Algemene voorwaarden (BV LB&O / BV ISG / Festivalrent / Lockerking)

Definitie

Artikel 1

BV LB&O, hierna de verhuurder, is een verhuurbedrijf van roerende goederen. De regels van het Burgerlijk Wetboek zijn van toepassing. De verhuurder verhuurt geen werk.

Huur van goederen is een contract waarbij de ene partij zich verbindt om de andere het genot van een zaak te doen hebben gedurende een zekere tijd, en tegen een bepaalde prijs, die de laatst genoemde zich verbindt te betalen. De levering en ophaling van de goederen zit hier niet inbegrepen, maar kan verzocht worden voor een meerprijs.

De huur heeft een zaak tot voorwerp, waarop een persoonlijke schuldvorderingsrecht van gebruik en genot is toegekend. De 2 essentiële bestanddelen zijn:

-Het vreedzaam gebruik en genot over een zaak verschaffen

-Tegen het betalen van een prijs De verhuurperiode is tijdelijk.

Introductie

Artikel 2

Deze algemene voorwaarden maken integraal deel uit van de overeenkomst. Er wordt naar verwezen bij elke prijsofferte, huurbevestiging en factuur. Er kan alleen schriftelijk in onderling overleg van worden afgeweken. De schriftelijke bemerkingen dienen binnen de 7 kalenderdagen na ontvangst offerte, huurbevestiging en/of factuur per e-mail te worden gericht aan: xxxx@xxxxxxxxxxxx.xx. Telefonische meldingen dienen te worden gevolgd door een e-mail. Er kan niet geconcludeerd worden dat de verhuurder akkoord gaat met schriftelijke bemerkingen bij gebrek aan feedback van de verhuurder. Deze moeten beantwoord worden om tegenwerpelijk te zijn.

Artikel 3

De geleverde goederen blijven eigendom van de verhuurder. De verhuurder zorgt ervoor dat de goederen zich in goede staat bevinden. De verhuurder onderneemt alles in zijn mogelijkheid om de goederen in een goede staat te verhuren. De huurder aanvaardt de goede staat van de goederen bij ingebruikname. Wanneer voor ingebruikname van de goederen toch defecten of beschadigingen vastgesteld worden, dan moet de huurder dit voorafgaand aan het event schriftelijk (en indien gewenst ook telefonisch) melden. Vervolgens zal de verhuurder een aantal mogelijkheden voorstellen. Wanneer er niet op één van de mogelijkheden wordt ingegaan door de huurder blijft de huurovereenkomst onverminderd van kracht.

De huurder draagt de risico’s vanaf de levering. Deze moet de goederen in hun staat bewaren.

Artikel 4

De verhuurder heeft het recht tot toegang tot alle goederen, zelfs gedurende het event. De verhuurder kan indien nodig bijkomende richtlijnen geven.

Offertes

Artikel 5

Aanvragen worden schriftelijk via e-mail of via de website gericht aan LB&O/Festivalrent/Lockerking. De verhuring kan enkel doorgaan als de aanvraag tijdig aan de verhuurder wordt gericht, zodat alle nodige maatregelen nog kunnen worden getroffen. Bij een laattijdige aanvraag kan er een extra administratieve en logistieke kost worden aangerekend.

Bij een aanvraag dienen volgende gegevens vermeld te worden:

-Gewenste goederen en aantal

-Datum van levering

-Datum van ophaling

-Locatie van levering (indien meerdere locaties dient dit te worden vermeld)

-Vermelding als er geen heftruck/vorklift/manitou aanwezig kan zijn De goederen worden verhuurd per weekend.

Artikel 6

Prijsoffertes worden via e-mail verstuurd naar de klant. Een prijsvoorstel wordt gegeven rekening houdend met het huren van de goederen voor een periode van 1 weekend. Bij een verhuring van lange duur (meer dan 1 weekend) dient dit expliciet vermeld te worden door de huurder, zodat hiermee rekening kan worden gehouden bij het prijsvoorstel.

Artikel 7

Prijsoffertes zijn gratis, vrijblijvend en gelden zolang de voorraad strekt. Pas na een schriftelijk bevestiging door de klant wordt een huurbevestiging gesloten en zal het materiaal voor u worden gereserveerd (mits betaling – zie topic betaling).

Masterkeys kunnen enkel worden gehuurd mits een vooraf te betalen waarborg van EUR 10.000. Bij verlies van de masterkey wordt de integrale kostprijs van alle lockers doorgerekend, EUR 50.000,00.

Huurbevestiging

Artikel 8

De huurbevestiging vermeldt de totale huurprijs. Deze huurprijs dient betaald te worden ten minste 10 kalenderdagen voor de datum van levering. Bemerkingen bij de huurbevestiging dienen schriftelijk binnen de 7 kalenderdagen na ontvangst van de huurbevestiging te worden gericht aan xxxx@xxxxxxxxxxxx.xx. Telefonische meldingen dienen te worden gevolgd door een e-mail om tegenwerpelijk te zijn.

Een huurbevestiging kan worden verkregen anderhalf jaar voor de aangevraagde datum. Wanneer echter door een wetswijziging (e.g. invoering kilometerheffing) of door omstandigheden extern aan de verhuurder de transportkosten zullen stijgen voor de verhuurder, kan dit bijkomend gefactureerd worden, ongeacht de opgegeven prijs.

Artikel 9

Mocht de klant 7 kalenderdagen voor de gewenste dag van levering nog geen huurbevestiging te hebben ontvangen dient dit via e-mail te worden opgemerkt om een tijdige levering te voorzien.

Artikel 10

De huurbevestiging vermeldt de gewenste datum van levering en ophaling van de klant. Hier wordt zo veel als mogelijk rekening mee gehouden. Deze datum is echter niet bindend. De levering wordt steeds voorzien in de werkweek voor het event en de ophaling wordt voorzien in de werkweek na het event. Het exacte ogenblik van levering zal ofwel via e-mail ofwel telefonisch worden vermeld. De levering en ophaling is een bijkomende service en is een middelenverbintenis.

Voor een levering in het weekend kan een meerkost worden aangerekend.

De levering gebeurt op 1 plaats zoals aangegeven door de huurder. Een levering op meerdere plaatsen dient expliciet vermeld te worden bij de aanvraag zodat hier rekening mee kan worden gehouden bij de prijsopgave.

Annuleren

Artikel 11

Annuleren door de huurder gebeurt via e-mail aan xxxx@xxxxxxxxxxxx.xx . Telefonische annuleren dient te worden gevolgd door een schriftelijke melding via e-mail om tegenwerpelijk te zijn. De kosten om te annuleren gebeuren conform volgend schema:

▪ Annuleren 14 kalenderdagen voor vooropgestelde leveringsdatum (cf. huurbevestiging):Geen kosten voor annuleren

▪ Annuleren tussen 14 en 7 kalenderdagen voor vooropgestelde leveringsdatum (cf.huurbevestiging): 50 % kosten voor annuleren (50% van de totaalprijs zoals aangegeven opde huurbevestiging)

▪ Annuleren tussen 7 kalenderdagen en 3 kalenderdagen voor vooropgestelde leveringsdatum(cf. huurbevestiging): 75% kosten voor annuleren (75% van de totaalprijs zoals aangegevenop de huurbevestiging)

▪ Annuleren vanaf 3 kalenderdagen voor vooropgestelde leveringsdatum: 100 % kosten voorannuleren (100% van de totaalprijs zoals aangegeven op de huurbevestiging)

▪ Annuleren na levering: 100% kosten voor annuleren (100% van de totaalprijs zoalsaangegeven op de huurbevestiging).

Levering

Artikel 12

De datum van levering – zie hierboven (huurbevestiging).

In geen geval zullen vertraagde leveringen de huurder éénzijdig het recht verlenen om de goederen te weigeren, de betaling te schorsen, de huurovereenkomst te verbreken of welke schadevergoeding dan ook te eisen.

Het terrein waar geleverd dient te worden moet toegankelijk zijn voor ons vervoer (oplegger / vrachtwagen + aanhangwagen). Het zich begeven op de aangeduide plaats van levering moet ongehinderd kunnen gebeuren, zoniet worden verleturen aangerekend en staat de huurder hier voor in. Wanneer de verhuurder zich met het vervoer op het terrein begeeft mits goedkeuren van de huurder is de huurder aansprakelijk voor de eventuele schade toegebracht aan het terrein.

Wanneer geen vorklift, manitou e.d. aanwezig zullen zijn bij de huurder, dient de huurder de verhuurder hiervan via e-mail te verwittigen (xxxx@xxxxxxxxxxxx.xx) 5 werkdagen voor datum van de gewenste levering.

De levering gebeurt op de door de huurder aangeduide plaats, conform de huurbevestiging. Wanneer een levering op meerdere plaatsen dient te gebeuren kan hiervoor een meerkost worden aangerekend.

De levering bestaat enkel uit het afleveren van het materiaal. De huurder is zelf verantwoordelijk voor het opstellen van de gehuurde goederen. Indien de goederen dienen te worden opgesteld door de verhuurder dient dit gemeld te worden bij de prijsaanvraag zodat er een meerprijs hiervan kan worden voorgesteld door de verhuurder.

Gebruik

Artikel 13

De huurder zorgt ervoor dat het gehuurde materiaal gebruikt wordt overeenkomstig hun bestemming en volgens de eventuele aanwijzingen van de verhuurder.

De verhuurde goederen mogen niet onderverhuurd worden, noch aan anderen in gebruik worden gegeven, met uitzondering van de lockers. De huurder is verantwoordelijk wanneer de lockers niet worden gebruikt overeenkomstig hun bestemming.

De verhuurder kan niet verantwoordelijk gesteld worden voor gebeurlijke ongevallen, diefstal of andere eventuele schadelijke gevolgen die voortvloeien uit en tijdens het gebruik van de gehuurde goederen. De huurder is aansprakelijk voor alle schade aangebracht tijdens de volledige huurperiode (dit wel zeggen vanaf moment van levering tot het ogenblik van ophaling).

Elke huurder is verplicht de gehuurde goederen na gebruik proper aan te bieden voor ophaling. De huurder zorgt ervoor dat de gehuurde goederen worden aangeboden zoals ze werden geleverd.

Ophaling

Artikel 14

Voor de ophaling dienen alle goederen aangeboden te worden identiek zoals ze werden geleverd, dit wil zeggen:

▪ Er horen 28 bouwhekken thuis in 1 bok + 32 blokken + 28 klemmen

▪ Er horen 10 crashbarriers thuis in hun stapelplaats

▪ Nadars dienen per 50 samengevoegd te worden

▪ Alle geleverde sleutels voor de lockers dienen opnieuw aangeboden te worden.

Alle geleverde spanbanden dienen rond de geleverde goederen te worden gebonden.

Wanneer bij de ophaling de geleverde goederen niet worden aangeboden conform levering, zullen wachturen worden aangerekend naast een handlingcost van EUR 175,00 per begonnen periode van 2 uur. Wanneer niemand telefonisch bereikt kan worden kan de verhuurder zelf opteren om de site te verlaten en zich op een later, vrij te kiezen tijdstip een tweede maal aan te bieden. Een vergeefse aanbieding zal extra worden aangerekend. De supplementaire kosten voor een niet-conforme aanbieding van de verhuurder hangen af - volgende elementen:

▪ Tijdstip ophaling (e.g. meerkost in weekend, meerkost ’s nachts, etc.)

▪ Duurtijd van de werken (e.g. 1uur versus 3 uur, etc.);

▪ Discretionaire beslissing van de chauffeur om de goederen niet samen te zoeken en zich eentweede keer aan te bieden (e.g. extra transportkosten, etc.)

▪ Etc.

De verhuurder raadt elke huurder aan om een conforme aanbieding te voorzien om meerkosten te vermijden! Bij het ophalen van het materiaal dient het gehuurde goed te zijn schoongemaakt, zoniet wordt een supplement voor de schoonmaak aangerekend. Wanneer dit niet mogelijk zou zijn, gelieve ons op voorhand te informeren zodat er een schoonmaakforfait ingecalculeerd kan worden.

Bij de ophaling door de verhuurder of een bedrijf ingehuurd door de verhuurder wordt zo veel als mogelijk rekening gehouden met de gewenste tijdstippen van de huurder. Dit is echter een middelenverbintenis. Bij een ophaling dat niet is gebeurd op het gewenste tijdstip van de huurder kan deze laatste niet het recht geven een korting te eisen op het verhuurde materiaal noch op de transportkosten.

Wanneer niet alle goederen worden aangeboden, of de goederen werden beschadigd en/of vernield zal de nieuwprijs worden aangerekend voor:

▪ bouwhekken, crashbarriers, nadars, etc.

▪ spanriem

▪ ontbrekende sleutel voor de lockers

▪ kapotte sleutel voor de lockers

▪ kapot slot voor de lockers

▪ ontbrekende sleutel voor xxxxx’x

en 50.000,00 EUR voor een ontbrekende masterkey.

Eventuele expertises zijn op kosten van de huurder.

Bij vaststelling van schade of vandalisme kan de verhuurder een bepaalde huurder tijdelijk of definitief uitsluiten voor verder verhuur ongeacht eventuele bestaande huurovereenkomsten.

Aan het gehuurde mag niet gespijkerd, geplakt, gezaagd of geschilderd worden zonder vooraf de schriftelijke goedkeuring van de verhuurder te hebben ontvangen. Zonder deze goedkeuring worden bovengenoemde kosten in rekening gebracht.

Vernietiging van het gehuurde in de loop van de huurtermijn door brand, storm of andere oorzaak geeft geen aanleiding tot opheffing of vermindering van de huurprijs of enigerlei schadeloosstelling aan de huurder. De huurder is verantwoordelijk voor het afsluiten van de nodige verzekeringen. De verhuurder kan niet verantwoordelijk gesteld worden voor gebeurlijke ongevallen, diefstal of andere eventuele schadelijke gevolgen die voortvloeien uit en tijdens het gebruik van de gehuurde goederen. De huurder is aansprakelijk voor alle schade aangebracht tijdens de volledige huurperiode (dit wel zeggen vanaf moment van levering tot het ogenblik van ophaling).

Klachten

Artikel 15

Klachten moeten om geldig te zijn binnen de 8 kalenderdagen na de uitvoering van de dienst of ontvangst van de goederen of na ontvangst van de factuur via e-mail aan de verhuurder kenbaar gemaakt worden. Klachten geven de huurder geen recht om de huurovereenkomst te ontbinden of de betaling geheel of gedeeltelijk uit te stellen of niet te verrichten. De verhuurder zal de klacht schriftelijk behandelen binnen de 30 kalenderdagen.

Overmacht

Artikel 16

De verhuurder kan niet aansprakelijk gesteld worden voor enige vorm van overmacht die het haar onmogelijk maakt geheel of gedeeltelijk haar verplichting na te komen (zoals daar zijn, ziekte, sterfgeval, oproer, stormschade van vorige verhuringen, rechtsvorderingen of beslag en iedere andere onmogelijkheid vanwege de verhuurder om geheel of gedeeltelijk aan zijn plichten te voldoen). Ieder geval van overmacht machtigt de verhuurder van rechtswege en zonder voorafgaande kennisgeving de overeenkomst geheel of gedeeltelijk uit te stellen of niet te verrichten. In dit geval verbreekt de verhuurder de overeenkomst zonder dat de huurder enig recht heeft op schadevergoeding.

Betaling / Facturatie

Artikel 17

De betaling dient te geschieden 10 kalenderdagen voor de gewenste leveringsdatum conform de huurbevestiging. Bij gebrek aan voorafgaande betaling heeft de verhuurder het recht om de huurovereenkomst op kosten van de huurder onmiddellijk en zonder schriftelijke of mondelinge kennisgeving te beëindigen.

De factuur wordt na het event verstuurd naar de huurder. Er wordt geen korting voor contante betaling toegestaan.

Niet betaling, zelfs gedeeltelijk op de vervaldag van een factuur heeft tot gevolg dat:

- Alle overige openstaande vorderingen met inbegrip van nog niet vervallen facturen onmiddellijk opeisbaar worden;

- Alle door ons verleende kortingen en betalingsfaciliteiten vervallen;

- Alle verschuldigde bedragen van rechtswege en zonder voorafgaande ingebrekestelling een interest afwerpen van 1% per maand, 12% per jaar, te rekenen vanaf de vervaldag;

- Alle verschuldigde bedragen worden van rechtswege verhoogd met 15% met een minimum van EUR 125,00;

- Elke maand er een bijkomende administratieve kost wordt aangerekend van EUR 12,00;

Klachten in verband met een factuur of met gefactureerde werken dienen schriftelijk te worden gemeld aan xxxx@xxxxxxxxxxxx.xx binnen 8 kalenderdagen na ontvangst van de factuur. Telefonische meldingen dienen achteraf ook per e-mail bevestigd te worden. De datum van ontvangst van de e-mail is geldig.

Bij de betaling van een factuur, zelfs bij een deelbetaling mag steeds geacht worden de werken aanvaard en goedgekeurd te zijn door de klant voor wat betreft de prijs alsook wat betreft de kwaliteit.

Bij niet (tijdige) betaling van de door de klant verschuldigde bedragen behoudt de verhuurder zich het recht de werkzaamheden op te schorten tot de vereffening van de nog openstaande schuld. Schadevergoedingen hier dientengevolge zijn vanwege de klant nooit eisbaar.

Aansprakelijkheid

Artikel 18

De verhuurder kan in geen geval aansprakelijk gesteld worden voor ongevallen, hoe dan ook ontstaan, veroorzaakt aan de huurder zelf of aan derden, zowel aan personen, dieren of goederen, onverschillig of deze zich binnen of buiten de unit bevinden en dit zowel tijdens de plaatsing of gedurende het terughalen, als gedurende de periode tussen levering en ophalen.

Vernietiging van het gehuurde in de loop van de huurtermijn door brand, storm of andere oorzaak geeft geen aanleiding tot opheffing of vermindering van de huurprijs of enigerlei schadeloosstelling aan de huurder. De huurder is verantwoordelijk voor het afsluiten van de nodige verzekeringen.

Geschillen

Artikel 19

In geval van geschil zijn alleen de rechtbanken bevoegd van het gerechtelijk arrondissement waar de maatschappelijke zetel van de verhuurder zich bevindt. RPR Gent, afdeling Oostende.

Bemerkingen

Artikel 20

Alle bemerkingen omtrent de algemene voorwaarden, huurbevestiging, levering, gebruik, ophaling en /of factuur dienen schriftelijk via e-mail gericht te worden aan: xxxx@xxxxxxxxxxxx.xx binnen de 8 kalenderdagen nadat:

▪ De huurbevestiging u werd toegestuurd (24h wanneer het event in 7 kalenderdagen zal doorgaan)

▪ De levering werd volbracht;

▪ Ophaling is geschiedt;

▪ De factuur u werd toegestuurd.

Telefonische meldingen dienen ook per e-mail te worden toegestuurd om tegenwerpelijk te zijn. De datum van de e-mail is geldig.

Geldigheid algemene voorwaarden

Artikel 21

De mogelijke nietigheid van één of meer bepalingen van de onderhavige algemene voorwaarden hebben in geen geval de nietigheid van de gehele overeenkomst tot gevolg.

Verzekering

Artikel 22

De huurder wordt aangeraden voor alle activiteiten een all- in verzekering voor het gehuurde materiaal af te sluiten ten bedrage van de aanschaffingswaarde van de gehuurde goederen. De gehuurde goederen worden geëvalueerd in de magazijnen van de verhuurder. Indien schade wordt vastgesteld wordt dit opgenomen in de factuur.

Slotbepalingen

Artikel 23

Elke overtreding van onderhavige algemene voorwaarden, evenals schade, vandalisme, misbruik of wanbetaling kan aanleiding geven tot een tijdelijke of definitieve uitsluiting van verhuur door de verhuurder. In alle gevallen die niet in deze algemene voorwaarden voorzien zijn beslist de verhuurder.

Bovengenoemde prijzen zijn allen exclusief BTW.

Verloren voorwerpen

Artikel 24

BV LB&O is niet verantwoordelijk verloren voorwerpen. Iets verloren in een locker? Contacteer de organisator van het event. Kan deze persoon je niet verder helpen, meld je verloren voorwerp mits goeie beschrijving via xxxx@xxxxxxxxxxxx.xx.

- Voorwerp teruggevonden

We verwittigen je onmiddellijk en je voorwerp kan afgehaald worden, mits afspraak, op de zetel.

- Voorwerp niet teruggevonden binnen de 50 dagen

We brengen je op de hoogte dat je voorwerp onvindbaar blijft en dat de opzoekingen gestopt worden. BV LB&O is niet verantwoordelijk voor verloren voorwerpen.

Heb je iets gevonden? Bezorg het aan ons personeel.

- Als er persoonsgegevens vermeld staan op het gevonden voorwerp dan wordt dit voorwerp overhandigd aan de politie die verantwoordelijk is om de eigenaar te contacteren.

- Kan de eigenaar niet achterhaald worden of worden gevonden voorwerpen niet opgehaald binnen de 50 dagen, dan bezorgen we deze aan de Kringwinkel.

Article 1

LB&O SPRL, ci-après le bailleur, est une entreprise de location de biens mobiliers. Xxx xxxxxx xx Xxxx Xxxxx xxxx x’xxxxxxxxxxx. Xx xxxxxxxx ne loue pas de travail.

La location de biens est un contrat par lequel une partie s’engage à procurer à l’autre, la jouissance

d’une chose pendant une durée déterminée, et ce moyennant le paiement d’un prix déterminé que cette dernière s’engage à payer. La livraison et l’enlèvement des biens ne sont pas compris dans celui-ci, mais peuvent faire l’objet d’un surcoût.

Le locataire a un droit d’usage du bien et a le plaisir du bien. Les 2 conditions principales sont:

- l’utilisation et la jouissance paisible du bien

- contre paiement d’un prix

La période de location est temporaire.

Introduction

Article 2

Ces conditions générales font intégralement partie du contrat. Elles servent de référence pour chaque offre de prix, confirmation de location et facture. Toute dérogation à celles-ci est seulement possible

par écrit et de commun accord. Les remarques doivent être adressées par écrit endéans les 7 jours ouvrables

après la réception de l’offre, de la confirmation de location et/ou de la facture, ou par courrier électronique à : xxxx@xxxxxxxxxxxx.xx. Les notifications téléphoniques doivent être suivies d’un email. En l’absence de feedback de la part du bailleur, il ne peut être conclu que le bailleur se rallie aux remarques écrites. Elles ne sont opposables que dans la mesure où une réponse leur à été donnée.

Article 3

Xxx xxxxx xxxxxx xxxxxxx xx xxxxxxxxx xx xxxxxxxx. Xx xxxxxxxx veille à ce que les biens soient en bon état. Le bailleur entreprend tout ce qui est en son pouvoir pour louer les biens en bon état. Le locataire accepte le bon état des biens lorsqu’il en prend possession. Lorsque des défaillances ou détériorations sont néanmoins constatées avant la mise à dispositions des biens, le bailleur doit le notifier par écrit avant l’événement (et aussi par téléphone si souhaité) . Ensuite le bailleur proposera un nombre de possibilités. Si le locataire ne réagit pas à l’une des possibilités, cela ne constituera pas un préjudice au contrat de location, qui restera en vigueur sans changement.

Le locataire assume les risques dès la livraison. Il doit conserver les biens dans leur état. Article 4

Le bailleur a le droit d’accéder à tous les biens, même durant l’événement. Le bailleur peut donner des directives supplémentaires, si nécessaire.

Devis

Article 5

Les demandes doivent être adressées par email ou par le biais du site web à LB&O/Festivalrent/Lockerking. La location ne peut se faire que si la demande a été faite suffisam-

ment tôt au bailleur, de sorte que toutes les mesures nécessaires puissent encore être prises.

Lors d’une demande tardive, un coût administratif et logistique supplémentaire peut être facturé. Dans la demande, les données suivantes doivent être mentionnées:

- Biens souhaités et quantité

- Date de la livraison

- Date de l’enlèvement

- Lieu de la livraison (s’il y a divers lieux, mentionnez le)

- Il faut signaler si un chariot élévateur n’est pas mis à disposition par le locataire.

Les biens sont loués par weekend. Article 6

Les devis sont envoyés au client par email. Une proposition de prix est faite en se basant sur la location des biens pour une durée d’1 weekend. Lors d’une réservation de longue durée (plus d’1 weekend) cela doit être mentionné expressément par le locataire, de manière à ce que cela puisse être pris en compte dans la proposition du prix.

Article 7

Les devis sont gratuits, sans engagement et sont valables jusqu’à épuisement des stocks.

Ce n’est qu’après une confirmation écrite de la part du client qu’une confirmation de réservation sera

Les Masterkeys ne peuvent être réservées que moyennant le paiement préalable d’une caution de EUR 10.000. En cas de perte de la masterkey, le prix intégral de tous les casiers sera facturé, EUR 50.000,00.

Confirmation de réservation

Article 8

La confirmation de réservation fait mention du loyer total. Ce loyer doit être payé au moins 10 jours ouvrables avant la date de la livraison. Des observations se rapportant à la réservation doivent

être adressées par écrit endéans les 7 jours ouvrables après la réception de la confirmation de la réservation à xxxx@xxxxxxxxxxxx.xx. Les notifications téléphoniques doivent être suivies d’un email pour être opposables.

Une confirmation de location peut être obtenue un an et xxxx xxxxx la date demandée. Toutefois, lorsque les coûts du transport augmentent pour le bailleur, suite à une modification de la loi (ex.

l’introduction de la redevance kilométrique) ou en raison de circonstances externes au bailleur, un supplément peut être facturé, quel que soit le prix indiqué.

Article 9

Dans le cas où le client n’aurait pas encore reçu de confirmation de réservation 7 jours ouvrables avant le jour de livraison souhaité, notifiez le par email/téléphone afin de vous assurer de la livraison dans les délais.

Article 10

La confirmation de réservation fait mention de la date souhaitée de la livraison et de l’enlèvement

du client. Cet élément est pris en compte autant que possible. Les dates mentionnées ne sont pas contraignantes. La livraison est toujours effectuée dans la semaine ouvrable précédant l’événement et l’enlèvement est prévu dans la semaine ouvrable suivant l’événement. Le moment exact de la livraison sera communiqué soit par email soit par téléphone. La livraison et l’enlèvement sont des services complémentaires et constituent une obligation de moyens.

Une livraison durant le weekend peut engendrer un surcoût.

La livraison se fait en 0 xxxx, xxxxx xxxx x xxx xxxxxxx xxx xx xxxxxxxxx. Une livraison à divers endroits doit être mentionnée expressément lors de la demande, de manière à ce que cela puisse être pris en compte

lors de l’établissement du prix.

Annulation

Article 11

L’annulation par le locataire se fait par email à xxxx@xxxxxxxxxxxx.xx. Une annulation par téléphone doit être suivie d’une notification écrite par email pour être opposable. Les coûts d’une annulation sont établis conformément au schéma suivant :

• Annulation 14 jours ouvrables avant la date de livraison prévue (cf. confirmation de réservation):

Pas de frais d’annulation

• Annulation entre 14 et 7 jours ouvrables avant la date de livraison prévue

(cf. confirmation de réservation): 50 % de frais d’annulation (50% du prix total tel qu’il est

indiqué sur la confirmation de réservation)

• Annulation entre 7 jours ouvrables et 3 jours ouvrables avant la date de livraison prévue (cf. confirmation de réservation ): 75% de frais d’annulation (75% du prix total tel qu’il est indiqué sur la confirmation de réservation)

• Annulation à partir de 3 jours ouvrables avant la date de livraison prévue : 100 % de frais d’annulation

(100% du prix total tel qu’il est indiqué sur la confirmation de réservation)

• Annuler après la livraison : 100% des frais d’annulation (100% du prix total tel qu’il est indiqué

sur la confirmation de réservation) .

Livraison

Article 12

La date de la livraison – voir ci-dessus (confirmation de réservation).

Des retards de livraisons n’accorderont aucunement le droit unilatéral au locataire de refuser les biens, de suspendre le paiement, de rompre le contrat de location ou d’exiger un dédommagement quelconque.

Le terrain où la livraison sera effectuée, doit être accessible à notre transport (semi-remorque/camion

+ remorque). Il doit être possible de se rendre sur les lieux sans qu’il y ait d’entraves, sinon des heures perdues seront facturées et c’est xx xxxxxxxxx x’x xxxxxxx. Xxxxxxx xx xxxxxxxx s'engage sur le terrain, sous réserve de l'approbation du locataire, le locataire est responsable de tout dommage causé au terrain.

Si aucun chariot élévateur à fourche, manitou e.a. n’est à disposition chez le locataire, le locataire doit en aviser le bailleur (xxxx@xxxxxxxxxxxx.xx) 5 jours ouvrables avant la date de livraison souhaitée.

La livraison se fait à l’endroit indiqué par le locataire, conformément à la confirmation de réservation.

Lorsqu’une livraison doit être effectuée à plusieurs endroits, un surcoût peut être facturé à cet effet.

La livraison ne consiste qu’à livrer le matériel. Le locataire est lui-même responsable pour ce qui est de la disposition des biens loués. Si les biens doivent être installés par le bailleur, il doit en être fait mention lors de la demande de prix afin que le bailleur puisse proposer un surcoût pour l’installation.

Utilisation

Article 13

Le locataire veille à ce que le matériel loué soit utilisé conformément à sa destination et suivant les éventuelles indications du bailleur.

Il ne faut pas que les biens loués soient donnés en sous-location, ni utilisés par d’autres personnes à l’exception des casiers. C’est le locataire qui endossera la responsabilité si les casiers ne sont pas utilisés conformément à leur destination.

Le bailleur ne peut être tenu responsable d’éventuels accidents, vols ou autres dommages

résultant

de l’utilisation des biens loués ou se produisant lors de l’utilisation. Le locataire est responsable de tous les dommages occasionnés durant la totalité de la période de location (c’est-à-dire à partir du moment de la livraison jusqu’au moment de l’enlèvement).

Après leur utilisation, tout locataire se doit de présenter les biens loués dans un état propre au moment de leur enlèvement. Le locataire veille à ce que les biens soient présentés tels qu’ils ont été livrés.

Retour / Enlèvement

Article 14

Avant leur enlèvement, tous les biens doivent être présentés dans un état identique à celui où

ils ont été livrés, c’est-à-dire:

• 1 élément de rangement peut contenir 28 clôtures + 32 blocs + 28 cales

• Il y a 10 crashbarriers dans un élément de rangement

• Les Nadars doivent être rassemblés par groupe de 50

• Toutes les clés fournies pour les casiers doivent être remises.

Toutes les sangles fournies doivent être liées autour des biens livrés.

Lorsque les biens livrés ne sont pas présentés conformément à la livraison, des heures d’attente

seront facturées ainsi qu’un coût de manutention de EUR 175,00 par période entamée de 2 heures. Lorsque personne ne peut être joint par téléphone, le bailleur peut choisir de quitter le site et de se représenter une deuxième fois plus tard, à un autre moment à sa convenance. Un supplément sera facturé. Les coûts supplémentaires engendrés dépendent des éléments suivants :

- Moment de l’enlèvement (ex. surcoût durant le weekend, la nuit, les jours fériés, etc.)

- Durée du temps perdu (ex. 1heure par rapport à 3 heures, etc.);

- Décision discrétionnaire du chauffeur de ne pas rassembler les biens et de se présenter une deuxième fois à sa meilleure convenance (ex. frais de transport supplémentaires, etc.)

- Etc.

Le bailleur conseille à chaque locataire de prévoir une présentation conforme afin d’éviter des frais

supplémentaires !

Lors de l’enlèvement du matériel, le bien loué doit être propre, faute de quoi un supplément sera facturé pour le nettoyage. Si cela devait s’avérer impossible, veuillez nous en avertir à l’avance afin que nous puissions intégrer un forfait nettoyage dans le montant de notre offre.

Lors de l’enlèvement par le bailleur ou par une entreprise embauchée par le bailleur, il est tenu compte

autant que possible avec les désidérata des locataires quant aux moments de l’enlèvement. Il s’agit là

toutefois d’une obligation de moyens. Lorsque l’enlèvement ne s’est pas passé au moment souhaité

par le locataire, cela ne donne pas le droit à ce dernier d’exiger une réduction sur le matériel loué ni sur les frais de transport.

Lorsque les biens ne sont pas présentés dans leur totalité, ou lorsque les biens ont été abîmés et/ou détruits, les coûts suivants seront facturés au prix neuf:

▪ les héras, les clôtures, crashbarriers, nadars, etc.

▪ sangle manquante

▪ clé manquante pour les casiers

▪ clé cassée pour les lockers

▪ serrure cassée pour les casiers

▪ clé manquante pour les caisses

et 50.000,00 EUR par masterkey manquante

Les frais d’expertises éventuelles sont à charge du locataire.

Lorsque des dégâts ou des actes de vandalisme sont constatés, le bailleur peut exclure un locataire - temporairement ou définitivement - d’une location ultérieure, même si d’éventuels contrats de locations ultérieures existent déjà

Pas de clous, autocollants, sciages, peintures ne peuvent être apposés sur le matériel loué sans accord écrit préalable du bailleur à cet effet. Sans cet accord, les frais susmentionnés seront d’application.

Une destruction (partielle) du matériel loué suite à un incendie, les intempéries ou une autre cause ne donnera pas lieu à une suppression ou à une diminution du prix de location. Aucune restitution ne sera fournie au locataire. Xx xxxxxxxxx xxx xxxxxxxxxxx xx xx xxxxxxxxxxxx xxx xxxxxxxxxx xxxxxxxxxxx. Xx xxxxxxxx ne peut être tenu responsable d’éventuels accidents, vols ou autres conséquences fâcheuses résultant de

l’utilisation des biens loués. Le locataire est responsable des dommages apportés aux biens loués durant la totalité de la période de location (c’est-à-dire à partir du moment de la livraison jusqu’au moment de

l’enlèvement).

Plaintes

Article 15

Pour être valables, les plaintes doivent être notifiées par mail au bailleur endéans les 8 jours ouvrables suivant la réception des biens ou la réception de la facture. Les plaintes ne donnent pas le droit au locataire de résilier le contrat de location ou de différer ou d’annuler le paiement. Le bailleur traitera la plainte par écrit endéans les 30 jours ouvrables.

Cas de force majeure

Article 16

Le bailleur ne peut être tenu responsable de cas de force majeure, quels qu’ils soient, lui empêchant

de remplir ses obligations dans leur totalité ou en partie (par exemple maladie, décès, intempéries sur un événement précédant, actions en justice et toute autre impossibilité du bailleur d’honorer ses engagements dans son entièreté ou tout autre cause qui empêcherait le bailleur de remplir ses obligations. Chaque cas de force majeure habilite le bailleur de plein droit et sans en faire la notification préalable à différer ou à annuler le contrat. Dans ce cas le bailleur rompt le contrat sans que le locataire n’ait droit à un dédommagement quelconque.

Paiement / Facturation

Article 17

Le paiement doit se faire endéans les 10 jours ouvrables avant la date de livraison requise confor- mément à la confirmation de réservation. A défaut de paiement préalable, le bailleur a le droit de mettre immédiatement fin au contrat de location à charge du locataire et sans notification écrite ou orale préalable.

Après l’événement, la facture est envoyée au locataire.

Aucun escompte est accordé pour un paiement comptant.

Un non paiement à l’échéance, même partiel, d’une facture entraine que:

- Toutes les autres créances ouvertes, y compris les factures non encore échues deviennent immédiatement exigibles ;

- Toutes les réductions et facilités de paiement que nous vous avons accordées sont annulées;

- Tous les montants dus produisent de plein droit et sans mise en demeure préalable un intérêt de 1% par mois, de 12% par an, à compter du jour de l’échéance;

- Tous les montants dus sont majorés de plein droit de 15% avec un minimum de EUR 125,00;

- Chaque mois un coût administratif supplémentaire de EUR 12,00 est facturé;

Les plaintes concernant une facture ou des travaux facturés doivent être communiquées par écrit à xxxx@xxxxxxxxxxxx.xx endéans les 8 jours ouvrables après réception de la facture. Les communications par téléphone doivent être confirmées ensuite par courrier électronique. La date de réception

de l’email est valable.

Lors d’un paiement d’une facture, même en cas de paiement partiel, les deux parties considèrent

que la livraison a été acceptée et agréée par le client, de même en ce qui concerne le prix et la qualité.

En cas de non paiement ou de paiement tardif des montants dus par le client, le bailleur se réserve le droit de suspendre les activités jusqu’au règlement de la dette encore impayée. Le client ne pourra jamais exiger de dédommagements suite à cela.

Responsabilité civile

Article 18

Quelle qu’en soit l’origine, le bailleur ne peut aucunement être tenu responsable des accidents causés impliquant le locataire lui-même ou des tiers, des personnes comme des animaux ou des biens, et qu’ils se trouvent dans ou en dehors de l’unité, et ce aussi bien durant l’installation ou le retrait, que pendant

la période entre la livraison et l’enlèvement.

Pendant la durée du bail, la destruction du matériel loué par le feu, les intempéries ou toute autre cause, ne peut donner lieu à une annulation ou diminution du prix de la location ou à tout autre dédommagement en faveur du locataire. Le locataire est responsable de la souscription des assurances nécessaires.

Litiges

Article 19

En cas de litiges, les seuls tribunaux compétents sont ceux du RPM Gent, division Oostende.

Remarques

Article 20

Toutes les remarques concernant les conditions générales, la confirmation de réservation, la livraison, l’utilisation, l’enlèvement et/ou la facturation doivent être adressées par écrit à xxxx@xxxxxxxxxxxx.xx endéans les 8 jours ouvrables après que :

• La confirmation de réservation vous ait été envoyée (24h lorsque l’événement aura xxxx xxxxxxx xxx 0 xxxxx xxxxxxxxx)

• La livraison ait été effectuée;

• L’enlèvement ait eu lieu;

• La facture vous ait été envoyée.

Les notifications téléphoniques doivent également être envoyés par email pour être opposables. La date de l’email est valide.

Validité des conditions générales

Article 21

L’éventuelle nullité d’une ou de plusieurs clauses des présentes conditions générales n’entraîne en aucun cas la nullité de la totalité du contrat.

Assurances

Article 22

Pour toutes les activités, on conseille au locataire de conclure une assurance tous risques pour le matériel

loué. Le montant de celle-ci doit équivaloir à la valeur d’acquisition des biens loués. Les biens loués sont

évalués dans les ateliers du bailleur. Si des dommages sont constatés, cela sera repris dans la facture.

Dispositions finales

Article 23

Toute violation des présentes conditions générales, ainsi que les dommages, vandalisme, abus ou non- paiement peuvent donner lieu à une exclusion temporaire ou définitive du locataire de la liste des clients du bailleur. Dans les cas qui ne sont pas prévus dans les présentes conditions générales, le bailleur décide.

Les prix susmentionnés sont hors TVA.

Les objets perdus

Article 24

LB&O SPRL ne peut être tenu responsable de la perte d’objets. Vous avez oublié quelque chose dans un casier ? Contactez dans ce cas l’organisateur de l’événement. Si cette personne ne peut pas vous aider signalez la perte de votre objet via xxxx@xxxxxxxxxxxx.xx et donnez-en une bonne description.

- L’objet a été retrouvé

Nous vous contactons immédiatement et votre objet peut être retiré, sur rendez-vous, au siège social.

- L’objet n’a pas été retrouvé endéans les 50 jours calendrier

Nous vous avertissons que votre objet reste introuvable et que les recherches ont été stoppées. LB&O SPRL n’est pas responsable de la perte d’objets.

Vous avez trouvé quelque chose? Donnez-nous cet objet !

- Si l’objet trouvé contient des données personnelles, il sera remis à la police. La responsabilité de contacter son propriétaire incombera à celle-ci.

- Si le propriétaire n’a pu être identifié ou si les objets trouvés ne sont pas retirés endéans les 50

jours, ils seront remis au Kringwinkel.

General conditions (BV LB&O / ISG BVBA / Festivalrent / Lockerking) Definition

Article 1

BV LB&O, hereafter the lessor, is a rental company of moveable goods. The law of the Civil Code is applicable. The lessor does not rent out work.

Renting of goods is a contract where one party agrees giving the other party the benefit of a good during a certain time, for a certain price, for which the other party agrees to pay the price. The delivery and picking up of the goods is not incuded herein, however this can be handled by BV LB&O upon specific request and if an additional fee will be paid.

The tenant can use the good and has the pleasure of the good. The 2 main conditions are:

-The use and pleasure of the good

-Paying of the price

Introduction

Article 2

The general conditions are fully part of the agreement. In each offer, confirmation and invoice is referred to these general conditions. There is only a possibility to deviate from these conditions in mutual consent and in writing. The remark should be addressed to xxxx@xxxxxxxxxxxx.xx whithin 7 calendardays upon receipt of the offer, confirmation and/or invoice. Remarks by phone should be followed by an email. The lessor should provide his feedback in writing. The tenant cannot conclude that the lessor agrees, simply because he has not given any oral or written feedback.

Article 3

The goods that are delivered remain property of the lessor. The lessor ensures that the goods find themselves in good conditions. The lessor takes each possible action to ensure that the goods are rented out in good conditions. The tenant accepts the condition of the goods as soon as he starts using them. If the tenant notices flaws or goods that are damaged, he should contact the lessor upfront and in writing. Afterwards, the lessor will suggest a few possibilities. If the tenant does not agree with 1 of the possibilities, the rental agreement remains in place.

The tenant is responsible for all risks as of the delivery. The tenant should guard the goods in the same conditions as upon receipt.

Article 4

The lessor has the right to access the goods, even during the event. The lessor can give additional instructions, if required.

Offer

Article 5

Requests to rent material should be send via email or via the website to LB&O/Festivalrent/Lockerking. Renting is only possible if the request has been made within due time, so that all required actions can still be taken care off. Request that or to late could result in an increase of administrative and logistic costs.

When sending out a request, following information should be captured:

- Description if the desired goods and the quantity

- Date of delivery

- Date of picking up

- Location for the delivery (if multiple locations, please mention this)

- Notification if no clarck will be available at the location by the tenant

The goods are rented out per weekend. Article 6

Offers will be provided to the client via email. In an offer we take into account a rental period of 1 weekend. If

the client would like to rent the goods for more than 1 weekend, he should explicitly mention this to the lessor, so he can take this into account when preparing the offer.

Article 7

All offers are made for free, without any strings attached and are valid as long as the lessor has stock. Only until a written confirmation by the client, a confirmation of the rental agreement will be made, and the material will be reserved for the client (if the payment is made upfront – cf. topic payment).

Masterkeys can only be rented if a caution of EUR 10.000 is paid. If a masterkey gets lost, the entire price of all lockers will be charged, approximately EUR 50.000,00.

Confirmation of location

Article 8

The confirmation of the location mentions the total fee for renting the material. This price should be paid 10 days before the date of the delivery. Remarks with respect tot he confirmation of location should be addressed in writtin within 7 calendar days upon receipt of the confirmation of location to xxxx@xxxxxxxxxxxx.xx . Remarks provided via phone should be followed by an email.

A confirmation of location can be provided for events 1 year and a half prior to the delivery date. When by a change of law (such as change of legislation for transportation) or due to a situation beyond the power of the lessor suh as the cost for transportation will increase for the lessor, this additional cost will become due by the tenant, irrespective of the intitial price.

Article 9

If the client has not received a confirmation of location 7 calendar days before the event, please contact the lessor via email/phone to ensure a timely delivery.

Article 10

The confirmation of location mentions the preferred date of delivery and return by the client. The lessor tries to take this into account as much as possible. However, the indicated date is not binding. The delivery will be foreseen in the week before the event and the return will be foreseen in the week after the event. The exact timing will be given via email or via phone. The delivery and return is an additional service and is not the core businness of the lessor. There are no garanties with respect to timing, however the lessor will do his utmost.

An additional fee will be charged for a delivery in the weekend.

The delivery will take place on 1 place, as indicated by the lessor. A delivery on multiple places should be explicitly mentioned in the offer, so this has been taken into account when calculating the total cost.

Cancellation

Article 11

Cancelling by the tenant is only possible via email to xxxx@xxxxxxxxxxxx.xx . Cancellations via phone should be followed by an email. The costs for cancelling the event will be calculated as follows:

▪ Cancelling 14 calendar days before the date of delivery as mentioned on the confirmation oflocation: no costs for cancellation

▪ Cancelling in between 14 and 7 calendar days before the date of delivery as mentiond on theconfirmation of location: 50% cancellation costs (i.e. 50% of the total price as mentioned onthe confirmation of location)

▪ Cancelling in between 7 and 3 calendar days before the date of delivery as mentioned on theconfirmation of location: 75% cancellation costs (i.e. 75% of the total price as mentioned onthe confirmation of location)

▪ Cancelling within 3 calendar days before the date of delivery as mentioned on the confirmationof location: 100% cancellation costs (i.e. 100% of the total price as mentioned on theconfirmation of location)

▪ Cancelling after delivery: 100% cancellation costs (i.e. 100% of the total price as mentioned onthe confirmation of location)

Delivery

Article 12

The date of delivery – see supra (confirmation of location).

Not in any case will a late delivery give the right tot he tenant to refuse the goods or refuse to pay, cancelling the rental agreement or any compensation or whatsoever.

The place of delivery should be accessable for our transport services (e.g. truck). The place of delivery should be accessible without any restriction, if not additional costs will become applicable for the tenant in function of the time the trucker looses. If the lessor access the place of delivery with approval of the tenant, the tenant is responsible for any possible damage that will be made.

If no clarck (or similar) is available to the tenant, the tenant should inform the lessor via email (xxxx@xxxxxxxxxxxx.xx) within 5 working days before the date of the requested delivery.

The delivery will occor on the place as indicated by the tenant, cf. the confirmation of location. If a delivery on multiple places is requested at time of the delivery, an additional fee will become due.

The delivery means discharging the truck. The tenant himself is responsible for the placement of the rented items. If the items should be placed by the lessor, this should be requested together with the offer so a correct pricing can be given tot he tenant.

Use

Article 13

The tenant makes sure that the rented items are used for their utulization purposes, and for the remarks made by the lessor (if so).

The rented items cannot be subletted, nor provided to others to use them. The only exception here are the lockers. The tenant is responsible for the lockers if these are not used for their utulization purposes.

The lessor cannot be held responsible for any possible accidents, theft or any other possible consequences with respect tot he rented items. The tenant is responsible for all damage that has been made during the entire period of rent (this means as of the moment of delivery until the return of the items).

The tenant is obligated to provide the rented items back in clean conditions. The tenant makes sure that the rented items are in the same condition as upon delivery.

Return / Pick up

Article 14

For the return, all goods should be provided in the same conditions and in the same way as they were delivered, meaning:

▪ 28 building fences should be put in 1 station + 32 blocks + 28 clemms

▪ 10 crash barriers should be put in 1 station

▪ Nadars should be put together per 50

▪ All keys as delivered by the lessor should be provided to the tenant during the pick up.

All tie raps should be put around the items, similar tot he delivery.

If the goods are not provided as mentioned above, additional costs will be charged per hour that the driver loses time and a handling cost of EUR 175,00 in addition per each period of 2 hours. If no one can be reached by phone, the lessor can opt to leave the place and to come back later at the most convenient timing for the lessor. Additional costs will be charged. The additional costs depend on the following factors:

-Timing of picking up (in the weekend, at night, legal holidays, etc.);

-Duration of the time lost (i.e. 1 hour vs 3 hours, etc.);

-Personal decision of the driver not to gather the goods himself and to come back later at themost convenient timing fot the lessor (e.g. additional transportation costs, etc.)

-Etc.

The lessor recommends each tenant to provide the goods correct to avoid additional charges!

Upon return of the material, the items should be clean, if not, an additional fee for cleaning will be charged. If cleaning the tenant cannot foresee to provide the goods clean, please inform us upfront so a lump sum amount for cleaning can be foreseen within the offer.

When picking up the items, the lessor, or a company hired by the lessor, will try to take into account to preferred timing by the tenant. However, this is no garanty. If the pick up did not occur during during the preferred timing by the tenant, the tenant has no right to claim any discount or whatsoever on the rented items, or on the transportation costs.

If the goods are not provided as requested, or if the goods or damaged or destroyed, the following costs will be charged at the rate of a new item:

▪ building fence, crash barrier, nadar;

▪ missing tie rap;

▪ missing key for the lockers;

▪ broken key for the lockers;

▪ lock that is broken for the lockers;

▪ missing key fort he cash desks;

and 50.000,00 EUR for each missing master key

Expertising costs are at the cost of the tenant.

If damage or vandalisme can be determined by the lessor, can the lessor for definite or indefinite period of time exclude for rent, even if their is still a rental agreement in place.

No damage by nails, stickers, paint, etc. can be put on the rented items without agreement in writing by the lessor. Without the approval, all related costs will be charged tot he tenant.

When the rented items or (partly) destroyed by a fire, bad weather conditions or any other cause, will not give any right on a discount the rental price, nor will the rental price be waived. No restitution at all will be provided to the tenant. The tenant himself is responsible for foreseeing all required insurances. The lessor cannot be held responsible for accidents, theft or any other consequences during the use of the rented goods. The tenant is responsible for all damage that is made tot he rented items during the entire rental period (this means as of the moment of delivery until the return).

Complaints

Article 15

Complaints shoud be addressed via email to the lessor within 8 calendar days after receipt of the goods or receipt of the invoice. Complaints cannot give the tenant the right to cancel the rental agreement or refuse to pay partially or entirely the entire fee due. The lessor will look into the complaint within 30 calendar days.

Circumstances beyond one’s control

Article 16

The lessor cannot be held responsible for any form of circumstances beyond one’s control who will make it

entirly or partially possible to fulfill one’s obligations (amongst others: illness, death, bad wheather conditions of former events, claims in court, or any other circumstance of the lessor who will make it impossible to fulfill his obligations. Any circumstances beyond one’s control gives the lessor the right without any notification upfront to postpone or cancell the rental agreement. In this case the lessor will cancell the agreement without the possibility of he tenant to claim a compensation.

Payment / Invoices

Article 17

The payment should be made 10 calendar days before the preferred date of delivery as mentioned in the rental confirmation. No payment upfront gives the right tot he lessor to cancell the rental agreement for which the costs will be charged to the tenant immidiately and without any written or oral notification.

The invoice will be sent to the tenant after the event. No discount will be granted for cash payments.

Not paying, even partially on the due date as mentioned on the invoice has the following consequences:

▪ All invoices that are not yet paid, even if the due date is not yet arrived will become payableimmediately

▪ All discounts that are granted by the lessor and payment facilities will be cancelled;

▪ All payments are immediately and without any notification upfront increased with an interestof 1% per month, 12% per year as of the due date;

▪ All payments are increased with 15% with a minimum of EUR 125,00;

▪ Each month an administrative cost of EUR 12,00 will be charged;

Complaints with respect to the invoice or with the items mentioned on the invoice should be addressed to the lessor via xxxx@xxxxxxxxxxxx.xx within 8 calendardays upon receipt of the invoice. Notifications via phone should also be notified via email. The date of receipt of the email is valid.

When paying the invoice, even a part of the invoice, both parties understand that the delivery is accepted and approved by the client, including the price and the quality.

Not paying or late paying by the client gives the right to the lessor stop performing any services until the outstanding amount is paid. No compensation or whatsoever can be claimed by the client/tenant.

Responsibility

Article 18

The lessor can not being held responsible for accidents, irrespective of the way they occurred, to the tenant or to third persons, even persons, animals or goods, irrespective if these found themselves within our out of the unit and this during the delivery of the return or during the period in between delivery and return.

Destroying the rented items during the period of rent via fire, bad weather conditions or any other cause do not give any right to any discount (partially or fully) of the total price as mentioned on the rental agreement or any compensation or whatsoever. The tenant is responsible to conclude all required insurances.

Discussions

Article 19

In the case of a discussion, only the court of RPR Gent, division in Oostende (Belgium) are authorized.

Remarks

Article 20

All remarks regarding the general conditions, confirmation of location/rental agreement, delivery, use, return and/or invoice should be addressed via email to xxxx@xxxxxxxxxxxx.xx within 8 calendar days after:

▪ The confirmation of location was provided to you (24h when the event will take place within7 calendar days upon receipt of the confirmation of location);

▪ The delivery took place;

▪ The return took place;

▪ The invoice was sent to you;

Notifications via phone should be followed by an email. The date of the email will be taken into account.

Validation of general conditions

Article 21

In the event that 1 or multiple statements of these general conditions are invalid, does not mean that the entire rental agreement or the entire general conditions are invalid.

Insurances

Article 22

We strongly advise the tenant to conclude an all-in insurance for all rented material for their value as mentioned above. The rented items are evaluated in the premises of the lessor. If damage is noticed, the financial consequences will be taken into account in the invoice.

Final remarks

Article 23

Each violation of these general conditions, including damage, vandalisme, abuse or non payment can result in the fact that the client is excluded from our client list, even temporary or for an indefinit period of time. For all discussions that are not foreseen in these general conditions, the lessor will decide.

All above mentioned prices are excluding VAT.

Lost and Found

Article 24

BV LB&O is not responsible for any lost item. Have you lost something in a locker? Please contact the responsible person of the event. Can this person not help you, please address your lost item to xxxx@xxxxxxxxxxxx.xx and include a good description in your email.

We will contact you immediately and you can pick up your item on an timing agreed uponupfront in our premises;

- We have not found your item within 50 calendar days

We inform you that we could not find the item and that we have stopped looking BV LB&O is not responsible for lost items.

Have you found an item? please provide it to us!

- If we can retrieve information regarding the identity of the individual, than we will provide the item to the police who is than responsible for contacting you;

- If we cannot retrieve any information regarding the identity of the owner, or the item that we have found is not picked up within the 50 days, than we will provide the items to the Kringwinkel.
