Regulamin promocji Flyspot “PLAYGROUND 5H” English version at the bottom
1. Organizatorem promocji „Playground 5 H” („Promocja”) jest AEROTUNEL Spółka z ograniczoną odpowiedzialnością z siedzibą w Warszawie, 00-090, Al. Solidarności 75/26, zarejestrowana w rejestrze przedsiębiorców pod numerem KRS 0000821632, NIP: 5252533508 („Flyspot”).
2. Z zastrzeżeniem ust. 3 poniżej, z Promocji mogą skorzystać wyłącznie osoby fizyczne (konsumenci), nazywani dalej 'Klientami'. Promocja obowiązuje od 1.01.2024 r. do 31.12.2024 r. (decyduje data zawarcia umowy w ramach Promocji).
3. W ramach Promocji Klient może kupić jednorazowo 5 godzin czasu tunelowego po aktualnej cenie widocznej na stronie Flyspot, przy czym pakiet lotów może zostać nabyty wyłącznie dla potrzeb jego wykorzystania przez jedną osobę małoletnią, w wieku od 6 do 12 lat, która jest proflyerem, tj. osobą doświadczoną w lotach tunelowych (‘Uczestnik’).
4. Promocja obejmuje czas tunelowy bez coachingu instruktorskiego (tę usługę należy wykupić dodatkowo u wybranego instruktora). Dodatkowo do pakietu dodawany jest bezpłatny udział w zawodach Flyspot Playground Challenge 2024.
5. Czas tunelowy, o którym mowa w ust. 3 powyżej musi być wylatany w ciągu 6 miesięcy od dnia zakupu Promocji.
6. Czas tunelowy może zostać wykorzystany wyłącznie przez Uczestnika i nie może być współdzielony z innymi uczestnikami ani innymi osobami, jak również nie może być odsprzedawany bądź udostępniany osobom trzecim.
7. Czas tunelowy może zostać wykorzystany tylko w jednym tunelu Flyspot, do wyboru Klienta,
tj. w Warszawie, Katowicach, Wrocławiu lub w Gdańsku, w ramach godzin przeznaczonych dla sportowców (proflyers), w terminach dostępnych według systemu rezerwacji dostępnego na stronie Flyspot, zgodnie z zasadą slotów dynamicznych. W razie pytań związanych z
rezerwacjami należy skontaktować się z Flyspot pod adresem: xxx@xxxxxxx.xxx.
8. Z zastrzeżeniem ust. 9 i 10 poniżej, Klient ma prawo odstąpić od umowy zakupu czasu
tunelowego w ramach Promocji, bez podania przyczyny i bez ponoszenia kosztów, w ciągu 14 dni od daty zawarcia umowy. Oświadczenie o odstąpieniu może zostać wysłane na adres xxx@xxxxxxx.xxx.
9. Rozpoczęcie realizacji usługi przed upływem terminu do odstąpienia od umowy będzie możliwe jedynie pod warunkiem, iż Klient - złoży wyraźne oświadczenie zawierające takie żądanie. W powyższej sytuacji, jeżeli Klient wykona prawo odstąpienia od umowy po
zgłoszeniu żądania, Xxxxxx będzie miał obowiązek zapłaty za świadczenia spełnione do chwili odstąpienia od umowy, z zastrzeżeniem, iż cena lotów w tunelu będzie określona według ich wartości rynkowej z dnia skorzystania przez Uczestnika ze świadczenia bądź z dnia zawarcia umowy przez Klienta (w zależności, która z cen będzie korzystniejsza dla Klienta). Informacje o cenach dostępne są na stronie Flyspot bądź w recepcji lub, na żądanie Klienta, mogą zostać
wysłane na wskazany przez niego adres e-mail.
10. W przypadku dokonania rezerwacji czasu tunelowego, Klientowi nie przysługuje prawo odstąpienia od umowy, zgodnie z art. 38 pkt. 12 ustawy o prawach konsumenta.
11. Rezerwacja czasu tunelowego będzie możliwa po opłaceniu przez Klienta całości ceny za pakiet lotów, o którym mowa w ust. 3 powyżej. W przypadku niedokonania opłaty w ciągu 2 dni od dnia zawarcia umowy, umowę uważa się za niezawartą.
12. Promocja nie podlega łączeniu z innymi promocjami oferowanymi przez Flyspot.
13. Administratorem danych osobowych Klienta jest AEROTUNEL Spółka z ograniczoną odpowiedzialnością, z siedzibą w Warszawie (pozostałe dane w ust. 1 powyżej). Dane osobowe będą przetwarzane przez Flyspot dla celów niezbędnych do wykonania umowy,
zawartej w ramach Promocji oraz dla celów wynikających z prawnie uzasadnionych interesów realizowanych przez administratora, w szczególności marketingu usług świadczonych przez Flyspot, w tym profilowania danych osobowych dla powyższych potrzeb, przy czym Klient ma prawo w każdym czasie zgłosić sprzeciw wobec przetwarzania jego danych osobowych dla
celów marketingowych. Klient ma również prawo do żądania od Flyspot dostępu do swoich danych osobowych, ich sprostowania, usunięcia lub ograniczenia przetwarzania, prawo do przenoszenia danych oraz wniesienia skargi do organu nadzorczego. Dane osobowe mogą być powierzane podwykonawcom Flyspot. Dane osobowe będą przechowywane przez Flyspot
przez okres realizacji umowy, a po tym czasie – przez okres wymagany przepisami prawa.
Podanie danych jest dobrowolne, przy czym jest ono niezbędne dla potrzeb zawarcia i realizacji umowy z Flyspot.
14. Podawanie przez Klienta danych osobowych Uczestnika nie jest konieczne w celu skorzystania przez Uczestnika z usługi. W tzw. kolejce lotów widocznej na tablicy świetlnej umieszczonej wewnątrz budynku Flyspot, zostaną podane dane Klienta, przy czym podczas rezerwacji Klient ma możliwość - edytując odpowiednie pole swojej rezerwacji - umieścić w kolejce lotu jedynie pseudonim (nick) Klienta lub Uczestnika wprowadzony w szczegółach rezerwacji.
15. Wartość świadczeń uzyskanych w ramach Promocji (sprzedaży premiowej) jest zwolniona od podatku dochodowego od osób fizycznych na podstawie art. 21 ust. 1 pkt 68 ustawy z dnia 26 lipca 1991 r. o podatku dochodowym od osób fizycznych (t.j. Dz. U. z 2018 r., poz. 1509 ze zm.).
16. W kwestiach nieuregulowanych w niniejszym Regulaminie stosuje się:̨ (i) w zakresie
dotyczącym zasad odstąpienia od umowy – postanowienia Regulaminu sklepu internetowego Flyspot (ii) w pozostałym zakresie - w tym zasad świadczenia usług, jakości, przetwarzania danych osobowych – Regulamin świadczenia usług – Flyspot. W pozostałym zakresie stosuje się ̨ obowiązujące przepisy prawa polskiego.
Regulations of the Flyspot Promotion "PLAYGROUND 5H"
1. The organizer of the "PLAYGROUND 5H" promotion ("Promotion") is AEROTUNEL Spółka z ograniczoną odpowiedzialnością with its registered office in Xxxxxx, 00-000, Xx. Xxxxxxxxxxxx 00/00, registered in the National Court Register under the number KRS 0000821632, NIP: 5252533508 ("Flyspot").
2. Subject to point 3 below, only natural persons (consumers), hereinafter referred to as 'Customers,' can take advantage of the Promotion. The Promotion is valid from January 1, 2024, to December 31, 2024 (the date of concluding the agreement within the Promotion determines the validity period).
3. Within the Promotion, a Customer can purchase a one-time package of 5 hour of tunnel time at the current price visible on the Flyspot website. However, the flight package can only be purchased for the use of one minor person, aged 6 to 12 years, who is a proflyer, i.e., an experienced person in tunnel flying ('Participant').
4. The Promotion includes tunnel time without instructor coaching (this service must be additionally purchased from the chosen instructor). Additionally, the package includes complimentary participation in the Flyspot Playground Challenge 2024 competition
5. The tunnel time mentioned in point 3 above must be flown within 6 months from the date of purchasing the Promotion.
6. The tunnel time can only be used by the Participant and cannot be shared with other participants or individuals. Additionally, it cannot be resold or provided to third parties.
7. The tunnel time can only be used in one Flyspot tunnel, as chosen by the Customer, i.e., in Warsaw, Katowice, Wrocław, or Gdańsk, during hours designated for athletes (proflyers) and within the dates available according to the reservation system on the Flyspot website,
following the dynamic slot principle. For questions related to reservations, please contact Flyspot at xxx@xxxxxxx.xxx.
8. Subject to points 9 and 10 below, the Customer has the right to withdraw from the purchase agreement of tunnel time within the Promotion without giving a reason and at no cost,
within 14 days from the date of concluding the agreement. A declaration of withdrawal can be sent to xxx@xxxxxxx.xxx.
9. Commencement of the service before the expiration of the withdrawal period will only be possible if the Customer submits a clear statement containing such a request. In this situation, if the Customer exercises the right of withdrawal after submitting the request, the Customer will be obliged to pay for the services performed until the withdrawal from the agreement, with the reservation that the price of tunnel flights will be determined based on their market value on the day the Participant uses the service or the day the agreement is concluded by the Customer (whichever is more favorable for the Customer). Information about prices is available on the Flyspot website or at the reception, and upon the Customer's request, it can be sent to the email address provided by them.
10. In the case of making a reservation for tunnel time, the Customer does not have the right to withdraw from the agreement, in accordance with Article 38, point 12 of the Consumer
Rights Act.
11. Reservation of tunnel time will be possible after the Customer pays the full price for the flight package mentioned in point 3 above. If the payment is not made within 2 days from the date of concluding the agreement, the agreement is considered not concluded.
12. The Promotion cannot be combined with other promotions offered by Flyspot.
13. The Administrator of the Customer's personal data is AEROTUNEL Spółka z ograniczoną odpowiedzialnością, with its registered office in Warsaw (other data in point 1 above).
Personal data will be processed by Flyspot for purposes necessary to perform the agreement concluded within the Promotion and for purposes arising from the legally justified interests pursued by the administrator, in particular marketing services provided by Flyspot, including profiling personal data for the above purposes. The Customer has the right to object to the processing of their personal data for marketing purposes at any time. The Customer also has the right to request access to their personal data, rectification, deletion, or restriction of processing, the right to data portability, and the right to lodge a complaint with the
supervisory authority. Personal data may be entrusted to subcontractors of Flyspot. Personal data will be stored by Flyspot for the duration of the agreement's performance, and after that time, for the period required by law. Providing data is voluntary, but it is necessary for the conclusion and performance of the agreement with Flyspot.
14. Providing the personal data of the Participant by the Customer is not necessary for the Participant to use the service. In the so-called flight queue visible on the electronic board
inside the Flyspot building, the Customer's data will be provided. During the reservation, the Customer has the option - by editing the appropriate field of their reservation - to place in
the flight queue only the pseudonym (xxxx) of the Customer or Participant entered in the reservation details.
15. The value of benefits obtained within the Promotion (premium sale) is exempt from personal income tax based on Article 21, paragraph 1, point 68 of the Act of July 26, 1991, on personal income tax (consolidated text Dz. U. of 2018, item 1509, as amended).
16. Matters not regulated in this Regulation are governed by: (i) regarding the principles of
withdrawal from the agreement – provisions of the Flyspot online store regulations, (ii) in other matters - including the provision of services, quality, processing of personal data - the Flyspot Service Regulations. In other respects, the applicable provisions of Polish law apply.
