及び支援機器を生産する事業体に対し、障害者の移動のあらゆる側面を考慮するよう奨励すること。

第二十一条 表現及び意見の自由並びに情報の利用の機会

締約国は、障害者が、第二条に定めるあらゆる形態の意思疎通であって自ら選択するものにより、表現及び意見の自由（他の者との平等を基礎として情報及び考えを求め、受け、及び伝える自由を含む。）についての権利を行使することができることを確保するための全ての適当な措置をとる。この措置には、次のことによるものを含む。

（a） 障害者に対し、様々な種類の障害に相応した利用しやすい様式及び機器により、適時に、かつ、追加の費用を伴わず、一般公衆向けの情報を提供すること。

（b） 公的な活動において、手話、点字、補助的及び代替的な意思疎通並びに障害者が自ら選択する他の全ての利用しやすい意思疎通の手段、形態及び様式を用いることを受け入れ、及び容易にすること。

（c） 一般公衆に対してサービス（インターネットによるものを含む。）を提供する民間の団体が情報及びサービスを障害者にとって利用しやすい又は使用可能な様式で提供するよう要請すること。

（d） マスメディア（インターネットを通じて情報を提供する者を含む。）がそのサービスを障害者にとって利用しやすいものとするよう奨励すること。

（e） 手話の使用を認め、及び促進すること。

第二十二条 プライバシーの尊重

１ いかなる障害者も、居住地又は生活施設のいかんを問わず、そのプライバシー、家族、住居又は通信その他の形態の意思疎通に対して恣意的に又は不法に干渉されず、また、名誉及び信用を不法に攻撃されない。障害者は、このような干渉又は攻撃に対する法律の保護を受ける権利を有する。

２ 締約国は、他の者との平等を基礎として、障害者の個人、健康及びリハビリテーションに関する情報に係るプライバシーを保護する。

第二十三条 家庭及び家族の尊重

１ 締約国は、他の者との平等を基礎として、婚姻、家族、親子関係及び個人的な関係に係る全ての事項に関し、障害者に対する差別を撤廃するための効果的かつ適当な措置をとる。この措置は、次のことを確保することを目的とする。

（a） 婚姻をすることができる年齢の全ての障害者が、両当事者の自由かつ完全な合意に基づいて婚姻をし、かつ、家族を形成する権利を認められること。

(a) Facilitating the personal mobility of persons with disabilities in the manner and at the time of their choice, and at affordable cost;

(b) Facilitating access by persons with disabilities to quality mobility aids, devices, assistive technologies and forms of live assistance and intermediaries, including by making them available at affordable cost;

(c) Providing training in mobility skills to persons with disabilities and to specialist staff working with persons with disabilities;

(d) Encouraging entities that produce mobility aids, devices and assistive technologies to take into account all aspects of mobility for persons with disabilities.

Article 21 Freedom of expression and opinion, and access to information

States Parties shall take all appropriate measures to ensure that persons with disabilities can exercise the right to freedom of expression and opinion, including the freedom to seek, receive and impart information and ideas on an equal basis with others and through all forms of communication of their choice, as defined in article 2 of the present Convention, including by:

(a) Providing information intended for the general public to persons with disabilities in accessible formats and technologies appropriate to different kinds of disabilities in a timely manner and without additional cost;

(b) Accepting and facilitating the use of sign languages, Braille, augmentative and alternative communication, and all other accessible means, modes and formats of communication of their choice by persons with disabilities in official interactions;

(c) Urging private entities that provide services to the general public, including through the Internet, to provide information and services in accessible and usable formats for persons with disabilities;

(d) Encouraging the mass media, including providers of information through the Internet, to make their services accessible to persons with disabilities;

(e) Recognizing and promoting the use of sign languages.

Article 22 Respect for privacy

1. No person with disabilities, regardless of place of residence or living arrangements, shall be subjected to arbitrary or unlawful interference with his or her privacy, family, home or correspondence or other types of communication or to unlawful attacks on his or her honour and reputation. Persons with disabilities have the right to the protection of the law against such interference or attacks.

2. States Parties shall protect the privacy of personal, health and rehabilitation information of persons with disabilities on an equal basis with others.

Article 23 Respect for home and the family

1. States Parties shall take effective and appropriate measures to eliminate discrimination against persons with disabilities in all matters relating to marriage, family, parenthood and relationships, on an equal basis with others, so as to ensure that:

(a) The right of all persons with disabilities who are of marriageable age to marry and to found a family on the basis of free and full consent of the intending spouses is recognized;

（b） 障害者が子の数及び出産の間隔を自由にかつ責任をもって決定する権利を認められ、また、障害者が生殖及び家族計画について年齢に適した情報及び教育を享受する権利を認められること。さらに、障害者がこれらの権利を行使することを可能とするために必要な手段を提供されること。

（c） 障害者（児童を含む。）が、他の者との平等を基礎として生殖能力を保持すること。

２ 締約国は、子の後見、養子縁組又はこれらに類する制度が国内法令に存在する場合には、それらの制度に係る障害者の権利及び責任を確保する。あらゆる場合において、子の最善の利益は至上である。締約国は、障害者が子の養育についての責任を遂行するに当たり、当該障害者に対して適当な援助を与える。

３ 締約国は、障害のある児童が家庭生活について平等の権利を有することを確保する。締約国は、この権利を実現し、並びに障害のある児童の隠匿、遺棄、放置及び隔離を防止するため、障害のある児童及びその家族に対し、包括的な情報、サービス及び支援を早期に提供することを約束する。

４ 締約国は、児童がその父母の意思に反してその父母から分離されないことを確保する。ただし、権限のある当局が司法の審査に従うことを条件として適用のある法律及び手続に従いその分離が児童の最善の利益のために必要であると決定する場合は、この限りでない。いかなる場合にも、児童は、自己の障害又は父母の一方若しくは双方の障害に基づいて父母から分離されない。

５ 締約国は、近親の家族が障害のある児童を監護することができない場合には、一層広い範囲の家族の中で代替的な監護を提供し、及びこれが不可能なときは、地域社会の中で家庭的な環境により代替的な監護を提供するようあらゆる努力を払う。

第二十四条 教育

１ 締約国は、教育についての障害者の権利を認める。締約国は、この権利を差別なしに、かつ、機会の均等を基礎として実現するため、障害者を包容するあらゆる段階の教育制度及び生涯学習を確保する。当該教育制度及び生涯学習は、次のことを目的とする。

（a） 人間の潜在能力並びに尊厳及び自己の価値についての意識を十分に発達させ、並びに人権、基本的自由及び人間の多様性の尊重を強化すること。

（b） 障害者が、その人格、才能及び創造力並びに精神的及び身体的な能力をその可能な最大限度まで発達させること。

（c） 障害者が自由な社会に効果的に参加することを可能とすること。

２ 締約国は、１の権利の実現に当たり、次のことを確保する。

（a） 障害者が障害に基づいて一般的な教育制度から排除されないこと及び障害のある児童が障害に基づいて無償のかつ義務的な初等教育から又は中等教育から排除されないこと。

（b） 障害者が、他の者との平等を基礎として、自己の生活する地域社会において、障害者を包容し、質が高く、かつ、無償の初等教育を享受することができること及び中等教育を享受することができること。

(b) The rights of persons with disabilities to decide freely and responsibly on the number and spacing of their children and to have access to age-appropriate information, reproductive and family planning education are recognized, and the means necessary to enable them to exercise these rights are provided;

(c) Persons with disabilities, including children, retain their fertility on an equal basis with others.

2. States Parties shall ensure the rights and responsibilities of persons with disabilities, with regard to guardianship, wardship, trusteeship, adoption of children or similar institutions, where these concepts exist in national legislation; in all cases the best interests of the child shall be paramount. States Parties shall render appropriate assistance to persons with disabilities in the performance of their child-rearing responsibilities.

3. States Parties shall ensure that children with disabilities have equal rights with respect to family life. With a view to realizing these rights, and to prevent concealment, abandonment, neglect and segregation of children with disabilities, States Parties shall undertake to provide early and comprehensive information, services and support to children with disabilities and their families.

4. States Parties shall ensure that a child shall not be separated from his or her parents against their will, except when competent authorities subject to judicial review determine, in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child. In no case shall a child be separated from parents on the basis of a disability of either the child or one or both of the parents.

5. States Parties shall, where the immediate family is unable to care for a child with disabilities, undertake every effort to provide alternative care within the wider family, and failing that, within the community in a family setting.

Article 24 Education

1. States Parties recognize the right of persons with disabilities to education. With a view to realizing this right without discrimination and on the basis of equal opportunity, States Parties shall ensure an inclusive education system at all levels and lifelong learning directed to:

(a) The full development of human potential and sense of dignity and self-worth, and the strengthening of respect for human rights, fundamental freedoms and human diversity;

(b) The development by persons with disabilities of their personality, talents and creativity, as well as their mental and physical abilities, to their fullest potential;

(c) Enabling persons with disabilities to participate effectively in a free society.

2. In realizing this right, States Parties shall ensure that:

(a) Persons with disabilities are not excluded from the general education system on the basis of disability, and that children with disabilities are not excluded from free and compulsory primary education, or from secondary education, on the basis of disability;

(b) Persons with disabilities can access an inclusive, quality and free primary education and secondary education on an equal basis with others in the communities in which they live;

（c） 個人に必要とされる合理的配慮が提供されること。

（d） 障害者が、その効果的な教育を容易にするために必要な支援を一般的な教育制度の下で受けること。

（e） 学問的及び社会的な発達を最大にする環境において、完全な包容という目標に合致する効果的で個別化された支援措置がとられること。

３ 締約国は、障害者が教育に完全かつ平等に参加し、及び地域社会の構成員として完全かつ平等に参加することを容易にするため、障害者が生活する上での技能及び社会的な発達のための技能を習得することを可能とする。このため、締約国は、次のことを含む適当な措置をとる。

（a） 点字、代替的な文字、意思疎通の補助的及び代替的な形態、手段及び様式並びに定位及び移動のための技能の習得並びに障害者相互による支援及び助言を容易にすること。

(c) Reasonable accommodation of the individual’s requirements is provided;

(d) Persons with disabilities receive the support required, within the general education system, to facilitate their effective education;

(e) Effective individualized support measures are provided in environments that maximize academic and social development, consistent with the goal of full inclusion.

3. States Parties shall enable persons with disabilities to learn life and social development skills to facilitate their full and equal participation in education and as members of the community. To this end, States Parties shall take appropriate measures, including:

(a) Facilitating the learning of Braille, alternative script, augmentative and alternative modes, means and formats of communication and orientation and mobility skills, and facilitating peer support and mentoring;

(b) Facilitating the learning of sign language and the promotion of the linguistic identity of the deaf community;

（c） 盲人、聾者又は盲聾者（特に盲人、聾者又は盲聾者である児童）の教育が、その個人にとって最も適当な言語並びに意思疎通の形態及び手段で、かつ、学問的及び社会的な発達を最大にする環境において行われることを確保すること。

４ 締約国は、１の権利の実現の確保を助長することを目的として、手話又は点字について能力を有する教員（障害のある教員を含む。）を雇用し、並びに教育に従事する専門家及び職員（教育のいずれの段階において従事するかを問わない。）に対する研修を行うための適当な措置をとる。この研修には、障害についての意識の向上を組み入れ、また、適当な意思疎通の補助的及び代替的な形態、手段及び様式の使用並びに障害者を支援するための教育技法及び教材の使用を組み入れるものとする。

５ 締約国は、障害者が、差別なしに、かつ、他の者との平等を基礎として、一般的な高等教育、職業訓練、成人教育及び生涯学習を享受することができることを確保する。このため、締約国は、合理的配慮が障害者に提供されることを確保する。

第二十五条 健康

締約国は、障害者が障害に基づく差別なしに到達可能な最高水準の健康を享受する権利を有することを認める。締約国は、障害者が性別に配慮した保健サービス（保健に関連するリハビリテーションを含む。）を利用する機会を有することを確保するための全ての適当な措置をとる。締約国は、特に、次のことを行う。

（a） 障害者に対して他の者に提供されるものと同一の範囲、質及び水準の無償の又は負担しやすい費用の保健及び保健計画（性及び生殖に係る健康並びに住民のための公衆衛生計画の分野のものを含む。）を提供すること。

（b） 障害者が特にその障害のために必要とする保健サービス（早期発見及び適当な場合には早期関与並びに特に児童及び高齢者の新たな障害を最小限にし、及び防止するためのサービスを含む。）を提供すること。

（c） これらの保健サービスを、障害者自身が属する地域社会（農村を含む。）の可能な限り近くにおいて提供すること。

(c) Ensuring that the education of persons, and in particular children, who are blind, deaf or deafblind, is delivered in the most appropriate languages and modes and means of communication for the individual, and in environments which maximize academic and social development.

4. In order to help ensure the realization of this right, States Parties shall take appropriate measures to employ teachers, including teachers with disabilities, who are qualified in sign language and/ or Braille, and to train professionals and staff who work at all levels of education. Such training shall incorporate disability awareness and the use of appropriate augmentative and alternative modes, means and formats of communication, educational techniques and materials to support persons with disabilities.

5. States Parties shall ensure that persons with disabilities are able to access general tertiary education, vocational training, adult education and lifelong learning without discrimination and on an equal basis with others. To this end, States Parties shall ensure that reasonable accommodation is provided to persons with disabilities.

Article 25 Health

States Parties recognize that persons with disabilities have the right to the enjoyment of the highest attainable standard of health without discrimination on the basis of disability. States Parties shall take all appropriate measures to ensure access for persons with disabilities to health services that are gender-sensitive, including health-related rehabilitation. In particular, States Parties shall:

(a) Provide persons with disabilities with the same range, quality and standard of free or affordable health care and programmes as provided to other persons, including in the area of sexual and reproductive health and population-based public health programmes;

(b) Provide those health services needed by persons with disabilities specifically because of their disabilities, including early identification and intervention as appropriate, and services designed to minimize and prevent further disabilities, including among children and older persons;

(c) Provide these health services as close as possible to people’s own communities, including in rural areas;

(d) Require health professionals to provide care of the same quality to persons with disabilities as to others, including on the basis of free and informed consent by, inter alia, raising awareness of the human

第二十六条 ハビリテーション（適応のための技能の習得）及びリハビリテーション

１ 締約国は、障害者が、最大限の自立並びに十分な身体的、精神的、社会的及び職業的な能力を達成し、及び維持し、並びに生活のあらゆる側面への完全な包容及び参加を達成し、及び維持することを可能とするための効果的かつ適当な措置（障害者相互による支援を通じたものを含む。）をとる。このため、締約国は、特に、保健、雇用、教育及び社会に係るサービスの分野において、ハビリテーション及びリハビリテーションについての包括的なサービス及びプログラムを企画し、強化し、及び拡張する。この場合において、これらのサービス及びプログラムは、次のようなものとする。

（a） 可能な限り初期の段階において開始し、並びに個人のニーズ及び長所に関する学際的な評価を基礎とするものであること。

（b） 地域社会及び社会のあらゆる側面への参加及び包容を支援し、自発的なものであり、並びに障害者自身が属する地域社会（農村を含む。）の可能な限り近くにおいて利用可能なものであること。

２ 締約国は、ハビリテーション及びリハビリテーションのサービスに従事する専門家及び職員に対する初期研修及び継続的な研修の充実を促進する。

３ 締約国は、障害者のために設計された補装具及び支援機器であって、ハビリテーション及びリハビリテーションに関連するものの利用可能性、知識及び使用を促進する。

第二十七条 労働及び雇用

１ 締約国は、障害者が他の者との平等を基礎として労働についての権利を有することを認める。この権利には、障害者に対して開放され、障害者を包容し、及び障害者にとって利用しやすい労働市場及び労働環境において、障害者が自由に選択し、又は承諾する労働によって生計を立てる機会を有する権利を含む。締約国は、特に次のことのための適当な措置（立法によるものを含む。）をとることにより、労働についての障害者（雇用の過程で障害を有することとなった者を含む。）の権利が実現されることを保障し、及び促進する。

（a） あらゆる形態の雇用に係る全ての事項（募集、採用及び雇用の条件、雇用の継続、昇進並びに安全かつ健康的な作業条件を含む。）に関し、障害に基づく差別を禁止すること。

（b） 他の者との平等を基礎として、公正かつ良好な労働条件（均等な機会及び同一価値の労働についての同一報酬を含む。）、安全かつ健康的な作業条件（嫌がらせからの保護を含む。）及び苦情に対する救済についての障害者の権利を保護すること。

rights, dignity, autonomy and needs of persons with disabilities through training and the promulgation of ethical standards for public and private health care;

(e) Prohibit discrimination against persons with disabilities in the provision of health insurance, and life insurance where such insurance is permitted by national law, which shall be provided in a fair and reasonable manner;

(f ) Prevent discriminatory denial of health care or health services or food and fluids on the basis of disability.

Article 26 Habilitation and rehabilitation

1. States Parties shall take effective and appropriate measures, including through peer support, to enable persons with disabilities to attain and maintain maximum independence, full physical, mental, social and vocational ability, and full inclusion and participation in all aspects of life. To that end, States Parties shall organize, strengthen and extend comprehensive habilitation and rehabilitation services and programmes, particularly in the areas of health, employment, education and social services, in such a way that these services and programmes:

(a) Begin at the earliest possible stage, and are based on the multidisciplinary assessment of individual needs and strengths;

(b) Support participation and inclusion in the community and all aspects of society, are voluntary, and are available to persons with disabilities as close as possible to their own communities, including in rural areas.

2. States Parties shall promote the development of initial and continuing training for professionals and staff working in habilitation and rehabilitation services.

3. States Parties shall promote the availability, knowledge and use of assistive devices and technologies, designed for persons with disabilities, as they relate to habilitation and rehabilitation.

Article 27 Work and employment

1. States Parties recognize the right of persons with disabilities to work, on an equal basis with others; this includes the right to the opportunity to gain a living by work freely chosen or accepted in a labour market and work environment that is open, inclusive and accessible to persons with disabilities. States Parties shall safeguard and promote the realization of the right to work, including for those who acquire a disability during the course of employment, by taking appropriate steps, including through legislation, to, inter alia:

(a) Prohibit discrimination on the basis of disability with regard to all matters concerning all forms of employment, including conditions of recruitment, hiring and employment, continuance of employment, career advancement and safe and healthy working conditions;

(b) Protect the rights of persons with disabilities, on an equal basis with others, to just and favourable conditions of work, including equal opportunities and equal remuneration for work of equal value, safe and healthy working conditions, including protection from harassment, and the redress of grievances;

（c） 障害者が他の者との平等を基礎として労働及び労働組合についての権利を行使することができることを確保すること。

（d） 障害者が技術及び職業の指導に関する一般的な計画、職業紹介サービス並びに職業訓練及び継続的な訓練を利用する効果的な機会を有することを可能とすること。

（e） 労働市場において障害者の雇用機会の増大を図り、及びその昇進を促進すること並びに職業を求め、これに就き、これを継続し、及びこれに復帰する際の支援を促進すること。

（f） 自営活動の機会、起業家精神、協同組合の発展及び自己の事業の開始を促進すること。

（g） 公的部門において障害者を雇用すること。

（h） 適当な政策及び措置（積極的差別是正措置、奨励措置その他の措置を含めることができる。）を通じて、民間部門における障害者の雇用を促進すること。

（i） 職場において合理的配慮が障害者に提供されることを確保すること。

（j） 開かれた労働市場において障害者が職業経験を得ることを促進すること。

（k） 障害者の職業リハビリテーション、職業の保持及び職場復帰計画を促進すること。

２ 締約国は、障害者が、奴隷の状態又は隷属状態に置かれないこと及び他の者との平等を基礎として強制労働から保護されることを確保する。

第二十八条 相当な生活水準及び社会的な保障

１ 締約国は、障害者が、自己及びその家族の相当な生活水準（相当な食糧、衣類及び住居を含む。）についての権利並びに生活条件の不断の改善についての権利を有することを認めるものとし、障害に基づく差別なしにこの権利を実現することを保障し、及び促進するための適当な措置をとる。

２ 締約国は、社会的な保障についての障害者の権利及び障害に基づく差別なしにこの権利を享受することについての障害者の権利を認めるものとし、この権利の実現を保障し、及び促進するための適当な措置をとる。この措置には、次のことを確保するための措置を含む。

（a） 障害者が清浄な水のサービスを利用する均等な機会を有し、及び障害者が障害に関連するニーズに係る適当なかつ費用の負担しやすいサービス、補装具その他の援助を利用する機会を有すること。

（b） 障害者（特に、障害のある女子及び高齢者）が社会的な保障及び貧困削減に関する計画を利用する機会を有すること。

（c） 貧困の状況において生活している障害者及びその家族が障害に関連する費用についての国の援助（適当な研修、カウンセリング、財政的援助及び介護者の休息のための一時的な介護を含む。）を利用する機会を有すること。

（d） 障害者が公営住宅計画を利用する機会を有すること。

（e） 障害者が退職に伴う給付及び計画を利用する均等な機会を有すること。

(c) Ensure that persons with disabilities are able to exercise their labour and trade union rights on an equal basis with others;

(d) Enable persons with disabilities to have effective access to general technical and vocational guidance programmes, placement services and vocational and continuing training;

(e) Promote employment opportunities and career advancement for persons with disabilities in the labour market, as well as assistance in finding, obtaining, maintaining and returning to employment;

(f) Promote opportunities for self-employment, entrepreneurship, the development of cooperatives and starting one’s own business;

(g) Employ persons with disabilities in the public sector;

(h) Promote the employment of persons with disabilities in the private sector through appropriate policies and measures, which may include affirmative action programmes, incentives and other measures;

(i) Ensure that reasonable accommodation is provided to persons with disabilities in the workplace;

(j) Promote the acquisition by persons with disabilities of work experience in the open labour market;

(k) Promote vocational and professional rehabilitation, job retention and return-to-work programmes for persons with disabilities.

2. States Parties shall ensure that persons with disabilities are not held in slavery or in servitude, and are protected, on an equal basis with others, from forced or compulsory labour.

Article 28 Adequate standard of living and social protection

1. States Parties recognize the right of persons with disabilities to an adequate standard of living for themselves and their families, including adequate food, clothing and housing, and to the continuous improvement of living conditions, and shall take appropriate steps to safeguard and promote the realization of this right without discrimination on the basis of disability.

2. States Parties recognize the right of persons with disabilities to social protection and to the enjoyment of that right without discrimination on the basis of disability, and shall take appropriate steps to safeguard and promote the realization of this right, including measures:

(a) To ensure equal access by persons with disabilities to clean water services, and to ensure access to appropriate and affordable services, devices and other assistance for disability-related needs;

(b) To ensure access by persons with disabilities, in particular women and girls with disabilities and older persons with disabilities, to social protection programmes and poverty reduction programmes;

(c) To ensure access by persons with disabilities and their families living in situations of poverty to assistance from the State with disabilityrelated expenses, including adequate training, counselling, financial assistance and respite care;

(d) To ensure access by persons with disabilities to public housing programmes;

(e) To ensure equal access by persons with disabilities to retirement benefits and programmes.

第二十九条 政治的及び公的活動への参加

締約国は、障害者に対して政治的権利を保障し、及び他の者との平等を基礎としてこの権利を享受する機会を保障するものとし、次のことを約束する。

（a） 特に次のことを行うことにより、障害者が、直接に、又は自由に選んだ代表者を通じて、他の者との平等を基礎として、政治的及び公的活動に効果的かつ完全に参加することができること（障害者が投票し、及び選挙される権利及び機会を含む。）を確保すること。

（i） 投票の手続、設備及び資料が適当な及び利用しやすいものであり、並びにその理解及び使用が容易であることを確保すること。

（ii） 障害者が、選挙及び国民投票において脅迫を受けることなく秘密投票によって投票し、選挙に立候補し、並びに政府のあらゆる段階において実質的に在職し、及びあらゆる公務を遂行する権利を保護すること。この場合において、適当なときは支援機器及び新たな機器の使用を容易にするものとする。

（iii）選挙人としての障害者の意思の自由な表明を保障すること。このため、必要な場合には、障害者の要請に応じて、当該障害者により選択される者が投票の際に援助することを認めること。

（b） 障害者が、差別なしに、かつ、他の者との平等を基礎として、政治に効果的かつ完全に参加することができる環境を積極的に促進し、及び政治への障害者の参加を奨励すること。政治への参加には、次のことを含む。

（i） 国の公的及び政治的活動に関係のある非政府機関及び非政府団体に参加し、並びに政党の活動及び運営に参加すること。

（ii） 国際、国内、地域及び地方の各段階において障害者を代表するための障害者の組織を結成し、並びにこれに参加すること。

第三十条 文化的な生活、レクリエーション、余暇及びスポーツへの参加

１ 締約国は、障害者が他の者との平等を基礎として文化的な生活に参加する権利を認めるものとし、次のことを確保するための全ての適当な措置をとる。

（a） 障害者が、利用しやすい様式を通じて、文化的な作品を享受する機会を有すること。

（b） 障害者が、利用しやすい様式を通じて、テレビジョン番組、映画、演劇その他の文化的な活動を享受する機会を有すること。

（c） 障害者が、文化的な公演又はサービスが行われる場所（例えば、劇場、博物館、映画館、図書館、観光サービス）を利用する機会を有し、並びに自国の文化的に重要な記念物及び場所を享受する機会をできる限り有すること。

２ 締約国は、障害者が、自己の利益のためのみでなく、社会を豊かにするためにも、自己の創造的、芸術的及び知的な潜在能力を開発し、及び活用する機会を有することを可能とするための適当な措置をとる。

３ 締約国は、国際法に従い、知的財産権を保護する法律が、障害者が文化的な作品を享受する機会を妨げる不当な又は差別的な障壁とならないことを確保するための全ての適当な措置を

Article 29 Participation in political and public life

States Parties shall guarantee to persons with disabilities political rights and the opportunity to enjoy them on an equal basis with others, and shall undertake:

(a) To ensure that persons with disabilities can effectively and fully participate in political and public life on an equal basis with others, directly or through freely chosen representatives, including the right and opportunity for persons with disabilities to vote and be elected, inter alia, by:

(i) Ensuring that voting procedures, facilities and materials are appropriate, accessible and easy to understand and use;

(ii) Protecting the right of persons with disabilities to vote by secret ballot in elections and public referendums without intimidation, and to stand for elections, to effectively hold office and perform all public functions at all levels of government, facilitating the use of assistive and new technologies where appropriate;

(iii) Guaranteeing the free expression of the will of persons with disabilities as electors and to this end, where necessary, at their request, allowing assistance in voting by a person of their own choice;

(b) To promote actively an environment in which persons with disabilities can effectively and fully participate in the conduct of public affairs, without discrimination and on an equal basis with others, and encourage their participation in public affairs, including:

(i) Participation in non-governmental organizations and associations concerned with the public and political life of the country, and in the activities and administration of political parties;

(ii) Forming and joining organizations of persons with disabilities to represent persons with disabilities at international, national, regional and local levels.

Article 30 Participation in cultural life, recreation, leisure and sport

1. States Parties recognize the right of persons with disabilities to take part on an equal basis with others in cultural life, and shall take all appropriate measures to ensure that persons with disabilities:

(a) Enjoy access to cultural materials in accessible formats;

(b) Enjoy access to television programmes, films, theatre and other cultural activities, in accessible formats;

(c) Enjoy access to places for cultural performances or services, such as theatres, museums, cinemas, libraries and tourism services, and, as far as possible, enjoy access to monuments and sites of national cultural importance.

2. States Parties shall take appropriate measures to enable persons with disabilities to have the opportunity to develop and utilize their creative, artistic and intellectual potential, not only for their own benefit, but also for the enrichment of society.

3. States Parties shall take all appropriate steps, in accordance with international law, to ensure that laws protecting intellectual property rights do not constitute an unreasonable or discriminatory barrier to access by persons with disabilities to cultural materials.

（c） 障害者がスポーツ、レクリエーション及び観光の場所を利用する機会を有することを確保すること。

（d） 障害のある児童が遊び、レクリエーション、余暇及びスポーツの活動（学校制度におけるこれらの活動を含む。）への参加について他の児童と均等な機会を有することを確保すること。

（e） 障害者がレクリエーション、観光、余暇及びスポーツの活動の企画に関与する者によるサービスを利用する機会を有することを確保すること。

第三十一条 統計及び資料の収集

１ 締約国は、この条約を実効的なものとするための政策を立案し、及び実施することを可能とするための適当な情報（統計資料及び研究資料を含む。）を収集することを約束する。この情報を収集し、及び保持する過程においては、次のことを満たさなければならない。

（a） 障害者の秘密の保持及びプライバシーの尊重を確保するため、法令に定める保障措置（資料の保護に関する法令を含む。）を遵守すること。

（b） 人権及び基本的自由を保護するための国際的に受け入れられた規範並びに統計の収集及び利用に関する倫理上の原則を遵守すること。

２ この条の規定に従って収集された情報は、適宜分類されるものとし、この条約に基づく締約国の義務の履行の評価に役立てるために、並びに障害者がその権利を行使する際に直面する障壁を特定し、及び当該障壁に対処するために利用される。

３ 締約国は、これらの統計の普及について責任を負うものとし、これらの統計が障害者及び他の者にとって利用しやすいことを確保する。

第三十二条 国際協力

１ 締約国は、この条約の目的及び趣旨を実現するための自国の努力を支援するために国際協力及びその促進が重要であることを認識し、この点に関し、国家間において並びに適当な場合には関連のある国際的及び地域的機関並びに市民社会（特に障害者の組織）と連携して、適当かつ効果的な措置をとる。これらの措置には、特に次のことを含むことができる。

（a） 国際協力（国際的な開発計画を含む。）が、障害者を包容し、かつ、障害者にとって利用しやすいものであることを確保すること。

4. Persons with disabilities shall be entitled, on an equal basis with others, to recognition and support of their specific cultural and linguistic identity, including sign languages and deaf culture.

5. With a view to enabling persons with disabilities to participate on an equal basis with others in recreational, leisure and sporting activities, States Parties shall take appropriate measures:

(a) To encourage and promote the participation, to the fullest extent possible, of persons with disabilities in mainstream sporting activities at all levels;

(b) To ensure that persons with disabilities have an opportunity to organize, develop and participate in disability-specific sporting and recreational activities and, to this end, encourage the provision, on an equal basis with others, of appropriate instruction, training and resources;

(c) To ensure that persons with disabilities have access to sporting, recreational and tourism venues;

(d) To ensure that children with disabilities have equal access with other children to participation in play, recreation and leisure and sporting activities, including those activities in the school system;

(e) To ensure that persons with disabilities have access to services from those involved in the organization of recreational, tourism, leisure and sporting activities.

Article 31 Statistics and data collection

1. States Parties undertake to collect appropriate information, including statistical and research data, to enable them to formulate and implement policies to give effect to the present Convention. The process of collecting and maintaining this information shall:

(a) Comply with legally established safeguards, including legislation on data protection, to ensure confidentiality and respect for the privacy of persons with disabilities;

(b) Comply with internationally accepted norms to protect human rights and fundamental freedoms and ethical principles in the collection and use of statistics.

2. The information collected in accordance with this article shall be disaggregated, as appropriate, and used to help assess the implementation of States Parties’ obligations under the present Convention and to identify and address the barriers faced by persons with disabilities in exercising their rights.

3. States Parties shall assume responsibility for the dissemination of these statistics and ensure their accessibility to persons with disabilities and others.

Article 32 International cooperation

1. States Parties recognize the importance of international cooperation and its promotion, in support of national efforts for the realization of the purpose and objectives of the present Convention, and will undertake appropriate and effective measures in this regard, between and among States and, as appropriate, in partnership with relevant international and regional organizations and civil society, in particular organizations of persons with disabilities. Such measures could include, inter alia:

(a) Ensuring that international cooperation, including international development programmes, is inclusive of and accessible to persons with disabilities;

２ この条の規定は、この条約に基づく義務を履行する各締約国の義務に影響を及ぼすものではない。

第三十三条 国内における実施及び監視

１ 締約国は、自国の制度に従い、この条約の実施に関連する事項を取り扱う一又は二以上の中央連絡先を政府内に指定する。また、締約国は、異なる部門及び段階における関連のある活動を容易にするため、政府内における調整のための仕組みの設置又は指定に十分な考慮を払う。

２ 締約国は、自国の法律上及び行政上の制度に従い、この条約の実施を促進し、保護し、及び監視するための枠組み（適当な場合には、一又は二以上の独立した仕組みを含む。）を自国内において維持し、強化し、指定し、又は設置する。締約国は、このような仕組みを指定し、又は設置する場合には、人権の保護及び促進のための国内機構の地位及び役割に関する原則を考慮に入れる。

３ 市民社会（特に、障害者及び障害者を代表する団体）は、監視の過程に十分に関与し、かつ、参加する。

第三十四条 障害者の権利に関する委員会

１ 障害者の権利に関する委員会（以下「委員会」という。）を設置する。委員会は、以下に定める任務を遂行する。

２ 委員会は、この条約の効力発生の時は十二人の専門家で構成する。効力発生の時の締約国に加え更に六十の国がこの条約を批准し、又はこれに加入した後は、委員会の委員の数を六人増加させ、上限である十八人とする。

３ 委員会の委員は、個人の資格で職務を遂行するものとし、徳望が高く、かつ、この条約が対象とする分野において能力及び経験を認められた者とする。締約国は、委員の候補者を指名するに当たり、第四条３の規定に十分な考慮を払うよう要請される。

４ 委員会の委員については、締約国が、委員の配分が地理的に衡平に行われること、異なる文明形態及び主要な法体系が代表されること、男女が衡平に代表されること並びに障害のある専門家が参加することを考慮に入れて選出する。

５ 委員会の委員は、締約国会議の会合において、締約国により当該締約国の国民の中から指名された者の名簿の中から秘密投票により選出される。締約国会議の会合は、締約国の三分の二をもって定足数とする。これらの会合においては、出席し、かつ、投票する締約国の代表によって投じられた票の最多数で、かつ、過半数の票を得た者をもって委員会に選出された委員とする。

(b) Facilitating and supporting capacity-building, including through the exchange and sharing of information, experiences, training programmes and best practices;

(c) Facilitating cooperation in research and access to scientific and technical knowledge;

(d) Providing, as appropriate, technical and economic assistance, including by facilitating access to and sharing of accessible and assistive technologies, and through the transfer of technologies.

2. The provisions of this article are without prejudice to the obligations of each State Party to fulfil its obligations under the present Convention.

Article 33 National implementation and monitoring

1. States Parties, in accordance with their system of organization, shall designate one or more focal points within government for matters relating to the implementation of the present Convention, and shall give due consideration to the establishment or designation of a coordination mechanism within government to facilitate related action in different sectors and at different levels.

2. States Parties shall, in accordance with their legal and administrative systems, maintain, strengthen, designate or establish within the State Party, a framework, including one or more independent mechanisms, as appropriate, to promote, protect and monitor implementation of the present Convention. When designating or establishing such a mechanism, States Parties shall take into account the principles relating to the status and functioning of national institutions for protection and promotion of human rights.

3. Civil society, in particular persons with disabilities and their representative organizations, shall be involved and participate fully in the monitoring process.

Article 34 Committee on the Rights of Persons with Disabilities

1. There shall be established a Committee on the Rights of Persons with Disabilities (hereafter referred to as “the Committee”), which shall carry out the functions hereinafter provided.

2. The Committee shall consist, at the time of entry into force of the present Convention, of twelve experts. After an additional sixty ratifications or accessions to the Convention, the membership of the Committee shall increase by six members, attaining a maximum number of eighteen members.

3. The members of the Committee shall serve in their personal capacity and shall be of high moral standing and recognized competence and experience in the field covered by the present Convention. When nominating their candidates, States Parties are invited to give due consideration to the provision set out in article 4, paragraph 3, of the present Convention.

4. The members of the Committee shall be elected by States Parties, consideration being given to equitable geographical distribution, representation of the different forms of civilization and of the principal legal systems, balanced gender representation and participation of experts with disabilities.

5. The members of the Committee shall be elected by secret ballot from a list of persons nominated by the States Parties from among their nationals at meetings of the Conference of States Parties. At those meetings, for which two thirds of States Parties shall constitute a quorum, the persons elected to the Committee shall be those who obtain the largest number of votes and an absolute majority of the votes of the representatives of States Parties present and voting.

８ 委員会の六人の追加的な委員の選挙は、この条の関連規定に従って定期選挙の際に行われる。

９ 委員会の委員が死亡し、辞任し、又は他の理由のためにその職務を遂行することができなくなったことを宣言した場合には、当該委員を指名した締約国は、残余の期間その職務を遂行する他の専門家であって、資格を有し、かつ、この条の関連規定に定める条件を満たすものを任命する。

10 委員会は、その手続規則を定める。

11 国際連合事務総長は、委員会がこの条約に定める任務を効果的に遂行するために必要な職員及び便益を提供するものとし、委員会の最初の会合を招集する。

12 この条約に基づいて設置される委員会の委員は、国際連合総会が委員会の任務の重要性を考慮して決定する条件に従い、同総会の承認を得て、国際連合の財源から報酬を受ける。

13 委員会の委員は、国際連合の特権及び免除に関する条約の関連規定に規定する国際連合のための職務を遂行する専門家の便益、特権及び免除を享受する。

第三十五条 締約国による報告

１ 各締約国は、この条約に基づく義務を履行するためにとった措置及びこれらの措置によりもたらされた進歩に関する包括的な報 を、この条約が自国について効力を生じた後二年以内に国際連合事務総長を通じて委員会に提出する。

２ その後、締約国は、少なくとも四年ごとに、更に委員会が要請するときはいつでも、その後の報 を提出する。

３ 委員会は、報 の内容について適用される指針を決定する。

４ 委員会に対して包括的な最初の報 を提出した締約国は、その後の報 においては、既に提供した情報を繰り返す必要はない。締約国は、委員会に対する報 を作成するに当たり、公開され、かつ、透明性のある過程において作成することを検討し、及び第四条３の規定に十分な考慮を払うよう要請される。

５ 報 には、この条約に基づく義務の履行の程度に影響を及ぼす要因及び困難を記載することができる。

6. The initial election shall be held no later than six months after the date of entry into force of the present Convention. At least four months before the date of each election, the Secretary-General of the United Nations shall address a letter to the States Parties inviting them to submit the nominations within two months. The Secretary-General shall subsequently prepare a list in alphabetical order of all persons thus nominated, indicating the State Parties which have nominated them, and shall submit it to the States Parties to the present Convention.

7. The members of the Committee shall be elected for a term of four years. They shall be eligible for re-election once. However, the term of six of the members elected at the first election shall expire at the end of two years; immediately after the first election, the names of these six members shall be chosen by lot by the chairperson of the meeting referred to in paragraph 5 of this article.

8. The election of the six additional members of the Committee shall be held on the occasion of regular elections, in accordance with the relevant provisions of this article.

9. If a member of the Committee dies or resigns or declares that for any other cause she or he can no longer perform her or his duties, the State Party which nominated the member shall appoint another expert possessing the qualifications and meeting the requirements set out in the relevant provisions of this article, to serve for the remainder of the term.

10. The Committee shall establish its own rules of procedure.

11. The Secretary-General of the United Nations shall provide the necessary staff and facilities for the effective performance of the functions of the Committee under the present Convention, and shall convene its initial meeting.

12. With the approval of the General Assembly of the United Nations, the members of the Committee established under the present Convention shall receive emoluments from United Nations resources on such terms and conditions as the Assembly may decide, having regard to the importance of the Committee’s responsibilities.

13. The members of the Committee shall be entitled to the facilities, privileges and immunities of experts on mission for the United Nations as laid down in the relevant sections of the Convention on the Privileges and Immunities of the United Nations.

Article 35 Reports by States Parties

1. Each State Party shall submit to the Committee, through the Secretary-General of the United Nations, a comprehensive report on measures taken to give effect to its obligations under the present Convention and on the progress made in that regard, within two years after the entry into force of the present Convention for the State Party concerned.

2. Thereafter, States Parties shall submit subsequent reports at least every four years and further whenever the Committee so requests.

3. The Committee shall decide any guidelines applicable to the content of the reports.

4. A State Party which has submitted a comprehensive initial report to the Committee need not, in its subsequent reports, repeat information previously provided. When preparing reports to the Committee, States Parties are invited to consider doing so in an open and transparent process and to give due consideration to the provision set out in article 4, paragraph 3, of the present Convention.

5. Reports may indicate factors and difficulties affecting the degree of fulfilment of obligations under the present Convention.

２ いずれかの締約国による報 の提出が著しく遅延している場合には、委員会は、委員会にとって利用可能な信頼し得る情報を基礎として当該締約国におけるこの条約の実施状況を審査することが必要であることについて当該締約国に通報（当該通報には、関連する報 が当該通報の後三箇月以内に行われない場合には審査する旨を含む。）を行うことができる。委員会は、当該締約国がその審査に参加するよう要請する。当該締約国が関連する報 を提出することにより回答する場合には、

１の規定を適用する。

３ 国際連合事務総長は、１の報 を全ての締約国が利用することができるようにする。

４ 締約国は、１の報 を自国において公衆が広く利用することができるようにし、これらの報 に関連する提案及び一般的な性格を有する勧 を利用する機会を得やすくする。

５ 委員会は、適当と認める場合には、締約国からの報 に記載されている技術的な助言若しくは援助の要請又はこれらの必要性の記載に対処するため、これらの要請又は必要性の記載に関する委員会の見解及び勧 がある場合には当該見解及び勧とともに、国際連合の専門機関、基金及び計画その他の権限

のある機関に当該報 を送付する。

第三十七条 締約国と委員会との間の協力

１ 各締約国は、委員会と協力するものとし、委員の任務の遂行を支援する。

２ 委員会は、締約国との関係において、この条約の実施のための当該締約国の能力を向上させる方法及び手段（国際協力を通じたものを含む。）に十分な考慮を払う。

第三十八条 委員会と他の機関との関係

この条約の効果的な実施を促進し、及びこの条約が対象とする分野における国際協力を奨励するため、

（a） 専門機関その他の国際連合の機関は、その任務の範囲内にある事項に関するこの条約の規定の実施についての検討に際し、代表を出す権利を有する。委員会は、適当と認める場合には、専門機関その他の権限のある機関に対し、これらの機関の任務の範囲内にある事項に関するこの条約の実施について専門家の助言を提供するよう要請することができる。委員会は、専門機関その他の国際連合の機関に対し、これらの機関の任務の範囲内にある事項に関するこの条約の実施について報 を提出するよう要請することができる。

（b） 委員会は、その任務を遂行するに当たり、それぞれの報 に係る指針、提案及び一般的な性格を有する勧 の整合性を確保し、並びにその任務の遂行における重複を避けるため、適当な場合には、人権に関する国際条約によって設置され

Article 36 Consideration of reports

1. Each report shall be considered by the Committee, which shall make such suggestions and general recommendations on the report as it may consider appropriate and shall forward these to the State Party concerned. The State Party may respond with any information it chooses to the Committee. The Committee may request further information from States Parties relevant to the implementation of the present Convention.

2. If a State Party is significantly overdue in the submission of a report, the Committee may notify the State Party concerned of the need to examine the implementation of the present Convention in that State Party, on the basis of reliable information available to the Committee, if the relevant report is not submitted within three months following the notification. The Committee shall invite the State Party concerned to participate in such examination. Should the State Party respond by submitting the relevant report, the provisions of paragraph 1 of this article will apply.

3. The Secretary-General of the United Nations shall make available the reports to all States Parties.

4. States Parties shall make their reports widely available to the public in their own countries and facilitate access to the suggestions and general recommendations relating to these reports.

5. The Committee shall transmit, as it may consider appropriate, to the specialized agencies, funds and programmes of the United Nations, and other competent bodies, reports from States Parties in order to address a request or indication of a need for technical advice or assistance contained therein, along with the Committee’s observations and recommendations, if any, on these requests or indications.

Article 37 Cooperation between States Parties and the Committee

1. Each State Party shall cooperate with the Committee and assist its members in the fulfilment of their mandate.

2. In its relationship with States Parties, the Committee shall give due consideration to ways and means of enhancing national capacities for the implementation of the present Convention, including through international cooperation.

Article 38 Relationship of the Committee with other bodies

In order to foster the effective implementation of the present Convention and to encourage international cooperation in the field covered by the present Convention:

(a) The specialized agencies and other United Nations organs shall be entitled to be represented at the consideration of the implementation of such provisions of the present Convention as fall within the scope of their mandate. The Committee may invite the specialized agencies and other competent bodies as it may consider appropriate to provide expert advice on the implementation of the Convention in areas falling within the scope of their respective mandates. The Committee may invite specialized agencies and other United Nations organs to submit reports on the implementation of the Convention in areas falling within the scope of their activities;

(b) The Committee, as it discharges its mandate, shall consult, as appropriate, other relevant bodies instituted by international human rights treaties, with a view to ensuring the consistency of their respective reporting guidelines, suggestions and general recommendations, and avoiding duplication and overlap in the

委員会は、その活動につき二年ごとに国際連合総会及び経済社会理事会に報 するものとし、また、締約国から得た報 及び情報の検討に基づく提案及び一般的な性格を有する勧 を行うことができる。これらの提案及び一般的な性格を有する勧 は、締約国から意見がある場合にはその意見とともに、委員会の報 に記載する。

第四十条 締約国会議

１ 締約国は、この条約の実施に関する事項を検討するため、定期的に締約国会議を開催する。

２ 締約国会議は、この条約が効力を生じた後六箇月以内に国際連合事務総長が招集する。その後の締約国会議は、二年ごとに又は締約国会議の決定に基づき同事務総長が招集する。

第四十一条 寄託者

この条約の寄託者は、国際連合事務総長とする。

第四十二条 署名

この条約は、二千七年三月三十日から、ニューヨークにある国際連合本部において、全ての国及び地域的な統合のための機関による署名のために開放しておく。

第四十三条 拘束されることについての同意

この条約は、署名国によって批准されなければならず、また、署名した地域的な統合のための機関によって正式確認されなければならない。この条約は、これに署名していない国及び地域的な統合のための機関による加入のために開放しておく。

第四十四条 地域的な統合のための機関

１ 「地域的な統合のための機関」とは、特定の地域の主権国家によって構成される機関であって、この条約が規律する事項に関してその構成国から権限の委譲を受けたものをいう。地域的な統合のための機関は、この条約の規律する事項に関するその権限の範囲をこの条約の正式確認書又は加入書において宣言する。その後、当該機関は、その権限の範囲の実質的な変更を寄託者に通報する。

２ この条約において「締約国」についての規定は、地域的な統合のための機関の権限の範囲内で当該機関について適用する。

３ 次条１並びに第四十七条２及び３の規定の適用上、地域的な統合のための機関が寄託する文書は、これを数に加えてはならない。

４ 地域的な統合のための機関は、その権限の範囲内の事項について、この条約の締約国であるその構成国の数と同数の票を締約国会議において投ずる権利を行使することができる。当該機関は、その構成国が自国の投票権を行使する場合には、投票権を行使してはならない。その逆の場合も、同様とする。

第四十五条 効力発生

１ この条約は、二十番目の批准書又は加入書が寄託された後三十日目の日に効力を生ずる。

Article 39 Report of the Committee

The Committee shall report every two years to the General Assembly and to the Economic and Social Council on its activities, and may make suggestions and general recommendations based on the examination of reports and information received from the States Parties. Such suggestions and general recommendations shall be included in the report of the Committee together with comments, if any, from States Parties.

Article 40 Conference of States Parties

1. The States Parties shall meet regularly in a Conference of States Parties in order to consider any matter with regard to the implementation of the present Convention.

2. No later than six months after the entry into force of the present Convention, the Conference of States Parties shall be convened by the Secretary-General of the United Nations. The subsequent meetings shall be convened by the Secretary-General biennially or upon the decision of the Conference of States Parties.

Article 41 Depositary

The Secretary-General of the United Nations shall be the depositary of the present Convention.

Article 42 Signature

The present Convention shall be open for signature by all States and by regional integration organizations at United Nations Headquarters in New York as of 30 March 2007.

Article 43 Consent to be bound

The present Convention shall be subject to ratification by signatory States and to formal confirmation by signatory regional integration organizations. It shall be open for accession by any State or regional integration organization which has not signed the Convention.

Article 44 Regional integration organizations

1. “Regional integration organization” shall mean an organization constituted by sovereign States of a given region, to which its member States have transferred competence in respect of matters governed by the present Convention. Such organizations shall declare, in their instruments of formal confirmation or accession, the extent of their competence with respect to matters governed by the present Convention. Subsequently, they shall inform the depositary of any substantial modification in the extent of their competence.

2. References to “States Parties” in the present Convention shall apply to such organizations within the limits of their competence.

3. For the purposes of article 45, paragraph 1, and article 47, paragraphs 2 and 3, of the present Convention, any instrument deposited by a regional integration organization shall not be counted.

4. Regional integration organizations, in matters within their competence, may exercise their right to vote in the Conference of States Parties, with a number of votes equal to the number of their member States that are Parties to the present Convention. Such an organization shall not exercise its right to vote if any of its member States exercises its right, and vice versa.

Article 45 Entry into force

1. The present Convention shall enter into force on the thirtieth day after the deposit of the twentieth instrument of ratification or accession.

２ この条約は、二十番目の批准書又は加入書が寄託された後にこれを批准し、若しくは正式確認し、又はこれに加入する国又は地域的な統合のための機関については、その批准書、正式確認書又は加入書の寄託の後三十日目の日に効力を生ずる。

第四十六条 留保

１ この条約の趣旨及び目的と両立しない留保は、認められない。

２ 留保は、いつでも撤回することができる。

第四十七条 改正

１ いずれの締約国も、この条約の改正を提案し、及び改正案を国際連合事務総長に提出することができる。同事務総長は、締約国に対し、改正案を送付するものとし、締約国による改正案の審議及び決定のための締約国の会議の開催についての賛 を通報するよう要請する。その送付の日から四箇月以内に締約国の三分の一以上が会議の開催に賛成する場合には、同事務総長は、国際連合の主催の下に会議を招集する。会議において出席し、かつ、投票する締約国の三分の二以上の多数によって採択された改正案は、同事務総長により、承認のために国際連合総会に送付され、その後受諾のために全ての締約国に送付される。

２ １の規定により採択され、かつ、承認された改正は、当該改正の採択の日における締約国の三分の二以上が受諾書を寄託した後三十日目の日に効力を生ずる。その後は、当該改正は、いずれの締約国についても、その受諾書の寄託の後三十日目の日に効力を生ずる。改正は、それを受諾した締約国のみを拘束する。

３ 締約国会議がコンセンサス方式によって決定する場合には、

１の規定により採択され、かつ、承認された改正であって、第三十四条及び第三十八条から第四十条までの規定にのみ関連するものは、当該改正の採択の日における締約国の三分の二以上が受諾書を寄託した後三十日目の日に全ての締約国について効力を生ずる。

第四十八条 廃棄

締約国は、国際連合事務総長に対して書面による通 を行うことにより、この条約を廃棄することができる。廃棄は、同事務総長がその通 を受領した日の後一年で効力を生ずる。

第四十九条 利用しやすい様式

この条約の本文は、利用しやすい様式で提供される。

第五十条 正文

この条約は、アラビア語、中国語、英語、フランス語、ロシア語及びスペイン語をひとしく正文とする。

以上の証拠として、下名の全権委員は、各自の政府から正当に委任を受けてこの条約に署名した。

2. For each State or regional integration organization ratifying, formally confirming or acceding to the present Convention after the deposit of the twentieth such instrument, the Convention shall enter into force on the thirtieth day after the deposit of its own such instrument.

Article 46 Reservations

1. Reservations incompatible with the object and purpose of the present Convention shall not be permitted.

2. Reservations may be withdrawn at any time.

Article 47 Amendments

1. Any State Party may propose an amendment to the present Convention and submit it to the Secretary-General of the United Nations. The Secretary-General shall communicate any proposed amendments to States Parties, with a request to be notified whether they favour a conference of States Parties for the purpose of considering and deciding upon the proposals. In the event that, within four months from the date of such communication, at least one third of the States Parties favour such a conference, the Secretary-General shall convene the conference under the auspices of the United Nations. Any amendment adopted by a majority of two thirds of the States Parties present and voting shall be submitted by the Secretary-General to the General Assembly of the United Nations for approval and thereafter to all States Parties for acceptance.

2. An amendment adopted and approved in accordance with paragraph 1 of this article shall enter into force on the thirtieth day after the number of instruments of acceptance deposited reaches two thirds of the number of States Parties at the date of adoption of the amendment. Thereafter, the amendment shall enter into force for any State Party on the thirtieth day following the deposit of its own instrument of acceptance. An amendment shall be binding only on those States Parties which have accepted it.

3. If so decided by the Conference of States Parties by consensus, an amendment adopted and approved in accordance with paragraph 1 of this article which relates exclusively to articles 34, 38, 39 and 40 shall enter into force for all States Parties on the thirtieth day after the number of instruments of acceptance deposited reaches two thirds of the number of States Parties at the date of adoption of the amendment.

Article 48 Denunciation

A State Party may denounce the present Convention by written notification to the Secretary-General of the United Nations. The denunciation shall become effective one year after the date of receipt of the notification by the Secretary-General.

Article 49 Accessible format

The text of the present Convention shall be made available in accessible formats.

Article 50 Authentic texts

The Arabic, Chinese, English, French, Russian and Spanish texts of the present Convention shall be equally authentic.

IN WITNESS THEREOF the undersigned plenipotentiaries, being duly authorized thereto by their respective Governments, have signed the present Convention.
