STANDARDOWE WARUNKI NAJMU
Niniejsze Standardowe Warunki Najmu stanowią integralną część Umowy Najmu zawartej pomiędzy Motorent Sp. z o.o. z siedzibą w Warszawie, xx. Xxxxxxxxxxxx 00 (Wynajmujący) i Najemcą wskazanym w Umowie Najmu. Przedmiotem najmu, jest opisany w Umowie Najmu samochód, który zostaje udostępniony Najemcy na warunkach i zasadach określonych w Umowie Najmu i załącznikach, w tym niniejszych Standardowych Warunkach Najmu.
1. WyDANIE I zWROT SAMOchODU
1.1 Wynajmujący wyda Najemcy samochód w dobrym stanie technicznym, bez uszkodzeń i usterek, z kompletnym wyposażeniem, pełnym zbiornikiem paliwa oraz z kompletem dokumentów i jednym kompletem kluczy. Wszelkie zastrzeżenia dotyczące stanu samochodu powinny zostać zgłoszone Wynajmującemu w momencie jego wydawa- nia. Złożenie przez Najemcę podpisu na Umowie Xxxxx oraz na Raporcie Uszkodzeń Przed/Po Wynajmie bez dodat- kowych uwag, jest jednocześnie potwierdzeniem, iż Xxxxxxx dokonał odbioru samochodu nie wnosząc zastrzeżeń, co do jego stanu technicznego, wyglądu oraz wyposażenia, jak również warunków najmu.
1.2 Najemca zobowiązany jest zwrócić samochód Wynajmującemu z kompletem dokumentów i wyposażenia, w stanie w jakim go wynajął, w miejscu i w dniu określonym w Umowie Najmu. W ramach zwrotu samochodu Najemca zobowiązany jest do zweryfikowania, wspólnie z pracownikiem Wynajmującego, stanu samochodu oraz po uwzględnieniu w Raporcie Uszkodzeń Przed/Po Wynajmie wszelkich zmian w stosunku do stanu, w którym samochód był wydawany, podpisania tego Raportu.
1.3 Wynajmujący zastrzega sobie prawo do rozwiązania Umowy Najmu ze skutkiem natychmiastowym i odebrania samochodu od Najemcy, na koszt Najemcy, w przypadku stwierdzenia użytkowania samochodu z naruszeniem warunków Umowy Najmu (w tym niniejszych Standardowych Warunków Najmu), a także w przypadku, gdy okoliczności stwierdzone przez Wynajmującego uzasadniają podejrzenie dokonania kradzieży samochodu przez osoby trzecie albo podjęcia próby jego przywłaszczenia przez Xxxxxxx. Strony zgodnie ustalają, że w przypadkach, o których mowa w zdaniu poprzednim, oświadczenie Wynajmującego o wypowiedzeniu Umowy Najmu może być przekazane Najemcy drogą elektroniczną w formie e-maila wysłanego na wskazany przez Wynajmującego adres poczty internetowej lub w formie„sms-a” wysłanego na wskazany przez Najemcę numer telefonu.
1.4 Najemca zobowiązany jest do zgłoszenia Wynajmującemu każdorazowej zmiany wskazanego w Umowie Najmu miejsca lub terminu zwrotu samochodu celem uzyskania akceptacji Wynajmującego na taką zmianę wraz z infor- macją na temat ewentualnych opłat dodatkowych z tego tytułu. Zwrot samochodu w miejscu i/lub terminie, które nie zostały uprzednio zaakceptowane przez Wynajmującego, nie powoduje zwolnienia Najemcy z odpowiedzialno- ści za samochód, w tym obowiązku ponoszenia określonych w Umowie Najmu kosztów (opłat) wynajmu (dobowej stawki najmu i innych opłat), do momentu jego faktycznego odbioru przez Wynajmującego.
1.5 W przypadku korzystania z urządzeń dodatkowych w postaci nawigacji GPS czy Routera WIFI, Najemca zobowiązany jest do zapoznania się ze szczegółowymi warunkami użytkowania tych urządzeń, które stanowią integralną część Umowy Najmu.
2. USzKODzENIE, UTRATA, KRADzIEż, ITD.
W przypadku uszkodzenia, utraty lub kradzieży samochodu albo jego wyposażenia, Najemca ponosi odpowiedzialność za powstałą z tego tytułu szkodę na zasadach wynikających z obowiązujących przepisów prawa i warunków najmu. W szczególności Najemca może zostać zobowiązany do pokrycia szkody poniesionej przez Wynajmującego z powodu zaistnienia zdarzeń, o których mowa w zdaniu poprzedzającym, jeżeli Najemca lub kierowca, któremu powierzył on sa- mochód, naruszył przepisy prawa, warunki najmu, przepisy drogowe lub zasady bezpieczeństwa ruchu na drogach. W ra- mach odszkodowania, Wynajmujący może domagać się od Najemcy pokrycia utraconych wpływów (korzyści), w wyso- kości odpowiadającej dobowej stawce najmu, naliczonej od dnia wyłączenia samochodu z eksploatacji do dnia, w którym uszkodzony samochód lub nowy samochód (nabyty w miejsce skradzionego / utraconego) znajdzie się w dyspozycji Wy- najmującego. Odpowiedzialność Najemcy może być ograniczona w przypadku wykupienia przez Najemcę opcji Collision Damage Waiver (CDW) i/lub Super Collision Damage Waiver (SCDW) i/lub Theft Protection (TP) i/lub Super Cover (SC) i/lub Glass Protection (GP), w zakresie i na zasadach właściwych dla poszczególnych opcji, które zostały opisane poniżej.
3. OPłATy
3.1 Najemca zobowiązany jest zapłacić wszelkie opłaty podane w Umowie Najmu lub wymienione w aktualnych cennikach.
3.2 Koszt wynajmu obliczany jest jako wielokrotność 24-godzinnych okresów, licząc od wskazanego w Umowie Najmu momentu rozpoczęcia wynajmu.
3.3 Jeżeli samochód nie zostanie zwrócony przez Najemcę w ustalonym w Umowie Najmu miejscu (punkcie zwrotu samocho- du) i/lub terminie, Najemca będzie zobowiązany do uiszczenia opłaty będącej odpowiednikiem dziennej stawki wynajmu, łącznie z uprzednio wykupionymi opcjami dodatkowymi, za każdy dzień lub część dnia zwłoki w zwrocie samochodu.
3.4 Najemca wyraża zgodę, aby w przypadku zgłoszenia przez Najemcę przedłużenia okresu najmu lub nie zwrócenia samochodu w ustalonym terminie zwrotu, Wynajmujący dokonał na karcie kredytowej udostępnionej w związku z wynajmem dodatkowej preautoryzacji, obejmującej przewidywane koszty (opłaty) wynikające z przedłużenia okresu najmu, ustalone na podstawie dziennej stawki wynajmu oraz innych opłat wynikających z Umowy Najmu.
4. WARUNKI UżyWANIA SAMOchODU
4.1 W okresie korzystania z samochodu Najemca zobowiązany jest do:
a) przestrzegania i stosowania postanowień Umowy Najmu (w tym niniejszych Standardowych Wa- runków Najmu),
b) przestrzegania przepisów prawa regulujących zasady korzystania z samochodu, w tym prawa o ruchu drogowym,
c) prawidłowego zabezpieczenia samochodu i wyposażenia przed kradzieżą, w szczególności poprzez każdorazowe zamykanie samochodu i stosowania zabezpieczeń, w jakie wyposażony jest samochód. Najemca w miarę posiadanych możliwości powinien parkować samochód na parkingach strzeżonych,
d) odpowiedniego zabezpieczania przed kradzieżą, utratą lub zniszczeniem dokumentów oraz klu- czyków, urządzenia GPS lub routera WIFI (jeżeli Najemca z niego korzysta) i nie pozostawianie ich w samochodzie, jak również innych wartościowych przedmiotów widocznych z zewnątrz,
e) wykonywania we własnym zakresie i na własny koszt obsługi codziennej samochodu obejmują- cej sprawdzanie i uzupełnianie płynów, sprawdzanie stanu i prawidłowego ciśnienia w oponach, sprawdzanie działania świateł,
f) stosowania w samochodzie rodzaju paliwa zgodnie ze specyfikacją silnika, podaną w dowodzie rejestracyjnym lub/i dokumentacji technicznej samochodu,
g) utrzymywania samochodu w należytej czystości,
h) przerwania jazdy, zabezpieczenia samochodu i natychmiastowego zawiadomienia Wynajmu- jącego o wszelkich stwierdzonych awariach, usterkach lub nieprawidłowościach w działaniu samochodu, w tym w szczególności Najemca zobowiązany jest niezwłocznie zawiadomić Wynaj- mującego o zapalaniu się którejkolwiek z kontrolek wskazujących na wystąpienie awarii, usterki lub nieprawidłowości. Najemca zobowiązany jest zastosować się do wskazówek Wynajmującego dotyczących zgłoszonej awarii, usterki lub nieprawidłowości.
4.2 Najemca nie może używać wynajętego samochodu:
a) do przewozu osób lub rzeczy w formie podnajmu;
b) do przewozu przedmiotów i substancji, które z powodu swoich właściwości lub zapachu mogą czasowo wyłą- czyć samochód z eksploatacji i/lub uniemożliwić jego dalszy wynajem;
c) do uruchamiania lub holowania innych samochodów, przyczep lub innych przedmiotów;
d) do przewozu większej ilości osób lub masy ładunku niż określone w dokumencie rejestracyjnym samochodu;
e) w wyścigach, rajdach lub zawodach;
f) gdy Najemca lub inny kierowca pojazdu pozostaje pod wpływem alkoholu, leków halucynogennych, narkoty- ków, barbituranów lub innych substancji osłabiających jego świadomość i zdolność reakcji;
g) wbrew przepisom celnym, drogowym lub innym obowiązującym w kraju użytkowania;
h) przez osobę inną niż Xxxxxxx, o ile osoba ta nie została wcześniej zaakceptowana przez Wynajmującego po- przez jej wskazanie (wpisanie) w Umowie Najmu. Osoba ta winna posiadać ważne prawo jazdy przynajmniej od roku oraz spełniać określone przez Wynajmującego warunki w zakresie minimalnego wieku;
i) poza granicami kraju, w którym nastąpił wynajem, bez pisemnej zgody Wynajmującego;
j) na obszarach geograficznych zabronionych przez Wynajmującego.
4.3 Najemca zobowiązany jest użytkować samochód w sposób, który nie spowoduje uszkodzeń jego wnętrza. W przy- padku uszkodzenia przez Najemcę wnętrza samochodu (łącznie z wnętrzem bagażnika) Najemca jest odpowiedzialny za wynikające z tego tytułu szkody. Do tego typu uszkodzeń zaliczamy np. wypalone dziury w tapicerce, zabrudzenie tapicerki, uszkodzenia przełączników, progów, wewnętrznych elementów karoserii, klamek, zamków itp.
4.4 W przypadku zawinionej przez Najemcę utraty (w tym zgubienia lub zniszczenia) dokumentów i/lub kluczyków samochodu, Najemca ponosi faktyczne koszty usprawnienia samochodu (wymiany zamków, przerejestrowania pojazdu), jak również Wynajmujący może domagać się od Najemcy pokrycia utraconych wpływów (korzyści) w wy- sokości odpowiadającej dobowej stawce najmu, naliczonej za każdy dzień wyłączenia samochodu z eksploatacji.
4.5 W przypadku, jeżeli Wynajmujący na wniosek organów ścigania lub administracji zobligowany będzie do udzielenia pi- semnej informacji o użytkowniku samochodu, w związku z popełnionym w okresie najmu wykroczeniem lub przestęp- stwem lub w związku z naliczeniem opłaty z tytułu nieopłaconego parkowania lub innej opłaty / kary z tytułu naruszenia jakichkolwiek przepisów lub regulaminów związanych z korzystaniem z samochodu, to Najemca obciążony zostanie przez Wynajmującego dodatkową opłatą administracyjną z tego tytułu w kwocie 123 (stu dwudziestu trzech) złotych brutto.
4.6 Zabronione jest palenie papierosów lub innych substancji w samochodzie (zakaz dotyczy zarówno Najemcy / użyt- kownika samochodu, jak i pasażerów). W przypadku stwierdzenia podczas zwrotu samochodu, iż w okresie najmu w samochodzie palono, Najemca, w związku z koniecznością usunięcia skutków palenia (zapachów), zobowiązany będzie do zapłaty na rzecz Wynajmującego opłaty w wysokości 300 (trzystu) złotych brutto.
5. UbEzPIEczENIE
Wynajmujący zapewnia ubezpieczenie zgodnie z polisą ubezpieczeniową od odpowiedzialności cywilnej (OC) wyłącznie tym osobom, które używają samochód za jego zgodą. Warunki ubezpieczenia OC pozostają, na życzenie Najemcy, do wglądu.
6. USzKODzENIA, KOlIzJE I KRADzIEżE
6.1 Najemca zobowiązany jest niezwłocznie zgłosić Wynajmującemu każde uszkodzenie, awarię lub utratę (w tym kradzież) samochodu lub jego wyposażenia, podając miejsce i okoliczności danego zdarzenia. Najemca, w każdym przypadku, zobowiązany jest sporządzić pisemne oświadczenie o okolicznościach danego zdarzenia. Najemca, bez zgody Wynajmującego, nie jest uprawniony do dokonywania w samochodzie jakichkolwiek napraw.
6.2 W przypadku kolizji z udziałem wynajmowanego samochodu lub kradzieży samochodu bądź jego wyposażenia, Najemca zobowiązany jest wezwać Policję na miejsce kolizji lub powiadomić Policję o kradzieży i równocześnie zawiadomić o zdarzeniu Wynajmującego. Najemca zobowiązany jest niezwłocznie przekazać Wynajmującemu pro- tokół Policji sporządzony na okoliczność kolizji / kradzieży. Najemca powinien ponadto dołożyć starań, aby w miarę posiadanych możliwości, uzyskać i przekazać Wynajmującemu dane dotyczące uczestników oraz świadków kolizji, kradzieży lub uszkodzenia samochodu, w tym w szczególności informacje o wystawcy i numerze polisy ubezpiecze- niowej OC sprawcy wypadku (jeżeli nie jest nim Najemca).
6.3 Najemca zobowiązany jest do udzielenia pomocy Wynajmującemu oraz/lub ubezpieczycielowi samochodu we wszystkich postępowaniach związanych z kolizją, uszkodzeniem lub kradzieżą samochodu lub/i jego wyposażenia, do jakich doszło w okresie najmu. W żadnym wypadku Xxxxxxx nie jest uprawniony do akceptowania jakichkolwiek roszczeń osób trzecich.
6.4 Naruszenie przez Najemcę któregokolwiek z powyższych obowiązków, w szczególności niedostarczenia Wynajmu- jącemu protokołu Policji dokumentującego kolizję lub kradzież, powoduje wyłączenie ochrony Najemcy wynikają- cej z wykupionych opcji CDW (SCDW), TP i/lub SC.
7. ODPOWIEDzIAlNOść WyNAJMUJącEGO
7.1 Wynajmujący nie ponosi odpowiedzialności za jakiekolwiek kary, mandaty lub opłaty (w tym parkingowe), których nałożenie wynika z naruszenia lub nieprzestrzegania przez Najemcę przepisów prawa, wtym przepisów o ruchu drogowym, jak również innych przepisów / regulaminów określających zasady korzystania z dróg i/lub parkingów. Wszelkie mandaty / opłaty oraz koszty, o których mowa w zdaniu poprzedzającym zobowiązany jest pokryć Najemca, z uwzględnieniem punktu 4.5.
7.2 Wynajmujący odpowiedzialny jest jedynie za straty lub szkody poniesione przez Najemcę lub osoby trzecie w związku z wynajmowanym samochodem lub jego użytkowaniem, gdy te straty lub szkody spowodowane zostały umyślnie lub przez zaniedbanie z jego strony.
7.3 Wynajmujący nie ponosi odpowiedzialności za rzeczy, które Najemca przewoził, utracił (zagubił) lub pozostawił w samochodzie.
8. KIEROWcy
8.1 Kierowcą samochodu może być wyłącznie osoba fizyczna wskazana w Umowie Najmu. Inna osoba fizyczna może być kierowcą samochodu wyłącznie w przypadku jej wskazania w Umowie Najmu (jako dodatkowego kierowcę) i wniesienia z tego tytułu opłaty wg aktualnego cennika. Najemca ponosi pełną odpowiedzial- ność za wszelkie działania osób, którym w okresie najmu powierzył prowadzenie samochodu.
8.2 Posiadanie międzynarodowego prawa jazdy jest obowiązkowe dla Najemców/kierowców, którzy posiadają prawo jazdy wydane w krajach nie wymienionych w Konwencji o Ruchu Drogowym (Dz.U. z dnia 24.02.1988 r.).
9. DANE PERSONAlNE
Motorent Sp. z o.o. z siedzibą 00-000 Xxxxxxxx, xx. Xxxxxxxxxxxx 00 (Wynajmujący), jako Administrator danych osobo- wych Najemcy, przetwarza je zgodnie z art. 23 ust. 1 Ustawy z dnia 29 sierpnia 1997 r. o ochronie danych osobowych (tj. Dz. U. z 2002 r. nr 101, poz. 926 z późn. zm.) w celu realizacji Umowy Najmu, włączając w to analizy statystyczne, archiwizację, kontrolę należności i ochronę majątku Wynajmującego, jak również przekazywanie dane osobowe podmio- tom współpracującym, w powyższym zakresie z Wynajmującym. Wynajmujący zapewnia Najemcy realizację uprawnień wynikających z w/w Ustawy, w szczególności umożliwia Najemcy wgląd do swoich danych i możliwości żądania uzu- pełnienia, uaktualnienia, sprostowania oraz czasowego lub stałego wstrzymania ich przetwarzania lub ich usunięcia.
10. SIEDzIbA I WłAścIWOść SąDU
Umowa Najmu podlega prawu polskiemu. Wszelkie spory, które mogą powstać w związku z Umową Najmu, podlegają rozstrzygnięciu przez sąd powszechny właściwy miejscowo, wedle uznania strony powodowej, ze względu na siedzibę/ miejsce zamieszkania strony pozwanej lub właściwy miejscowo ze względu na miejsce wykonania Umowy Najmu, przez które przyjmuje się miejsce wydania samochodu Najemcy.
11. OGRANIczENIE ODPOWIEDzIAlNOścI NAJEMcy
11.1 Zawierając Umowę Najmu Najemca może ograniczyć swoją odpowiedzialność za samochód wybierając odpowied- nią opcję z oferty Wynajmującego oraz uiszczając dodatkową opłatę zgodnie z aktualnym cennikiem, pod warun- kiem wykupienia podstawowych opcji CDW i TP.
11.2 Wynajmujący w ramach usługi wynajmu samochodu udostępnia następujące opcje:
a) Collision Damage Waiver (dalej: „CDW”), ewentualnie uzupełnione o Super Collision Damage Waiver (dalej:
„SCDW”) – wykupując opcję CDW odpowiedzialność Najemcy za uszkodzenie samochodu zostaje ograniczona do wysokości udziału, lub w przypadku dokupienia opcji SCDW, do 50% udziału własnego przewidzianego dla opcji CDW. Ograniczenie odpowiedzialności w ramach opcji CDW/SCDW nie obejmuje uszkodzeń lub utraty: kół (felg, kołpaków, opon), lusterek, anteny, wycieraczek, wnętrza samochodu (wraz z wnętrzem bagażnika), uszkodzenia dachu, podwozia (w tym tłumika, miski olejowej) oraz tablic rejestracyjnych;
b) Theft Protection (dalej: „TP”) – wykupując opcję TP odpowiedzialność Najemcy na wypadek kradzieży samo- chodu zostaje ograniczona do wysokości udziału własnego;
c) Super Cover (dalej: „SC”) – wykupując opcję SC odpowiedzialność Najemcy za uszkodzenie samochodu lub na wypadek kradzieży samochodu zostaje zniesiona. Ograniczenie odpowiedzialności w ramach opcji SC nie obej- muje uszkodzeń: kół (felg, kołpaków, opon), lusterek, anteny, wycieraczek, wnętrza samochodu (wraz z wnę- trzem bagażnika), uszkodzenia dachu, podwozia (w tym tłumika, miski olejowej) oraz tablic rejestracyjnych;
d) Glass Protection (dalej: „GP”) – wykupując opcję GP zniesiona zostaje odpowiedzialność Xxxxxxx za wybicie lub uszkodzenie szyb w samochodzie;
e) Tyre Protection – wykupując opcję Tyre Protection zniesiona zostaje odpowiedzialność Xxxxxxx w przypadku uszkodzenia opon.
11.3 Wykupienie którejkolwiek z opcji wskazanych powyżej w pkt. 11.1 lub pkt. 11.2 nie będzie skuteczne i nie spowoduje wyłączenia odpowiedzialności Najemcy za szkodę w pełnej wysokości w przypadku niedopełnienia przez Najemcę obowiązków przewidzianych na wypadek uszkodzenia lub kradzieży samochodu lub jego wyposażenia, szczegółowo określonych w punkcie 6 powyżej lub w przypadku rażącego zaniedbania lub celowego naruszenia przez Najemcę lub osobę, której powierzył prowadzenie samochodu, obowiązujących przepisów prawa lub warunków najmu.
12. UbEzPIEczENIE OSObOWE (PI)
Najemca zawierając Umowę Najmu ma możliwość wykupienia (według stawki podanej w aktualnym cenniku) ubezpieczenia osób podróżujących samochodem od następstw nieszczęśliwych wypadków. Wykupując opcję PI Najemca uzyskuje prawo do odszkodowania, które mu przysługuje w ramach ubezpieczenia osobowego w następującym zakresie: (i) śmierci do kwoty 25 000 EUR, (ii) kalectwa do kwoty 25 000 EUR, (iii) zwrotu udokumentowanych kosztów leczenia NNW do kwoty 1 000 EUR.
STANDARD RENTAl TERMS AND cONDITIONS
These Standard Rental Terms and conditions are an integral part of the Rental Agreement made by and between Motorent Sp. z o.o. with its registered office in Warsaw, 34 Ostrobramska Street (the lessor) and the customer named in the Rental Agreement. The subject of the rental is the vehicle described in the Rental Agreement, made available to the customer upon the terms and conditions specified in the Rental Agreement and in enclosures thereto, including these Standard Rental Terms and conditions.
1. PIcK-UP AND RETURN OF ThE VEhIclE
1.1 The Lessor shall provide the Customer with a vehicle in a good technical condition, undamaged and faultless, filled up, complete with accessories, all necessary documents and with one set of keys. Any reservations regarding the condition of the vehicle should be reported to the Lessor at the moment of pick-up. By signing the Rental Agreement and the Pre-/ Post-Rental Damage Report with no additional comments, the Customer confirms that he/she has picked up the vehicle without questioning its technical condition, its appearance or accessories, as well as the rental terms and conditions.
1.2 The Customer shall be obliged to return the vehicle to the Lessor, together with the complete set of documents and accessories, in the same condition as he/she has rented it, at the location and on the date designated in the Rental Agreement. At the vehicle return, the Customer shall be obliged to check the condition of the vehicle together with the Xxxxxx’x employee. Having acknowledged any changes to the vehicle’s pick-up condition recorded in the Pre-/ Post-Rental Damage Report, the Customer shall be obliged to sign the said Report.
1.3 The Lessor reserves the right to terminate the Rental Agreement without notice and to collect the vehicle from the Customer, at the Customer’s cost, should the vehicle be found to be used in a manner incompliant with the terms and conditions of the Rental Agreement (including these Standard Rental Terms and Conditions), or should the circumstances discovered by the Lessor justify the Xxxxxx’x suspicion that the vehicle might have been stolen by third parties or the suspicion of an attempt by the Customer to appropriate the vehicle. The Parties agree that in cases such as those mentioned in the preceding sentence, the Xxxxxx’x statement of Rental Agreement termination can be sent to the Customer electronically via e-mail to the email address provided by the Customer or via text message sent to the telephone number provided by the Customer.
1.4 The Customer shall be obliged to report to the Lessor any changes to the vehicle return location or date specified in the Rental Agreement, in order for the Lessor to approve of any such change and to inform the Customer of any applicable additional charges incurred by such change. The return of the vehicle at a place and/or date which has not been previously approved by the Lessor shall not release the Customer from his/her responsibility for the vehicle, including the duty to pay the costs (charges) of rental (daily rate and other charges) as specified in the Rental Agreement until the actual collection of the vehicle by the Lessor.
1.5 In case of using additional accessories such as a GPS navigation device or a WIFI Router, the Customer shall be obliged to acknowledge the specific terms and conditions of use of such accessories, which are an integral part of the Rental Agreement.
2. DAMAGE, lOSS, ThEFT, ETc.
In case of a damage, loss or theft of the vehicle or its accessories, the Customer shall be liable for the damages thus incurred pursuant to the applicable legal regulations and the rental terms and conditions. In particular, the Customer may be obliged to cover the damage suffered by the Lessor as a result of the events listed in the preceding sentence, if the Customer or the driver authorised by the Customer to drive the vehicle has breached any legal provisions, rental terms and conditions, traffic regulations or the road safety provisions. As part of the damages, the Lessor may request the Customer to cover the lost opportunities (profits) in the amount equivalent a daily rental rate, counted from the day the vehicle is excluded from use until the day the damaged vehicle or a new vehicle (purchased to replace the stolen / lost one) can be used the Lessor. The Customer’s liability may be limited if the Customer has purchased the Collision Damage Waiver (CDW) and/or Super Collision Damage Waiver (SCDW) and/or Theft Protection (TP) and/or Super Cover (SC) and/ or Glass Protection (GP) options, where the coverage and conditions specific for each of the options are described below.
3. chARGES
3.1 The Customer shall be obliged to pay all the charges specified in the Rental Agreement or listed in the applicable pricelists.
3.2 The rental cost shall be calculated as a multiplication of 24-hour period rates, starting from the beginning of rental specified in the Rental Agreement.
3.3 If the vehicle is not returned by the Customer at the location and/or time specified in the Rental Agreement, the Customer shall be charged with an equivalent of the daily rate, including the purchased additional options, for each day or a part of a day of the delay.
3.4 The Customer agrees that in case the Customer declares the rental period to be extended or fails to return the vehicle at the agreed return date, the Lessor makes an additional pre-autorisation on the credit card used for the rental, to cover the expected costs (charges) resulting from the extended rental period, based on the daily rental rate and other charges specified in the Rental Agreement.
4. USE OF VEhIclE – TERMS AND cONDITIONS
4.1 During his/her use of the vehicle, the customer is obliged to:
a) comply with and apply the Rental Agreement provisions (including these Standard Rental Terms and conditions),
b) comply with legal regulations pertaining to the use of vehicles, including road traffic regulations,
c) properly secure the vehicle and its accessories to prevent theft, in particular by always locking the vehicle and using the security devices provided in the vehicle. Whenever possible, the customer should park the vehicle at supervised parking lots,
d) properly secure the documents and keys, the GPS navigation device or the WIFI Router (if used by the customer) against theft, loss or damage and not to leave them in the vehicle; any valuable objects visible from the outside should also not be left in the vehicle,
e) carry out and cover the costs of the daily maintenance of the vehicle, including fluids checking and refilling, checking the condition and required pressure of the tyres, checking the proper function of the lights,
f) use the appropriate type of fuel for the vehicle engine, as specified in the vehicle registration certificate or/and in the technical documents of the vehicle,
g) keep the vehicle reasonably clean,
h) stop driving, secure the vehicle and immediately notify the lessor of any failures, defects or malfunctions of the vehicle; in particular the customer is obliged to notify the lessor immediately of any signal lights turning on and indicating a vehicle failure, defect or malfunction. The customer shall be obliged to follow the xxxxxx’x recommendations regarding the reported failure, defect or malfunction.
4.2 The Customer may not use the rented vehicle:
a) for transportation of people or objects in the form of sub-renting;
b) for transportation of objects and substances which, because of their properties or smell, may temporarily render the vehicle out of use and/or prevent it from being rented again;
c) for the start-up or towing of any other vehicles, trailers or other objects;
d) for transportation of a number of people or cargo load exceeding those specified in the vehicle registration certificate;
e) for racing, road rallies or contests;
f) when the Customer or any other driver of the vehicle is under the influence of alcohol, mind-altering drugs, narcotics, barbiturates or any other substances which alter consciousness and impair responsiveness;
g) against customs, road traffic or any other regulations effective in the country where the vehicle is used;
h) by any other person than the Customer, unless such person has been previously approved by the Lessor by being named (entered) in the Rental Agreement. Such person should hold a valid driving license for at least one year and meet the minimum age requirement defined by the Lessor;
i) outside the territory of the country where the rental took place, without a written permission by the Lessor;
j) in geographic areas prohibited by the Lessor.
4.3 The Customer shall be obliged to use the car in such manner as not to damage its interior. Should the Customer damage the car interior (including the inside of the boot), the Customer shall be liable for any resulting losses. Such damages include, among others: cigarette holes burned in the upholstery, soiled upholstery, damages to switches, side sills, interior elements of the vehicle bodywork, handles, locks etc.
4.4 In case of a loss (including mislaying or damage) of the vehicle documents and/or keys attributable to the Customer, the Customer shall cover the actual costs of vehicle reinstatement (lock replacement, reregistration); further, the Lessor may demand that the Customer should cover the lost opportunities (profits) in the amount equivalent to the daily rental rate, calculated for each day the vehicle remains out of use.
4.5 In case the Lessor is obliged by prosecuting or administration authorities to provide information in writing regarding the vehicle user in relation to an offence or crime committed during the rental time or in relation to a fine for not paying the parking fee or to any other charge/fine for breaching any provisions or rules and regulations related to the use of the vehicle, the Customer shall be charged by the Lessor with an additional administration fee of 123 (one hundred and twenty three) zlotys gross.
4.6 Smoking of cigarettes or any other substances in the vehicle is prohibited (the prohibition applies both to the Customer/vehicle user and to the passengers). If it is detected during the vehicle return procedure that smoking took place in the vehicle during the rental, the Customer shall be obliged to pay to the Lessor the amount of 300 (three hundred) zlotys gross to cover the cost of the removal of smoking results (smells).
5. INSURANcE
According to the insurance policy, the Lessor ensures a third party liability (OC) coverage only to persons authorised by the Lessor to use the car. The terms and conditions of the third party liability (OC) insurance are available for reading upon the Customer’s request.
6. DAMAGE, cOllISION AND ThEFT
6.1 The Customer shall be obliged to immediately report to the Lessor any damage, failure or loss (including theft) of the vehicle or its accessories, informing the Lessor of the place and circumstances of such event. The Customer, in each such case, shall be obliged to make a written statement of the circumstances of the event. The Customer shall not be authorized to make any repairs in the vehicle without the consent of the Lessor.
6.2 In case of a collision involving the rented vehicle or of a theft of the vehicle or its accessories, the Customer shall be obliged to call the Police to the scene of the collision or to notify the Police of the theft, and to notify the Lessor of the event at the same time. The Customer shall be obliged to immediately provide the Lessor with the Police report regarding the collision/theft. Further, the Customer should use his/her best efforts to obtain and forward to the Lessor the details of the participants and witnesses of the collision, theft or vehicle damage, including in particular the information of the issuer and number of the third party liability coverage insurance policy of the accident perpetrator (if other than the Customer).
6.3 The Customer shall be obliged to provide help to the vehicle Lessor and/or insurer in all proceedings related to the collision, damage or theft of the vehicle or/and its accessories which occurred during the rental period. Under no circumstances is the Customer authorised to accept any claims of any third parties.
6.4 The Customer’s breach of any of the above obligations, in particular his/her failure to provide the Lessor with the Police report evidencing the collision or theft, shall invalidate the Customer’s coverage under the purchased options CDW (SCDW), TP and/or SC.
7. ThE xXXXXX’X lIAbIlITy
7.1 The Lessor shall not be responsible for any fines, traffic fines or charges (including parking space fees) which have been imposed due to the Customer’s breach or non-observance of legal provisions, including road traffic regulations or any other provisions/rules and regulations determining the manner of using roads or/and parking areas. Any traffic fines/ charges and costs mentioned in the preceding sentence shall be covered by the Customer, inclusive of item 4.5.
7.2 The Lessor shall only be liable for losses suffered by the Customer or any third parties in relation to the rented vehicle or its use if such losses or damages have been caused intentionally or by act of negligence on the part of the Lessor.
7.3 The Lessor shall not be responsible for objects transported by the Customer and then lost (mislaid) or left in the vehicle.
8. DRIVERS
8.1 The vehicle may only be driven by the natural person named in the Rental Agreement. Another natural person may drive the vehicle only if named in the Rental Agreement (as an additional driver) and if the required payment has been made at the applicable pricelist rate. The customer shall be held fully responsible for any acts by persons allowed by him/her to drive the vehicle during the rental time.
8.2 An international driving license must be held by any Customer/drivers whose driving licenses have been issued in other countries than listed in the Convention on Road Traffic (Journal of Laws of 24.02.1988).
9. PERSONAl DETAIlS
Motorent Sp. z o.o with its registered office at 00-000 Xxxxxxxx, 34 Ostrobramska Street (the Lessor), as the Administrator of the Customer’s personal data, shall process it according to Art. 23 clause 1 of the Personal Data Protection Act of 29 August 1997 (i.e. Journal of Laws of 2002 No. 101, item 926, as amended) for the purpose of executing the Rental Agreement, including statistical analyses, filing, receivables control and the protection of the Xxxxxx’x assets, as well as provision of such personal data to entities cooperating with the Lessor in that respect. The Lessor shall ensure that the Customer’s rights under the said Act are executed, in particular the Customer shall be allowed to access his/her data and to request that such data be amended, updated, rectified or be either temporarily or permanently withheld from processing or removed.
10. ThE cOURT SEAT AND JURISDIcTION
The Rental Agreement is governed by the Polish law. Any disputes which might arise in connection with the Rental Agreement shall be subject to resolution by a common court with the territorial jurisdiction either over the registered office/residence of the defendant or over the area of the execution of the Rental Agreement, understood as the location of the vehicle pick-up by the Customer, as the suing party might choose.
11. ThE lIMITS ON ThE cUSTOMER’S lIAbIlITy
11.1 When entering into the Rental Agreement, the Customer may limit his/her liability for the vehicle by choosing the applicable option from the Xxxxxx’x offer and paying an additional fee, according to the applicable pricelist, provided basic options CDW and TP have been purchased.
11.2 As part of the vehicle rental, the Lessor offers the following options:
a) Collision Damage Waiver (hereinafter “CDW”), possibly with Super Collision Damage Waiver (hereinafter: “SCDW”) – with the CDW option purchased, the liability of the Customer for the damage of the vehicle shall be limited to the deductible or, in case of the additional SCDW purchase, to 50% of the deductible for the CDW option. The limited liability under the CDW/SCDW option does not cover any damage to or loss of: wheels (wheel rims, hubcaps, tyres), mirrors, antenna, wipers, car interior (including the inside of the boot), damage to the vehicle roof, chassis (including the muffler and the engine oil sump) or the registration plates;
b) Theft Protection (hereinafter: “TP”) – with the TP option purchased, the Customer’s liability in case of vehicle
theft is limited to the deductible;
c) Super Cover (hereinafter: “SC”) – with the SC option purchased, the Customer’s liability for the damage of the vehicle or in case of vehicle theft shall be waived. The limitation of liability under the SC option does not cover any damage to: wheels (wheel rims, hubcaps, tyres), mirrors, antenna, wipers, car interior (including the inside of the boot), damage to the vehicle roof, chassis (including the muffler, the engine oil sump) or the registration plates;
d) Glass Protection (hereinafter: “GP”) – with the GP option purchased, the Customer’s liability in case of smashing or damaging a vehicle glass pane shall be waived;
e) Tyre Protection – with the Tyre Protection option purchased, the Customer’s liability in case of a tyre damage shall be waived.
11.3 The purchase of any of the options listed above in items 11.1 or 11.2 shall not be effective and shall not waive the Customer’s liability for the damage if the Customer has failed to fulfil his/her obligations in case of damage or theft of the vehicle or its accessories, as specified in detail in clause 6 above or if the applicable legal regulations or the rental terms and conditions have been grossly neglected or intentionally violated by the Customer or the person authorized by the Customer to drive the vehicle.
12. PERSONAl INSURANcE (PI)
When entering into the Rental Agreement, the Customer can purchase (at the rate specified in the applicable price- list) a personal accident insurance for persons travelling in the vehicle. By purchasing the PI option, the Customer becomes entitled to damages payable under the personal insurance with the following coverage: (i) in case of death up to EUR 25 000, (ii) in case of impairment up to EUR 25 000, (iii) refund of the documented post-accident treatment costs up to EUR 1 000.
