(1) 고객의 요청이 있는 경우, 은행은 해당 공개가 금융실명거래 및 비밀보장에 관한 법률 등 기타 법령 및 규정과 상충하지 않는 범위 내에서 고객에 대한 거래 기록 및 자료를 제공하여야 합니다. 은행이 어떠한 사정으로 인하여 해당 기록 및 자료를 제공할 수 없는 경우, 은행은 고객에게 그 사유를 즉시 통지합니다. | (a) Upon the request of the Client, the Bank shall provide such transaction records and materials in respect of the Client to the extent such disclosure does not conflict with other laws and regulations, such as the Act on Real Name Financial Transactions and Guarantee of Secrecy. Provided, that if the Bank cannot provide such records and materials due to any circumstance, the Bank shall immediately notify the Client of the reason. |

제22조 분쟁 | 22. Disputes |
(1) 고객이 본 약정에 따라 이루어진 전자금융거래에 이의를 제기하는 경우, 고객은 은행이 지정한 분쟁해결 담당자에게 해당 분쟁을 서면으로 통지하거나 금융감독원의 분쟁조정위원회, 금융투자협회 또는 한국소비자보호원의 소비자분쟁조정위원회를 통한 분쟁 해결을 신청할 수 있습니다. | (a) If the Client disputes any electronic financial transactions entered into pursuant to this Agreement, the Client may notify, in writing, the person(s) designated by the Bank as responsible for and in charge of dispute resolution of such dispute, or apply for a resolution of disputes through the Financial Dispute Resolution Committee of the Financial Supervisory Service, Korea Financial Investment Association, or Customer Dispute Resolution Committee of the Korea Customer Agency. |

(1) 호가 은행은 고객에게 거래통화(currency pairs)에 대한 지속적인 호가 정보(streaming price)를 본 웹사이트를 통해 수시로 제공하게 됩니다. 제공된 호가는 그 종료 시점 전까지 또는 은행이 달리 철회하는 시점 전까지 유효하게 거래 지시에 사용될 수 있습니다. 각 호가는 상기 시점 이후에는 거래 지시에 사용될 수 없습니다. 각 호가는 고객이 해당 거래통화와 결제일자의 새로운 호가를 수락한 때에 종료됩니다. 상기 호가는 해당 거래의 유형(현물 및 선물), tenors 또는 결제일자에 의해 은행의 재량으로 결정될 수 있습니다. 각각의 호가는 은행이 지정한 최고 한도액을 초과하지 않는 명목 원금으로 거래되는 거래의 지시에 이용됩니다. 고객은 본 시스템에서 통상적으로 제공하지 않는 거래통화 또는 결제일자를 지시할 수 있으며, 이를 시스템은 한도초과 거래로 인식하게 됩니다. 은행은 자신의 고유재량으로 상기 요청에 응하여 한정된 기간 동안 해당하는 지속적인 호가 정보를 제공할 수 있습니다. 상기와 같이 고객의 요청에 응하여 은행이 호가 정보를 제공하였다 하더라도 은행은 차후에 그와 동일한 또는 다른 거래통화 또는 결제일자에 대한 요청에 응하여 호가 정보를 제공할 의무를 지지 않습니다. 이러한 호가 및 최고 한도액이 은행이 다른 고객에게 제공하는 호가 및 최고 한도액과 다를 수 있으며 사전 통지 없이 철회 또는 변경될 수 있습니다. 은행은 시장상황의 변화 등에 따라 일부 또는 전체 거래통화 및 결제일자에 대한 호가 정보 제공이 곤란한 경우 고객에 대한 사전 통지 없이 해당 호가 정보의 제공을 하지 못할 수 있습니다. | a. Prices. Bank may supply streaming prices through the Website in such currency pairs and during such times as it shall notify Client from time to time. Each price shall be effective and may be used in a trade instruction prior to the earlier of its expiration time and the time, if any, at which it is otherwise withdrawn by Bank. A price may not be used in a trade instruction after such time. A price shall expire upon receipt by Client of a new price for such currency pair and value date. Such prices may be specified for spot and forward transactions of such types and with such tenors or value dates as Bank may determine in its discretion. Each price shall be available for use in a trade instruction for a transaction with a principal amount not to exceed a maximum specified by Bank. Client may request streaming prices by so indicating through the System for Transactions in excess of the maximum specified by Bank for a currency pair or for value dates other than those normally available through the System. Bank may in its sole discretion provide such streaming prices for a limited period of time in response to such request. The provision of such prices by Bank in response to such a request shall not obligate Bank to provide such prices in response to any subsequent requests for the same or other currency pairs or value dates. These prices and maximum amounts may differ from prices and maximum amounts provided to other customers of Bank and may be withdrawn or changed without prior notice. Bank may, in case it becomes difficult to provide the prices for some or all currency pairs or value dates due to change in market situation or otherwise, without prior notice to Client cease the provision of the relevant prices. |

The Principal Amount shall be no greater than the maximum amount specified by Bank on the Website from time to time or the amount permitted in a request for streaming prices. Bank shall have no obligation to accept any trade instruction that does not comply with the limitations set forth above but may do so in its discretion. Acceptance of any such nonconforming instruction shall not obligate Bank to accept any subsequent nonconforming instruction. |

Client may place orders to enter into spot foreign exchange transactions with Bank or to modify prior orders (in each case, an "Order") through the Website by entering the terms of such Orders in the manner provided in the Specifications. An Order shall constitute an offer by the Client to enter into or modify a Transaction. In addition, the Client may cancel existing Orders through the Website. The Bank may give the Client the capability to specify whether an Order shall be auto or manually executed (the "Execution Mode"). Auto executed Orders shall be monitored and executed by the System in accordance with these Terms and Conditions and the Specifications. Manually executed orders shall be monitored and executed by Bank’s traders in accordance with customary market practice as determined by Bank in its sole discretion. Client may change the Execution Mode after an Order has been entered by notification to Bank through the Website but may not change the Execution Mode after the Order has been accepted by Bank. Notwithstanding any specification made by the Client, Bank may change the Execution Mode, (1) where, due to any improvements or alterations in the Website and/or its functionalities, it is appropriate to do so in order for safe execution of the Transaction, (2) where a market dislocation has occurred, (3) where the financial markets have, become abnormally volatile, (4) where it is appropriate to do so, for the purpose of resolving any technology issues with the Website or carrying out any maintenance, repair or upgrading works, (5) where the change in Execution Mode will not in itself adversely affect the Client’s ability to enter into Transactions with the Bank, (6) where the change in Execution Mode would be a prudent step for better monitoring the risks related to the Client’s trading activities, or (7) where the change in Execution Mode would better facilitate the Client’s trading activities. |

Any Order not executed prior to the Expiry Time shall expire at such Expiry Time. Execution of an Order by Bank (which shall be evidenced by execution of a transaction in the foreign exchange markets (which may be with another desk, office or affiliate of Bank) in respect of such Order) shall constitute a binding agreement to a Transaction between Client and Bank on the terms of such Order. Bank shall use reasonable efforts to notify Client through the Website of such execution but any failure or delay in providing such notice shall not affect the effectiveness of such Transaction. |

To the extent that Client (“Principal”) is using an agent (“Agent”) to use the Website and enter into or otherwise manage Transactions on its behalf, Client agrees (i) to the extent permitted by applicable law, to provide to Bank prior to the date on which the parties enter into any Transaction, with all necessary documents evidencing its appointment of such Agent and the scope of the Agent’s authority; and (ii) to promptly notify Bank, of any changes in the said agency arrangements. Client agrees to indemnify Bank for any losses, damages, expenses or costs that Bank may suffer or incur as a result of relying on the said documents or otherwise acting on the instructions of such Agent. |
