The Embassy of Switzerland presents its compliments to the Ministry of Foreign Affairs of the Kingdom of the Netherlands and has the hon- our to propose, with reference to the Co-operation Agreement between Switzerland and the European Police Office of 24 September 2004 (here- inafter ‘‘the Agreement’’), and in view of Article 41, paragraph 2 of the Convention based on Article K.3 of the Treaty on European Union, on the establishment of a European Police Office (Europol Convention,
26 July 1995), that the privileges and immunities necessary for the proper performance of the tasks of the liaison officers at Europol referr- ed to in Article 14 and Xxxxx XXX of the Agreement, be agreed upon as set out in the Attachment.
If this proposal is acceptable to the Ministry, the Embassy proposes that this note and the affirmative note of the Ministry shall constitute an Agreement between Switzerland and the Kingdom of the Netherlands,
which shall be applied provisionally from the day on which this affirma- tive note has been received by the Embassy, but not before the date the Agreement between Switzerland and the European Police Office of 24 September 2004 enters into force.
The Embassy of Switzerland avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Kingdom of the Netherlands the assurances of its highest consideration.

Attachment
1. Definitions
In this Agreement:
a). ‘‘Liaison officer’’ means: any official stationed at Europol in ac- cordance with Article 14 of the Agreement;
b) ‘‘Government’’ means the Government of the Kingdom of the Netherlands;
c) ‘‘Host State authorities’’ means such State, municipal or other authorities of the Kingdom of the Netherlands as may be appropriate in the context of and in accordance with the laws and customs applicable in the Kingdom of the Netherlands;
d) ‘‘Sending State’’ means Switzerland;
e) ‘‘Archives of the liaison officer’’ means all records, correspond- ence, documents, manuscripts, computer and media data, photographs, films, video and sound recordings belonging to or held by the liaison officer, and any other similar material which in the unanimous opinion of the Sending State and the Government forms part of the archives of the liaison officer.
2. Privileges and immunities
1. Subject to the provisions of this Agreement, the liaison officer and members of his family who form part of his household and do not pos- sess Dutch nationality, shall enjoy in and vis-à-vis the Kingdom of the Netherlands the same privileges and immunities as are conferred on members of the diplomatic staff by the Vienna Convention on Diplo- matic Relations of 18 April 1961.
2. The immunity granted to persons mentioned in paragraph 1 of this Article shall not extend to either:
(i) civil action by a third party for damages, including personal injury or death, arising from a traffic accident caused by any such per- son; or
(ii) criminal and civil jurisdiction over acts performed outside the course of their official duties.
3. The obligations of Sending States and their personnel that apply under the Vienna Convention to members of the diplomatic staff, shall apply to the persons referred to in paragraph 1 of this Article.
3. Entry, stay and departure
1. The Government shall facilitate, if necessary, the entry, stay and departure of the liaison officer and members of his family forming part of the household.
2. This Article shall not prevent the requirement of reasonable evi- dence to establish that persons claiming the treatment provided for under this Article come within the classes described in paragraph 1 of this Arti- cle.
3. Visas which may be required by persons referred to in this Article shall be granted without charge and as promptly as possible.
4. Employment
Members of the family forming part of the household of the liaison officer not having the nationality of an EU Member State shall be exempt from the obligation to obtain working permits for the duration of the secondment of the liaison officer.
5. Inviolability of archives
The archives of the liaison officer wherever located and by whomso- ever held shall be inviolable.
6. Personal Protection
The Host State authorities shall, if so requested by the Sending State, take all reasonable steps in accordance with their national laws to ensure the necessary safety and protection of the liaison officer, as well as mem- bers of his family who form part of his household, whose security is endangered due to the performance of the tasks of the liaison officer at Europol.
7. Facilities and immunities in respect of communication
1. The Government shall permit the liaison officer to communicate freely and without a need for special permission, for all official purposes, and shall protect the right of the liaison officer to do so. The liaison officer shall have the right to use codes and to dispatch and receive offi- cial correspondence and other official communications by courier or in sealed bags which shall be subject to the same privileges and immuni- ties as diplomatic couriers and bags.
2. The liaison officer shall, as far as may be compatible with the Inter- national Telecommunications Convention of 6 November 1982, for his official communications enjoy treatment not less favourable than that accorded by the Kingdom of the Netherlands to any international organi- sation or government, in the matter of priorities for communication by mail, cable, telegraph, telex, radio, television, telephone, fax, satellite, or other means.
8. Notification
1. The Sending State shall promptly notify the Government of the name of the liaison officer, his arrival and his final departure or the ter- mination of his secondment as well as the arrival and final departure of the members of the family forming part of the household and, where appropriate, the fact that a person has ceased to form part of the house- hold.
2. The Government shall issue to the liaison officer and members of his family forming part of the household, an identification card bearing the photograph of the holder. This card shall serve to identify the holder in relation to all Host State authorities.
9. Settlement of Disputes
1. Any dispute between the Sending State and the Government concerning the interpretation or application of this Agreement, or any question affecting the liaison officer or the relationship between the Sending State and the Government which is not settled amicably, shall be referred for final decision to a tribunal of three arbitrators, at the request of the Sending State or the Government. Each party shall appoint one arbitrator. The third, who shall be chairman of the tribunal, is to be chosen by the first two arbitrators.
2. If one of the parties fails to appoint an arbitrator within two months following a request from the other party to make such an appointment, the other party may request the President of the Court of Justice of the European Communities or in his absence the Vice-President, to make such an appointment.
3. Should the first two arbitrators fail to agree upon the third within two months following their appointment, either party may request the President of the Court of Justice of the European Communities, or in his absence the Vice-President, to make such appointment.
4. Unless the parties agree otherwise, the tribunal shall determine its own procedure.
5. The tribunal shall reach its decision by a majority of votes. The Chairman shall have a casting vote. The decision shall be final and bind- ing on the Parties to the dispute.
10. Territorial scope
With respect to the Kingdom of the Netherlands, this Agreement shall apply to the part of the Kingdom in Europe only.

The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents its compliments to the Embassy of Switzerland and has the hon- our to confirm receipt of Note no. 4 – 2006, dated 11 January 2006, concerning the proposal to conclude an Agreement between the King- dom of the Netherlands and Switzerland on the privileges and immuni- ties of the Swiss liaison officers at Europol which reads as follows:

The Ministry has the honour to inform the Embassy that the Govern- ment of the Kingdom of the Netherlands agrees to the contents of the above-mentioned Note, and that the Embassy’s Note and this Note expressing the agreement of the Government of the Kingdom of the Netherlands shall constitute an Agreement between the Kingdom of the Netherlands and Switzerland, which shall be applied provisionally from the day on which this affirmative note has been received by the Embassy but not before the date the Agreement between Switzerland and the European Police Office of 24 September 2004 enters into force, and which shall enter into force on the first day of the second month follow-
ing the date on which the Kingdom of the Netherlands and Switzerland- have informed each other that the formalities required for the entry into force have been complied with.

Nota nr. 4 - 2006
Den Xxxx, 11 januari 2006
De Ambassade van Zwitserland biedt het Ministerie van Buitenlandse Zaken van het Koninkrijk der Nederlanden haar complimenten aan en heeft de eer onder verwijzing naar het Samenwerkingsverdrag tussen Zwitserland en de Europese Politiedienst van 24 september 2004 (hierna te noemen het Samenwerkingsverdrag), en xxxxx op artikel 41, tweede lid, van de Overeenkomst op grond van artikel K.3 van het Verdrag betreffende de Europese Unie tot oprichting van een Europese Politie- dienst (Europol-Overeenkomst, 26 juli 1995), voor te stellen dat ten aan- zien van de voorrechten en immuniteiten benodigd voor xx xxxxx taak- vervulling van de verbindingsofficieren bij Europol, bedoeld in artikel 14 en Bijlage 3 van het Samenwerkingsverdrag overeenstemming wordt bereikt zoals vervat in het Aanhangsel.
Indien dit voorstel aanvaardbaar is voor het Ministerie, stelt de Am- bassade voor dat deze nota en de bevestigende nota van het Ministerie een verdrag zullen vormen tussen Zwitserland en het Koninkrijk der Nederlanden, dat voorlopig xxx xxxxxx toegepast vanaf de dag van ont- vangst door de Ambassade van deze bevestigende nota, echter niet voor de datum waarop het Samenwerkingsverdrag tussen Zwitserland en de Europese Politiedienst van 24 september 2004 in xxxxxxx treedt.
De Ambassade van Zwitserland maakt van deze gelegenheid gebruik om het Ministerie van Buitenlandse Zaken van het Koninkrijk der Nederlanden opnieuw te verzekeren xxx xxxx zeer bijzondere hoogach- ting.

1. Begripsomschrijvingen
In dit Verdrag wordt verstaan onder:
a. ,,verbindingsofficier’’, elke functionaris die in overeenstemming met artikel 14 van het Samenwerkingsverdrag bij Europol wordt ge- plaatst;
b. ,,Regering’’, de Regering van het Koninkrijk der Nederlanden;
c. ,,autoriteiten van de gastheerstaat’’, autoriteiten van de centrale of gemeentelijke overheid of andere autoriteiten van het Koninkrijk der Nederlanden, naar gelang het geval is, in het kader van en in overeen- stemming met de wetten en gebruiken die in het Koninkrijk der Xxxxx- xxxxxx van toepassing zijn;
d. ,,zendstaat’’, Zwitserland;
e. ,,archief van de verbindingsofficier’’, alle dossiers, corresponden- tie, documenten, manuscripten, computer- en mediagegevens, foto’s, films, video- en geluidsopnamen die toebehoren aan of in het bezit zijn van de verbindingsofficier, alsmede enig ander soortgelijk materiaal dat naar het unanieme oordeel van de zendstaat en de Regering xxxx uit- maakt van het archief van de verbindingsofficier.
2. Voorrechten en immuniteiten
1. Onverminderd de bepalingen van dit Verdrag genieten de verbindingsofficier en de gezinsleden die xxxx uitmaken van zijn huis- houding en niet de Nederlandse nationaliteit bezitten, in en ten aanzien van het Koninkrijk der Nederlanden dezelfde voorrechten en immunitei- ten als die xxxxx xxxxxx verleend aan de leden van het diplomatieke personeel door het Verdrag van Wenen van 18 april 1961 inzake diplo- matiek verkeer.
2. De immuniteit die aan de in het eerste lid van dit artikel genoemde personen wordt verleend, strekt zich niet uit tot:
i. civiele vorderingen xxx xxxxxx xxxxxx xxxxxx, met inbegrip van lichamelijk letsel of overlijden ten gevolge van verkeersongevallen die door deze personen zijn veroorzaakt; of
ii. strafrechtelijke en civielrechtelijke rechtsmacht ten aanzien van
gedragingen die plaatsvinden buiten de uitoefening van hun offi- ciële taken.
3. De verplichtingen van zendstaten en hun personeel die krachtens het Verdrag van Wenen van toepassing zijn op de leden van het diplo- matieke personeel, zijn van toepassing op de in het eerste lid van dit arti- kel bedoelde personen.
3. Binnenkomst, verblijf en vertrek
1. De Regering vergemakkelijkt, indien nodig, de binnenkomst, het verblijf en het vertrek van de verbindingsofficier en van zijn gezinsleden die xxxx uitmaken van de huishouding.
2. Dit artikel laat de mogelijkheid onverlet te verlangen dat redelijk bewijs wordt geleverd waaruit blijkt dat de personen die zich op de in dit artikel bedoelde behandeling beroepen, onder de in het eerste lid van dit artikel omschreven categorieën vallen.
3. De eventueel benodigde visa voor de in dit artikel bedoelde perso- xxx xxxxxx kosteloos en zo spoedig mogelijk verstrekt.
4. Tewerkstelling
Gezinsleden die xxxx uitmaken van de huishouding van de verbindings- officier die niet de nationaliteit van een EU-lidstaat hebben, zijn voor de duur van de detachering van de verbindingsofficier vrijgesteld van de verplichting een werkvergunning te verkrijgen.
5. Onschendbaarheid van het archief
Het archief van de verbindingsofficier, waar dit zich ook bevindt en wie het ook xxxxx xxxx heeft, is onschendbaar.
6. Persoonlijke bescherming
Indien de zendstaat daarom verzoekt, nemen de autoriteiten van de gastheerstaat in overeenstemming met hun nationale wetten alle rede- lijke maatregelen om de nodige veiligheid en bescherming te waarbor- gen van de verbindingsofficier, alsmede van de gezinsleden die xxxx uit- maken van zijn huishouding, xxxx veiligheid in het geding is als gevolg van de taakvervulling van de verbindingsofficier bij Europol.
7. Faciliteiten en immuniteiten met betrekking tot berichtenverkeer
1. De Regering staat de verbindingsofficier toe vrijelijk en zonder het vereiste van bijzondere toestemming te communiceren voor alle officiële doeleinden, en beschermt dit recht van de verbindingsofficier. De verbindingsofficier is gerechtigd codes te gebruiken en officiële corres-
pondentie en andere officiële berichten te verzenden of te ontvangen per koerier of in verzegelde zakken, waarvoor dezelfde voorrechten en immuniteiten gelden als voor diplomatieke koeriers en zakken.
2. Voor zover dit verenigbaar is met het Internationaal Verdrag betref- fende de Telecommunicatie van 6 november 1982, geniet de verbindings- officier voor zijn officiële berichtenverkeer een behandeling die niet min- der gunstig is xxx die xxxxx door het Koninkrijk der Nederlanden aan een internationale organisatie of regering wordt toegekend, inzake prio- riteiten voor poststukken, kabeltelegrammen, telegrammen, telexberich- ten, radiotelegrammen, televisie-, telefoon-, fax-, satelliet- of andere ver- bindingen.
8. Kennisgeving
1. De zendstaat stelt de Regering onverwijld in kennis van de naam van de verbindingsofficier, van zijn aankomst en van zijn definitieve ver- trek of van de beëindiging van zijn detachering, alsmede van de aan- komst en het definitieve vertrek van de gezinsleden die xxxx uitmaken van de huishouding en, indien van toepassing, van het xxxx dat een per- soon niet xxxxxx xxxx uitmaakt van de huishouding.
2. De Regering verstrekt aan de verbindingsofficier en aan de gezins- leden die xxxx uitmaken van de huishouding een identiteitskaart voorzien van de foto van xx xxxxxx. Deze kaart dient ter identificatie van de hou- der ten overstaan van alle autoriteiten van de gastheerstaat.
9. Beslechting van geschillen
1. Elk geschil tussen de zendstaat en de Regering betreffende de interpretatie of toepassing van dit Verdrag dat, of enige kwestie die betrekking heeft op de verbindingsofficier of op de verhouding tussen de zendstaat en de Regering die niet in der minne wordt geschikt, wordt, op verzoek van de zendstaat of van de Regering, ter onherroepelijke beslis- sing voorgelegd aan een scheidsgerecht bestaande uit drie scheidsrech- ters. Elke partij benoemt een scheidsrechter. De derde scheidsrechter, die voorzitter van het scheidsgerecht zal zijn, wordt gekozen door de eerste twee scheidsrechters.
2. Indien een van de partijen verzuimt een scheidsrechter xx xxxxx- men binnen twee maanden na een verzoek van de andere partij een der- gelijke benoeming te verrichten, kan de andere partij de President van het Hof van Justitie van de Europese Gemeenschappen, of in zijn afwe- zigheid de Vice-President, verzoeken deze benoeming te verrichten.
3. Indien de eerste twee scheidsrechters binnen twee maanden na hun benoeming geen overeenstemming bereiken over de derde, xxx xxxx par-
tij de President van het Hof van Justitie van de Europese Gemeenschap- pen, of in zijn afwezigheid de Vice-President, verzoeken deze benoe- ming te verrichten.
4. Tenzij de partijen anders overeenkomen, stelt het scheidsgerecht zijn eigen procedure vast.
5. Het scheidsgerecht neemt zijn beslissing bij meerderheid van stem- men. De voorzitter heeft een beslissende stem. De beslissing is onher- roepelijk en bindend voor de partijen bij het geschil.
10. Territoriale reikwijdte
Wat het Koninkrijk der Nederlanden betreft, is dit Verdrag slechts van toepassing op het xxxx van het Koninkrijk in Europa.

Het Ministerie van Buitenlandse Zaken van het Koninkrijk der Xxxxx- xxxxxx biedt de Ambassade van Zwitserland zijn complimenten aan en heeft de eer de ontvangst te bevestigen van nota 4-2006 van 11 januari 2006 betreffende het voorstel tot sluiten van een Verdrag tussen het Koninkrijk der Nederlanden en Zwitserland inzake de voorrechten en immuniteiten van de Zwitserse verbindingsofficieren bij Europol dat luidt als volgt:

Het Ministerie heeft de eer de Ambassade xxxxx in xxxxxx xx stellen dat de Regering van het Koninkrijk der Nederlanden instemt met de inhoud van de bovengenoemde nota en dat de nota van de Ambassade en deze nota waarin de Regering van het Koninkrijk der Nederlanden haar instemming kenbaar maakt een verdrag zullen vormen tussen het Koninkrijk der Nederlanden en Zwitserland, dat voorlopig xxx xxxxxx toegepast vanaf de dag van ontvangst door de Ambassade van deze bevestigende nota, echter niet voor de datum waarop het Samenwerkings- verdrag tussen Zwitserland en de Europese Politiedienst van 24 septem- ber 2004 in xxxxxxx treedt, en dat in xxxxxxx xxx treden op de eerste dag van de tweede maand volgend op de dag waarop het Koninkrijk der
Nederlanden en Zwitserland elkaar hebben medegedeeld dat aan de voor de inwerkingtreding vereiste formaliteiten is voldaan.

D. PARLEMENT
Het in de nota’s vervatte verdrag, met bijlage, behoeft ingevolge arti- kel 91 van de Grondwet de goedkeuring van de Staten-Generaal, xxxx- xxxx het Koninkrijk aan het verdrag xxx xxxxxx gebonden.
F. VOORLOPIGE TOEPASSING
Het in de nota’s vervatte verdrag, met bijlage, wordt ingevolge het in de op één na laatste alinea van nota Nr. I en de laatste alinea van nota Nr. II gestelde vanaf 21 April 2006 voorlopig toegepast.
Wat het Koninkrijk der Nederlanden betreft, geldt de voorlopige toe- passing ingevolge punt 10 van de bijlage alleen voor Nederland.
G. INWERKINGTREDING
De bepalingen van het in de nota’s vervatte verdrag, met bijlage, zul- len ingevolge het in de één na laatste alinea van nota Nr. I en de laatste alinea van nota Nr. II gestelde in xxxxxxx xxxxxx op de eerste dag van de tweede maand volgend op de dag waarop het Koninkrijk der Xxxxx- xxxxxx en Zwitserland elkaar hebben medegedeeld dat aan de voor de inwerkingtreding vereiste formaliteiten is voldaan.
