hierna te noemen huurder, komen het volgende overeen:
1. Huur en verhuur, het gehuurde, bestemming
1.1 Verhuurder verhuurt aan huurder die in huur aanneemt de onzelfstandige woonruimte, gelegen aan

Huurder bezit bij het aangaan van de overeenkomst de hoedanigheid van student in de zin van artikel 7:274d lid 2 Burgerlijk Wetboek (BW) dan wel van promovendus als bedoeld in artikel 7:274e lid 2 BW, welke hoedanigheid vereist is voor het huren van de woning.
1.2 Het gehuurde omvat naast de onzelfstandige woonruimte ook de bij de woonruimte behorende voor gemeenschappelijk gebruik bestemde ruimte(n) en voorzieningen.
1.3 Het gehuurde verkeert bij aanvang van de huur in goede staat, behoudens normale slijtage. De aanwezige voorzieningen functioneren naar behoren. Huurder zal binnen bekwame tijd na ingebruikneming van de woning eventuele gebreken bij DUWO melden.
1.4 Het gehuurde is bestemd voor de huisvesting van studenten en promovendi als bedoeld in artikel 7:274d lid 2 resp. artikel 7:274e lid 2 BW. Na beëindiging van deze huurovereenkomst zal de woonruimte opnieuw worden verhuurd aan een persoon als bedoeld in deze artikelen.
1.5 Het gehuurde is uitsluitend bestemd om te dienen tot woonruimte voor huurder. Het is huurder verboden het gehuurde (in strijd met artikel 9.4 van de algemene huurvoorwaarden) geheel of gedeeltelijk in gebruik te geven aan derden, onder te verhuren of (in strijd met artikel 9.3 van de algemene huurvoorwaarden) op welke andere wijze dan ook te onttrekken aan de bestemming.
Bij overtreding van dit verbod verbeurt huurder aan verhuurder een direct opeisbare boeten van € 1.500,- te vermeerderen met een boete van € 50,- per dag dat de overtreding voortduurt, tot een maximum van € 15.000,-. Daarnaast heeft DUWO in afwijking van artikel 6:92 BW de keuze in plaats van de boete volledige schadevergoeding op grond van de wet te vorderen.
2. Duur van de huurovereenkomst
De huurovereenkomst wordt met ingang van {contractOriginalStartDateFull} aangegaan voor onbepaalde tijd.
3. Huurprijs en servicekosten
3.1 De huurprijs (ook 'kale huur') bedraagt bij aanvang van de huur € {netRentTotal}
3.2 Het verrekenbare voorschot op de kosten van bijkomende leveringen en diensten (de zgn. servicekosten) alsmede de gebruiksbelastingen zijn bij aanvang van de huur als volgt samengesteld, in totaal € {serviceCostsTotal}.
3.3 De huurovereenkomst omvat de volgende bijkomende leveringen en diensten:

3.4 Het bij aanvang van de huur maandelijks door de huurder te betalen bedrag komt daarmee op totaal €
{totalRentInclTotal}.
3.5 Het totaalbedrag moet vooruit worden voldaan en dient uiterlijk op de eerste van de maand in het bezit te zijn van de verhuurder. In geval deze overeenkomst met meerdere huurders is aangegaan is het totaalbedrag slechts eenmaal per maand verschuldigd.
4. Doorstroming
4.1 Het is huurder bekend dat verhuurder een actief doorstromingsbeleid voert, erop gericht om het complex zoveel mogelijk en blijvend te laten beantwoorden aan zijn bestemming voor de huisvesting van studenten en promovendi.
4.2 Zodra de huurder niet langer kan worden aangemerkt als student in de zin van artikel 7:274d lid 2 BW of als promovendus in de zin van artikel 7:274e lid 2, doet huurder hiervan via het huurdersportaal mededeling aan verhuurder.
4.3 Huurder verklaart geen bezwaar te hebben tegen het, minimaal één maal per jaar, verstrekken van informatie door de onderwijsinstelling aan verhuurder over het al dan niet aangemerkt kunnen worden als student of promovendus in de zin van de genoemde bepalingen.
4.4 Huurder zal op eerste verzoek van verhuurder aan verhuurder binnen drie maanden informatie verstrekken over het al dan niet ingeschreven staan als student of promovendus in de zin van de genoemde bepalingen, onder overlegging van de nodige bewijsstukken, indien van toepassing.
4.5 In geval huurder gedurende de huurtijd op enig moment zijn studie of promotie aan de onderwijsinstelling als bedoeld in 4.4 beëindigt, zal huurder zijn medewerking verlenen aan de realisering van het doorstromingsbeleid van verhuurder door de huurovereenkomst binnen zes maanden na beëindiging van de studie te beëindigen, hetzij door in te stemmen met opzegging zijdens de verhuurder, hetzij door de huurovereenkomst zelf door opzegging te beëindigen.
4.6 Huurder zal zich vanaf het moment dat hij kennis draagt van de datum van beëindiging van zijn studie maximaal inspannen om zo spoedig mogelijk vervangende woonruimte te vinden. Deze inspanning zal huurder onder meer leveren door zich, voor zover dat binnen de geldende woonruimteverdelingsregels mogelijk is, actief als woningzoekende op te stellen.
4.7 Indien huurder de huurovereenkomst niet zelf heeft opgezegd tegen het einde van de zesde maand na beëindiging van zijn studie en evenmin heeft ingestemd met opzegging door de verhuurder tegen dat tijdstip, zal verhuurder beëindiging van de huurovereenkomst vorderen bij de bevoegde rechter.
4.8 Indien huurder niet aantoont ingeschreven te staan en evenmin instemt met beëindiging van het huurcontract, maar vóór betekening van de dagvaarding in de beëindigingprocedure alsnog aantoont
ingeschreven te staan aan een onderwijsinstelling als bedoeld in 4.4, is huurder gehouden de door verhuurder gemaakte werkelijke kosten gemoeid met de voorbereiding van de procedure te vergoeden, met een minimum van € 60,00.
5. Hospiteren
Huurder heeft het recht om, bij beëindiging van een huurovereenkomst met één van de andere huurders vande tot de afdeling behorende onzelfstandige woonruimten, met de overige huurders van die onzelfstandige woonruimten een nieuwe bewoner aan te wijzen, overeenkomstig de hospiteerregels zoals die door verhuurder in overleg met de huurderorganisaties waar verhuurder een samenwerkingsovereenkomst mee heeft gesloten, zijn vastgesteld en zoals die gelden op het moment van de huurbeëindiging, als bedoeld in de vorige zin.
6. Voorwaarden
6.1 Huurder verklaart bij het aangaan van de huurovereenkomst een exemplaar te hebben ontvangen van de Huurvoorwaarden (versie 2021), die van toepassing zijn op deze huurovereenkomst.
6.2 Verhuurder verwerkt persoonsgegevens van huurder conform de op de website van verhuurder weergegeven privacyverklaring en huurder stemt hiermee in.
7. Slotbepaling
Deze overeenkomst is bij wijze van dienstverlening aan huurder zowel in het Nederlands als in het Engels opgesteld. De vertaling naar het Engels is met de grootst mogelijke zorg uitgevoerd. Bij eventuele geschillen over de uitleg van deze overeenkomst is de Nederlandstalige tekst doorslaggevend.

hereinafter: the Tenant, agree as follows:
1. Tenancies, the rented property, purpose
1.1 The Lessor rents to the Tenant, who accepts the renting of the non-self-contained housing located at

On conclusion of the lease, the tenant qualifies as a student in the sense of Article 7:274d Paragraph 2 Dutch Civil Code or of doctorate candidate in the sense of Article 7:274e Paragraph 2 Dutch Civil Code, which capacity is prescribed for the leasing of the housing.
1.2 In addition to the non-self-contained housing, the rented property includes any areas intended for common use that are part of the accommodation as well as any shared facilities.
1.3 The property is at the time of commencement of the lease in a good condition, subject to normal wear and tear. The available facilities function adequately. The tenant will promptly after occupying the property report any defects to DUWO.
1.4 The property is intended for the housing of students and doctorate candidates in the sense of Article 7:274d Paragraph 2 and Article 7:274e Paragraph 2 Dutch Civil Code, respectively. On termination of this tenancy agreement, the property will again be let to a person as referred to in said articles.
1.5 The rented property is exclusively intended for residential use by the tenant. The tenant is not allowed to make the rented property, in whole or in part, available to third parties (as per article 9.4 of the tenancy regulations), to sublet the rented property, or to change its purpose in any other manner whatsoever (as per article 9.3 of the tenancy regulations).
The tenant will upon infringement of this prohibition owe an immediately claimable penalty of € 1,500, to be increased with a fine of € 50 for each day the violation continuous, up to a maximum of € 15,000. In addition, by way of derogation from article 6:92 CC, DUWO by law has the right to claim full compensation instead of the penalty.
2. Duration of the tenancy agreement
The tenancy agreement enters into effect on {contractOriginalStartDate} for an indefinite period.
3. Rental price and service costs
3.1 At the start of the rental period, the rental price (also 'basic rent') will be € {netRent1} per month.
3.2 The deductible advance payment for the costs of additional deliveries and services (the so-called service costs) as well as the consumption taxes are determined at the start of the rental period, as follows,

3.3 The tenancy agreement comprises the following supplementary supplies and services:

3.4 The rental price at the start of the rental period, to be paid monthly by the Tenant, consequently totals an amount of €
{netTotalRent}.
3.5 The total amount must be paid in advance and must be received by the Lessor no later than on the first day of the month. In the event that this agreement has been entered into with multiple tenants, the total amount is due only once a month.
4. Housing circulation
4.1 The tenant acknowledges that the lessor actively pursues a housing circulation policy in order to have the complex fulfil, as much as possible and permanently, its purpose of housing students and doctoral candidates.
4.2 The tenant will inform the lessor by means of the tenant portal as soon as he no longer qualifies as a student in the sense of Article 7:274d Paragraph 2 or as doctorate candidate in the sense of Article 7:274e Paragraph 2 Dutch Civil Code.
4.3 The tenant declares to have no objection against the provision, at least once a year, by the educational institution to the lessor of information regarding whether or not he qualifies as a student or doctorate candidates in the sense of the aforementioned provisions.
4.4 The tenant will at the first request of the lessor provide information on whether or not he is registered as a student or doctorate candidate in the sense of the aforementioned provisions, with submission of the necessary documentary evidence, if applicable.
4.5 If the tenant during the rental period ceases his studies or doctorate activities at the educational institution as referred to in 4.4, the tenant will cooperate in the realisation of the housing circulation policy of the lessor by terminating the tenancy agreement within six months of ending his studies, either by cooperating in termination by the lessor or by doing so himself.
4.6 From the moment that they are aware of the date of termination of their studies, the tenant will make every effort to find alternative housing as soon as possible. This effort will include, as far as possible within the rules applicable to housing allocation, becoming an active house hunter.
4.7 If the tenant has not terminated the lease effective at the end of the sixth month after termination of his studies and has not agreed to termination by the lessor effective at the time, the lessor will request that the court terminate the tenancy agreement.
4.8 If the tenant neither submits proof of registration, nor consents to the termination of the tenancy agreement, but proves to be enrolled at an educational institution as referred to in 4.4 before service of the writ, the tenant will be held to reimburse the lessor for actual costs resulting from the preparation of the procedure, with a minimum of €60.
5. Voting in
5.1 Upon termination of a tenancy agreement with one of the other tenants of the non-self-contained housing belonging to the department, the tenant is entitled, together with the other tenants, to nominate a new resident in accordance with the vote-in regulations as they have been adopted by the lessor in consultation with the residents' organisations with which the lessor has concluded a cooperation agreement, as they are in force at the time of the termination of the tenancy agreement referred to in the beginning of the sentence.
6. Conditions
6.1 The tenant declares to have received a copy of the tenancy regulations (2021 version) at the time of entering into the tenancy agreement, which is applicable on this tenancy agreement.
6.2 The lessor will process the personal data of the tenant in accordance with the privacy statement on the website of the lessor, to which the tenant agrees.
7. Final clause
7.1 This agreement has been drawn up in both Dutch and English by way of service to the tenant. It has been translated into English with the greatest possible care. The Dutch text prevails if there are any disputes about the explanation of this agreement.
