BEMIDDELINGSVOORWAARDEN Property Services & Beheer ENGLISH BELOW
In deze voorwaarden wordt verstaan onder Opdrachtgever: Iedere natuurlijke of rechtspersoon, die Property Services & Beheer (hierna te noemen “Makelaar”) een opdracht verstrekt om tegen betaling als tussenpersoon zich in te spannen een huurovereenkomst voor Opdrachtgever geschikte woonruimte tot stand te brengen met een derde.
Artikel 1: Totstandkoming opdracht
De opdracht komt tot stand door de inschrijving (naar waarheid) via internet op xxx.xxxxxxxxxxxxxxxxxxxxxxxx.xx en acceptatie van deze voorwaarden.
Artikel 2: Inschrijving
2.1 Opdrachtgever (kandidaat huurder) kan zich geheel kosteloos inschrijven bij Makelaar
2.2 Alvorens een huurovereenkomst tot stand komt, is Opdrachtgever verplicht geldige identiteitspapieren en inkomensgegevens aan Makelaar te overleggen.
2.3 Alle door Makelaar gedane aanbiedingen van woonruimte, zowel schriftelijke als mondelinge, zijn vrijblijvend. Opdrachtgever kan hieraan geen rechten ontlenen.
2.4 Alle kosten die door Makelaar worden gemaakt met betrekking tot de uitvoering van de opdracht, komen voor rekening van Xxxxxxxx.
Uitzondering hierop zijn de kosten die worden gemaakt bij het niet na komen van een bezichtigingsafspraak, zonder tijdig (< 1 uur) voorafgaand bericht van verhindering.
Makelaar erkent uitsluitend telefonische berichten van verhindering.
Voor de gemaakte kosten geldt een uurtarief van €75,00 en een kilometervergoeding van
€0,19. In de avonden, vanaf 18.00 uur, geldt een toeslag van 50% en in de weekenden een toeslag van 100% op het uurtarief.
Artikel 3: Werkzaamheden
De werkzaamheden van de Makelaar kunnen, al naar gelang de wensen van Opdrachtgever en hetgeen partijen daarover bij de uitvoering van deze overeenkomst nader overeenkomen, bestaan uit onder meer de volgende onderdelen:
• bezichtigen door Opdrachtgever van en het geven van informatie over één of meer te huur staande woning(en), waaronder de organisatie daarvan;
• geven van algemene voorlichting over onder meer de mogelijkheden om een woning te vinden, de lokale woningmarkt, de huisvestingsvergunning, de huurtoeslag, de huurbescherming, de huurprijzen, de inschrijving in de gemeentelijke basisadministratie;
• evaluatie van bezichtiging(en) met Opdrachtgever;
• samenstellen van een dossier over Opdrachtgever en het voordragen op basis daarvan van Opdrachtgever als kandidaat-huurder bij potentiële verhuurder(s) en zich ervoor inspannen dat deze de desbetreffende woning aan Opdrachtgever gunt;
• namens Opdrachtgever voeren van onderhandelingen met potentiële verhuurder(s) over de inhoud van de huurovereenkomst;
• tot stand brengen van een schriftelijke huurovereenkomst en het verzorgen van de ondertekening van de huurovereenkomst door beide partijen;
• geven van informatie over en een toelichting op de huurovereenkomst;
• erop toezien dat de eerste betaling aan verhuurder tijdig wordt verricht;
• organiseren van de oplevering van de woning aan de Opdrachtgever;
• opstellen van een inspectierapport;
• zo nodig aanspreken van de verhuurder op de nakoming van zijn verplichtingen bij de aanvang van de huurovereenkomst.
3.1 Makelaar zal bij de uitvoering van de bovengenoemde werkzaamheden uitsluitend de belangen van Opdrachtgever behartigen en niet die van de (potentiële) verhuurder.
3.2 Opdrachtgever is ervan op de hoogte dat Makelaar van diverse potentiële verhuurders van woonruimten toestemming heeft of zal krijgen om die woonruimten te presenteren via diverse media, waaronder de website van Makelaar en/of derden, zoals Pararius, en dat Makelaar daarvoor geen loon in rekening brengt aan deze potentiële verhuurders. Opdrachtgever stemt daarmee in, ook ingeval het de verhuurder betreft met wie Opdrachtgever door de bemiddelingswerkzaamheden van Makelaar een huurovereenkomst voor de desbetreffende gepresenteerde woonruimte sluit.
3.3 Opdrachtgever en Makelaar beogen niet dat Makelaar door Opdrachtgever is of zal worden gevolmachtigd om in zijn naam rechtshandelingen te verrichten of dat Makelaar uit hoofde van een lastgeving voor rekening van Opdrachtgever rechtshandelingen verricht.
3.4 Opdrachtgever zal op eigen initiatief aan Makelaar alle informatie, gegevens en bescheiden verstrekken die noodzakelijk zijn voor de uitvoering van de opdracht en Opdrachtgever staat in voor de juistheid daarvan. Onder deze informatie en bescheiden wordt onder andere, maar niet uitsluitend, verstaan: geldig identiteitsbewijs, geldig bewijs van verblijf in Nederland, recente salarisspecificatie(s), recente bankafschriften (waaruit salarisbetalingen blijken), werkgeversverklaring en dergelijke.
3.5 Zodra Opdrachtgever zijn keuze heeft bepaald voor een bepaalde woonruimte zullen partijen dit schriftelijk vastleggen in een door Opdrachtgever te ondertekenen intentieverklaring. Daarin zullen tevens vastgelegd worden: specificaties van de desbetreffende woonruimte, de werkzaamheden die Makelaar reeds heeft verricht, de werkzaamheden die Makelaar nog zal verrichten en de eventueel nog door Opdrachtgever over te leggen informatie, gegevens en bescheiden. Opdrachtgever zal bij de ondertekening van de intentieverklaring bij wege van aanbetaling een bedrag ter hoogte van 1 maand huur, te vermeerderen met 21% BTW, aan de Makelaar betaalbaar stellen. Xxxxxxxx zal na de ondertekening van de intentieverklaring Opdrachtgever presenteren bij de verhuurder van de desbetreffende woonruimte en, indien de verhuurder bereid is Opdrachtgever als huurder te aanvaarden, met de verhuurder namens huurder onderhandelingen over de inhoud van de huurovereenkomst starten.
Artikel 4 – Vergoeding voor de dienstverlening van Makelaar (courtage); no cure no pay
4.1 Indien uit de dienstverlening van Makelaar een huurovereenkomst voor woonruimte tussen Opdrachtgever en een verhuurder voortvloeit, is Opdrachtgever aan Makelaar een
vergoeding, hierna te noemen ‘courtage’, verschuldigd. Tenzij anders vermeld in de advertenties.
4.2 Deze courtage is gelijk aan een maand bruto huur (derhalve inclusief eventuele servicekosten) conform het verhuuraanbod van de desbetreffende verhuurder, te vermeerderen met 21% BTW en is door Opdrachtgever bij wege van aanbetaling verschuldigd bij de acceptatie van de woning door Opdrachtgever (bij de ondertekening van de intentieverklaring). De betaling wordt definitief zodra een huurovereenkomst tot stand is gekomen. Indien na de aanbetaling geen huurovereenkomst voor de desbetreffende woonruimte tot stand komt, restitueert Makelaar het bedrag van de aanbetaling aan Opdrachtgever.
4.3 De courtage wordt geacht een redelijke vergoeding te zijn voor de werkzaamheden die Makelaar voor Opdrachtgever ter uitvoering van deze overeenkomst verricht. Partijen nemen daarbij in aanmerking dat, ongeacht de door Makelaar ter uitvoering van deze overeenkomst verrichte werkzaamheden, door Opdrachtgever geen courtage verschuldigd is, zolang geen huurovereenkomst tot stand gekomen is en dat de verschuldigde courtage een in de markt gebruikelijk tarief is dat niet gekoppeld is aan de omvang van de door Makelaar te verrichten werkzaamheden maar aan een te behalen resultaat (no cure no pay).
4.4 Opdrachtgever stemt ermee in de huur voor de eerste maand, de waarborgsom en de courtage aan Makelaar te zullen betalen en de woonruimte pas te zullen betrekken nadat hij deze betalingen heeft gedaan.
4.5 Eventuele gerechtelijke kosten of buitenrechtelijke kosten zullen bij uitblijven van betaling voor rekening van Opdrachtgever komen.
4.6 Indien Opdrachtgever en/of relatie(s) van hem/haar op een adres gaat wonen, dat Opdrachtgever van Xxxxxxxx heeft verkregen, is Opdrachtgever bemiddelingskosten aan Makelaar verschuldigd.
Artikel 5: Aansprakelijkheid
Makelaar is niet aansprakelijk voor de wijze waarop een verhuurder, na ondertekening van het contract, zijn verplichtingen als verhuurder nakomt. Opdrachtgever dient zich steeds rechtstreeks tot verhuurder te wenden.
MEDIATION TERMS AND CONDITIONS
In these conditions, the following definitions shall apply as Client: any natural or legal person, that gives Property Services & Beheer (hereinafter referred to as "Broker") a paid assignment as an intermediary to make efforts for Client to close a lease contract with a third party.
Article 1: Establishment of the assignment
The assignment is established by registration (to truth) on internet at xxx.xxxxxxxxxxxxxxxxxxxxxxxx.xx and acceptance of these terms and conditions.
Article 2: Registration
2.1 Client (prospective tenant) can register free of charge at the Broker
2.2 Before a rental contract is concluded, the Client is required to provide the Broker with valid identity documents and proof of income.
2.3 All offers made by Broker of residential space, both written and oral, are non-binding. The Client may not derive any rights from this.
2.4 All costs incurred by Xxxxxx be made regarding the performance of the contract, will be paid by Xxxxxx. Exceptions to this are the costs that are created when Client misses a viewing appointment, without prompt notification (< 1 hour).
Broker acknowledges only notifications by telephone.
The costs incurred are subject to a hourly rate of € 75,- and a mileage allowance of € 0,19. In the evenings, from 18:00 hours on, there is a 50% surcharge and in the weekend a surcharge of 100% on the hourly rate.
Article 3: Brokers’ tasks
The tasks of the Broker may, depending on the wishes of the Client and all further that parties agree to, include the following components:
• viewing(s) with the Client and giving information about one or more available apartments, including the organization of it;
• giving general information on possibilities to find a property, the local housing market, housing permits, the rent allowance, the rental protection, the rents, the registration in the municipal personal records database;
• evaluation of viewing(s) with Client;
• compiling a dossier on the Client and introduce the Client as a candidate-tenant to potential landlord (s), to ensure that he/she will give the relevant property to the Client;
• conducting negotiations on behalf of the Client about the content of the lease contract with potential landlord;
• establish a written lease contract and taking care of the signing of it by both parties;
• giving information about and an explanation on the lease contract;
• ensuring that the first payment to the landlord is carried out in a timely manner;
• organize the delivery of the property to the Client;
• draw up an inspection report;
• if necessary, addressing the landlord on the performance of its obligations at the beginning of the lease.
3.1 While carrying out the above tasks, Xxxxxx will only represent the interests of the Client and not of the (potential) landlord.
3.2 The Client is aware that Broker has, or will get permission from various potential landlords to present their homes through various media, including the website of Broker and/or third parties such as Pararius and that Broker is not charging anything to these potential landlords. Client agrees to this, also if it concerns the landlord with whom the Client, by the conciliation proceedings of Broker with such a Landlord, will sign a lease contract.
3.3 Client and Broker are not aiming for Broker to be or will be authorized to perform legal acts in Clients’ name or Broker to carry out legal acts under a mandate of the Client.
3.4 Client will provide on his/her own initiative the Broker with all information, particulars and documents necessary for the performance of the contract. The Client is responsible for the accuracy of it. This information and documents, but not exclusively, includes: valid photo ID, proof of residence in the Netherlands, recent salary specification (s), recent bank statements (from which salary payments prove), employers ' statement.
3.5 Once the Client has determined his/her choice for a particular house, the Parties will sign a letter of intent. Therein shall be recorded: specifications of the relevant housing, the work the Broker has already done, work that Broker still has to do and, if necessary, the information, particulars and documents that Client has to provide. Client will at the signing of the letter of intent pay a deposit for the amount of 1 month's rent, plus 21% VAT, set payable to the Broker immediately. After the signing of the letter of intent, Xxxxxx present the Client to the Landlord of the chosen house and, if the landlord is willing to accept Client, start negotiations on the contents of the lease contract with the landlord on behalf of Client.
Article 4 – fee for the services provided by Broker (Brokerage); no cure no pay
4.1 If the service of Broker leads to a lease contract for housing between the Client and a landlord, Client owes Broker a fee, hereinafter referred to as ' Brokerage '.

4.2 This fee is equal to a month gross rent (therefore including any service charge) in line with the rental offer of the relevant landlord, plus 21% VAT and is paid by the Client due upon the acceptance of the property by the Client (at the signing of the letter of intent). The payment is final as soon as a lease contract has been concluded. If, after down payment, the lease contract is not concluded, the Broker will refund the deposit to the Client.
4.3 The Brokerage is regarded as a fair compensation for the work that Xxxxxx has carried out for the Client to pursue a lease contract. Parties take into consideration that, regardless of the amount of work carried out by Xxxxxx to pursue this agreement, no brokerage is payable by the Client, as long as no lease contract was signed and that the required fee is an usual rate in the market, not linked to the extent of the work to be performed by Xxxxxx, but to achieve a result (no cure no pay).
4.4 Client agrees to pay the rent for the first month, the deposit and the brokerage to Broker and only will move in no earlier than after these payments.
4.5 Any court costs or extrajudicial costs as a result of non-payment will come at the expense of the Client.
4.6 If Client and/or his/her relationship (s) are going to live at an address, obtained from Broker, Client is due to pay Broker the brokerage.
Article 5: Liability
Xxxxxx is not responsible for the way in which a landlord, after signing the contract, to comply with its obligations as a landlord. Client must always refer directly to landlord.
