1. Rol van het federale Ministerie van Economische Zaken
Artikel 1. Het federale Ministerie van Economische Zaken vervult een coördinerende rol t.o.v. de federale departementen met bevoegdheden die het investeringsklimaat kunnen beïnvloeden.
Een Dienst van het Ministerie van Economische Zaken wordt met deze opdracht belast. Deze Dienst licht de Gewesten in over geplande maatregelen en over de stand van onderhandelingen met de functionele ministeries.
Art. 2. Indien het Ministerie van Economische Zaken op de hoogte wordt gebracht van een voorstel voor investering, worden de investeringsdiensten van de Gewesten hiervan onmiddellijk en gelijktijdig op de hoogte gebracht.
Deze behandelen dit voorstel voor investering verder.
Art. 3. Indien het Ministerie van Economische Zaken een vraag voor informatie ontvangt, verstrekt het zo vlug mogelijk een antwoord voor wat betreft de federale bevoegdheden.
Het documentatiemateriaal dat de Gewesten ter beschikking stellen, wordt automatisch hierbij gevoegd.
Het Ministerie van Economische Zaken brengt de Gewesten onmiddellijk en gelijktijdig op de hoogte van de vragen om informatie.
Het stelt de relevante informatie inzake de federale bevoegdheden die de buitenlandse investeringen gunstig kunnen beïnvloeden ter beschikking van de gewesten.
Art. 4. Op vraag van de Gewesten verzekert de Dienst van het Ministerie van Economische Zaken namelijk de coördinatie van bezoekprogramma's van de Gewesten door de kandidaat- investeerders of de organisatie van seminaries voor het Vlaams Gewest, het Waalse Gewest en het Brusselse Hoofdstedelijk Gewest.
2. Rol van de diplomatieke en consulaire posten
Art. 5. In het kader van de bevordering van België als investeringsland verlenen de diplomatieke en consulaire posten hun steun aan de Gewesten voor hun promotiebeleid inzake investeringen.
Deze taak behelst mee de verstrekking van informatie over de federale bevoegdheden die het investeringsklimaat kunnen beïnvloeden.
Art. 6. In dit kader brengen zij de gewestelijke investeringsdiensten onmiddellijk en gelijktijdig op de hoogte van elke vraag naar informatie en elk investeringsvoorstel dat hen wordt meegedeeld en waarbij de kandidaat-investeerder geen voorkeur uitdrukt voor een Gewest.
De Gewesten sturen een kopie aan het Ministerie van Economische Zaken en aan het Ministerie van Buitenlandse Zaken, Buitenlandse Handel en Ontwikkelingssamenwerking wanneer de vraag of het voorstel op de federale bevoegdheden betrekking heeft.
Indien de investeerder een voorkeur uitdrukt voor een Gewest, wordt enkel dit Gewest op de hoogte gebracht van deze belangstelling.
De vragen om informatie of de voorstellen voor investering worden verder behandeld door de bevoegde gewestelijke dienst(en).
De diplomatieke posten kunnen de besprekingen met de kandidaat-investeerder voortzetten in overleg met de bevoegde gewestelijke dienst(en). Zij brengen het betrokken Gewest onmiddellijk op de hoogte van de verkregen informatie.
Art. 7. Elke mededeling of vraag om medewerking van een Gewest i.v.m. een investeringsproject wordt vertrouwelijk behandeld.
Art. 8. Op vraag van de Gewesten kunnen de diplomatieke posten :
- informatie en brochures verspreiden die de Gewesten ter beschikking stellen;
- medewerking verlenen bij de organisatie van investeringsseminaries of bij bezoeken van de Gewesten.
Art. 9. Wanneer de projecten ontdekt worden door de gewestelijke vertegenwoordigers, worden zij exclusief door hen behandeld en organiseren zij de programma's in België met hun Gewest.
De Belgische Ambassade in het betrokken land en het Ministerie van Economische Zaken worden door het Gewest ingelicht over het bestaan van het project wanneer het op de federale bevoegdheden betrekking kan hebben.
De gewestelijke vertegenwoordiger licht de Ambassade en de andere Gewesten in over het bestaan van een project dat zijn Gewest niet zou interesseren.
3. De verbindingscel tussen de Gewesten en de Federale overheid
Art. 10. Er wordt een verbindingscel opgericht met vertegenwoordigers van de Gewestministers bevoegd voor economie alsook met vertegenwoordigers van de federale Ministeries van Economische Zaken, van Buitenlandse Zaken, van Buitenlandse Handel en van Ontwikkelingssamenwerking, die regelmatig zal vergaderen om het investeringsklimaat in ons land te bespreken (art. 1), om de toepassing van dit samenwerkingsakkoord te evalueren en om voorstellen te formuleren teneinde regelmatig terugkerende problemen eventueel op te lossen.
Art. 11. De verbindingscel wordt beurtelings voorgezeten door een vertegenwoordiger van één van de Gewesten. Het secretariaat wordt verzekerd door de Dienst van het Ministerie van Economische Zaken, zoals bedoeld in artikel 1. Het voorzitterschap wisselt om de zes maanden.
In principe vergadert de Onthaalcel maandelijks in de lokalen van het Gewest dat het voorzitterschap waarneemt.
4. Slotbepalingen
Art. 12. Dit akkoord treedt in werking op 22 februari 1995.
Art. 13. Dit akkoord wordt gesloten voor onbepaalde duur.
Dit akkoord is opgesteld in vijf originele exemplaren in het Nederlands en vijf in het Frans. Xxxxxxx, 0 februari 1995.

I. Memorie van toelichting
De bevordering van de buitenlandse investeringen behoort tot de exclusieve bevoegdheden van de Gewesten, op basis van artikel 6, §l, VI, van de bijzondere wet tot hervorming van de instellingen van 8 augustus 1980, zoals gewijzigd door de wet van 8 augustus 1988, door de wet van 12 januari 1989 m.b.t. de Brusselse instellingen, door de bijzondere wet van 16 januari 1989
m.b.t. de financiering van de Gemeenschappen en de Gewesten, door de bijzondere wet van 5 mei 1993 betreffende de internationale betrekkingen van de Gemeenschappen en Gewesten en de bijzondere wet van 16 juli 1993 tot vervollediging van de federale staatsstructuur.
De federale Regering is bevoegd inzake de organisatie van de economie, het belastingwezen, de toekenning van verblijfsvergunningen en van beroepskaarten, de telecommunicatie,...
Deze bevoegdheden bepalen mee het investeringsklimaat in ons land.
Bijgevolg is het noodzakelijk dat de federale en gewestelijke overheden overleg plegen, teneinde de competitiviteit van ons land te behouden en te versterken inzake het aantrekken van buitenlandse investeringen.
Hierdoor wordt ook de doeltreffendheid van de gewestelijke acties verhoogd.
Het is noodzakelijk dat de buitenlandse investeerder reeds bij het eerste contact een juist beeld van de mogelijkheden van en de bevoegdheidsverdeling in ons land krijgt.
Binnen de internationale context richt een buitenlandse investeerder zich ook tot de diplomatieke posten van een land om inlichtingen te bekomen.
Het is dus essentieel dat de bevoegdheden en verantwoordelijkheden van elkeen worden erkend.
Sinds de regionalisering van de handelsattachés op 1 juli 1994 beschikken ook de Gewesten over een uitgebreid net van agenten in het buitenland. Daarenboven zijn er ook investeringsprospectoren van de gewesten in het buitenland aanwezig.
Er wordt vastgesteld dat de buurlanden het belang van de buitenlandse investeringen niet onderschatten en om die reden meer personeel in dienst nemen dat belast is met de bevordering van de investeringen.
Teneinde ook in het buitenland efficiënt op te treden, is het belangrijk dat er sluitende overeenkomsten gesloten worden tussen de gewesten en de federale overheid.
De Belgische diplomatieke posten, die het Koninkrijk vertegenwoordigen, zijn er derhalve mee belast de belangen te verdedigen van de Gemeenschappen en van de Gewesten.
II. Inhoud van het akkoord
Onderhavig samenwerkingsakkoord wordt in een geest van federale loyauteit en wederzijdse samenwerking uitgevoerd tussen de federale en gewestelijke overheden in België en in de Belgische diplomatieke en consulaire zendingen in het buitenland.

1. Rôle du Ministère fédéral des Affaires économiques
Article 1. Le Ministère fédéral des Affaires économiques assure un rôle de coordination des départements ministériels fédéraux dont les compétences peuvent influencer le climat d'investissements.
Un Service du Ministère des Affaires économiques est chargé de cette mission. Ce Service informe les Régions des dispositions prévues et des négociations en cours avec les ministères fonctionnels.
Art. 2. Lorsque le Ministère des Affaires économiques est averti d'une proposition d'investissement, il en informe immédiatement et simultanément les Services d'investissements des Régions.
Ceux-ci assurent eux-mêmes le suivi de cette proposition d'investissement
Art. 3. Lorsque le Ministère des Affaires économiques est saisi d'une demande d'information, il fournit les éléments de réponse dans les meilleurs délais en ce qui concerne les compétences fédérales.
La documentation mise à disposition par les trois Régions est automatiquement jointe.

Il met à la disposition des Régions les informations pertinentes relatives aux compétences fédérales susceptibles d'influencer favorablement les investissements étrangers.
Art. 4. A la demande des Régions, le Service du Ministère des Affaires économiques assure notamment la coordination de programmes de visites des Régions par les candidats- investisseurs ou l'organisation de séminaires conviant les Régions flamande, wallonne et de Bruxelles-Capitale.
2. Rôle des postes diplomatiques et consulaires
Art. 5. Dans la cadre de la promotion de la Belgique comme terre d'investissements, les postes diplomatiques et consulaires fournissent une assistance aux Régions pour leurs politiques de promotion des investissements étrangers.
Cette tâche comprend également la mise à disposition de l'information sur les compétences fédérales qui peuvent influencer le climat d'investissement.
Art. 6. Dans ce cadre, ils se doivent d'informer immédiatement et simultanément les Services d'investissements des Régions de toute demande d'information et de toute proposition d'investissement qui leur sont communiquées et pour lesquelles le candidat investisseur n'exprime pas de préférence en faveur d'une Région.
Les Régions envoyant copie xx Xxxxxxxxx xxx Xxxxxxxx xxxxxxxxxxx xx xx Xxxxxxxxx xxx Xxxxxxxx xxxxxxxxxx, du Commerce extérieur et de la Coopération au Développement, lorsque les compétences fédérales peuvent être concernées.
Lorsque l'investisseur exprime une préférence pour une Région, seule cette Région sera informée de cette marque d'intérêt.
Le suivi des demandes d'information ou des propositions d'investissements est assuré par le(s) service(s) régional(aux) compétent(s).
En concertation avec le(s) service(s) régional(aux), les postes diplomatiques peuvent poursuivre les discussions avec les candidats-investisseurs. Ils informent immédiatement la Région concernée des informations obtenues
Art. 7. Chaque information ou demande de coopération d'une Région concernant un projet d'investissements sera traitée confidentiellement.
Art. 8. A la demande des Régions, les postes diplomatiques peuvent:
- diffuser des informations ainsi que des brochures que les Régions mettent à disposition;
- assurer une collaboration dans le cadre de l'organisation de séminaires d'investissements ou de visites des Régions.
Art. 9. Lorsque les projets sont découverts par les représentants régionaux, ceux-ci les traitent exclusivement et organisent les programmes en Belgique avec leur Région.
L'Ambassade de Belgique dans le pays concerné et le Xxxxxxxxx xxx Xxxxxxxx xxxxxxxxxxx xxxx xxxxxxxx xxx xxx Xxxxxxx de l'existence du projet, lorsque les compétences fédérales peuvent être concernées.
Le représentant régional informe l'Ambassade et les autres Régions de l'existence d'un projet qui n'intéresserait pas sa Région.
3. La Cellule de liaison entre les Régions et le niveau federal
Art. 10. Une Cellule de liaison constituée des représentants des Ministères régionaux compétents en matière d'économie ainsi que des représentants des Ministères fédéraux des Affaires économiques, des Affaires étrangères, du Commerce extérieur et de la Coopération au Développement, se réunira régulièrement dans le but de discuter du climat d'investissements dans notre pays (art. 1), d'évaluer l'application du présent accord de coopération et de formuler des propositions pour résoudre éventuellement des problèmes récurrents.
Art. 11. La Cellule de liaison est, à tour de rôle, présidée par un représentant de l'une des Régions. Le secrétariat est assuré par le Service du Ministère des Affaires économiques tel que visé à l'article 1. La présidence change tous les six mois.
En principe, la Cellule d'accueil se réunit mensuellement dans les locaux de la Région qui assume la présidence.
4. Clauses finales
Art. 12. Cet accord entre en application à partir du 22 février 1995.
Art. 13. Cet accord est conclu pour une durée indéterminée.
Cet accord est établi en cinq exemplaires originaux en néerlandais et cinq en francais. Bruxelles, le 7 février 1995.

I. Exposé des motifs
La promotion des investissements étrangers relève de la compétence exclusive des Régions, en exécution de l'article 6, § 1er, VI, de la loi spéciale de réformes institutionnelles du 8 août 1980, modifiée xxx xx xxx xx 0 xxxx 0000, xxx xx xxx du 12 janvier 1989 relative aux Institutions bruxelloises, par la loi spéciale du 16 janvier 1989 relative au financement des Communautés et des Régions, par la loi spéciale du 5 mai 1993 sur les relations internationales des Communautés et des Régions et par la loi spéciale du 16 juillet 1993 visant à achever la structure fédérale de l'Etat.
Le Gouvernement fédéral exerce une compétence dans le domaine de l'organisation de l'économie, de la fiscalité, de l'octroi de permis de séjour et de cartes professionnelles, des télécommunications, ....
Ces compétences influencent le climat d'investissements dans notre pays.
Par conséquent, il est nécessaire que les autorités fédérale et régionales coopèrent afin de maintenir et renforcer la compétitivité de notre pays en vue d'attirer des investisseurs étrangers.
L'objectif n'est autre que de renforcer l'efficacité des actions menées par les Régions.
Il est indispensable que l'investisseur étranger ait, dès le premier contact, une image adéquate des potentialités de notre pays et de la répartition des compétences respectives.
Dans le contexte international, l'investisseur étranger est également amené à s'adresser aux postes diplomatiques d'un pays afin d'obtenir des informations le concernant.
Il est dès lors essentiel que les compétences et les responsabilités de chacun soient parfaitement appréhendées.
Xxxxxx xx 0xx xxxxxxx 0000 xx xx xxxxxxxxxxxxxxx xxx xxxxxxxx xxxxxxxxxxx, xxx Xxxxxxx disposent d'un large réseau d'agents à l'étranger. De plus, les entités fédérées disposent de prospecteurs d'investissements respectifs également présents à l'étranger.
Force est de constater que les pays voisins, loin de sous-estimer l'importance que revêtent les investissements étrangers, ont renforcé de manière conséquente leur personnel chargé de la promotion de ces investissements.
Enfin, pour que les Régions puissent faire preuve d'une présence efficace à l'étranger, il importe que des accords fermes soient conclus entre les autorités fédérale et régionales.
Les postes diplomatiques belges représentent le Royaume et sont de ce fait chargés de défendre les intérêts des Communautés et des Régions.
II. Contenu de l'accord
Le présent Accord de coopération s'applique dans un esprit de loyauté fédérale et de coopération réciproque entre les pouvoirs fédéraux et régionaux en Belgique ainsi que dans les postes diplomatiques et consulaires belges à l'étranger.

Cooperation agreement of 7 February 1995 between the Federal State, the Flemish Region, the Walloon Region and the Brussels Capital Region on foreign investment (Belgian Official Gazette 29 June 1995)
1. Role of the Federal Ministry of Economic Affairs
Article 1. The Federal Ministry of Economic Affairs shall coordinate those Federal Ministerial Departments whose remits may influence the investment climate.
A service of the Ministry of Economic Affairs shall be tasked with this duty. This Service shall inform the Regions of planned measures and of negotiations in progress with the functional ministries.
Art. 2. When an investment proposal comes to the notice of the Ministry of Economic Affairs, it shall inform all the investment services of the Regions immediately and at the same time.
Such services shall be responsible for following up the investment proposals themselves.
Art. 3. If the Ministry of Economic Affairs receives an enquiry, it shall supply the necessary information on federal competences at the earliest possible opportunity.
Documents supplied by the three Regions shall be automatically attached.
The Ministry of Economic Affairs shall inform the Regions of the enquiry immediately and at the same time.
It shall supply the Regions with relevant information on federal competences likely to have a favourable impact on foreign investment.
Art. 4. If requested by the Regions, the Service of the Ministry of Economic affairs shall, inter alia, coordinate programmes of visits to the Regions by potential investors or organize seminars to which the Flemish, Walloon and Brussels Capital Region are invited.
2. Role of diplomatic and consular missions
Art. 5. The diplomatic and consular missions shall assist the Regions with their foreign investment promotion policies to promote Belgium as an investment location.
Their duties shall likewise include the supply of information on federal competences likely to influence the investment climate.
Art. 6. To that end, they have a duty to inform all the investment services of the Regions immediately and at the same time of all enquiries or investment proposals communicated to them for which the potential investor expresses no preference for a particular Region.
The Regions shall send copies to the Ministries of Economic Affairs, Foreign Affairs, Foreign Trade and Development Cooperation if federal competences may be involved.
If the investor expresses a preference for a Region, only that Region shall be informed of the expression of interest.
The competent regional service(s) shall be responsible for following-up enquiries and investment proposal.
Diplomatic missions may pursue discussions with potential investors in concertation with the regional service(s). They shall immediately inform the Region concerned of the information obtained.
Art. 7. All information or request for cooperation from a Region concerning investment plans shall be treated as confidential.
Art. 8. If requested by the Regions, diplomatic missions may:
- disseminate the information and brochures made available by the Regions;
- cooperate in the organizing of investment seminars or visits to Regions.
Art. 9. Where projects are discovered by regional representatives, they alone shall handle them and organize programmes to Belgium with their Region.
The Regions shall inform the Belgian Embassy in the country concerned and the Ministry of Economic Affairs of the existence of the project if federal competences may be involved.
The regional representative shall inform the Embassy and the other Regions of the existence of projects of no concern to his own region.
3. Liaison Unit between the Regions and the Federal Government
Art. 10. A Liaison Unit consisting of representatives of the Regional Ministries with responsibility for economic affairs, representatives of the Federal Ministries of Economic Affairs, Foreign Affairs, Foreign Trade and Development Cooperation, shall meet at regular intervals to discuss the investment climate in this country (article 1), review the application of this cooperation agreement and propose ways of solving recurrent problems, if any.
Art. 11. The Liaison Unit shall be chaired by a representative of each Region in turn. The secretariat shall be provided by the service of the Ministry of Economic Affairs referred to in article 1. The chairmanship shall rotate on a six-monthly basis.
The Liaison Unit shall meet monthly as a rule on the premises of the Region holding the chairmanship.
Art. 12. This agreement shall enter into force on 22 February 1995.
Art. 13. This agreement is concluded without duration of time.
This agreement is made in five originals in the Dutch and French languages.

I. Explanatory memorandum
The Regions have sole powers over the promotion of foreign investment under Article 6, §1, VI of the Special Institutional Reform Law of 8 August 1980 as amended by the Law of 8 August 1988, the Brussels Institutions Law of 12 January 1989, the Special Communities and Regions (Finance) Law of 16 January 1989, the Special Communities and Regions (International Relations) Law of 5 May 1993 and the Federal State (Completion) Law of 16 July 1993.
The Federal Government has powers over the management of the economy, taxation, the granting of residence permits and labour cards, telecommunications, …
These powers affect the climate of investment in this country.
This makes it necessary for the federal and regional authorities to cooperate in order to cooperate in order to maintain and strengthen this country’s competitiveness in order to attract inward investment.
The purpose is simply to increase the efficiency of activities carried out by the Regions.

For the regions to have a demonstrably effective presence abroad, firm agreements have to be concluded between the federal and regional authorities.
As representatives of the Kingdom of Belgium, Belgian diplomatic missions have a duty to uphold the interests of the Communities and the Regions.
II. Contents of the agreement
This cooperation agreement shall be applied in a spirit of allegiance to the federation and mutual cooperation between the federal and regional authorities in Belgium, and in Belgian diplomatic and consular missions abroad.
