Het Vlaams Woninghuurdecreet in werking sinds 1 januari 2019
Vlaams Woninghuurdecreet
Het Vlaams parlement keurde op 24 oktober 2018 het Vlaams Woninghuurdecreet definitief goed.
Het Vlaams Woninghuurdecreet is van toepassing op huurovereenkomsten voor een woning als hoofdverblijfplaats[1] en huurovereenkomsten voor studentenhuisvesting[2]. Voor de overige huurovereenkomsten blijft de oude regelgeving van toepassing.
De nieuwe bepalingen van het Vlaams Woninghuurdecreet zijn sinds 1 januari 2019 van toepassing.[3] Dit wil zeggen dat alle huurovereenkomsten gesloten voor een woning als hoofdverblijfplaats of studentenhuisvesting gelegen in het Vlaamse gewest, vanaf 1 januari 2019 onder deze nieuwe regelgeving vallen.
Het Vlaams Woninghuurdecreet is niet van toepassing op lopende huurovereenkomsten, waardoor nog ruime tijd beide regelgevingen naast elkaar zullen worden gebruikt. De datum van ondertekening is hiervoor bepalend.
Woning als hoofdverblijfplaats?
Een woning is elk roerend of onroerend goed of een deel ervan (verschil met
huidige regelgeving!) dat als hoofdverblijfplaats van de huurder is bestemd.
Onder ‘woning als hoofdverblijfplaats’ wordt verstaan: ‘een woning die de huurder, met uitdrukkelijke of stilzwijgende toestemming van de verhuurder, vanaf de ingenottreding tot zijn hoofdverblijfplaats bestemt’.
Belangrijkste wijzigingen?
Enkele belangrijke wijzigingen voor huurovereenkomsten voor een woning als hoofdverblijfplaats in het Vlaams Woninghuurdecreet zijn:
Bekendmaking en affichering[4]: Indien een goed bestemd is voor bewoning in de ruime betekenis dienen zowel de huurprijs als de kosten en lasten te worden vermeld.
De maximale boete hiervoor wordt verhoogd naar 350,00 euro en kan ook worden opgelegd aan een gevolmachtigde (vb. een vastgoedmakelaar)
Opeisbare gegevens van een kandidaat-huurder[5]: Als verhuurder mag je (enkel) de documenten opvragen die noodzakelijk zijn om na te gaan of de kandidaat-huurder aan zijn huurdersverplichtingen zal kunnen voldoen.
Het is dus niet toegelaten om gegevens over gezondheid of een strafrechtelijk verleden op te vragen gezien deze documenten niet vereist zijn om te kunnen nagaan of de huurder aan zijn verplichtingen zal kunnen voldoen.
Leveringsplicht en staat van het goed bij aanvang[6]: De verhuurder moet bij aanvang van de huurovereenkomst de woning in goede staat van onderhoud leveren. Het goed moet voldoen aan elementaire vereisten van art. 5 Vlaamse Wooncode. De federale woonkwaliteitseisen vallen dus weg.
Nieuw is dat er een conformiteitsattest van maximaal drie maanden oud aanwezig dient te zijn bij aanvang van de huurovereenkomst. Dit geldt als (weerlegbaar) vermoeden dat de woning voldeed aan de normen bij aanvang van de huurovereenkomst. Indien deze verplichting niet werd nageleefd, is nietigheid de sanctie.
Leveringsplicht en staat van het goed tijdens de huurovereenkomst[7]: De verhuurder heeft een onderhouds- en herstellingsplicht voor herstellingen nodig door ouderdom of overmacht. De huurder staat daarentegen in voor
kleine herstellingen of herstellingen door oneigenlijk gebruik of door een gebrek aan onderhoud als een goede huisvader.
In praktijk leidde de onderhouds- en herstellingsplicht vaak tot discussie tussen huurder en verhuurder gezien het voor interpretatie vatbaar is wat men net onder een ‘een kleine herstelling’ diende te verstaan. Om hieraan een einde te maken, stelde de Vlaamse regering een lijst op van deze kleine herstellingen: Bijlage 4: Lijst van kleine herstellingen als vermeld in artikel 7.[8]
Dringende herstellingen[9]: Een huurder dient dringende herstellingen te gedogen, ongeacht de ongemakken die daardoor bij hem worden veroorzaakt. Als de herstellingen langer dan 30 dagen (i.p.v. 40 dagen) duren, wordt de huurprijs verminderd naar evenredigheid van de tijd waarvoor en van het gedeelte van het goed waarvan de huurder het genot heeft moeten derven.
Gebruik van het goed als goed huisvader[10]: Een huurder dient de woning te gebruiken als een goede huisvader. Nieuw is dat de huurder een meldingsplicht heeft en de verhuurder op de hoogte dient te brengen van herstellingen die nodig zijn en ten laste van de verhuurder vallen.
Herziening huurprijs[11]: Een gewone huurprijsherziening kan minnelijk of via de Vrederechter gebeuren. Nieuw is dat de huurprijs thans ook kan worden herzien bij energiebesparende investeringen. Deze herziening kan ten allen tijde minnelijk of via de Vrederechter indien de huurwaarde 10% is gestegen door energiebesparende investeringen. Hierbij mag geen rekening worden gehouden met verplichte energiebesparingen zoals vb. dakisolatie of dubbelglas.
Huurwaarborg[12]: De huurwaarborg zal gelijk kunnen zijn aan drie maanden huur (i.p.v. twee maanden). De huurder kiest zelf hoe hij aan de waarborgverplichting voldoet: via een geïndividualiseerde rekening bij een financiële instelling, via een zakelijke zekerheidsstelling bij een financiële instelling of via een bankwaarborg ten gevolge van een standaardcontract tussen het OCMW en de financiële instelling. De Vlaamse Regering legt een formulier vast waarmee de financiële instellingen ten aanzien van de
verhuurders bevestigt dat de huurwaarborg toegekend is, ongeacht de manier waarop die waarborg werd gesteld.
De brand én waterschadeverzekering[13] worden verplicht voor de huurder én verhuurder. De huurder wordt vanaf 1 januari 2019 vermoed aansprakelijk te zijn niet meer alleen voor brand , maar ook voor waterschade. Dit impliceert dat hij zal moeten aantonen dat de schade buiten zijn fout is ontstaan. De nood aan een brandverzekering, waarin tevens een dekking voor huurdersaansprakelijkheid wordt opgenomen, voor de huurder is dus pertinent.
Tot slot is het vernieuwend dat het Vlaams woninghuurdecreet een heel hoofdstuk wijdt aan medehuur[14]

Le Décret flamand sur le bail d’habitation en vigueur depuis le 1er janvier 2019
Décret flamand sur le bail d’habitation
Le 24 octobre 2018, le Parlement flamand a définitivement approuvé le Décret flamand xxx xx xxxx x’xxxxxxxxxx.
Xx Xxxxxx xxxxxxx xxx le bail d’habitation s’applique aux contrats de location d’une habitation en tant que résidence principale[1] et aux contrats de locations de logements pour étudiants[2]. Pour les autres baux, l’ancienne réglementation continue de s’appliquer.
Les nouvelles dispositions du Décret flamand sur le bail d’habitation sont d’application depuis le 1er janvier 2019[3]. Cela signifie que tous les baux conclus pour une maison en tant que résidence principale ou logement étudiant située en Région flamande seront soumis à cette nouvelle réglementation à partir du 1er janvier 2019.
Le Décret flamand sur le bail d’habitation ne s’applique pas aux baux en cours, ce qui signifie que les deux réglementations continueront à être utilisés côte à côte pendant une longue période. La date de la signature est déterminante à cet égard.
Habitation en tant que résidence principale ?
Une habitation est tout bien meuble ou immeuble ou une partie de celui-ci (différent de la réglementation actuelle) qui est destiné à être la résidence principale du locataire.
Par « résidence principale », on entend : « une résidence que le locataire, avec l’accord explicite ou tacite du bailleur, affecte dès son entrée dans les lieux loués à la résidence principale ».
Changement les plus importants ?
Quelques modifications importantes pour les contrats d’habitation en tant que
résidence principale dans le Décret flamand sur le bail d’habitation :
Publication et affichage[4]: Si un bien est destiné à l’habitation au sens large, le loyer ainsi que les frais et charges doivent être indiqués.
L’amende maximale peut être augmentée jusqu’à 350,00 € et peut également être infligée à un mandataire ( p. ex. un agent immobilier)
Données exigibles d’un candidat-preneur[5] :
En tant que bailleur, vous pouvez (uniquement) demander les documents nécessaires pour vérifier si le candidat-preneur pourra remplir ses obligations de preneur.
Il n’est donc pas permis de demander des informations sur la santé ou un passé criminel, car ces documents ne sont pas nécessaires pour vérifier si le locataire sera en mesure de remplir ses obligations.
Obligation de livraison et état du bien au commencement[6]: Le bailleur doit, au début du contrat de location, livrer le bien en bon état d’entretien. Le bien doit répondre aux exigences élémentaires de l’article 5 du code flamand du logement. Les exigences fédérales en matière de qualité de vie sont donc abolies. La nouveauté est qu’un certificat de conformité datant de moins de 3 mois doit être présent au début du contrat de location. Il s’agit d’une présomption (réfragable) que la maison répondait aux normes au début du contrat de bail. Si cette obligation n’a xxx xxx xxxxxxxxx, xx xxxxxxxx xxx xx xxxxxxx.
Obligation de livraison et état du bien pendant le contrat de location[7]: Le bailleur a une obligation d’entretien et de réparation pour les réparations requises par la vétusté ou la force majeure. Le locataire, par contre, est responsable des petites réparations ou des réparations dues à une mauvaise utilisation ou à un manque d’entretien comme bon père de famille.
Dans la pratique, l’obligation d’entretien et de réparation a souvent donné xxxx x xxx xxxxxxxxxxx xxxxx xx xxxxxxxxx xx xx xxxxxxxx, car il est impossible d’interpréter ce que l’on entend par « petite réparation ». Pour y mettre fin, le gouvernement flamand a dressé une liste de ces petites réparations : Annexe 4 : Liste des petites réparations comme énoncé à l’article 7[8].
Réparations urgentes[9]: Un locataire doit tolérer les réparations urgentes, quels que soient les inconvénients qui lui sont causés. Si les réparations durent plus de 30 jours (au lieu de 40 jours), le prix du loyer sera réduit en proportion du temps et de la partie du bien pour laquelle le locataire a perdu la jouissance.
Utilisation raisonnable du bien[10]: Le locataire doit utiliser le bien comme un bon père de famille. La nouveauté est que le locataire a une obligation de notification et le bailleur doit être tenu informé par le locataire des réparations nécessaires qui sont à la charge du bailleur.
Révision du loyer[11]: Une révision ordinaire du loyer peut se faire à l’amiable ou via le juge de paix. Une nouveauté est que le loyer peut désormais être révisé pour les investissements économiseurs d’énergie. Cette révision peut se faire à l’amiable ou par l’intermédiaire du juge de paix à tout moment si la valeur locative a augmenté de 10% en raison d’investissements économiseurs d’énergie. On ne peut pas tenir compte des investissements économiseurs d’énergie obligatoires comme l’isolation du toit ou le double vitrage.
Garantie locative[12]: La garantie locative sera égale à 3 mois de loyer (au lieu de deux mois). Le locataire choisit le mode d’exécution de l’obligation de garantie : via un compte individualisé auprès d’un établissement financier, via une sûreté réelle auprès d’un établissement financier, ou via une garantie bancaire résultant d’un contrat-type entre un CPAS et un établissement financier. Le Gouvernement flamand établit un formulaire par lequel les institutions financières confirment aux bailleurs que la garantie locative a été accordée, quelle que soit la manière dont cette garantie a été fournie.
L’assurance incendie et dégâts des eaux[13] sera obligatoire pour le locataire et le bailleur. A partir du 1er janvier 2019, le locataire est présumé responsable non seulement de l’incendie, mais aussi des dégâts des eau. Cela implique qu’il devra prouver que le dommage s’est produit en dehors de sa
faute. La nécessité d’une assurance incendie, qui couvre également la responsabilité civile des locataires, est donc pertinente pour le locataire.

The Flemish parliament definitely approved the “Vlaams Woninghuurdecreet”on 24 October 2018.
The “Vlaams Woninghuurdecreet”applies to rental contracts for a house as primary residence[1] and rental contracts for student accommodation.[2] The old regulations continue to apply to the other rental contracts
The new provisions of the “Vlaams Woninghuurdecreet” apply since 1 January 2019.[3] This means all rental contracts concluded for a house as a primary residence or student accommodation located in the Flemish Region will be subject to this new regulation starting from 1 January 2019.
The “Vlaams Woninghuurdecreet” doesn’t apply to ongoing rental agreements, which means both regulations will be used next to one another for a while. The date of signing is determinant in this respect.
House as primary residence?
A house is any movable or immovable property or part thereof (different from current regulation!) that is intended to be the tenant’s primary residence.
“House as primary residence” means: “a residence that the tenant, with the explicit or tacit consent of the lessor, designates from the taking possessing as his main residence’.
Most important changes?
Some of the most important changes in the “Vlaams Woninghuurdecreet”
concerning rental contracts for a house as primary residence are:
Notification and posting[4]: If a property is intended for habitation in the broad sense, both the rental fee and the costs and charges must be stated.
The maximum fine for this is increased to 350.00 euro and can also be imposed on an authorised representative (e.g. a real estate agent).
Demandable data of a prospective tenant[5] : As a lessor, you are only allowed to request the documents necessary to check whether the prospective tenant will be able to meet his tenancy obligations.
It is therefore not allowed to request information about health or a criminal past, as these documents are not required to be able to verify whether the tenant will be able to meet his obligations.
Delivery obligation and condition of the property at the start[6]: The lessor is obliged to deliver the property in good condition at the start of the rental agreement. The property must meet the basic requirements of art. 5 Vlaamse Wooncode. The federal housing quality requirements will therefore no longer apply.
It is new that a certificate of conformity of maximum three months old must be present at the start of the rent contract. This applies as a (refutable) presumption that the house met the standards at the start of the rental contract. If this obligation was not complied with, it is sanctioned with nullity.
Delivery obligation and condition of the property during the rental agreement[7]: The lessor has a maintenance and repair obligation for repairs required by age or force majeure. The tenant, on the other hand, is responsible for minor repairs or repairs due to improper use or due to a lack of maintenance as a “prudent man”.
In practice, the maintenance and repair obligation often led to discussion between the tenant and the lessor, as it is open to interpretation what is meant by a ‘minor repair’. To put an end to this, the Flemish government drew up a list of these small repairs: Annex 4: List of small repairs as mentioned in article 7.[8]
Urgent repairs[9] : A tenant must tolerate urgent repairs, regardless of the inconveniences caused to him because of that. If the repairs last longer than 30 days (instead of 40 days), the rent will be reduced in proportion to the time for which and the part of the property for which the tenant has had to lose the enjoyment.
Use of the property as a prudent man (bonus pater familias)[10] : A tenant should use the property as a prudent man. It is new that the tenant has an obligation to report and inform the lessor of any repairs that are necessary and are at the lessor’s expense.
Rental fee review [11]: An ordinary rental fee review can be done amicably or through the “Vrederechter”. A new feature is that the rental fee can now also be reviewed in respect to energy-saving investments. This revision can be done amicably or via “Vrederechter” at any time if the rental value has
Rent guarantee[12] : The rent guarantee shall be the equivalent of three months rent (instead of two months). The tenant chooses how to meet the guarantee obligation: via an individualised account at a financial institution, via a collateral with a financial institution or via a bank guarantee as a result of a standard contract between the OCMW and the financial institution. The Flemish Government shall establish a form by which the financial institutions shall confirm to the lessors that the rent guarantee has been granted, regardless of the way in which this guarantee has been provided.
Fire and water damage insurance[13] will become compulsory for both the tenant and the lessor. As from 1 January 2019 the tenant is suspected of being liable not only for fire, but also for water damage. This implies that he will have to prove the damage occurred through no fault of his own. The need for a fire insurance, which also includes cover for tenant liability, is therefore crucial for the tenant.
Finally the Vlaams Woninghuurdecreet devotes a whole chapter to co- renting.[14]
