I / we hereby tender to execute the above- mentioned work on piece work basis and in

accordance with the terms & conditions of the quotations and as per specifications, in consideration of payment being made for the quantity of work executed at the tendered rates / percentage indicated in Schedule ‘A’ hereto. The cost of materials is to be suplied by the Corporation under Schedule ‘B’ shall be paid by us at the rates indicated therein.

CONDITION OF TENDER AND INSTRUCTION TO TENDERERS

1. The Tender, as submitted by the Tenderer shall consist of the complete set of Tender documents, duly filled in and initialed on each page and signed by the Tender at the prescribed places.

2. Submission of a Tender by a Tenderer implies that he has read the conditions of Tender and instructions to the Tenderer as also other relevant documents and has made himself aware of the scope of work and specification of the work to be done and conditions and other factors bearing on execution of the work.

3. The Tenderer shall submit the Tender which satisfies each and every condition laid down in the document, failing which the Tender will be rejected.

4. The Tenderers are advised to visit the site sufficiently in advance of the date of receipt of Tender. The Tenderers are deemed to have full knowledge of the site and scope of work and local conditions, whether they inspect them or not. They are also supposed to have full knowledge about the relevant document, sample, specifications etc.

5. The Tenderers shall pay a sum as shown in the Tender notice as xxxxxxx money deposit, in form of DD/Pay Order, in favor of PANVEL MUNICIPAL CORPORATION failing which the Tender will be rejected.

6. The Xxxxxxx money deposit by the unsuccessful Tenderers shall be refunded. The xxxxxxx money deposit of the successful Tenderer shall be adjusted towards the security deposit. No interest shall be allowed on the xxxxxxx money deposit.

7. The Tender/offer shall be valid for acceptance, for a period of 120 days from the date of submission.

8. The acceptance of Tender on behalf of the corporation will be done by the officer to whom such powers have been delegated. The corporation is not bound to accept the lowest or any other Tender. The right to reject any or all Tenders, without assigning any reasons, whatsoever, is reserved.

9. On acceptance of the Tender, the contractor shall have to pay security deposite at the rate of 5% of the value of work. The same will be released to the contractor after completion of the defect liability period

10. The contractor shall have to make his own arrangements for water supply and electricity required for the work

11. The work is to be completed in a time bound manner, within the period stipulated in the Tender notice, or as indicated by the Engineer-In-Charge.

12. The work will be executed in strict accordance with the accepted Tenders and conditions mentioned there under. The work shall be carried out with due care only after inspection of the work. The work shall not be considered as complete, unless defects are rectified and the site is cleared of surplus materials, scaffolding,. Rubbish etc.

13. All work are to be executed in a workmanlike manner. The work is to be executed as per the specifications contained in the Standard Specifications of the P.W & H. Department and relevant Indian Standard Specifications.

14. The material used, when supplied by the contractor, shall be of best quality available in the market. A sample shall be got approved from the Engineer-In-Charge before using the same in the works.

15. All the materials supplied to the contractor, however, shall remain the absolute property of the Corporation. The materials shall not be removed from the work site without the permission of the Engineer-In-Charge. No advance payment against material brought on site shall be made.

16. The quality of work executed shall be measured and paid at least once in a month or any such interval of time as decided by the Engineer-In-Charge. A deduction of 3% to 10% at the discretion of Engineer-In-Charge shall be made in the bill to safeguard against the over payment or bad work. The amount so deducted shall be released at the time of final bill payment, subject to the contract rectifying any defect pointed out to the entire satisfaction of the Engineer-In-Charge.

17. The rates of several items of work agreed to shall be valid when the item concerned is accepted as having been completed fully in accordance with sanctioned specification. In cases where the item of work are not accepted as so completed, the Engineer-in-Charge may make payment on account of such item at such reduced rates as he may considered reasonable in preparation of running account bill/ final bill.

18. The payment to the contractor shall be made by cheque /RTGS.

19. The contractor shall be furnished with a completion certificate by the Engineer-in-Charge. The Engineer-in-Charge may put an end this agreement at any time in cases of bad workmanship or substandard material used in work. The Engineer-in-Charge may also reduce the scope of work and put an end to this agreement at any time without assigning any reason whatsoever and notice thereof.

20. The cost of rectification of bad work or replacing the substandard material shall be borne by the contractor.

21. The contractor shall have to pay all quarry fees, royalties, ground rent for stacking materials and all other taxes. The rate quoted by the contractor is deemed to include the same except GST. GST Shall be paid to contractor separately as applicable by Government notification.

22. The contractor shall not employ any person under the age of 15 years.

23. The contractor shall pay reasonable wages as per minimum wages act to the workmen employed by him in the work undertaken by him. In the event of any dispute arising between the contractor and his workmen on the ground that the wages paid are not fair and reasonable, the dispute shall be referred to the Engineer-in-Charge whose decision shall be conclusive and binding on the contractor, but such decision shall not in any way affect the conditions of the contract regarding the payment made by the Corporation at the sanctioned rates.

24. The contractor shall be responsible for and shall pay compensation to his workmen. Payable under the workmen compensation act, 1923 for injuries caused to the workmen. Such compensation. If not paid by the contractor may be recovered by the contractor, without prejudice to any other remedy, from any amount due or may become due to the contractor executing the contract.

25. The contractor shall be responsible for and shall pay the expenses of providing medical aid to any workmen who may suffer an injuries a result of an accident. Any expenditure towards such a cause, if incurred by the Corporation, shall be recoverable from the contractor from the amount due or may become due to him.

26. The contractor shall not be entitled to any compensation from the corporation on any account, unless he shall have submitted a claim in writing to the Engineer-In-

27. Charge within fifteen days of the cause of such claim arising i.e. from the date of measurements, clarification or order as to the change in design etc.

28. DEVIATION LIMIT :

For the purpose of this Tender, the variations or deviations in carrying out the items of work shall not exceed plus or minus 15 percent of the contract sum.

29. The contractor will have to provide on work site, informative/cautionary signboard to avoid incidents during execution of work at his own cost.

30. Panvel Municipal Corporation may appoint an internal Third Party Quality Audit team to carry out quality audit of the work. The contractor has to extend all necessary coordination to the team and comply the inspection report as well as issues raised during the inspection within the allotted duration. After compliance of observations and duly certification from Third Party Auditor, the payment towards the work done will be made.
