Het Vlaams Woninghuurdecreet voor studentenhuisvesting in werking sinds 1 januari 2019

Vlaams Woninghuurdecreet

Het Vlaams parlement keurde op 24 oktober 2018 het Vlaams Woninghuurdecreet definitief goed.

Het Vlaams Woninghuurdecreet is van toepassing op huurovereenkomsten voor een woning als hoofdverblijfplaats [1] en huurovereenkomsten voor studentenhuisvesting[2]. Voor de overige huurovereenkomsten blijft de oude regelgeving van toepassing.

De nieuwe bepalingen van het Vlaams Woninghuurdecreet zijn sinds 1 januari 2019 van toepassing.[3] Dit wil zeggen dat alle huurovereenkomsten gesloten voor een woning als hoofdverblijfplaats of studentenhuisvesting gelegen in het Vlaamse gewest, vanaf 1 januari 2019 onder deze nieuwe regelgeving vallen.

Het Vlaams Woninghuurdecreet is niet van toepassing op lopende huurovereenkomsten, waardoor nog ruime tijd beide regelgevingen naast elkaar zullen worden gebruikt. De datum van ondertekening is hiervoor bepalend.

We bespraken de huurovereenkomst voor een woning als hoofdverblijfplaats in onze vorige bijdrage. Deze bijdrage zal de huurovereenkomst voor studentenhuisvesting behandelen.

Studentenhuisvesting ?

Een ‘student’ betreft iedere persoon die ingeschreven is bij een instelling die voltijds onderwijs aanbiedt of een schoolverlater die de wachtperiode doorloopt. Het gehuurde goed mag niet tot hoofdverblijf worden bestemd.[4]

Belangrijkste wijzigingen

Enkele belangrijke wijzigingen voor huurovereenkomsten voor studentenhuisvesting in het Vlaams Woninghuurdecreet zijn:

Uitzondering op verbod op overdracht/onderhuur[5]: een verhuurder zal thans verplicht zijn in te stemmen met overdracht of onderhuur aan een andere student als de huurder deelneemt aan een studie- uitwisselingsprogramma of een stage volbrengt.

Een weigering om gegronde redenen blijft nog wel mogelijk.

De huurprijs moet alle kosten en lasten bevatten[6] dit met uitzondering van het verbruik van energie, water en telecommunicatie (wel bijvoorbeeld kosten onderhoud gemeenschappelijke delen, jaarlijks onderhoud lift etc.).

Huurwaarborg[7]: De huurwaarborg mag maximaal twee maanden huurgelden bedragen en dient maximaal twee maanden voor de start van de studentenhuurovereenkomst te worden xxxxxxxxx.Xx huurwaarborg dient te worden gestort op een geblokkeerde rekening, een rekening bij een zakelijke zekerheidsstelling of op rekening van de xxxxxxxxxx.Xx huurwaarborg dient te worden terug gegeven binnen drie maanden na verlaten van het pand.

Onderhouds- en herstellingsplicht[8]: In praktijk leidt de onderhouds- en herstellingsplicht vaak tot discussie tussen student en verhuurder gezien het voor interpretatie vatbaar is wat men onder ‘een kleine herstelling’ diende te verstaan. Om hieraan een einde te maken, stelde de Vlaamse regering een lijst op van deze kleine herstellingen: Bijlage 4: Lijst van kleine herstellingen als vermeld in artikel 7.

Verbod op stilzwijgende verlening[9] De huurovereenkomst zal eindigen na verloop van de in de overeenkomst vermelde duur en dient niet uitdrukkelijk te worden opgezegd door de student of de verhuurder. Indien partijen de huurovereenkomst toch willen verder zetten, dienen zij een nieuwe huurovereenkomst te sluiten. Opgelet!

Einde huur[10]:

1. de huurovereenkomst kan worden opgezegd voor inwerkingtreding van de huurovereenkomst.Indien de huurovereenkomst wordt opgezegd binnen twee maanden voor aanvang van de huurovereenkomst, is een

opzegvergoeding van 2 maanden huurgelden verschuldigd.! Dit is zeer opmerkelijk, dit heeft namelijk tot gevolg dat een studentenhuurovereenkomst dewelke normaliter in september zou ingaan, nog kan worden opgezegd tot de voorafgaande maand juni zonder dat een opzegvergoeding verschuldigd is. Hierdoor zal de verhuurder mogelijks op zeer korte termijn op zoek dienen te gaan naar een nieuwe huurder.

2. Einde van de huurovereenkomst bij het einde van de studie.Indien de opzegtermijn van twee maanden wordt nageleefd, is geen schadevergoeding verschuldigd.

3. Overlijden van één van de ouders of een andere persoon die instaat voor het onderhoud van de huurder.

Indien de opzegtermijn van twee maanden wordt nageleefd, is geen schadevergoeding verschuldigd.

4. Overlijden van de huurder. de studentenhuurovereenkomst zal van rechtswege worden ontbonden.

Xx Xxxxxxxxx xxxxxxx a adopté définitivement le décret flamand sur les baux d’habitation le 24 octobre 2018.

Ce décret concerne les contrats de bail de résidence principale[1] et les contrats de location des logements étudiants.[2] L’ancienne réglementation reste applicable aux autres types de location.

Les nouvelles dispositions du Décret flamand des baux d’habitation sont en vigueur depuis le 1er janvier 2019.[3] Ce qui veut dire que les contrats de baux de résidence principale et de logement d’étudiant conclus depuis le 1er janvier 2019 sont soumis aux nouvelles dispositions.

Le Décret flamand sur les baux d’habitation n’est pas applicable aux contrats en cours, ce qui veut dire que les deux législations devront être utilisées en parallèle. La date de signature du contrat sera dans ce cas-ci déterminante.

Notre contribution précédente porte sur le contrat de bail de de résidence principale. La présente contribution porte sur les logements étudiants.

Logements étudiants ?

Il faut entendre par « étudiant » : chaque personne inscrite dans une institution qui offre un enseignement à temps plein ou à temps partiel. Le bien loué ne peut pas être l’habitation principale de l’étudiant.[4]

Changements importants

Quelques changements importants pour les contrats de location de logements étudiants dans le Décret flamand sur les baux d’habitation:

Exception d’interdiction de cession/sous-location[5]: le bailleur sera maintenant obligé d’accepter la cession ou la sous-location à un autre étudiant si le locataire participe à un programme d’échange ou à un stage.

Le bailleur peut toujours refuser pour une raison motivée.

Le loyer doit comprendre tous les frais[6], à l’exception de l’énergie, de l’eau et de la télécommunication (comme par exemple les frais d’entretien des parties communes, l’entretien annuel de l’ascenseur, etc.)

La garantie locative[7]: la garantie locative ne peut être supérieure à deux mois de loyer et doit être constituée maximum deux mois avant le début du contrat de xxxxxxxx.Xx garantie locative devra être constituée sur un compte bloqué, sur un compte de sécurité sociale ou sur un compte xx xxx xx xxxxxxxx.Xx xxxxxxxx xxxxxxxx xxxxx xxxx xxxxxxxxx xxx xx xxxxxxxxx xx plus tard trois mois après avoir quitté le logement.

Devoir d’entretien et de réparation[8]: En pratique, il y a souvent des discussions entre le bailleur et l’étudiant au sujet du devoir d’entretien et de réparation parce que le terme « petites réparations » est souvent sujet à interprétation. Pour mettre un terme aux discussions, le gouvernement flamand a dressé une liste des « petites réparations » : annexe 4 : Liste des petites réparations au sens de l’article 7.

Interdiction de la tacite reconduction[9]: le contrat de location prendra fin au terme de la période stipulée dans le contrat et ni le locataire ni le bailleur ne devra y mettre fin explicitement. Si une des parties souhaite prolonger la location, il devra conclure un nouveau contrat.Attention !

Fin du contrat[10]:

1. Le contrat pourra être résilié avant son entrée en xxxxxxx.Xx le contrat est résilié dans les deux mois précédant le début du contrat, une indemnité de deux mois sera due.! Remarque importante, car cela signifie qu’un contrat de location d’étudiant qui commencerait normalement en septembre peut encore être résilié jusqu’au mois de juin sans qu’aucun préavis ne soit due. Par conséquent, il se peut que le propriétaire doive chercher un nouveau locataire à très court délai.

2. Fin du contrat à la fin des études.

Si le terme de deux mois est respecté, aucune indemnité n’est due.

3. Xxxxx d’un des parents ou d’une des personnes responsable de l’entretien du locataire.

4. Décès du locataire : le contrat sera résilié de plein droit.

Vlaams Woninghuurdecreet

The Flemish parliament definitively approved the “Vlaams Woninghuurdecreet”on 24 October 2018.

The “Vlaams Woninghuurdecreet”applies to rental contracts for a house as primary residence[1] and rental contracts for student accommodation.[2] The old regulations continue to apply to the other rental contracts

The new provisions of the “Vlaams Woninghuurdecreet” apply since 1 January 2019.[3] This means all rental contracts concluded for a house as a primary residence or student accommodation located in the Flemish Region will be subject to this new regulation starting from 1 January 2019.

The “Vlaams Woninghuurdecreet” doesn’t apply to ongoing rental agreements, which means both regulations will be used next to one another for a while. The date of signing is determinant in this respect.

We discussed the rental contract for a house as primary residence in our previous article. This article will discuss the rental contract for student accommodation.

Student accommodation?

A ‘student’ refers to any person registered at an institution that offers full-time education or a school-leaver who completes the waiting period. The rented property may not be used as the primary residence.[4]

Exception to the prohibition of transfer/subletting[5]: a lessor will now be obliged to agree to transfer or subletting to another student if the tenant participates in a study exchange programme or completes an internship.

A refusal for well-founded reasons (“gegronde redenen”) remains possible. The rental fee must include all costs and charges[6] with the exception of the consumption of energy, water and telecommunications (for example, costs of maintenance of common parts, annual elevator maintenance, etc.).

Rental guarantee[7] : The rental guarantee may not exceed two months’ rent and must be provided up to two months before the start of the student rental agreement.

The rental guarantee must be deposited into a blocked account, an account with a security deposit or the landlord’s account.

The rental guarantee must be returned within three months of leaving the property.

Maintenance and repair obligation[8] : In practice, the maintenance and repair obligation often leads to discussion between the student and the lessor, as it is open to interpretation what is meant by a ‘minor repair’. To put an end to this, the Flemish government drew up a list of these small repairs: Annex 4: List of small repairs as mentioned in article 7.

Prohibition of tacit renewal[9]: The rental agreement will end after the expiry of the term stated in the agreement and does not need to be explicitly terminated by the student or the lessor. If the parties nevertheless wish to

continue the rental agreement, they must conclude a new rental agreement. Attention!

End of the rent[10]:

1. the rental agreement can be terminated before the rental agreement comes into effect.If the rental agreement is terminated within two months before commencement of the rental agreement, a termination fee of 2 months rent is due.! This is very remarkable, as it means that a student rental agreement which normally would start in September, can still be terminated until the previous month of June without a termination fee being due. As a result, the lessor may have to look for a new tenant at very short notice.

2. End of the rental agreement at the end of the study.If the two-month notice period is observed, no compensation is due.

3. Death of one of the parents or another person responsible for the maintenance of the tenant.If the two-month notice period is observed, no compensation is due.

4. Death of the tenant. The student rental agreement will be terminated automatically.
